84STATEMENT OF THE ISSUE
88The issue for determination is whether Respondent violated
96section 1012.795(1)(j), Florida Statutes (2015), 1/ and Florida
104Administrativ e Code Rule s 6A - 10.081(5)(a), (h), and (i) ; and, if
117so, what penalty should be imposed.
123PRELIMINARY STATEMENT
125On October 14, 2014, Petitioner, Pam Stewart, as
133C ommissioner of E ducation ( " Petitioner " ), filed a four - count
146Administrative Complaint charging Respondent , Irwin Kellen , with
153violations of section 1012.795(1)(j), and Florida Administrative
160Code Rule s 6A - 10.081(5)(a), (h), and (i). In the Administrative
172Complaint, Petitioner charged Mr. Kellen with presenting a
180fraudulent letter of recommendation with his application for
188employment as a teacher within the Lee County School District
198(the " School District " ) .
203Mr. Kellen disputed the allegations in the Administrative
211Complaint and timely requested an administrative hearing pursuant
219to section 120.57(1) , Florida Statutes . On March 6, 2015, the
230matter was referred to the Division of Administrative Hearings
239( " DOAH " ) for assignment of an Administrative Law Judge . The case
252was noticed for final hearing to be held on May 12, 2015. After
265two continuances, t he case was heard on July 14, 2015.
276At the final hearing, Petitioner presented the testimony of
285Mr. Kellen, Alice Barfield, Brad Buckowich, and Georgianna
293McDaniel . Petitioner ' s Exhibits numbered 1 through 12 were
304admitted into evidence. Mr. Kellen testi fied on his own behalf.
315Mr. Kellen did not call any other witnesses or offer an exhibit
327that was admitted into evidence .
333The hearing Transcript was filed with DOAH on July 31, 2015.
344Petitioner timely filed its Proposed Recommended Order , which was
353duly c onsidered in the preparation of this Recommended Order.
363FINDING S OF FACT
3671. Petitioner is responsible for investigating and
374prosecuting allegations of misconduct against individuals holding
381educator certificates.
3832. Mr. Kellen is currently licensed as a teacher in Florida
394and has been issued Florida educator certificate 1007357.
402Mr. Kellen ' s certificate covers the areas of Educational
412Leadership, English , Pre - K indergarten /Primary Education, Reading,
421and Exceptional Student Education. Mr. Kellen ' s certif icate
431expires on June 30, 2020.
4363. Prior to obtaining his Florida educator certificate ,
444Mr. Kellen was employed as a teacher in the State of Indiana from
4571997 to 2005. In 2006, Mr. Kellen moved to Florida and became a
470reading teacher in Collier County f rom 2006 to 2007. From 2007
482to 2008, he was a middle school teacher at Six Mile Charter
494Academy with Charter School USA. From 2009 to 2011, Mr. Kellen
505was employed as a substitute teacher in Lee County, Florida.
515From January through March 2012, Mr. Kell en was a
525paraprofessional in Monroe County, Florida.
5304. In August 2012, Mr. Kellen was employed as a teacher at
542Knox Academy in Lee County, Florida. Three months later, in
552November 2012, Knox Academy terminated his employment. Brad
560Buckowich was the p rincipal at Knox Academy. Mr. Buckowich both
571hired and fired Mr. Kellen.
5765. In July 2013, Mr. Kellen applied for a teaching position
587at James Stevens International Academy ( " James Stevens Academy " ),
597a school within the School District. Alice Barfield, p rincipal
607at James Stevens Academy, interviewed Mr. Kellen for a reading
617teacher position. Shortly, thereafter, she offered him the
625position.
6266. As part of the hiring process, the School District
636required Mr. Kellen to submit references from previous empl oyers.
646On July 31, 2013, Mr. Kellen met with Georgianna McDaniel , the
657Executive Director of Personnel Services for the School District,
666to discuss the School District hiring procedure s . Ms. McDaniel
677explained to Mr. Kellen that School District policy req uired the
688hiring school to contact the candidate ' s previous employer before
699the School District would hire him.
7057. Following the July 31 meeting, Mr. Kellen brought to
715Ms. Barfield at James Stevens Academy a recommendation letter
724from Knox Academy dat ed July 8, 2013, and signed by Brad
736Buckowich. The recommendation letter was a photocopy. However,
744Mr. Kellen represented throughout the hiring process (and
752maintained during the final hearing) that Mr. Buckowich prepared
761and signed the original recommen dation letter on behalf of Knox
772Academy. 2 / The photocopied recommendation letter which Mr. Kellen
782provided to Ms. Barfield included a Knox Academy letterhead. The
792letter also bore the signature of Brad Buckowich at the bottom.
803Upon review of the recomme ndation letter, however, Ms. Barfield
813noticed that the signature seemed odd. The top of the letter " B "
825in the name " Brad " and " Buckowich " was cut off. The signature
836was also slightly slanted.
8408. Thereafter, Ms. Barfield contacted Mr. Buckowich to
848pers onally inquire about Mr. Kellen ' s employment with Knox
859Academy, obtain his verbal recommendation as Mr. Kellen ' s last
870employer, and discuss the recommendation letter. When
877Ms. Barfield ' s secretary reached Mr. Buckowich by phone, however,
888he declined to re commend Mr. Kellen for the position.
898Furthermore, he denied that he had ever written a recommendation
908letter for Mr. Kellen. Ms. Barfield then faxed the
917recommendation letter to Mr. Buckowich. After reviewing the
925letter, Mr. Buckowich repeated to Ms. Ba rfield that he did not
937draft or sign the letter.
9429. Ms. Barfield faxed a copy of the recommendation letter
952to Ms. McDaniel at the School District office on August 2, 2013.
96410. On August 5, 2013, Mr. Kellen visited James Stevens
974Academy. He was told th ere was a problem with his reference
986letter. Later that morning, Mr. Kellen met again with
995Ms. McDaniel at the School District office. Ms. McDaniel
1004informed Mr. Kellen that Mr. Buckowich said he did not prepare or
1016sign the recommendation letter. Mr. Kel len disclosed that he had
1027actually prepared the letter for Mr. Buckowich ' s signature.
1037However, Mr. Kellen insisted that Mr. Buckowich signed the letter
1047he submitted.
104911. In the afternoon of August 5, 2013, Mr. Kellen wrote an
1061e - mail addressed to Mr. B uckowich. In the e - mail, Mr. Kellen
1076asked Mr. Buckowich to " please fill out this form as you promised
1088in March, that you would give me a good recommendation based on
1100my working as Asst. Principal/Instructor. " Mr. Kellen added,
" 1108[t] o avoid any mis - communi cation, email the form signed to me at
1123this email and to Mrs [.] McDaniel in HR. "
113212. On August 9, 2013, Mr. Buckowich met with Ms. McDaniel
1143to discuss and review the recommendation letter. Mr. Buckowich
1152observed that the signature on the photocopied l etter was, in
1163fact, a copy of his signature. However, Mr. Buckowich reiterated
1173that he did not draft or sign the recommendation letter.
118313. Further, Mr. Buckowich produced for Ms. McDaniel
1191another document he signed in October 2012 , which he believed wa s
1203the source of the signature that was " cut and pasted " onto the
1215recommendation letter Mr. Kellen presented to Ms. Barfield.
1223Mr. Buckowich had provided this document to Knox Academy
1232employees , including Mr. Kellen. Mr. Buckowich surmised that
1240Mr. Kellen, likely by using a computer W ord or PDF program, cut
1253his signature from the October 2012 document and pasted it onto
1264the recommendation letter.
126714. Based on her meeting with Mr. Buckowich, Ms. McDaniel
1277concluded that the recommendation letter Mr. Kelle n submitted to
1287support his application for the teaching position was fraudulent.
1296Ms. McDaniel determined that the School District would not hire
1306Mr. Kellen.
130815. At the final hearing, Mr. Buckowich expanded on why the
1319recommendation letter should not be considered genuine.
1326Mr. Buckowich stated that the recommendation letter had several
1335formatting and style errors that he would not have used or made.
1347These mistakes included: he would have adjusted the date to the
1358right margin, not centered it under the Knox Academy seal; he
1369would have placed the subject line flush with the left margin,
1380not indented it; and he would not have capitalized every word of
1392the addressee line. As far as the letter ' s content,
1403Mr. Buckowich stated that he would not have use d the words or
1416phrases written in the letter. He would not have identified
1426Mr. Kellen as the " Assistant Principal/Instructional Leader. "
1433Neither would he have used the term " RTI strategies. "
144216. Finally, regarding the signature, other than not
1450actually signing the recommendation letter, Mr. Buckowich
1457commented that the signature looked as if it had been cut and
1469pasted, as if from another PDF or scanned document, onto this
1480letter. Aside from this fact, Mr. Buckowich testified that his
1490actual signature block rea ds " Brad J. Buckowich,
1498Principal/Director, Knox Academy , " not " Mr. Brad Buckowich,
1505Founder/Principal, Knox Academy , " as written on the letter. To
1514conclude, Mr. Buckowich commented that if he would have actually
1524drafted a recommendation letter for Mr. Kell en, he would have
1535sent an original letter with a Knox Academy color logo and an
1547original signature, not a photocopy.
155217. At the final hearing, Mr. Kellen adamantly asserted
1561that the recommendation letter with Mr. Buckowich ' s signature was
1572genuine. Mr. Kellen stated that he obtained the letter from his
1583former attorney. His attorney had received it from Mr. Buckowich
1593and then forwarded it to Mr. Kellen.
160018. The Florida Education Practices Commission is the
1608state agency charged with the certification an d regulation of
1618Florida educators. See Chapter 1012 , Fla. Stat . Prior to this
1629current matter, the Education Practice s Commission entered two,
1638separate f inal o rders against Mr. Kellen sanctioning his educator
1649certificate for misconduct , one dated December 4, 2006, and one
1659dated October 23, 2008.
166319. Based on the evidence and testimony presented during
1672the final hearing, Petitioner demonstrated, by clear and
1680convincing evidence, that Mr. Kellen submitted a fraudulent
1688recommendation letter to the School Di strict as part of his
1699application for employment in a teaching position.
1706CONCLUSIONS OF LAW
170920. T he Division of Administrative Hearings has
1717jurisdiction over the subject matter and the parties to this
1727action in accordance with sections 120.569 and 120.57( 1), Florida
1737Statutes.
173821. This is a disciplinary action by Petitioner in which
1748Petitioner seeks to permanently revoke Mr. Kellen ' s teaching
1758certificate. Reflecting the penal nature of revoking a person ' s
1769ability to teach in Florida, Petitioner bears the b urden of proof
1781to demonstrate the allegations in the Administrative Complaint by
1790clear and convincing evidence. Dep ' t of Banking and Fin . v.
1803Osborne Stern & Co. , 670 So. 2d 932 (Fla. 1996); Ferris v.
1815Turlington , 510 So. 2d 292 (Fla. 1987).
182222. Clear and c onvincing evidence " requires more proof than
1832a ' preponderance of the evidence ' but less than ' beyond and to
1846the exclusion of a reasonable doubt. '" In re Graziano ,
1856696 So. 2d 744, 753 (Fla. 1997). As the Florida Supreme Court
1868stated:
1869Clear and convincing evidence requires that
1875the evidence must be found to be credible;
1883the facts to which the witnesses testify
1890must be distinctly remembered; the testimony
1896must be precise and lacking in confusion as
1904to the facts in issue. The evidence must be
1913of such a weig ht that it produces in the
1923mind of the trier of fact a firm belief or
1933conviction, without hesitancy, as to the
1939truth of the allegations sought to be
1946established.
1947In re Henson , 913 So. 2d 579, 590 (Fla. 2005), quoting Slomowitz
1959v. Walker , 429 So. 2d 797, 8 00 (Fla. 4th DCA 1983). " Although
1972this standard of proof may be met where the evidence is in
1984conflict, it seems to preclude evidence that is ambiguous. "
1993Westinghouse Elec. Corp. v. Shuler Bros. , 590 So. 2d 986, 989
2004(Fla. 1991) .
200723. Section 1012.795 autho rizes the Education Practices
2015Commission to suspend, revoke, or otherwise penalize a teaching
2024certificate, provided it can be shown that the holder of the
2035certificate has committed any of the violations enumerated.
204324. The material allegations in the Admi nistrative
2051Complaint state that " [o] n or about August 2, 2013, [Mr. Kellen]
2063submitted a fraudulent letter of recommendation, with his
2071application of employment, to the principal of James Stevens
2080International Academy, in Lee County, Florida, and to the Lee
2090County School District. " In Count I, the Administrative
2098Complaint alleges Mr. Kellen violated section 1012.795(1)(j) ,
2105which is applicable when a teacher:
2111Has violated the Principles of
2116Professional Conduct for the Education
2121Profession prescribed by State Board of
2127Education rules.
212925. Counts 2, 3, and 4 of t he Administrative Complaint
2140charge Mr. Kellen with violating three provisions within r ule
21506A - 10.081(5). Rule 6A - 10.081(5) provides, in pertinent part:
2161(5) Obligation to the profession of
2167education re quires that the individual:
2173(a) Shall maintain honesty in all
2179professional dealings.
2181* * *
2184(h) Shall not submit fraudulent information
2190on any document in connection with
2196professional activities.
2198* * *
2201(i) Shall not make any fraudulent state ment
2209or fail to disclose a material fact in one ' s
2220own or another ' s application for a
2228professional position.
223026. As stated above, based on the evidence and testimony
2240presented at the final hearing, Petitioner demonstrated by clear
2249and convincing evidence t hat Mr. Kellen submitted a fraudulent
2259document with his application for a teaching position with Lee
2269County. This conclusion is readily reached based on the
2278testimony of Mr. Buckowich , who emphatically declared that he did
2288not draft or sign the recommenda tion letter. Further, as
2298Mr. Buckowich detailed while examining the recommendation letter,
2306numerous aspects of the letter ' s formatting, style, and word
2317choice, as well as the highly dubious signature block, easily
2327cause one to deduce that the letter was n ot what Mr. Kellen
2340represented it to be. Accordingly, the fact that Mr. Kellen
2350presented the letter to both James Stevens Academy , as well as
2361the School District , demonstrates that Mr. Kellen was acting in a
2372deceptive and dishonest manner. Therefore, Pet itioner has
2380proven, by clear and convincing evidence, that Mr. Kellen
2389violated section 1012.795(1)(j) and r ule s 6A - 10.081(5)(a), (h),
2400and (i).
240227. T he Education Practices Commission has adopted
2410disciplinary guidelines for the imposition of penalties
2417author ized for violations of section 1012.795 and/or rule
24266A - 10.081. See Fla . Admin . Code R . 6B - 11.007(2). The
2441undersigned has considered the range of penalties for each of the
2452violations Petitioner has proven and the factors listed in the
2462guidelines that may be considered in mitigation or aggravation of
2472a penalty. Further, section 1012.795(6 ) (b) instructs that the
2482Education Practices Commission shall adopt rules requiring the
2490issuance of a final order permanently revoking an individual ' s
2501Florida educator cert ificate, if the individual has been the
2511subject of sanctions by the Education Practices Commission on two
2521previous occasions.
252328. In light of the facts alleged and proven in this case,
2535as well as Mr. Kellen ' s prior disciplinary record with the
2547Education Pr actices Commission, revocation of Mr. Kellen ' s
2557educator certificate is appropriate.
2561RECOMMENDATION
2562Based on the foregoing Findings of Fact and Conclusions of
2572Law, it is RECOMMENDED that the Education Practices Commission
2581enter a final order finding Respond ent , Irwin Kellen, in
2591violation of section 1012.795(1)(j) and r ule s 6A - 10.081(5)(a),
2602(h), and (i). It is further RECOMMENDED that Petitioner revoke
2612Respondent ' s certificate for a period of time deemed appropriate
2623by the Education Practices Commission.
