80STATEMENT OF THE ISSUE
84Whether PetitionerÓs application for licensure as a

103PRELIMINARY STATEME NT
106On or about March 12, 2014, Petitioner submitted an
115application to the Florida Board of Nursing (the Board) for
125licensure as a Certified Nursing Assistant (CNA). On April 21,
1352014 , the Board issued a Notice of Intent to Deny PetitionerÓs
146application. Thereafter, Petitioner timely filed a request for
154an administrative hearing, which the Board forwarded on July 2,
1642014, to the Division of Administrative Hearings (DOAH).
172By Notice dated July 21, 2014, the final hearing was
182scheduled for August 27, 2014, a t 9:30 a.m. in Leesburg,
193Florida. The cause came on for hearing as noticed. The
203Petitioner failed to appear at the hearing, and no evidence was
214adduced in proof of the Petitioner's claims.
221Respondent was represented at the hearing by counsel, who
230offered in evidence one exhibit, consisting of a certified copy
240of PetitionerÓs CNA application file. Respondent did not call
249any witnesses to testify.
253At the conclusion of the presentation of RespondentÓs case,
262Respondent advised that the Board would not be ord ering a copy
274of the transcript of the final hearing. Board counsel requested
284that proposed recommended orders be filed within ten days of the
295date of hearing. That request was granted.
302As of 10:10 a.m. Petitioner had still not appeared at the
313hearing. P etitioner having been given ample opportunity to
322appear, the hearing was adjourned at that time.
330Respondent timely filed its Proposed Recommended Order on
338September 2, 2014. Petitioner did not file a proposed
347recommended order.
349FINDING S OF FACT
3531. This c ause was scheduled for hearing for August 27,
3642014, at the City Hall, 2 nd Floor Conference Room, 501 West
376Meadow Street, Leesburg, Florida, at 9:30 a.m. Eastern Time.
385The Notice of Hearing was sent to the Petitioner's last known
396address of record at 3423 Southwinds Cove Way, Leesburg, Florida
40634748, notifying the Petitioner of the hearing on the above
416date, time, and place. There was no communication from the
426Petitioner by motion, letter, telephonically, or otherwise
433indicating that the Petitioner had an y difficulty which might
443prevent her attending the hearing at the noticed date, time, and
454place.
4552. Upon convening the hearing, the Petitioner failed to
464appear. A substantial period of time was allowed to elapse,
474(forty minutes) in which the undersigned and the Respondent's
483counsel waited for the Petitioner to appear to put on her case.
495Additionally, the undersigned and Respondent's counsel did
502observe within the building at the hearing site and in the
513immediate environs of the building to see if the Pet itioner was
525observed in the vicinity of the hearing site. The Petitioner
535was not observed in the environs of the hearing site and never
547appeared at the hearing during the additional time allowed for
557her appearance.
5593. More than three weeks have elapsed s ince the hearing
570date, and there has been no communication from the Petitioner
580with the undersigned, and no indication from the Respondent that
590any communication from the Petitioner has been received by the
600Respondent, which might explain the Petitioner's absence from
608the noticed hearing.
6114. Petitioner applied for a license as a CNA . A Notice of
624Intent to Deny was issued by the Board on April 21, 2014.
6365. Petitioner was convicted of misdemeanor theft and
644attempted child endangerment in 2002.
6496. In her r equest for hearing, Petitioner did not dispute
660the convictions.
6627. The application for CNA licensure contained the
670following question:
672Have you EVER been convicted of, or
679entered a plea of guilty, nolo
685contendere, or no contest to, a crime
692in any jurisdic tion other than a minor
700traffic offense? You must include all
706misdemeanors and felonies even if
711adjudication was withheld. [emphasis
715added] .
7178. Petitioner answered the above question ÐNoÑ.
7249. PetitionerÓs negative answer to the above question was
733untr uthful.
735CONCLUSIONS OF LAW
73810 . The Division of Administrative Hearings has
746jurisdiction of this action pursuant to sections 120.569, 120.57
755and 120.60, Florida Statutes ( 2013 ) .
76311 . Section 456.072(1)(h), Florida Statutes, provides that
771grounds for denial of an application include attempting to
780obtain or obtaining a license to practice a profession by
790fraudulent misrepresentation.
79212. Section 456.018(1)(a) provides that grounds for denial
800of an application include procuring or attempting to procure a
810lice nse to practice nursing by knowing misrepresentations.
81813. Respondent made a prima facie case that Petitioner
827made a misrepresentation on her application.
83314. Petitioner failed to appear and demonstrate that she
842did not intend to deceive the Board or tha t the question was
855confusing or ambiguous.
85815. As an applicant for licensure, Petitioner bears the
867burden of proof in this proceeding. Dep't of Transp. v. J.W.C.
878Co., Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981); Balino v. Dep't
891of HRS , 348 So. 2d 349 (Fla. 1st DCA 1977). Petitioner failed
903to appear and has failed to communicate with the undersigned ,
913and no indication from the Respondent has been received by the
924undersigned which would indicate any effort by the Petitioner to
934communicate with the Respondent on the day of or since the day
946of the noticed hearing.
95016. Petitioner failed to rebut RespondentÓs prima facie
958showing that Petitioner made an intentional misrepresentation on
966her application for licensure. As such, Respondent is
974justified, pursuant to s ections 456.072(1)(h) and 456.018(1)(a),
982in denying PetitionerÓs application.
986RECOMMENDATION
987Upon consideration of the facts found and the conclusions
996of law reached, it is RECOMMENDED that the application of
1006DENISE STRALKA for licensure as a certified nur sing assistant be
1017denied.
