75October 17, 2016.
78STATEMENT OF THE CASE
82On February 1 8 , 2015, Petitioners, Evelyn Green and Akeem E.
93Brown, individually and on behalf of Akeem Brown (Akeem), a minor,
104filed a Petition Under Protest Pursuant to Florida Statute Section
1147 66.301 et seq. (Petition), with the Division of Administrative
124Hearings (DOAH). The Petition was subsequently amended, and the
133Amended Petition Under Protest was filed on June 18, 2015.
143The Petition named Marwan Munib Shaykh, M.D., as the
152physician prov iding obstetric services at the birth of Akeem at
163Memorial Hospital in Jacksonville, Florida, on May 15, 2012.
172DOAH served NICA with a copy of the Petition on February 25,
1842015. DOAH served Marwan Munib Shaykh, M.D., with a copy of the
196Petition on Februa ry 26, 2015. DOAH served Memorial Hospital
206Jacksonville with a copy of the Petition on February 27, 2015.
217On June 29, 2015, Memorial Healthcare Group, Inc., d/b/a
226Memorial Hospital Jacksonville, filed a Petition to Intervene,
234which was granted.
237On Nove mber 17, 2015, NICA filed a response to the Amended
249Petition, giving notice that the injury does not "meet the
259definition of a 'birth - related neurological injury' as defined in
270section 766.302(2), Florida Statutes, which specifically requires
277that the inju ry render 'the infant permanently and substantially
287mentally and physically impaired.'" NICA requested that a hearing
296be scheduled to resolve whether the claim was compensable.
305A hearing was scheduled for June 28, 201 6 . A Motion for
318Continuance was gran ted and the hearing was rescheduled for
328October 6, 2016. On September 23, 2016, Intervenor Memorial
337Hospital Jacksonville filed a Notice of Withdrawal, stating that
346it would take no part in advancing or opposing any argument
357regarding the issue of compens ability. Petitioners and Respondent
366filed a Joint Notice Regarding Need for Final Hearing, stating
376that with the withdrawal of Intervenor Memorial Hospital
384Jacksonville, there was no longer any need for a final hearing.
395The hearing scheduled for October 6, 2016, was canceled.
404On October 17, 2016, NICA filed a Motion for Summary Final
415Order, asserting that Akeem did not sustain a birth - related
426neurological injury as that term is defined in section 766.302(2),
436Florida Statutes. While no response to the mot ion was filed by
448Petitioners, it is noted that the Petition was filed under protest
459and asserted that the Petitioners are not claimants.
467FINDINGS OF FACT
4701. Akeem Brown was born on May 15, 2012, at Memorial
481Hospital Jacksonville in Jacksonville, Florida.
4862. NICA retained Donald C. Willis, M.D. (Dr. Willis), to
496review AkeemÓs medical records. In a medical report dated May 14,
5072015, Dr. Willis made the following findings and expressed the
517following opinion:
519Spontaneous vaginal delivery was apparently
524u ncomplicated. Birth weight was 3,626 grams
532or 8 lbs. The baby was not depressed. Apgar
541scores were 8/9.
544Newborn hospital course appears to be
550uncomplicated. Progress note on the day after
557birth recommended routine newborn care.
562Neurology evaluation a t 20 months of age
570stated the baby had global developmental
576delay, hypotonia, and hyperreflexia. MRI at
582about 2 years of age showed bilateral motor
590cortex hyperintense FLAIR, suggestive of
595gliosis. A subsequent neurology note stated
601this finding was like ly related perinatal
608ischemia.
609In summary, there was no apparent fetal
616distress during labor. Delivery was
621uncomplicated. The newborn was not depressed.
627Newborn hospital course was uncomplicated.
632The baby was subsequently found to have global
640developme ntal delay and an abnormal MRI as
648described above. There is nothing in the
655medical records to suggest this brain injury
662was related to hypoxia or trauma during the
670birth process.
672There was no apparent obstetrical event that
679resulted in loss of oxygen or mechanical
686trauma to the babyÓs brain during labor,
693delivery or the immediate post delivery
699period.
7003. Dr. Willis reaffirmed his opinion in an affidavit dated
710October 31 , 2016.
7134. Dr. WillisÓ opinion that there was no obstetrical event
723that resulted in loss of oxygen or mechanical trauma to the
734babyÓs brain during labor, delivery or in the immediate post -
745delivery period is credited.
7495. Respondent retained Laufey Y. Sigurdardottir, M.D.
756(Dr. Sigurdardottir), a pediatric neurologist, to evaluate Akeem.
764Dr. Sigurdardottir reviewed AkeemÓs medical records, and
771performed an independent medical examination on him on
779October 21, 2015. Dr. Sigurdardottir made the following findings
788and summarized her evaluation as follows:
794Summary: Akeem is a 3 - year 5 - mont h - old black
808male who has a possible bilateral hemiplegic
815cerebral palsy following a fairly
820uncomplicated pregnancy and delivery. His
825MRI shows evidence of old hypoxia. After
832review of fairly extensive maternal records
838and labor and delivery records, it s eems
846clear that timing his injury is difficult as
854he did not show any evidence of recent
862neurologic injury at the time of birth.
869Although sparse medical records of Akeem are
876made available to us, such as physical
883therapy or occupational therapy records,
888co gnitive testing or language assessments and
895no additional neurologic evaluations are at
901hand it seems clear that Akeem has relatively
909spared cognitive abilities.
912Final result:
914Results of question 1: The patient is found
922to have a permanent substantial p hysical
929impairment, but to have relatively mild
935mental impairment mainly in the areas of
942language.
943Results of question 2: There is evidence on
951neuroimaging that AkeemÓs difficulties could
956relate to hypoxic neurologic injury, but no
963clear evidence to sugg est the timing of such
972an injury and, therefore, it cannot be
979established that it occurred in the immediate
986perinatal period.
988Results of question 3: We would expect full
996life expectancy, although a guarded prognosis
1002for motor recovery and likely ongoing
1008disability from his significant bilateral
1013hemiplegia. We expect favorable recovery in
1019areas of cognition and language. In light of
1027the above - mentioned details, difficulty with
1034clear timing of AkeemÓs injury, we do not
1042recommend Akeem to be included into the
1049Neurologic Injury Compensation Association
1053(NICA) Program and would be happy to answer
1061additional questions.
10636. Dr. Sigurdardottir reaffirmed her opinions in an
1071affidavit dated November 29 , 2016.
10767. In order for a birth - related injury to be compen sable
1089under the Plan, the injury must meet the definition of a birth -
1102related neurological injury and the injury must have caused both
1112permanent and substantial mental and physical impairment.
11198. Dr. SigurdardottirÓs opinion that while Akeem has a
1128substant ial physical impairment, he has a relatively mild mental
1138impairment , mainly in the area of language , is credited.
11479. A review of the file in this case reveals that there
1159have been no expert opinions filed that are contrary to the
1170opinion of Dr. Sigurdard ottir that Akeem does not have a
1181substantial mental impairment.
1184CONCLUSIONS OF LAW
118710. The Division of Administrative Hearings has jurisdiction
1195over the parties to and the subject matter of this proceeding.
1206§§ 766.301 - 766.316, Fla. Stat. (2014).
121311. T he Plan was established by the Legislature "to provide
1224compensation on a no - fault basis, for a limited class of
1236catastrophic injuries that result in unusually high costs for
1245custodial care and rehabilitation." § 766.301, Fla. Stat. The
1254Plan applies only to a birth - related neurological injury, which is
1266defined in section 766.302(2) as follows:
"1272Birth - related neurological injury" means
1278injury to the brain or spinal cord of a live
1288infant weighing at least 2,500 grams for a
1297single gestation or, in the case o f a multiple
1307gestation, a live infant weighing at least
13142,000 grams at birth caused by oxygen
1322deprivation or mechanical injury occurring in
1328the course of labor, delivery, or
1334resuscitation in the immediate postdelivery
1339period in a hospital, which renders th e infant
1348permanently and substantially mentally and
1353physically impaired . This definition shall
1359apply to live births only and shall not
1367include disability or death caused by genetic
1374or congenital abnormality. (emphasis added).
137912. The injured infant, h er or his personal representative,
1389parents, dependents, and next of kin, may seek compensation under
1399the plan by filing a claim for compensation with DOAH.
1409§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. The Florida
1418Birth - Related Neurological Injur y Compensation Association, which
1427administers the Plan, has "45 days from the date of service of a
1440complete claim . . . in which to file a response to the petition
1454and submit relevant written information relating to the issue of
1464whether the injury is a bir th - related neurological injury."
1475§ 766.305(4), Fla. Stat.
147913. If NICA determines that the injury alleged in a claim is
1491a compensable birth - related neurological injury, it may award
1501compensation to the claimant, provided that the award is approved
1511by the Administrative Law Judge to whom the claim has been
1522assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1533disputes the claim, as it has in the instant case, the dispute
1545must be resolved by the assigned Administrative Law Judge in
1555accordance wit h the provisions of chapter 120, Florida Statutes.
1565§§ 766.304, 766.309, and 766.31, Fla. Stat.
157214. In discharging this responsibility, the Administrative
1579Law Judge must make the following determinations based upon all
1589available evidence:
1591(a) Whether t he injury claimed is a birth -
1601related neurological injury. If the claimant
1607has demonstrated, to the satisfaction of the
1614administrative law judge, that the infant has
1621sustained a brain or spinal cord injury caused
1629by oxygen deprivation or mechanical injury and
1636that the infant was thereby rendered
1642permanently and substantially mentally and
1647physically impaired, a rebuttable presumption
1652shall arise that the injury is a birth - related
1662neurological injury as defined in s.
1668766.302(2).
1669(b) Whether obstetrical se rvices were
1675delivered by a participating physician in the
1682course of labor, delivery, or resuscitation in
1689the immediate postdelivery period in a
1695hospital; or by a certified nurse midwife in a
1704teaching hospital supervised by a
1709participating physician in the course of
1715labor, delivery, or resuscitation in the
1721immediate postdelivery period in a hospital.
1727§ 766.309(1), Fla. Stat. An award may be sustained only if the
1739Administrative Law Judge concludes that the "infant has sustained
1748a birth - related neurological injury and that obstetrical services
1758were delivered by a participating physician at birth."
1766§ 766.31(1), Fla. Stat.
177015. In the instant case, Petitioners filed a claim seeking a
1781determination of whether Akeem sustained a birth - related
1790neurological injury that is compensable under the NICA plan. As
1800the proponent of the issue of compensability, the burden of proof
1811is upon Petitioners. § 766.309(1)(a), Fla. Stat. See also Balino
1821v. Dep't of Health & Rehab ilitative Servs. , 348 So. 2d 349, 350
1834(Fla. 1st DCA 1977)("[T]he burden of proof, apart from statute, is
1846on the party asserting the affirmative of an issue before an
1857administrative tribunal.").
186016. Dr. Willis established that there was no apparent
1869obstetrical event which resulted in oxygen deprivation or
1877mechanical trauma to the babyÓs brain during labor, delivery and
1887the immediate post - delivery period. The remaining issue to be
1898determined is whether the injury resulted in a permanent and
1908substantial mental impairment and a permanent and substantial
1916physi cal impairment, inasmuch as both are required to establish
1926compensability. Fla. Birth - Related Neurological Injury Comp.
1934Ass'n v. Div. of Admin. Hearings , 686 So. 2d 1349 (Fla. 1997).
194617. The evidence, which is not refuted, established that
1955Akeem does not have a permanent and substantial mental impairment.
1965Thus, Akeem is not entitled to benefits under the Plan.
1975CONCLUSION
1976Based on the foregoing Findings of Fact and Conclusions of
1986Law, it is ORDERED :
1991T hat the P etition filed by Evelyn Green and Akeem E . Brown,
2005individually and on behalf of Akeem Brown, is dismissed with
2015prejudice.
