49This cause came on for consideration upon Respondent's

57Motion for Summary Final Order, filed on April 20, 2015.

67STATEMENT OF THE CASE

71On March 6, 2015, Pe titioner, Nadege Jean - Michel, on behalf

83of and as parent and natural guardian of Cherica Fremond

93(Cherica), a minor, filed a Petition for Benefits Pursuant to

103Florida Statute Section 766.301 et seq. (Petition) with the

112Division of Administrative Hearings ( DOAH) for compensation under

121the Florida Birth - Related Neurological Injury Compensation Plan

130(Plan). On March 24, 2015, Petitioner filed an Amended Petition

140for Benefits. The Amended Petition named Sameh Fayez Wanis,

149M.D., as the physician who provided o bstetric services at the

160birth of Cherica at Bethesda Memorial Hospital East on

169February 17, 2014.

172DOAH served the Florida Birth - Related Neurological Injury

181Compensation Association (NICA) with a copy of the Petition on

191March 11, 2015. Bethesda Memorial H ospital East was served with

202a copy of the Petition on March 12, 2015. On March 16, 2015,

215DOAH received a receipt from the United States Postal Service

225that Sameh Fayez Wanis, M.D., had been served with a copy of the

238Petition. Neither Dr. Wanis nor Bethe sda Memorial Hospital East

248has petitioned to intervene in this proceeding.

255On April 20, 2015, NICA filed a Motion for Summary Final

266Order, stating that, at the time of ChericaÓs birth, Dr. Wanis

277was not a "participating physician" as that term is defined b y

289section 766.302(7), Florida Statutes (201 4 ). No response to the

300Motion for Summary Final Order was filed by Petitioner.

309FINDINGS OF FACT

3121. The Amended Petition named Dr. Wanis as the physician

322providing obstetric services at ChericaÓs birth on Februar y 17,

3322014.

3332. Attached to the Motion for Summary Final Order is an

344affidavit of NICA's custodian of records, Tim Daughtry, attesting

353to the following, which has not been refuted:

361One of my official duties as Custodian of

369Records is to maintain NICAÓs off icial

376records relative to the status of physicians

383as participating physicians in the Florida

389Birth - Related Neurological Compensation Plan

395who have timely paid the Five Thousand Dollar

403($5,000.00) assessment prescribed in Section

409766.314(4)(c), Florida Sta tutes, and the

415status of physicians who may be exempt from

423payment of the Five Thousand Dollar

429($5,000.00) assessment pursuant to Section

435766.314(4)(c), Florida Statutes. Further, I

440maintain NICA's official records with respect

446to the payment of the Two H undred Fifty

455Dollar ($250.00) assessment required by

460Section 766.314(4)(b)1., Florida Statutes, by

465all non - participating, non - exempt physicians.

473* * *

476As payments of the requisite assessments are

483received, NICA compiles data in the ÐNICA

490CARESÑ d atabase for each physician. The

497ÐNICA CARES physician payment history/reportÑ

502attached hereto for Dr. Sameh F. Wanis,

509indicates that in the year 2014, the year in

518which Dr. Sameh F. Wanis participated in the

526delivery of Cherica Fremond, as indicated in

533th e PetitionerÓs Petition for Benefits,

539Dr. Sameh F. Wanis did not pay the Five

548Thousand Dollar ($5,000) assessment required

554for participation in the Florida Birth -

561Related Neurological Injury Compensation

565Plan.

566Further, it is NICAÓs policy that if a

574physici an falls within the exemption from

581payment of the Five Thousand Dollar ($5,000)

589assessment due to their status as a resident

597physician, assistant resident physician or

602intern as provided in Section 766.314(4)(c),

608Florida Statutes, annual documentation as t o

615such exempt status is required to be provided

623to NICA. NICA has no records with respect to

632Dr. Sameh F. Wanis in relation to an exempt

641status for the year 2014. To the contrary,

649the attached "NICA CARES physician payment

655history/report shows that in 20 14, Dr. Sameh

663F. Wanis paid the Two Hundred and Fifty

671Dollar ($250) assessment required by Section

677766.314(4)(b)1., Florida Statutes, for non -

683participating, non - exempt licensed physician.

6893. The physician payment history/report for Dr. Wanis

697supports Mr. DaughtryÓs affidavit.

7014. Petitioner has not offered any exhibits, affidavits or

710any other evidence refuting the affidavit of Mr. Daughtry, which

720shows that Dr. Wanis had not paid his $5,000 assessment for 2014.

7335. At the time of the birth of Cherica, D r. Wanis was not a

748participating physician in the Plan.

753CONCLUSIONS OF LAW

7566. The Division of Administrative Hearings has jurisdiction

764over the parties to, and the subject matter of, these

774proceedings. §§ 766.301 - 766.316, Fla. Stat.

7817. The Plan was est ablished by the Legislature "for the

792purpose of providing compensation, irrespective of fault, for

800birth - related neurological injury claims" relating to births

809occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

8208. The injured infant, her or his personal representative,

829parents, dependents, and next of kin may seek compensation under

839the Plan by filing a claim for compensation with the Division of

851Administrative Hearings. §§ 766.302(3), 766.303(2), and

857766.305(1), Fla. Stat. The Florida Bir th - Related Neurological

867Injury Compensation Association, which administers the Plan, has

"87545 days from the date of service of a complete claim . . . in

890which to file a response to the petition and to submit relevant

902written information relating to the issu e of whether the injury

913is a birth - related neurological injury." § 766.305(4), Fla.

923Stat.

9249. If NICA determines that the injury alleged in a claim is

936a compensable birth - related neurological injury, it may award

946compensation to the claimant, provided tha t the award is approved

957by the administrative law judge to whom the claim has been

968assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

979disputes the claim, as it has in the instant case, the dispute

991must be resolved by the assigned administrati ve law judge in

1002accordance with the provisions of chapter 120, Florida Statutes.

1011§§ 766.304, 766.309, and 766.31, Fla. Stat.

101810. In discharging this responsibility, the administrative

1025law judge must make the following determination based upon the

1035availa ble evidence:

1038(a) Whether the injury claimed is a birth -

1047related neurological injury. If the claimant

1053has demonstrated, to the satisfaction of the

1060administrative law judge, that the infant has

1067sustained a brain or spinal cord injury

1074caused by oxygen depr ivation or mechanical

1081injury and that the infant was thereby

1088rendered permanently and substantially

1092mentally and physically impaired, a

1097rebuttable presumption shall arise that the

1103injury is a birth - related neurological injury

1111as defined in s. 766.303(2).

1116(b) Whether obstetrical services were

1121delivered by a participating physician in the

1128course of labor, delivery, or resuscitation

1134in the immediate postdelivery period in a

1141hospital; or by a certified nurse midwife in

1149a teaching hospital supervised by a

1155par ticipating physician in the course of

1162labor, delivery, or resuscitation in the

1168immediate postdelivery period in a hospital.

1174§ 766.309(1), Fla. Stat. An award may be sustained only if the

1186administrative law judge concludes that the "infant has sustained

1195a birth - related neurological injury and that obstetrical services

1205were delivered by a participating physician at birth."

1213§ 766.31(1), Fla. Stat.

121711. Pertinent to this case, "participating physician" is

1225defined by section 766.302(7), to mean:

1231[A] physici an licensed in Florida to practice

1239medicine who practices obstetrics or performs

1245obstetrical services either full - time or

1252part - time and who had paid or was exempt ed

1263from payment at the time of the injury the

1272assessment required for participation in the

1278bir th - related neurological injury

1284compensation plan for the year in which the

1292injury occurred.

129412. Dr. Wanis had not paid his assessment of $5,000 at the

1307time Cherica was born; therefore, he was not a participating

1317physician at the time of ChericaÓs birth. No evidence was

1327submitted that, at the time of ChericaÓs birth, Dr. Wanis was

1338excluded from paying the $5,000 assessment required for

1347participating physicians. To the contrary, the physician payment

1355history/report shows that in 2014, Dr. Wanis paid the $ 250

1366assessment required by section 766.314(4)(6)1., for non -

1374participating, non - exempt licensed physicians.

138013. The obstetrical services provided during Cherica's

1387birth were not provided by a participating physician. Thus, the

1397claim of Cherica is not comp ensable under the Plan.

1407CONCLUSION

1408Based on the Findings of Fact and Conclusions of Law, it is

1420ORDERED that Respondent's Motion for Summary Final Order is

1429granted, and the Petition is dismissed with prejudice.
