29Pursuant to notice, a hearing was conducted in this case

39pursuant to sections 120.569 and 120.57(1), Florida Statutes,

119STATEMENT OF THE ISSUE S

124Whether Respondent, John R. Blum ( Mr. Blum ), violated the

135re - employment provisions set forth in section 121.091(13) (c) 5.d . ,

147Florida Statute s (2013) , and , therefore , must repay his Deferred

157Retirement Option Program (DROP) distribution and subsequent

164monthly retirement benefits.

167PRELIMINARY STATEMENT

169By letter dated May 8, 2014, the Department of Management

179Services, Di vision of Retirement (Division) , advised Mr. Blum

188that the Division intended to void his participation in DROP.

198The letter further instructed Mr. Blum to repay all retirement

208benefits received, including his DROP accumulation, in the amount

217of $227,755.51 . The letter cited sections 121.021(39)(b)2. and

227121.091(13)(c)5.d., Florida Statutes, as authority; it also

234afforded Mr. Blum a point of entry to challenge the DivisionÓs

245decision.

246Mr. Blum disputed the DivisionÓs decision and timely

254requested an adminis trative hearing. The request for a hearing

264was forwarded to DOAH on or about June 17, 2014. A hearing was

277scheduled for August 5, 2014.

282At hearing, Mr. Blum testified on his own behalf and offered

293t he testimony of Teresa Strepp, chief of personnel s erv ices at

306the Department of Highway Safety and Motor Vehicles.

314Petitioner Ós Exhibits 1 through 3 and 5 were admitted into

325evidence. The Division offered the testimony of two witnesses:

334Ira Gaines, r etirement benefits a dministrator with t he Division;

345and B onnie Bevis, assistant d irector of Finance and Accounting

356for the Department of Highway Safety and Motor Vehicles.

365RespondentÓs Exhibits 1 through 6 , 8 , and 9 were admitted into

376evidence. The DivisionÓs Motion for Official Recognition of

384sections 121.091 (1), 121.091(13)5.d., 121.021(39)(b)2.,

389121.021(17), and 121.021(24) was granted.

394The hearing was not transcri bed. The parties timely filed

404proposed recommended o rders, which have been duly considered in

414the preparation of this Recommended Order.

420Refere nces to Florida Statutes will be to the 2013 version

431unless otherwise noted.

434FINDING S OF FACT

4381. The Division is the state agency charged with the

448responsibility of administering the Florida Retirement System

455(FRS).

4562. Mr. Blum w as employed as a highway patrol o fficer with

469the Department of Highway Safety and Motor Vehicles (DHSMV). He

479made the decision to enter DROP , and , f or the last five years of

493his employment with DHSMV, he participated in DROP.

5013. Prior to ending his DROP participation, Mr. Blum

510c ompleted a Deferred Retirement Option Program Termination

518Notification , confirming he would terminate employment on May 31,

5272013 . The notif ication was also signed by the retirement

538c oordinator for DHSMV confirming Mr. BlumÓs employment

546termination date, a nd reads in pertinent part:

554In order to satisfy your employment

560termination requirement, you must terminate

565all employment relationships with all

570participating FRS employers for the first 6

577calendar months after your DROP termination

583date. Termination req uirement means you

589cannot remain employed or become employed

595with any FRS covered employer in a position

603covered or non - covered by retirement for the

612first 6 calendar months following your DROP

619termination date. This includes but is not

626limited to: part - time work, temporary work,

634other personal services (OPS), substitute

639teaching, adjunct professor or non - Division

646approved contractual services.

649* * *

652If you fail to meet the termination

659requirement, you will void (cancel) your

665retirement and DROP participation and you

671must repay all retirement benefits received

677(including accumulated DROP benefits).

6814. The form has been incorporated by reference into Florida

691Administrative Code Rule 60S - 11.004(9).

6975. Mr. Blum terminated his employment with DHS MV on the

708agreed termination date of May 31, 2013.

7156. In July 2013, Mr. Blum began to work once again with

727DHSMV. He had applie d and was hired to return as a reserve

740o fficer to work security at Florida turnpike stations. The

750Florida Highway Patrol provi ded Mr. Blum with access to the

761online system for payroll, and he was paid for his work through

773direct deposit from DHSMV, an FRS employer.

7807. Mr. Blum was under the mistaken impression that , when he

791worked the security for the turnpike stations, he was working for

802a private vendor. He had no intention of violating the

812termination of employment provisions.

8168 . In September 2013, after working for almost three

826months, Mr. Blum was notified that he had violated the

836termination of employment provisions of D ROP, and he ceased

846working as a reserve o fficer.

8529 . On May 8, 2014, the Division sent a letter to Mr. Blum,

866notifying him that his DROP participation and retirement had been

876voided and that he must repay all retirement benefits, including

886his DROP accum ulation. The total amount paid is $227,755.51,

897which the Division seeks to recover. He was also informed that

908his retirement account would be credited t o reflect membership

918from March 2009 through May 2013.

92410. Mr. Blum has returned to work as a h ighwa y patrol

937o fficer , and his DROP application has been approved effective

947May 1, 2014.

950CONCLUSIONS OF LAW

95311 . The Division of Administrative Hearings has

961jurisdiction over the parties and subject matter of this

970proceeding. §§ 120.569 & 120.57(1), Fla. Stat. (2014 ).

97912. This proceeding is de novo. § 120.57(1)(k), Fla. Stat.

989(2014 ).

99113. The burden of proof in an administrative proceeding is

1001on the party asserting the affirmative of the issue unless the

1012burden is established otherwise by statu te. Balino v. DepÓt of

1023HRS , 348 So. 2d 349 (Fla. 1st DCA 1977 ) . The Division, as the

1038party asserting that Mr. Blum has voided his retirement benefits

1048and that those benefits must now be repaid, has the burden of

1060proof in this proceeding. The standard of proof is by a

1071preponderance of the evidence. Nelson v. DepÓt of Mgmt. Servs.,

1081Div. of Ret. , Case No. 11 - 4343 ( Fla. DOAH June 6, 20 12), aff Ód .

1099107 So. 3d 410 (Fla. 1st DCA 2013).

110714. The Division is the state agency responsible for

1116administering the FRS. §§ 121.025 & 121.031, Fla. Stat.

112515. The Legislature has imposed limitations upon employees

1133who opt to participate in DROP: specifically, there is a waiting

1144period of six months after termination of employment before a

1154participant can return to employment with an FRS employer.

1163Section 121.09 1 (13)(c)5. provides:

1168At the conclusion of the member Ós

1175participation in DROP, the Division shall

1181distribute the member Ós total accumulated

1187DROP benefits, subject to the following:

1193* * *

1196d. A D ROP participant who fails to terminate

1205all employment relationships as provided in

1211s. 121.021(39) shall be deemed as not

1218retired, and the DROP election is null and

1226void. Florida Retirement Services membership

1231shall be reestablished retroactively to the

1237da te of the commencement of DROP . . . .

124816. Section 121.021(39) provides as follows:

1254(b) ÐTerminationÑ for a member electing to

1261participate in the DROP occurs when the

1268program participant ceases all employment

1273relationships with an employer in accor dance

1280with s. 121.091(13), however:

1284* * *

12872. For termination dates occurring on or

1294after July 1, 2010, if the member becomes

1302employed by any such employer within the next

13106 calendar months, termination will be deemed

1317not to have occurred . . . .

132517. Rule 60S - 11.004(9) states that , if a participant fail s

1337to meet the te rmination requirement, the participant void s or

1348cancels their retirement and DROP participation and must repay

1357all retirement bene fits received, incl uding accumulated DROP

1366ben efits .

136918 . Mr. Blum, without the intention of doing so, voided his

1381termination of employment by returning to work with the same FRS

1392em ployer within the forbidden six - month period after he

1403terminated his participation in DROP.

140819 . Mr. Blum mu st , therefore, repay the Division the total

1420amount of $227,755.51, which includes the DROP accrual, the

1430health insurance subsidy, and the monthly retirement benefits he

1439received.

144020. Given the facts established by the Division, the

1449undersigned has no discretion to conclude otherwise.

1456RECOMMENDATION

1457Based on the foregoing Findings of Fact and Conclusions of

1467Law, it is RECOMMENDED that the Division enter a final o rder

1479finding that Mr. Blum violated the re - employment provisions of

1490section 121.091(13)( c)5.d., Fl orida Statutes, and , therefore ,

1498must repay retirement payments in the amount of $227,755.51 to

1509the Division.
