106STATEMENT OF THE ISSUE

110The issue in this case is whether the RespondentÓs license

120to practice as a certified nursing assistant should be revoked or

131otherwise disciplined based on the charges of unprofessional

139conduct by s tealing from a patient.

146PRELIMINARY STATEMENT

148The Petitioner, Department of Health (DOH), Board of Nursing

157(Board) , filed an Administrative Complaint against the

164Respondent, Tamar Laurent, charging her with intentionally

171violating s ection 464.204(1)(b), Fl orida Statutes (2012), by

180engaging in unprofessional conduct under 464.018(1)(h), as

187defined by Florida Administrative Code R ule 64B9 - 8.005(4), by

198stealing from a patient. (Unless otherwise stated, all statutes

207and rules are the versions in effect at the time of the alleged

220theft in early 2013). The Respondent requested a hearing, and

230the matter was referred to DOAH.

236At the DOAH hearing on June 24, 2015, DOH called the

247Respondent and four other witnesses who were cross - examined by

258the Respondent: Detecti ve David Osso; the patientÓs son,

267R.G. III; the floor nurse at Westminster Towers , Rita Burginia ;

277and the former director of nursing at Westminster Towers, Nicole

287Daigneault. PetitionerÓs Exhibits 1 through 3 were received in

296evidence. The Respondent te stified in her case - in - chief after

309DOH rested .

312The Transcript of the final hearing was filed on August 5,

3232015. The parties were given until August 15, 2015, to file

334proposed recommended orders. Only DOH has filed a proposed

343recommended order, and it has been considered in preparation of

353this Recommended Order.

356FINDING S OF FACT

3601. The Respondent, Tamar Laurent, is a certified nursing

369assistant (CNA) in the State of Florida having been issued

379license CNA 43605. This is the first time action has been take n

392by DOH and the Board to discipline her license.

4012. In December 2012 and January 2013, the Respondent was

411employed by Westminster Towers. While working at Westminister

419Towers , the R espondent was assigned to care for patient R.G.

4303. R.G. was given a c ell phone by his son R.G. III. The

444Respondent picked up the cell phone , which was lying on the floor

456next to R.G.Ós bed , and placed it in the drawer of a nightstand

469that was for and contained R.G.Ós personal items. T he Respondent

480thou ght the phone belong ed to R.G. One week later , she went back

494into the drawer and took the cell phone to give to her son.

5074. While visiting his father , R.G. III realized that the

517cell phone was missing. R.G. III attempted to find the phone

528using family location tracking and looking up the call log. The

539information he uncovered was given to the Orlando Police

548Department and Westminster Towers .

5535. Nicole Daigneault was the director of nursing at the

563time of the incident. After receiving the information from

572R.G. III, she initiated an internal investigation and reported

581the incident as a theft to the Agency for Healthcare

591Administration. The internal investigation discovered that the

598Respondent and the RespondentÓs son were in possession of the

608cell phone . The Respondent contacted Detective Osso of the

618Orlando Police Department. During an interview with Detective

626Osso, the Respondent admitted to taking R.G.Ós cell phone. A few

637days after the interview , the Respondent retrieved the cell phone

647from her son and gave it to h er attorney to return to R.G. III.

6626. During the hearing , the Respondent maintained that she

671did not know the cell phone belonged to R.G. and that she placed

684it in his bedside table because she found it next to his bed.

697T his contradicted her own testimo ny during the hearing , and in

709the RespondentÓs earlier statement to the Orlando Police

717Department , that she assumed the cell phone belonged to R.G. when

728she put it in his drawer. T he Respondent knew that the cell

741phone did not belong to her and that she d id not have a right to

757take it.

7597. During the hearing, the Respondent stated her

767supervisor, Rita, gave her permission to take the cell phone if

778she brought it back the next day. However, Rita Burginia, the

789supervisor of nursing assistants at the time o f the incident ,

800never had a conversation with the Respondent or would n ever

811authorize anyone to take the personal property of a patient.

821After the testimony of Ms. Burginia, the Respondent then claimed

831she spoke to a different supervisor , also named Rita. Nicole

841Daigneault can only recall one Rita working at Westminster Towers

851at that time, Rita Burginia. In any event, t he Respondent did

863not return the cell phone the next day but rather kept it for a

877few weeks.

879CONCLUSIONS OF LAW

8828. Section 464.204(1)(b ), Florida Statutes (2012),

889authorizes the board to impose discipline against a license for

899intentionally violating any provision of chapter 464, chapter

907456, or the rules adopted by the B oard.

9169. Intentionally committing unprofessional conduct under

922sect ion 464.018 (1) (h) as defined by r ule 64B9 - 8.005(4), by

936stealing from a patient, is grounds for license discipline.

94510. This is a license discipline case, which placed the

955burden on DOH to prove the charges by clear and convincing

966evidence. DepÓt of Banki ng & Fin. v. Osborne Stern & Co. , 670

979So. 2d 932 (Fla. 1996); Ferris v. Turlington , 510 So. 2d 292

991(Fla. 1987). The Supreme Court has stated:

998Clear and convincing evidence requires that

1004the evidence must be found to be credible;

1012the facts to which the wi tnesses testify must

1021be distinctly remembered; the testimony must

1027be precise and lacking in confusion as to the

1036facts in issue. The evidence must be of such

1045a weight that it produces in the mind of the

1055trier of fact a firm belief or conviction,

1063without he sitancy, as to the truth or the

1072allegations sought to be established.

1077In re Henson , 913 So. 2d 579, 590 (Fla. 2005) (quoting Slomowitz

1089v. Walker , 429 So. 2d 797, 800 (Fla. 4th DCA 1983)).

110011. The evidence was clear and convincing that the

1109Respondent inte ntionally committ ed unprofessional conduct, as

1117defined by rule 64 B 9 - 8.005(4) , by stealing a cell phone from

1131patient R.G.

113312. Rule 64B9 - 15.009 contains the penalty guidelines for

1143violations. The range of discipline for a first offense under

1153section 464.01 8(1)(h) is from a $50 fine, reprimand and

1163probation, and continuing education, to a denial of certification

1172or $150 fine, reprimand, suspension followed by probation, or

1181revocation. Fla. Admin. Code R. 64B9 - 15.009(3)(ii). The

1190evidence does not support de viat ion from the guidelines based on

1202mitigating or aggravating factors . Fla. Admin. Code R. 64B9 -

121315.009(5) . The RespondentÓs intentional wrongdoing, compounded

1220by her untruthfulness, justifies revocation.

122513. Section 456.072(4) provide s that the Board s hall assess

1236costs related to the investigation and prosecution, in addition

1245to other discipline imposed for violating a practice act.

1254RECOMMENDATION

1255Based upon the foregoing Findings of Fact and Conclusions of

1265Law, it is RECOMMENDED that the Board of Nursi ng enter a final

1278order finding the Respondent guilty as charged ; and revok ing her

1289license to practice as a certified nursing assistant ; and

1298assessing costs of investigation and prosecution.
