83STATEMENT OF THE CASE

87On November 18, 2014, Petitioners, Allen Eugene James and

96December Sabrina James, on behalf of and as parents and natural

107guardians of Emma Debora James (Emma), a mi nor, filed a Petition

119for Benefits Pursuant to Florida Statute Section 766.301 et seq.

129(Petition) with the Division of Administrative Hearings (DOAH)

137for a determination of compensability under the Florida Birth -

147Related Neurological Injury Compensation Pla n (Plan). The

155Petition named Shannon Loe, M.D., as the physician providing

164obstetrical services at the birth of Emma on July 23, 2011, at

176Orange Park Medical Center located in Orange Park, Florida.

185DOAH served NICA with a copy of the Petition on November 20,

197201 4 . On December 1, 2014, DOAH received a return receipt from

210the United States Postal Service showing that Orange Park Medical

220Center had been served with a copy of the Petition. DOAH served

232Shanan Michelle Loe , M.D., with a copy of the Petition on

243December 19, 2014.

246On July 16, 2015, NICA filed a Motion for Summary Final

257Order, asserting that Emma did not sustain a "birth - related

268neurological injury" as that term is defined in section

277766.302(2), Florida Statutes. An Order to Show Cause was ente red

288on July 29, 2015, advising Petitioners to show cause in writing

299no later than August 13, 2015, why RespondentÓs Motion for

309Summary Final Order should not be granted. To date, no response

320h as been filed by Petitioners.

326As of the date of this Summary F inal Order of Dismissal, no

339petition to intervene h as been filed by Dr. Loe or Orange Park

352Medical Center.

354FINDINGS OF FACT

3571. Emma Debora James was born on July 23, 2011, at Orange

369Park Medical Center located in Orange Park, Florida. Emma

378weighed 3 ,894 grams at birth.

3842. Donald Willis, M.D. (Dr. Willis), was requested by NICA

394to review the medical records for Emma. In a medical report

405dated April 30, 2015, Dr. Willis opined in pertinent part as

416follows:

417Spontaneous vaginal delivery was complicated

422by a shoulder dystocia. Time from delivery

429of the head until completion of the delivery

437was two minutes. Birth weight was 3,894

445grams or 8 lbs 9 ozÓs .

452Apgar scores were 6/8. The baby was pale and

461responsive at birth. Only stimulation was

467required for resuscitation. The babyÓs right

473arm was limp. Mild nasal flaring was

480present. The baby was taken to the NICU for

489management of mild respiratory distress.

494Respiratory distress resolved within 15

499minutes of birth. Brachial plexus palsy was

506diagnosed. The baby was treated with

512antibiotics for two days due to maternal

519chorioamnionitis. Antibiotics were

522discontinued and the baby discharged home two

529days after birth.

532Summary: vaginal delivery at 39 weeks

538gestational age was complicated by a shoulder

545dy stocia and resulting brachial plexus

551injury. Newborn hospital course was

556otherwise benign.

558This child suffered a brachial plexus injury

565at delivery. However, there was no apparent

572obstetrical event that resulted in loss of

579oxygen or mechanical trauma to the babyÓs

586brain or spinal cord during labor, delivery,

593or the immediate post delivery period.

5993. Dr. Willis reaffirmed his opinion in an affidavit dated

609July 13, 2015, that Emma suffered a brachial plexus injury at

620delivery and that there was no appar ent obstetrical event that

631resulted in loss of oxygen or mechanical trauma to the babyÓs

642brain or spinal cord during labor, delivery or the immediate post

653delivery period.

6554. NICA retained Michael S. Duchowny, M.D. (Dr. Duchowny),

664a pediatric neurologist, to examine Emma and to review her

674medical records. Dr. Duchowny examined Emma on April 2 2 , 2015.

685In a medical report regarding his independent medical examination

694of Emma, Dr. Duchowny opined as follows:

701IN SUMMARY, EmmaÓs neurological examination

706revea ls findings consistent with a right

713ErbÓs palsy involving the C 5 and C6

721dermatomal segments. There is no involvement

727of the left upper extremit y or the lower

736extremities and no other significant

741neurological findings. Her mental abilities

746are age - appropr iate.

751* * *

754The findings of todayÓs evaluation together

760with the medical record review do not reveal

768a permanent or substantial mental or physical

775impairment due to oxygen deprivation or

781mechanical injury to the brain or spinal

788cord. EmmaÓs neurological injury involves

793cervical roots outside the spinal cord. I

800therefore do not believe that Emma should be

808considered for compensation within the NICA

814program.

8155 . In an affidavit dated July 14, 2015, Dr. Duchowny

826reaffirmed his opinion that his medical exa mination of Emma

836together with the medical record review does not reveal a

846permanent or substantial mental or physical impairment due to

855oxygen deprivation or mechanical injury to the brain or spinal

865cord.

8666 . A review of the file in this case reveals that there

879have been no expert opinions filed that are contrary to the

890opinion of Dr. Willis that there was no apparent obstetrical

900event that resulted in loss of oxygen or mechanical trauma to the

912baby's brain or spinal cord during labor, delivery, or the

922imm ediate post delivery period. Dr. WillisÓ opinion is credited.

932There are no contrary expert opinions filed that are contrary to

943Dr. DuchownyÓs opinion that Emma does not have a permanent or

954substantial mental or physical impairment due to oxygen

962deprivati on or mechanical injury to the brain or spinal cord.

973Dr. DuchownyÓs opinion is credited.

978CONCLUSIONS OF LAW

9817 . The Division of Administrative Hearings has jurisdiction

990over the parties to and the subject matter of these proceedings.

1001§§ 766.301 - 766.316, Fla. Stat.

10078 . The Plan was established by the Legislature "for the

1018purpose of providing compensation, irrespective of fault, for

1026birth - related neurological injury claims" relating to births

1035occurring on or after January 1, 1989. § 766.303(1), Fla. Stat .

10479 . The injured infant, her or his personal representative,

1057parents, dependents, and next of kin may seek compensation under

1067the Plan by filing a claim for compensation with DOAH.

1077§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1085which administers the Plan, has "45 days from the date of service

1097of a complete claim . . . in which to file a response to the

1112petition and to submit relevant written information relating to

1121the issue of whether the injury is a birth - related neurological

1133injury ." § 766.305(4), Fla. Stat.

113910 . If NICA determines that the injury alleged in a claim

1151is a compensable birth - related neurological injury, it may award

1162compensation to the claimant, provided that the award is approved

1172by the administrative law judge to w hom the claim has been

1184assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1195disputes the claim, as it has in the instant case, the dispute

1207must be resolved by the assigned administrative law judge in

1217accordance with the provisions of chapter 12 0, Florida Statutes.

1227§§ 766.304, 766.309, and 766.31, Fla. Stat.

12341 1 . In discharging this responsibility, the administrative

1243law judge must make the following determination based upon the

1253available evidence:

1255(a) Whether the injury claimed is a birth -

1264rel ated neurological injury. If the claimant

1271has demonstrated, to the satisfaction of the

1278administrative law judge, that the infant has

1285sustained a brain or spinal cord injury

1292caused by oxygen deprivation or mechanical

1298injury and that the infant was thereby

1305rendered permanently and substantially

1309mentally and physically impaired, a

1314rebuttable presumption shall arise that the

1320injury is a birth - related neurological injury

1328as defined in s. 766.303(2).

1333(b) Whether obstetrical services were

1338delivered by a partic ipating physician in the

1346course of labor, delivery, or resuscitation

1352in the immediate postdelivery period in a

1359hospital; or by a certified nurse midwife in

1367a teaching hospital supervised by a

1373participating physician in the course of

1379labor, delivery, or res uscitation in the

1386immediate postdelivery period in a hospital.

1392§ 766.309(1), Fla. Stat. An award may be sustained only if the

1404administrative law judge concludes that the "infant has sustained

1413a birth - related neurological injury and that obstetrical serv ices

1424were delivered by a participating physician at birth."

1432§ 766.31(1), Fla. Stat.

14361 2 . The term "birth - related neurological injury" is defined

1448in section 766.302(2) as follows:

"1453Birth - related neurological injury" means

1459injury to the brain or spinal co rd of a live

1470infant weighing at least 2,500 grams for a

1479single gestation or, in the case of a

1487multiple gestation, a live infant weighing at

1494least 2,000 grams at birth caused by oxygen

1503deprivation or mechanical injury occurring in

1509the course of labor, deliv ery, or

1516resuscitation in the immediate postdelivery

1521period in a hospital, which renders the

1528infant permanently and substantially mentally

1533and physically impaired.

15361 3 . The evidence, which is not refuted, established that

1547Emma did not sustain an injury to the brain or spinal cord caused

1560by oxygen deprivation or mechanical injury in the course of

1570labor, delivery, or resuscitation in the immediate post - delivery

1580period in a hospital. Therefore, Emma is not eligible for

1590benefits under the Plan.

1594CONCLUSION

1595Ba sed upon the foregoing Findings of Fact and Conclusions of

1606Law, it is ORDERED that the Petition filed by Allen Eugene James

1618and December Sabrina James, on behalf of Emma Debora James, is

1629dismissed with prejudice. The hearing scheduled for

1636September 16, 20 15, is cancelled.
