84STATEMENT OF THE CASE

88On January 20 , 201 5 , Petitioners, Aiza P. V e lazquez and

100Enemias Velazquez , individually and on behalf of Bentley X.

109Velazquez ( Bentley ), a m inor, filed a Petition Under Protest

121Pursuant to Florida Statute Section 766.301 et seq. (Petition)

130with the Division of Administrative Hearings (DOAH) for a

139determination of compensability under the Florida Birth - Related

148Neurological Injury Compensation P lan (Plan). The Petition named

157John J. Orrego Franco , M . D. , as the physician who provided

169obstetric services for the birth of Bentley on September 19,

1792009 , at Health Central in Ocoee , Florida.

186DOAH served NICA, John J. Orrego Franco, M.D., and Health

196Cen tral a copy of the Petition on January 26, 2015.

207On March 12, 2015, John J. Orrego Franco, M.D., filed a

218Motion to Intervene, which was granted by Order dated March 20,

2292015. As of the date of the Summary Final Order of Dismissal ,

241Health Central has not petitioned to intervene in this

250proceeding.

251On April 3 , 201 5 , NICA filed a Motion for Summary Final

263Order, requesting that a s ummary f inal o rder be entered finding

276that the claim was not compensable because Bentley did not

286sustain a Ðbirth - related neurolo gical injuryÑ as that term is

298defined in section 766.302(2), Florida Statutes . NICA

306represented in the Motion that Intervenor has no objection or

316opposition to this motion or the relief sought by the motion. It

328is noted that the Petition was filed ÐUnder ProtestÑ and that

339Petitioner s are described therein as Ðnot claimant s .Ñ

349FINDINGS OF FACT

3521. Bentley X. Velazquez was born on September 19 , 2 009 , at

364Health Central in Ocoee , Florida.

3692. Donald Willis, M.D. (Dr. Willis), was requested by NICA

379to review the medical records for Bentley . In a report dated

391March 9 , 201 5 , Dr. Willis described his findings in pertinent

402part as follows:

405Fetal heart rate (FHR) monitor tracing during

412labor was reviewed. The FHR pattern was

419reactive and did not suggest f etal distress.

427Delivery was by spontaneous vaginal birth.

433Birth weight was 3,327 grams (7 lbs 5 ozÓs).

443There was a loose nuchal cord. The newborn

451was not depressed. Apgar scores were 9/10.

458No resuscitation was required.

462Newborn exam noted Ðear shape tilt down . Ñ

471Otherwise, newborn exam was normal. The baby

478was not in distress. Newborn hospital course

485was benign. Discharge home was on DOL 2.

493Right - sided weakness was noted at 6 months of

503age. MRI showed an old cerebral infarct.

510Coagulation evaluatio n was negative. The

516child was subsequently diagnosed with spastic

522hemiplegia and developmental delay. Follow

527up MRIÓs showed remote insult of left middle

535cerebral artery and resulting

539encephalomalacia.

540In summary, labor and delivery were

546apparently with out complications. Delivery

551was by spontaneous vaginal birth. The baby

558was not depressed. Apgar scores were 9/10.

565The newborn hospital course was benign with

572discharge home on DOL 2.

577The child was found to have a cerebral

585infarct at 6 months of age. T he infarct does

595not appear to be related to a hypoxic event

604or trauma during labor, delivery or the

611immediate post - delivery period.

6163. A review of the file reveals that no contrary evidence

627was presented to dispute Dr. WillisÓ finding that while Bentley

637was found to have a cerebral infarct at 6 months of age,

649BentleyÓs injuries were not related to a hypoxic event or trauma

660during labor, delivery or the immediate post - delivery period.

670Dr. WillisÓ opinion is credited.

6754. The Petition was filed on January 20, 2015, which is

686more than five years after BentleyÓs birth.

693CONCLUSIONS OF LAW

6965 . The Division of Administrative Hearings has jurisdiction

705over the parties to and the subject matter of these proceedings.

716§§ 766.301 - 766.316, Fla. Stat.

7226 . The Plan w as established by the Legislature "for the

734purpose of providing compensation, irrespective of fault, for

742birth - related neurological injury claims" relating to births

751occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

7627 . The injured infant, h er or his personal representative,

773parents, dependents, and next of kin may seek compensation under

783the Plan by filing a claim for compensation with DOAH.

793§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

801which administers the Plan, has "45 days from the date of service

813of a complete claim . . . in which to file a response to the

828petition and to submit relevant written information relating to

837the issue of whether the injury is a birth - related neurological

849injury." § 766.305(4), Fla. Stat .

8558 . NICA has determined that Petitioners do not have a claim

867that is compensable under the Plan and has filed a Motion for

879Summary Final Order, requesting that an order be entered finding

889that the claim is not compensable.

8959 . In ruling on the motion, the a dministrative l aw ju dge

909must make the following determination based upon the available

918evidence:

919(a) Whether the injury claimed is a birth -

928related neurological injury. If the claimant

934has demonstrated, to the satisfaction of the

941administrative law j udge, that the infant has

949sustained a brain or spinal cord injury

956caused by oxygen deprivation or mechanical

962injury and that the infant was thereby

969rendered permanently and substantially

973mentally and physically impaired, a

978rebuttable presumption shall aris e that the

985injury is a birth - related neurological injury

993as defined in s. 766.303(2).

998§ 766.309(1), Fla. Stat.

100210 . The term "birth - related neurological injury" is defined

1013in section 766.302(2) as follows:

"1018Birth - related neurological injury" means

1024inj ury to the brain or spinal cord of a live

1035infant weighing at least 2,500 grams for a

1044single gestation or, in the case of a

1052multiple gestation, a live infant weighing at

1059least 2,000 grams at birth caused by oxygen

1068deprivation or mechanical injury occurring in

1074the course of labor, delivery, or

1080resuscitation in the immediate postdelivery

1085period in a hospital, which renders the

1092infant permanently and substantially mentally

1097and physically impaired.

110011 . The evidence, which is not refuted, established that

1110alth ough Bentley was found to have a cerebral infarct at six

1122months of age, the infarct was not related to a hypoxic event or

1135trauma during labor, delivery or the immediate post - delivery

1145period. Thus, Bentley is not eligible for benefits under the

1155Plan.

115612. Moreover, the Petition for Benefits was filed more than

1166five years after the birth of Bentley. This is beyond the five -

1179year statute of limitations set forth in section 766.313, and is,

1190therefore, barred.

1192CONCLUSION

1193Based upon the foregoing Findings of Fact and Conclusions of

1203Law, it is ORDERED that the Petition filed by Aiza P. Velazquez

1215and Enemias Velazquez , individually and on behalf of Bentley X.

1225Velazquez , a minor, is dismissed with prejudice.

1232DONE AND ORDERED this 23rd day of April , 2015 , in
