230The issue in this case is whether Madeline Elizabeth Kitchen

240suffered an injury for which compensation should be awarded under

250the Florida Birth - Related Neurological Injury Compensation Plan

259(Plan).

260PRELIMINARY STATEMENT

262On February 24, 201 5 , Sarah W. Kitchen and Steven Kitchen, o n

275behalf of and as natural guardians of Madeline Elizabeth Kitchen

285(Madeline), a minor, filed a Petition for Benefits Pursuant to

295Florida Statute Section 766.301 et seq. (Petition), with the

304Division of Administrative Hearings (DOAH). The Petition alleged

312that Madeline suffered a birth - related neurological brain and/or

322spinal cord injury.

325The Petition named Robert Roland Powers, D.O. ;

332Eric Edelenbos, D.O. ; and R. Sharonn Jones, CNM, ARNP, as the

343medical providers providing obstetric services, and alleged t hat

352Madeline was born at Orange Park Medical Center , which is located

363in Orange Park, Florida, on March 9, 2013.

371DOAH served the Florida Birth - Related Neurological Injury

380Compensation Association (NICA) on March 4, 2015. DOAH served

389Robert Roland Powers, D.O. ; Eric J. Edelenbos, D.O. ; and

398R. Sharonn Jones, CNM, ARNP, with a copy of the Petition on

410March 5, 2015.

413On March 12, 2015, Orange Park Medical Center filed a

423Petition to Intervene, which was granted by Order dated March 20,

4342015. On March 23, 201 5, R. Sharonn Jones, CNM, ARNP ; and North

447Florida OB/GYN, LLC, filed a Petition for Leave to Intervene,

457which was granted by Order dated March 31, 2015.

466On August 19, 2015, NICA filed a response to the Petition,

477giving notice that the alleged injury did n ot "meet the definition

489of a 'birth - related neurological injury' as defined in section

500766.302(2), Florida Statutes, which requires that an injury to the

510brain or spinal cord caused by oxygen deprivation or mechanical

520injury occurring in the course of labo r, delivery or resuscitation

531in the immediate post delivery period, and that the injury render

542'the infant permanently and substantially mentally and physically

550impaired.'" NICA requested that a hearing be scheduled to resolve

560whether the claim was compen sable.

566A final hearing was scheduled for March 3, 201 6 . On

578February 11, 201 6 , the parties filed a Joint Motion to Submit

590Stipulated Factual Record in Lieu of a Contested Hearing. On

600February 12, 201 6 , an Order was entered granting the parties leave

612to s ubmit a stipulated record in lieu of a live administrative

624hearing.

625On March 25, 2016, Orange Park Medical Center filed a Notice

636of Withdrawal, withdrawing as an Intervenor in this case.

645On April 8, 2016, the parties filed a Stipulated Record,

655consisting of printed copies of Joint Exhibits A through AA.

743FINDINGS OF FACT

7461. Sarah W. Kitchen and Steven Kitchen are the natural

756parents of Madeline E lizabeth Kitchen (Madeline), a minor.

7652. Madeline was born a live infant at Orange Park Medical

776Center, a licensed hospital in Orange Park, Florida, on March 9,

7872013.

7883. Obstetrical services at the time of MadelineÓs birth w ere

799provided by Sharonn J ones , CNM, ARNP ; and her employer, North

810Florida OB/GYN, LLC. At all material times, Nurse J ones and North

822Florida OB/GYN were participants in the Florida Birth - Related

832Neurological Compensation Plan. NICA Ós notice is not at issue as

843to Nurse Jones or North Florida OB/GYN in this proceeding.

8534. Madeline weighed in excess of 2,500 grams at birth.

8645. Petitioners and Interveno rs contend that Madeline

872suffered a birth - related neurological injury , and Petitioners seek

882compensation under the NICA Plan. Petitioners and Intervenors

890take the position that MadelineÓs brain injury was caused by

900oxygen deprivation or mechanical injury occurring in the course of

910labor, delivery or resuscitation in the immediate post - delivery

920period, which rendered Madeline permanently and substantially

927impaired. Respondent contends that MadelineÓs injury does not

935meet the definition of a birth - related n eurological injury as

947defined in section 766.302(2), Florida Statutes.

9536. Petitioner Sarah Kitchen was admitted to Orange Park

962Medical Center on March 9, 2013. Her membranes were artificially

972ruptured at 12:48 in the afternoon, and her amniotic fluid wa s

984clear. There were some fetal heart decelerations during labor.

993After Mrs. Kitchen pushed for over an hour, vacuum extraction with

1004two pulls was used to assist vaginal delivery. There was meconium

1015stained amniotic fluid requiring intubation and suctioni ng before

1024first cry.

10267. MadelineÓs Apgar scores were 4 at one minute, 9 at 5

1038minutes and 9 at 10 minutes.

10448. The cord blood pH was 7.155.

10519. Madeline was in the transitional nursery for a period of

1062time but was not admitted to the NICU. She then spent two days in

1076the regular nursery prior to being discharged home. Other than

1086concerns about MadelineÓs ability to nurse, there appear to have

1096been no other concerns at discharge.

110210. When Madeline was about seven months old, Mrs. Kitchen

1112began to have concerns about MadelineÓs progress and discussed her

1122concerns with MadelineÓs pediatrician. In July 2014, Madeline was

1131seen by Dr. Harry Abram s , a pediatric neurologist with Nemours

1142ChildrenÓs Clinic in Jacksonville. He concurred with the parentsÓ

1151concer ns of motor , as well as language delays. Dr. Abrams

1162recommended an MRI of the brain, referral to Nemours Orthopedics

1172and Nemours GI, as well as the Early Steps Program anticipating

1183the need for speech and physical therapy. He also noted mild

1194microcephaly .

119611. Madeline had an MRI of the brain in August 2014 , when

1208she was approximately 16 months of age. The MRI revealed

1218Ðbilateral periventricular hyper intense signal areas with cystic

1226changes with old hemorrhagic products along with the lateral

1235ventricles lining with a thin corpus callosum consistent with

1244periventricular leukomalacia. Ñ

124712. Following the results of the MRI, Madeline had a follow -

1259up appointment with Dr. Abrams who reviewed the results with

1269MadelineÓs parents and Ðdiscussed in detail the usa ge of the term

1281of Òcerebral palsy.ÓÑ Dr. Abrams Ó notes reflect that the

1291importance of early intervention was discussed and noted that the

1301evaluation for the Early Steps Program had already begun.

131013. Dr. Abrams again saw Madeline at an appointment i n

1321December 2014. His notes reflect that the mother reported ongoing

1331developmental progress, but had expressed frustration at

1338MadelineÓs therapies being limited to physical therapy once per

1347month and speech therapy once per week, with no occupational

1357thera py. Dr. Abrams recommended more frequent therapies.

136514. At an appointment in June 2015, Dr. AbramsÓ notes

1375describe Madeline as a Ð2 - year - old child with mild cerebral palsy

1389who is making good progress.Ñ

139415. At the time of Mrs. KitchenÓs deposition on Ju ly 1,

14062015, Madeline was receiving physical therapy (once a week for 30

1417minutes), speech therapy for eating (once a week for 60 minutes) ,

1428and occupational therapy consults on an ir regular basis . She is

1440able to feed herself, mostly with her fingers. Madel ine did not

1452walk until 18 months of age, but is now walking without having to

1465hold on to anything. Her left leg is the ÐweakerÑ leg and is

1478slightly shorter than her right leg. Her left foot turns in.

1489There have been discussions regarding the possibility of a brace

1499for her left leg if it does not correct itself. Her speech is

1512limited to a few words.

151716. NICA retained Donald C. Willis, M.D., to review

1526MadelineÓs medical records. Dr. Willis made the following

1534findings and expressed the following opinio n in a report dated

1545April 20, 2015:

1548I have reviewed the medical records for the

1556above individual. The mother, Sarah Kitchen

1562was a 28 year old G1. Her AFP screen was

1572positive for Down syndrome. She was evaluated

1579by M aternal - Fetal Medicine. Amniocentesi s was

1588declined. The abnormal AFP was not a factor

1596in the outcome of this case.

1602The mother was seen for decreased fetal

1609movement three days before delivery.

1614Biophysical profile (BPP) was 8/8 with normal

1621amniotic fluid volume (AFI of 10 cms).

1628Findings sug gested the fetus was not in

1636distress. Non - stress test (NST) was done the

1645following day and was reactive, again

1651suggesting the fetus was not in distress.

1658The mother presented to the hospital in labor

1666about two days after the above NST. Her

1674cervix was dil ated 4 cms. Amniotic fluid was

1683reported to be clear. Fetal h eart rate (FHR)

1692tracing during labor was not available for

1699review, but labor and delivery record reported

1706Ðmeconium stained fluid and decelerationsÑ as

1712complications.

1713Vacuum extractor with two pulls was used to

1721assist vaginal delivery. Birth weight was

17273,538 grams (7 lbs 12 ozÓs). Apgar scores

1736were 4/9/9. The newborn was intubated for

1743meconium and suctioned. Arterial cord blood

1749gas was within normal limits with a pH of

17587.155 and a base exces s of - 5.

1767Newborn physical gives an overall assessment

1773of normal exam. Newborn hospital course was

1780uneventful. The baby was discharged home on

1787two days after birth.

1791The child was subsequently followed for

1797developmental delay. MRI on 08/04/2014 (about

18031 6 months of age) showed periventricular

1810leukomalacia.

1811In summary, there was not significant oxygen

1818deprivation during labor and delivery and

1824indicated by normal blood gas and normal Apgar

1832score at 5 minutes. The newborn hospital

1839course was uncomplicated .

1843There was no apparent obstetrical event that

1850resulted in loss of oxygen or mechanical

1857trauma to the babyÓs brain during labor,

1864delivery, or the immediate post delivery

1870period.

1871In a follow - up report dated August 1 3 , 2015, Dr. Willis reaffirmed

1885his opi nion :

1889I have reviewed the fetal heart rate (FHR)

1897tracing for the above individual. The base

1904line FHR is normal at about 140 bpm on

1913admission and heart rate variability is

1919normal. The FHR monitor tracing does not

1926suggest fetal distress during labor.

1931The normal appearing FHR tracing would be in

1939agreement with my previous medical opinion

1945that the baby did not suffer oxygen

1952deprivation during labor.

195517. Dr. WillisÓ opinion that there was no apparent

1964obstetrical event that resulted in loss of oxygen or mech anical

1975trauma to the babyÓs brain during labor, delivery, or the

1985immediate post - delivery period is credited.

199218. Respondent retained Laufey Y. Sigurdardottir, M.D., to

2000evaluate Madeline. Dr. Sigurdardottir is a pediatric neurologist

2008with the Division of Neurology of Nemours . Dr. Sigurdardottir

2018reviewed MadelineÓs medical records and performed an independent

2026medical examination on Madeline on July 29, 2015.

2034Dr. Sigurdardottir made the following findings and summarized her

2043evaluation as follows:

2046MEDICAL HISTORY:

2048Madeline is a 2 - year 4 - month - old Caucasian

2060female who was born via vaginal delivery at

206840 weeks Ó gestation after a normal pregnancy.

2076The labor was slightly prolonged, some fetal

2083heart decelerations were noted and the

2089delivery ended with vacuum ex traction. There

2096was meconium stained amniotic fluid,

2101requiring intubation and suctioning below

2106vocal cords. The patient was 7 pounds 13

2114ounces at birth, had diminished respiratory

2120effort at birth and Apgar scores were 4 after

21291 minute and 9 after 5 minute s. The patient

2139was briefly tended to in the transitional

2146nursery, but then spent 2 days with mom in

2155the newborn nursery prior to being discharged

2162home, presumed to be in good health.

2169Madeline has been found to have significant

2176delays in both motor and co gnitive

2183development. She has been diagnosed with a

2190chronic static encephalopathy including

2194cerebral palsy with left greater than right -

2202sided symptoms, language delay and poor

2208social interaction for age. MRI imaging has

2215shown signs of old intracerebral he morrhage

2222and cystic periventricular leukomalacia. Due

2227to the severity of MadelineÓs delays, her

2234case is being considered for NICA

2240compensation.

2241* * *

2244Labor history:

2246Mom presented on 03/09/13 at 10: 10 a.m. and

2255was admitted for labor. The chart documen ts

2263a total hours in labor as 62 hours and

2272documents stage 1 as 60 hours 15 minutes,

2280stage 2 was 1 hour 54 minutes, and stage 3 as

22914 minutes. An epidural anesthesia was used,

2298the fetal heart rate tracing is not provided

2306for our review, but there is documen tation of

2315decelerations without further clarification

2319in an inpatient summary from Orange Park

2326Medical Center. Mom reports having push for

2333more than 1 hour and therefore vacuum

2340extraction was used. Some documentation

2345describes forceps attempt, but this c annot be

2353verified on record review. Two vacuum

2359attempts were needed and a third degree

2366perineal laceration was sustained by

2371MadelineÓs mother. When Madeline was born,

2377there is no documentation of shoulder

2383dystocia, and she is noted to be blue and

2392have po or respiratory effort. Suctioning was

2399performed below vocal cords due to meconium

2406staining of amniotic fluid. She had Apgar

2413score of 4 at 1 minute. Her Apgar scores

2422quickly improved being 9 after 5 minutes and

24309 after 10 minutes with her only lack being

2439in area of color. Arterial cord blood was

2447sent revealing a pH of 7.16 with a pCO2 of

245767.8 and pO2 of less than 47%. A venous cord

2467blood was also sent with the pH of 7.24 and a

2478pC O 2 of 51. Madeline was 50 cm at birth,

24893538 g and a head circumference of 32.5 cm,

2498which places her head circumference to be at

2506the 8 th percentile, her length to be at the

251634 th percentile and her weight at birth to be

2526at the 62 nd percentile per the CDC growth

2535curve. The patient was discharged home,

2541presumed to be in good health .

2548Developmental and Medical History:

2552MadelineÓs mother reports early feeding

2557difficulties. She recalls her being fairly

2563floppy and that the parents were worried

2570about delayed visual fixation until about 3 - 4

2579months of age. MadelineÓs mother brought her

2586to her pediatrician around the age of 6

2594months for complaints of not grabbing toys

2601and not showing interest in rolling over or

2609sitting up. She had an early frenulectomy

2616due to poor sucking and was referred for hip

2625x - rays for poor mobility at the age of 15

2636months, which was found to be normal. The

2644patient was referred to physical,

2649occupational and speech therapy and was able

2656to walk unassisted around the age of 20

2664months. The parents feel that her left side

2672is weaker than her right. She seems

2679unsteady, h aving a broad stance and frequent

2687falling. The parents are also worried about

2694her language development and report her

2700having only 5 - 6 words (bye - bye, mama, dada,

2711papa and milk) and a few signs at 2 yr 4

2722months of age. She seems to be very

2730attracted to mu sic and will want to listen to

2740music and dance along. Madeline is not

2747interested in interacting with her peers.

2753She loves to swing on swings and will often

2762just go about the house on her own terms.

2771Her parents do feel that she will turn

2779towards their fa ce if they say her name, but

2789that it has been difficult to get her to

2798repeat words or point to pictures or label

2806items. They do feel that she knows her body

2815parts. Due to concerns for possible cerebral

2822palsy, she was seen by Dr. Abram of Neurology

2831in Nem ours ChildrenÓs Specialty Care,

2837Jacksonville in July of 2014 at the age of 15

2847months. A neurologic exam did comment on her

2855head circumference being below the 5 th

2862percentile, there being no dysmorphic

2867features and that her neurologic exam did not

2875have obvi ous asymmetries. An MRI performed

2882at that time showed: Bilateral

2887periventricular hyperintense FLAIR signal

2891areas are seen with a few cystic changes more

2900severe on the right side. Old hemorrhagic

2907products are seen along the lining of the

2915lateral ventricl es. Corpus callosum is thin.

2922Findings are consistent with periventricular

2927leukomalacia. Myelination is appropriate for

2932age. Size and configuration of the

2938ventricles and basal cisterns appear normal.

2944There is no evidence of restricted diffusion.

2951No evide nce of abnormal intracranial

2957enhancement. The pituitary gland and

2962cervical medullary junction region appears

2967normal. Hippocampi appear normal. Posterior

2972fossa structures including brain stem and

2978cerebellum appear normal.

2981* * *

2984Developmental testing : She has had the

2991following developmental testing performed in

2996August of 2014, PLS - 5 language assessment

3004with a comprehension of 87, expressive

3010language of 89 and total score within the low

3019range of normal. The Battelle Developmental

3025Inventory, however, at the age of 17 months

3033paints a different picture with motor skills

3040at 57, self - help and adaptive skills of a

3050standard score 55, social and emotional a

3057standard score of 85, cognitive a standard

3064score of 77 and communication standard score

3071of 61.

3073* * *

3076NEUROLOGIC EXAMINATION: Mental status:

3080Madeline is on the move throughout the visit,

3088going from 1 toy to the next and seems

3097significantly on her own terms for the

3104majority of the visit. She does at times

3112interact with her parents, but little eye

3119contact is noted. She will at times come up

3128to the examiner briefly. She will look

3135towards voice at times. She will follow

3142simple commands such as stop or no. She will

3151accept food from her parentsÓ hands but not

3159have joint attention during that time. No

3166clear repetitive behavior is noted. No

3172understandable words are heard by the

3178examiner. Cranial nerves: Her pupils are

3184equal, they do react to light. She has

3192conjugate eye movements for the most part,

3199but occasional left eye extropia is noted,

3206especially if she is looking up and to the

3215right. She has symmetric facial features,

3221but seems to keep her mouth open. Her

3229hearing seems intact. Her motor exam reveals

3236diminished axial tone with some tendency for

3243slip through when held in vertical

3249suspension. She ha s asymmetric to ne, mainly

3257in the lower extremities with increased

3263resistance to passive range of motion in the

3271left lower extremit y. Her strength seems to

3279be diminished in bilateral lower extremities

3285and she will at times keep her knees and hips

3295slightly flexed during ambulation. Reflexes

3300are slightly brisker in the left lower

3307extremity than the right. This is not noted

3315in upper extremity. She seems to favor her

3323right upper extremity on exam, using that

3330consistently to grab for toys. Balance and

3337coordi nation: There is significant

3342abnormality with a broad based, slightly

3348ataxic gait and frequent falls. Her intoeing

3355does seem to lead to her tripping over her

3364left foot. She will, however, stand up off

3372the floor without difficulty. There is

3378significant clumsiness with fine motor

3383skills, both on the right and left upper

3391extremity. There is no seizure - like

3398occurrences and no clear tremor, no

3404monoclinic jerking.

3406Overall assessment: Here we have a 2 - year 4 -

3417month - old female with chronic static

3424encephalopat hy manifested by borderline

3429microcephaly, left greater than right sided

3435CP, moderate receptive and expressive

3440language delay and some delays in social

3447interaction and attention. Her language

3452testing from one year ago is outdated and her

3461current language a bilities from what can be

3469observed here would result in her total

3476language score below 70. She has motor

3483disability with bilateral hemiplegic

3487symptoms, but overall good functional skills

3493with independent ambulation having been

3498obtained at 20 months. She is also able to

3507feed herself orally and has been relatively

3514physically healthy from birth.

3518On review of the case, there is no evidence

3527of a prenatal vascular events or periods of

3535decreased fetal movements. On review of the

3542labor and delivery records the re is little to

3551support a serious ischemic event and her mild

3559depressed 1 minute apgar score alone with

3566arterial cord blood pH being 7.16 does not

3574support such an event.

3578Results of IME:

3581As to question 1: The patient is found to

3590have a permanent but not substantial physical

3597impairment and mental abilities that are

3603delayed but progressing.

3606As to question 2: On review of medical

3614records, there is minimal evidence of

3620substantial birth asphyxia. Although initial

3625Apgar score was 4 there was immediate

3632recove ry and the mild decrease in arterial

3640cord blood pH is not below the 7.00 cut off.

3650The neuroimaging findings are consistent with

3656a hypoxic ischemic injury but do not help in

3665the timing of such an injury.

3671As to question 3: At this time, MadelineÓs

3679prognos is regarding her motor development are

3686good, with independent ambulation already in

3692place. Her cognitive development seems to be

3699more difficult to prognosticate at this time,

3706but ongoing speech therapy along with further

3713workup of possible autistic charac teristics

3719would be indicated. We expect ongoing

3725progress in this area and we estimate her

3733life expectancy as being full. At this time,

3741it seems likely that she will need

3748significant ongoing supportive services,

3752although the need for this lifelong is

3759unce rtain at this time.

3764I am therefore not recommending Madeline to

3771be included into the NICA program and would

3779be happy to answer additional questions.

378519. Dr. SigurdardottirÓs opinion that Madeline has a

3793permanent , but not substantial , physical impairment and mental

3801abilities that are delayed , but improving , is credited.

380920. Dr. SigurdardottirÓs opinion that there is minimal

3817evidence of substantial birth asphyxia Ðbut there is little to

3827support a serious ischemic event and her mild depressed 1 minute

3838apg ar score alone with arterial blood pH being 7.16 does not

3850support this eventÑ is credited.

385521 . The greater weight of the evidence establishes through

3865the opinions of two experts that there was no apparent

3875obstetrical event that resulted in loss of oxygen or mechanical

3885injury to Madeline Ós brain during labor, delivery or the post -

3897delivery period.

389922 . Here, the stipulated record demonstrates, along with

3908Dr. SigurdardottirÓs expert opinion, that MadelineÓs physical

3915impairment is permanent , but not substan tial, and that mental

3925abilities are delayed , but progressing. While Madeline has some

3934motor and mental deficits, these deficits do not render her

3944permanently and substantially mentally and physically impaired.

3951CONCLUSIONS OF LAW

395423 . The Division of Admi nistrative Hearings has jurisdiction

3964over the parties to and the subject matter of this proceeding.

3975§§ 766.301 - 766.316, Fla. Stat. (201 5 ).

398424 . The Plan was established by the Legislature "to provide

3995compensation on a no - fault basis, for a limited class o f

4008catastrophic injuries that result in unusually high costs for

4017custodial care and rehabilitation." § 766.301, Fla. Stat. The

4026Plan applies only to a birth - related neurological injury, which is

4038defined in section 766.302(2) as follows:

"4044Birth - related neu rological injury" means

4051injury to the brain or spinal cord of a live

4061infant weighing at least 2,500 grams for a

4070single gestation or, in the case of a multiple

4079gestation, a live infant weighing at least

40862,000 grams at birth caused by oxygen

4094deprivation or m echanical injury occurring in

4101the course of labor, delivery, or

4107resuscitation in the immediate postdelivery

4112period in a hospital, which renders the infant

4120permanently and substantially mentally and

4125physically impaired . This definition shall

4131apply to live births only and shall not

4139include disability or death caused by genetic

4146or congenital abnormality. (emphasis added).

415125 . The injured infant, her or his personal representative,

4161parents, dependents, and next of kin, may seek compensation under

4171the plan by filing a claim for compensation with DOAH.

4181§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. The Florida

4190Birth - Related Neurological Injury Compensation Association, which

4198administers the Plan, has "45 days from the date of service of a

4211complete cl aim . . . in which to file a response to the petition

4226and submit relevant written information relating to the issue of

4236whether the injury is a birth - related neurological injury."

4246§ 766.305(4), Fla. Stat.

425026 . If NICA determines that the injury alleged in a claim is

4263a compensable birth - related neurological injury, it may award

4273compensation to the claimant, provided that the award is approved

4283by the Administrative Law Judge to whom the claim has been

4294assigned. § 766.305(7), Fla. Stat. If, on the other han d, NICA

4306disputes the claim, as it has in the instant case, the dispute

4318must be resolved by the assigned Administrative Law Judge in

4328accordance with the provisions of chapter 120, Florida Statutes.

4337§§ 766.304, 766.309, and 766.31, Fla. Stat.

434427 . In disch arging this responsibility, the Administrative

4353Law Judge must make the following determinations based upon all

4363available evidence:

4365(a) Whether the injury claimed is a birth -

4374related neurological injury. If the claimant

4380has demonstrated, to the satisfacti on of the

4388administrative law judge, that the infant has

4395sustained a brain or spinal cord injury caused

4403by oxygen deprivation or mechanical injury and

4410that the infant was thereby rendered

4416permanently and substantially mentally and

4421physically impaired, a reb uttable presumption

4427shall arise that the injury is a birth - related

4437neurological injury as defined in s.

4443766.302(2).

4444(b) Whether obstetrical services were

4449delivered by a participating physician in the

4456course of labor, delivery, or resuscitation in

4463the i mmediate postdelivery period in a

4470hospital; or by a certified nurse midwife in a

4479teaching hospital supervised by a

4484participating physician in the course of

4490labor, delivery, or resuscitation in the

4496immediate postdelivery period in a hospital.

4502§ 766.309(1) , Fla. Stat. An award may be sustained only if the

4514Administrative Law Judge concludes that the "infant has sustained

4523a birth - related neurological injury and that obstetrical services

4533were delivered by a participating physician at birth."

4541§ 766.31(1), Fla. Stat.

454528 . In the instant case, Petitioners filed a claim alleging

4556that Madeline did sustain a birth - related neurological injury that

4567is compensable under the NICA plan. As the proponent of the issue

4579of compensability, the burden of proof is upon Petiti oners.

4589§ 766.309(1)(a), Fla. Stat. See also Balino v. Dep't of Health &

4601Rehab. Servs. , 348 So. 2d 349, 350 (Fla. 1st DCA 1977)("[T]he

4613burden of proof, apart from statute, is on the party asserting the

4625affirmative of an issue before an administrative tri bunal.").

463529 . Dr. WillisÓ opinion that there was not Ðsignificant

4645oxygen deprivation during labor and delivery Ñ is consistent with

4655Dr. SigurdardottirÓs opinion that there Ðis little to support a

4665serious ischemic event. Ñ

46693 0. The greater weight of the evid ence establishes that

4680there was not an apparent obstetrical event that resulted in loss

4691of oxygen or mechanical injury to MadelineÓs brain during labor,

4701delivery and continuing into the post - delivery period as

4711contemplated by the NICA statutes .

47173 1. Even if the evidence to support a serious ischemic event

4729were more substantial, the remaining issue to be determined is

4739whether the injury resulted in a permanent and substantial mental

4749impairment and a permanent and substantial physical impairment,

4757inasmuch as both are required to establish compensability. Fla.

4766Birth - Related Neurological Injury Comp. Ass'n v. Div. of Admin.

4777Hearings , 686 So. 2d 1349 (Fla. 1997)(the Ð Birnie " decision).

4787Petitioners and Intervenors take the position that Madeline is

4796permanently and substantially impaired. NICA takes the position

4804that Madeline is not permanently and substantially mentally or

4813physically impaired, irrespective of the timing or cause of any

4823such impairment.

48253 2 . While Petitioners have presented factual evidence

4834r egarding MadelineÓs difficult birth and that she has physical

4844impairments and developmental delays, they have not established

4852through expert opinion that Madeline has a permanent and

4861substantial mental and physical impairment as contemplated by

4869section 766 .302 . There have been no expert opinions filed

4880contrary to the credible opinions set forth above by NICAÓs

4890experts. Thus, Madeline is not entitled to benefits under the

4900Plan.

4901CONCLUSION

4902Based on the foregoing Findings of Fact and Conclusions of

4912Law, it is ORDERED that the petition filed by Sarah W. Kitchen

4924and Steven Kitchen, on behalf of and as parents of Madeline

4935Elizabeth Kitchen, is dismissed with prejudice.
