92A. Did Respondent, Fresenius Medical Care (Fresenius) ,
99discriminate against Petitioner, David E . McDonald , in employment
108on account of his disability?
113B . Did Fresenius discriminate against Mr. McDonald in

128PRELIMINARY STATEMENT
130Mr. McDonald filed a complaint of age and disability
139discrimination with the Florida Comm ission on Human Relations
148(FCHR) on August 18, 2014. In his complaint, Mr. McDonald
158alleged that the long - term disability benefits insurance provided
168by his employer discriminated against him on the basis of his age
180and disability by only providing long - t erm disability benefits
191for one year, based on his age at the time long - term disability
205benefits commenced.
207The Florida Commission on Human Relations issued a
215Determination of No Cause on December 31, 2014.
223Mr. McDonald filed a timely Petition for Relief w ith FCHR on
235January 13, 2015. The Petition asserts that Mr. McDonald
244experienced a Ðmini - strokeÑ and suffered vision problems in his
255right eye from it. This is his allegation of a disability.
266The Commission referred the matter to the Division of
275Admini strative Hearings to conduct a hearing on the Petition.
285The undersigned conducted the hearing, after one continuance, on
294April 16, 2015.
297Mr. McDonald subpoenaed Ryan Zech of the insurance company
306CIGNA. The subpoena was served in the evening of April 1 4, 2015.
319Mr. Zech moved to quash the subpoena on account of short notice
331and his unavailability on April 16, 2015. At the start of the
343hearing, the undersigned granted the motion subject to
351re - visiting it after the parties presented evidence to allow a
363b etter opportunity to evaluate the need for Mr. ZechÓs testimony
374and consider continuing the hearing to obtain his testimony.
383Mr. McDonald had tried to subpoena Mr. Zech earlier in this
394proceeding using an address provided by counsel for Fresenius.
403That ad dress turned out to be incorrect. Counsel provided a
414second address, which is the one where Mr. Zech was served. The
426evidence presented by Mr. McDonald and his argument made it clear
437that Mr. Zech did not have testimony relevant to the issues in
449this pro ceeding. His testimony related to Mr. McDonaldÓs
458continuing claim that Mr. Zech did not properly inform him about
469the limits of disability insurance when he elected to claim the
480benefits . That claim cannot be addressed in this proceeding to
491determine whe ther Fresenius discriminated against Mr. McDonald.
499The subpoena is quashed.
503Mr. McDonald testified and agreed to admission of Fresenius
512Exhibits 3 and 6 during his testimony. After Mr. McDonald
522testified, he repeatedly confirmed that he had no other evid ence
533to present except the testimony of Mr. Zech. Kathy Hardwick,
543clinical manager for Fresenius , was available to testify , if
552called. Mr. McDonald did not express a desire to have her
563testify.
564Fresenius moved for a directed verdict. The undersigned
572a dvised that the rules governing this proceeding do not provide
583for a directed verdict. The undersigned also advised that the
593testimony of Mr. McDonald made it clear that he did not claim
605that Fresenius had discriminated against him and that he had no
616evid ence of discrimination. The undersigned terminated the
624hearing for resolution on the basis of the undisputed facts
634presented during Mr. McDonaldÓs case - in - chief. Both parties were
646given an opportunity to submit proposed recommended orders.
654The parties di d not order a transcript. Fresenius timely
664filed a proposed recommended order. Mr. McDonald filed a letter
674to the undersigned denominated ÐSettlement Phase,Ñ stating that
683it was time to submit ÐSettlement Proposals to your good self.Ñ
694The letter offered to waive costs, objected to the unavailability
704of Ryan Zech as a witness, and objected to the purported
715unavailability of Kathy Hardwick as a witness. The letter also
725requested that FCHR award Mr. McDonald Ð Long Term disability
735payments; according to the ; usual and time honored definition of
745Long Term.Ñ The letter also asked: ÐFailing LTD payments, I
755request a substantial lump sum payment in lieu thereof.Ñ
764FINDING S OF FACT
7681. Mr. McDonald worked for Fresenius as a social worker in
779its Sebring, Florida , facility.
7832. Fresenius provided Mr. McDonald family and medical leave
792because of back and knee problems. After Mr. McDonald exhausted
802the available leave, Fresenius granted him n on - FMLA medical
813leave.
8143. Because of his continuing health problems, Mr. McDonald
823obtained long - term disability benefits in 2013 under a plan
834provided by CIGNA and sponsored by Fresenius. Mr. McDonald was
84479 years old. Mr. McDonaldÓs testimony established that he
853received one year of benefit payments under the plan.
8624. On August 29, 2013, Mr. McDonald wrote Fresenius a
872letter identified as regarding ÐL.T.D. approval.Ñ The first
880three paragraphs stated:
883On Saturday 7/27/13, I received a copy of
891the letter dated 7/19/13 sent to you by Ryan
900Zech, of CIGNA, informing you th at my Ðclaim
909for Long Term Disability was approved,
915benefits starting on 8/07/13.Ñ
919This means, barring the time it takes for me
928to reconcile my affairs with our H.R Dept.
936that my employment with F.M.C. has come to
944an end.
946I had hoped that my medical cond ition would
955have improved, such that I would have been
963able to perform effectively, the required
969percentage of my duties to qualify to return
977to F/T employment. This has not turned out
985to be the case. It is therefore with mixed
994sentiments that I accept t he medical
1001decision/s of CIGNA and my attending
1007physicians including my ÐEye specialists. "
10125. This letter stated Mr. McDonaldÓs voluntary decision to
1021end his employment with Fresenius. Mr. McDonald did not present
1031evidence that the decision was coerced or even encouraged by any
1042representative of Fresenius. Mr. McDonald voluntarily terminated
1049his employment with Fresenius.
10536. Mr. McDonald does not maintain that Fresenius
1061discriminated against him on account of age or disability. He
1071testified repeatedly and clearly that he does not claim that
1081Fresenius discriminated against him in any way on account of his
1092age or physical condition.
10967. Mr. McDonald bases his complaint upon his assertion that
1106CIGNA representative Mr. Zech did not properly advise him tha t
1117the long - term disability policy provided only one year of
1128payments.
11298. Mr. McDonald also did not present any evidence that
1139could support an inference that Fresenius discriminated against
1147him on account of his age or a disability.
11569. Mr. McDonald did n ot argue or present evidence that
1167CIGNA employee Ryan Zech was an employee or agent of Fresenius .
1179CONCLUSIONS OF LAW
118210 . The Division of Administrative Hearings has
1190jurisdiction over the subject matter of this proceeding and of
1200the parties pursuant to se ctions 120.569 and 120.57(1), Florida
1210Statutes (2014) . 1/
121411. Section 760.11(7) , Florida Statutes, permits a party
1222who receives a no cause determination to request a formal
1232administrative hearing before the Division. "If the
1239administrative law judge finds that a violation of the Florida
1249Civil Rights Act of 1992 has occurred, he or she shall issue an
1262appropriate recommended order to the Commission prohibiting the
1270practice and recommending affirmative relief from the effects of
1279the practice, including back - p ay." Id.
128712 . Se ction 760.10 (1)(a) makes it unlawful for an employer
1299to take an adverse action against an individual because of the
1310individualÓs age or because of the individualÓs disability.
131813 . Mr. McDonald bears the burden of proving the
1328allegations o f his P etition by a preponderance of the evidence.

1367general rule is that a party asserting the affirmative of an

145514. There is no persuasive, credible evidence that
1463Fresenius discriminated against Mr. McDonald on account of age or
1473disability. In addition , Mr. McDonald does not claim that
1482F resenius discriminated against him.
1487RECOMMENDATION
1488Based on the foregoing Findings of Fact and Conclusions of
1498Law, it is RECOMMENDED that the Florida Commission on Human
1508Relations deny the Petition for Relief of David E. McDonald .
