59This cause came on for consideration upon a n Amended Motion
70for Summary Final Order filed by Respondent, Florida Birth -
80Related Neurological Injury Compensation Association (NICA), on
87August 8, 2016.
90STATEMENT OF THE CASE
94On December 29, 2014, Petitioner, Ashley Suzanne Tilka,
102individually and on b ehalf of Addyson Tilka (Addyson), a minor,
113filed a Petition Under Protest Pursuant to Florida Statute
122Section 766.301 et seq. with the Division of Administrative
131Hearings (DOAH) for a determination of compensability under the
140Florida Birth - Related Neurolog ical Injury Compensation Plan
149(Plan). On November 9, 2015, Petitioner filed an Amended
158Petition Under Protest (Petition).
162DOAH served NICA with a copy of the Petition on January 5,
1742015. DOAH served Bayfront Medical Center , Inc., with a copy of
185the Petit ion on January 6 , 2015. The Petition named Jennifer
196Gilby, M.D., as the physician who provided obstetrical services
205at the birth of Addyson on June 22, 2012, at Bayfront Medical
217Center , Inc., located in St. Petersburg, Florida. Bayfront
225Health, Education and Research Organization, Inc. , f/k/a Bayfront
233Medical Center , Inc. , filed a Motion to Intervene, which was
243granted by Order dated January 27, 2015.
250On April 9, 2015, DOAH received a notice from the United
261States Postal Service showing that Jennifer Gil by, M.D., had been
272served with a copy of the Petition. As of the date of this
285Summary Final Order of Dismissal, Jennifer Gilby, M.D., has not
295petitioned to intervene into this proceeding.
301On February 11, 2016, NICA filed a Response to Petition for
312Benefit s, asserting that Addyson did not sustain a "birth - related
324neurological injury" as that term is defined in section
333766.302(2), Florida Statutes, and requested that a hearing be
342scheduled to determine compensability. The case was scheduled
350for final hearin g on August 30, 2016. PetitionerÓs attorney
360filed a Motion to Withdraw as Counsel, which was granted by Order
372date d May 26, 2016.
377On August 8, 2016, NICA filed an Amended Motion for Summary
388Final Order. The final hearing was cancelled. IntervenorÓs
396re quest for an extension of time in which to respond to NICAÓs
409Amended Motion for Summary Final Order was granted. Ultimately,
418the parties were ordered to respond to NICAÓs Motion for Summary
429Final Order no later than March 7, 2017. On February 28, 2017,
441I ntervenor filed a notice that it does not oppose NICAÓs Amended
453Motion. As of the date of this Summary Final Order of Dismissal,
465Petitioner has not filed a response to NICAÓs Amended Motion.
475FINDINGS OF FACT
4781. Addyson Tilka was born on June 22, 2012, at Bayfront
489Medical Center , Inc., located in St. Petersburg, Florida.
497Addyson weighed in excess of 2,500 grams at birth.
5072. Donald Willis, M.D. (Dr. Willis), was requested by NICA
517to review the medical records for Addyson. In an affidavit dated
528August 3 , 2016, Dr. Willis opined as follows:
536In summary, the baby was delivered
542prematurely at 34 weeks due to premature
549rupture of the membranes. Apgar scores were
5565/8. The baby had respiratory distress
562syndrome of prematurity. Oxygen and
567ventilation support was required for
572respiratory distress. Neurologic exam was
577appropriate for gestational age. The baby
583did not have seizures. No head imaging
590studies were done during the newborn hospital
597course.
598There was no apparent obstetrical event that
605resulted in loss of oxygen deprivation or
612mechanical trauma to the babyÓs brain during
619labor, delivery or the immediate post
625delivery period.
6273. NICA retained Laufey Y. Sigurdardottir, M.D.
634(Dr. Sigurdardottir), a pediatric neurologist, to examine Addyson
642and to re view her medical records. Dr. Sigurdardottir examined
652Addyson on January 20, 2016. In an affidavit dated August 5,
6632016, Dr. Sigurdardottir summarized her examination of Addyson
671and opined as follows:
675NEUROLOGICAL EXAM: Mental status: Addyson
680is a beau tiful, interactive girl who speaks
688in full sentences with minor pronunciation
694difficulties. She has no autistic features
700and seems age appropriate in all aspects.
707Cranial nerves are intact. Pupils are equal
714and reactive to light. Visual fields are
721full . There is nystagmus, no amblyopia, no
729strabismus. Her facial expressions are
734symmetric. There is no hearing abnormality
740noted. Her motor exam reveals normal muscle
747tone, motor strength, symmetric reflexes are
753present. Balance and coordination seems
758g rossly intact for age.
763ASSESSMENT AND PLAN: In summary, here we
770have a 3 year 6 month old girl who was born
781premature at 34 weeks and needed a neonatal
789intensive care unit (NICU) stay due to
796respiratory compromise. There are, however,
801no clear concerns of her development at this
809time. No suggestions of physical impairment.
815There is nothing on history or record review
823that suggests neurologic injury to the brain
830or spinal cord acquired due to oxygen
837deprivation or mechanical injury.
841Results as to quest ion 1: The patient is
850found to have no substantial physical or
857mental impairment.
859Results as to question 2: there is no
867evidence of perinatal neurologic depression
872and no evidence of ischemic injury at birth
880or in the immediate postnatal period.
886Result s as to question 3: We would expect
895full life expectancy as no noted
901abnormalities are found on exam.
906In light of the above - mentioned details, I do
916not recommend Addyson to be included in the
924Neurologic Injury Compensation Association
928program and will be happy to answer
935additional questions.
937All of my opinions are within a reasonable
945degree of medical probability.
9494. A review of the file in this case reveals that there
961have been no expert opinions filed that are contrary to the
972opinion of Dr. Willis that there was no apparent obstetrical
982event that resulted in loss of oxygen or mechanical trauma to the
994baby's brain during labor, delivery or the immediate post -
1004delivery period. Dr. WillisÓ opinion is credited. There are no
1014expert opinions filed that a re contrary to Dr. SigurdardottirÓs
1024opinion that Addyson does not have a substantial physical or
1034mental impairment. Dr. SigurdardottirÓs opinion is credited.
1041CONCLUSIONS OF LAW
10445. The Division of Administrative Hearings has jurisdiction
1052over the p arties to and the subject matter of these proceedings.
1064§§ 766.301 - 766.316, Fla. Stat.
10706. The Plan was established by the Legislature "for the
1080purpose of providing compensation, irrespective of fault, for
1088birth - related neurological injury claims" relatin g to births
1098occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
11097. The injured infant, her or his personal representative,
1118parents, dependents, and next of kin may seek compensation under
1128the Plan by filing a claim for compensation with DOAH.
1138§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1146which administers the Plan, has "45 days from the date of service
1158of a complete claim . . . in which to file a response to the
1173petition and to submit relevant written information relatin g to
1183the issue of whether the injury is a birth - related neurological
1195injury." § 766.305(4), Fla. Stat.
12008. If NICA determines that the injury alleged in a claim is
1212a compensable birth - related neurological injury, it may award
1222compensation to the claimant , provided that the award is approved
1232by the administrative law judge to whom the claim has been
1243assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1254disputes the claim, as it has in the instant case, the dispute
1266must be resolved by the assigne d administrative law judge in
1277accordance with the provisions of chapter 120, Florida Statutes.
1286§§ 766.304, 766.309, and 766.31, Fla. Stat.
12939. In discharging this responsibility, the administrative
1300law judge must make the following determination based up on the
1311available evidence:
1313(a) Whether the injury claimed is a birth -
1322related neurological injury. If the claimant
1328has demonstrated, to the satisfaction of the
1335administrative law judge, that the infant has
1342sustained a brain or spinal cord injury
1349caused by oxygen deprivation or mechanical
1355injury and that the infant was thereby
1362rendered permanently and substantially
1366mentally and physically impaired, a
1371rebuttable presumption shall arise that the
1377injury is a birth - related neurological injury
1385as defined in s. 7 66.303(2).
1391(b) Whether obstetrical services were
1396delivered by a participating physician in the
1403course of labor, delivery, or resuscitation
1409in the immediate postdelivery period in a
1416hospital; or by a certified nurse midwife in
1424a teaching hospital supervi sed by a
1431participating physician in the course of
1437labor, delivery, or resuscitation in the
1443immediate postdelivery period in a hospital.
1449§ 766.309(1), Fla. Stat. An award may be sustained only if the
1461administrative law judge concludes that the "infant ha s sustained
1471a birth - related neurological injury and that obstetrical services
1481were delivered by a participating physician at birth."
1489§ 766.31(1), Fla. Stat.
149310. The term "birth - related neurological injury" is defined
1503in section 766.302(2) as follows:
" 1508Birth - related neurological injury" means
1514injury to the brain or spinal cord of a live
1524infant weighing at least 2,500 grams for a
1533single gestation or, in the case of a
1541multiple gestation, a live infant weighing at
1548least 2,000 grams at birth caused by oxygen
1557deprivation or mechanical injury occurring in
1563the course of labor, delivery, or
1569resuscitation in the immediate postdelivery
1574period in a hospital, which renders the
1581infant permanently and substantially mentally
1586and physically impaired.
158911. The evidence, which is not refuted, established that
1598Addyson did not sustain an injury to the brain or spinal cord
1610caused by oxygen deprivation or mechanical injury in the course
1620of labor, delivery, or resuscitation in the immediate post -
1630delivery period in a hospital w hich rendered her permanently and
1641substantially mentally and physically impaired. Therefore,
1647Addyson is not eligible for benefits under the Plan.
1656CONCLUSION
1657Based upon the foregoing Findings of Fact and Conclusions of
1667Law, it is ORDERED that the Amended Petition filed by
1677Ashley Tilka, individually and as mother of Addyson Tilka, is
1687dismissed with prejudice.
1690DONE AND ORDERED this 9th day of March , 2017 , in
