96STATEMENT OF THE ISSUE
100W hether Petitioner utilized the correct M edicaid per diem
110rates at its facility for the 18 - month audit period identified
122in the November 7, 2011 , Medicaid Examination Report .
131PRELIMINARY STATEMENT
133On May 8, 2012, the Agency for Health Care Administration
143(Respondent) issued a Medicaid Examinati on Report to BHI, LLC
153d/b/a Blountstown Health and Rehabilitation Center (Petitioner)
160for the 18 - month audit period ending on October 31, 2004.
172Petitioner was informed of its right to contest the results of
183the audit, and a timely Petition for Formal Admi nistrative
193Hearing was filed by Petitioner . The Petition was transmitted
203to D ivision of Administrative Hearings and was assigned to the
214undersigned.
215The Initial Order was entered on January 13, 2015. On
225January 20, 2015, a ÐResponse to Initial OrderÑ wa s filed by the
238registered agent for Petitioner, in which the registered agent
247acknowledged receipt of the pleadings in this case and , since
257Petitioner had been administratively dissolved, indicated that
264he had transmitted them to a manager of PetitionerÓs corporate
274parent.
275On January 26, 2015, the undersigned entered an Order to
285Show Cause why the case should not be dismissed based on the
297administrative dissolution of the corporate facility - owning
305entities. The response filed by Respondent provided
312sati sfactory grounds for the case to proceed , and the case was
324set for hearing to commence on March 9, 2015.
333On February 18, 2015, the registered agent filed a Notice
343of Non - Representation and Request for Clarification. On
352February 19, 2015, an Order on Re quest for C larification was
364entered. The substance of the Order may be determined by
374reference to the docket in this case .
382Petitioner did not file or exchange a witness list, exhibit
392list, or proposed exhibits, pursuant to the Order of Pre - Hearing
404Instr uctions. Respondent timely filed and served its exhibit
413list, along with an affidavit of a person familiar with the
424records at issue.
427The final hearing was convened at 9:00 a.m. on March 9,
4382015, as noticed. No one appeared on behalf of Petitioner.
448Co unsel for Respondent appeared. A court reporter was in
458attendance, having been retained by Respondent. After
465preliminary matters were disposed of, a 15 - minute recess was
476granted to allow for an appearance by Petitioner. The final
486hearing was reconvened at 9:20 a.m. , without an appearance by
496Petitioner. RespondentÓs Exhibits 1 and 2, consisting of the
505Medicaid Audit Report and a recent review thereof, were received
515in evidence. The final hearing was thereafter adjourned.
523Given the burden of proof as di s cussed herein, post - hearing
536submittals were determined to be unnecessary.

555FINDINGS OF FACT
5581 . By letter dated May 8, 2012, which included the
569Medicaid Audit Report that is th e subject of this proceeding,
580Respondent gave Petitioner notice of its Medicaid reimbursement
588rate errors , subject to PetitionerÓs right to contest the
597determinations of error and to demonstrate that its rates were
607correct in an administrative hearing.
6122 . A timely Petition for Formal Administrative Hearing
621involving disputed issues of material fact was filed on behalf
631of Petitioner.
6333 . A fter filing the hearing request, Pe titioner took no
645further action to contest RespondentÓs audit results. Despite
653ha ving knowledge of the se proceedings through its registered
663agent, Petitioner failed to comply with the Initial Order or the
674Order of Pre - Hearing Instructions , and failed to appear at the
686final hearing.
6884 . Based on PetitionerÓs failure to appear and offe r
699evidence, there is no evidentiary basis on which findings can be
710made regarding the Medicaid Audit Report, other than it was
720provided to Petitioner with a notice of rights.
728CONCLUSIONS OF LAW
7315. The Division of Administrative Hearings has
738jurisdiction over the parties to and the subject matter of this
749proceeding. §§ 120.569 and 120.57, Fla. Stat. (201 4 ).
7596 . As the party c hallenging the audited Medicaid rates,
770Petitioner has the burden of proving that its rates were
780correct. Sunrise Community, Inc. v. Ag. for Health Care Admin. ,
790Case No s . 1 0 - 4204 , et al ., (Fla. DOAH Apr. 25, 2011 ; AHCA
807A ug. 25, 2011 ) .
8137 . Petitioner failed to meet its burden of proof.
823RECOMMENDATION
824Based on the foregoing Findings of Fact and Conclusions of
834Law, it is RECOMMENDED that the Agency for Health Care
844Administration enter a final order dismissing the Petition for
853Formal Administrative Hearing and adopt ing the Medicaid Audit
862Report as final agency action in this proceeding.
