109STATEMENT OF THE ISSUE
113Whether Respondent, Hialeah Housing Authority (the Housing
120Authority), discriminated against Petitioner, Diana Varona, in
127violation of the Florida Fair Housing Act (the Act), and, if so,
139the relief to which Petitioner is entitled.
146PRELIMINARY STATEMENT
148The Florida Commission on Human Relations (FCHR) and the
157Federal Department of Housing and Urban Development (HUD)
165administe r the Act , sections 760.20 through 760.37, Florida
174Statutes (201 5 ). By letter dated August 26, 2013, Petitioner
185was notified that the Housing Authority was terminating her
194participation in the Section 8 Housing Choice Voucher Program
203(section 8 program), for two reasons: (1) D ocumentation
212evidencing Petitioner Ós arrest on April 30, 2013 , for alleged
222violent criminal activity ; and (2) A determination that two
231unauthorized individuals ha d been living in PetitionerÓs rental
240unit. Petitioner requested an a dministrative hearing regarding
248the termination of her housing assistance.
254Petitioner requested a continuance of the Housing
261AuthorityÓs administrative hearing. The Housing Authority
267granted her request, and the administrative hearing was re -
277scheduled to early December 2013.
282By letter dated December 9, 2013, the Housing Aut hority
292notified Petitioner that following the administrative hearing,
299at which Petitioner was represented by counsel, and careful
308consideration of the testimony and documentation, Pet i tioner's
317termination from the s ection 8 program was upheld.
326On November 10, 2014, Petitioner executed a housing
334discrimination complaint with the Florida Commission on Human
342Relations (Commission). 1/ The Commission investigated, and on
350February 12, 2015, entered a Notice of Determination of No Cause
361(Notice). The Notice was sent to Petitioner via certified mail.
371On March 23, Petitioner filed a Petition for Relief with the
382Commission, and the Commission referred the case to the Division
392that same day.
395At the final hearing, Petitioner testified on her own
404behalf. PetitionerÓs 21 exhibits 2/ were admitted into evidence
413over objection. Respondent presented the testimony of
420Magalys Forte, Paulette Smith, Rene Gutierrez, Joel Bonilla , and
429Yinet Companioni. RespondentÓs Exhibits A through O were
437admitted into evidence. 3/
441At the end of the hearing, RespondentÓs counsel confirmed
450that a transcript of the final hearing would be ordered.
460Petitioner asked for 15 days following the filing of the
470transcript in whi ch to file proposed recommended order s (PRO s ) .
484T he request was granted.
489The Transcript was filed on September 21, 2015, and the
499undersigned immediately issued a Notice of Filing Transcript
507(N otice). That N otice confirmed that the Ðproposed orders in
518this matter must be filed with the Division of Administrative
528Hearings by close of business on or before October 6, 2015.Ñ
539The parties timely submitted their PROs, which have been
548duly considered in the preparation of this Recommended Order.
557Unless otherwise stated, all stat utory references are to

573FINDING S OF FACT
5771. Petitioner is a black Hispanic female. She is a former
588resident of an apartment complex administered by the Housing
597Authority.
5982. The Housing Auth ority is a public housing authority
608that administers the section 8 program within Miami - Dade County,
619Florida, pursuant to 42 U.S.C. section 1437f.
6263. Under the section 8 program, the Housing Authority uses
636funds, supplied by HUD, to pay a percentage of th e monthly rent
649on a leased "unit" directly to the landlord. The section 8
660program tenant pays the balance of the monthly rent to the
671landlord. As part of the Housing AuthorityÓs program, each year
681section 8 participants must complete a personal declarati on
690form. This form requires specific information about various
698aspects of the declarant and those family members authorized to
708participate in the program. The information includes the
716declarantÓs financial circumstances and other facts .
7234. In or around January 2012, Petitioner moved into an
733apartment complex administere d by the Housing Authority from
742out Î of - state. Petitioner and her two minor children were the
755only authorized occupants for the apartment.
7615. Petitioner was diagnosed with ADH D (attent ion deficit
771hyperactivity disorder), bipolar disorder , and cancer in 2012 or
7802013. She was scheduled for cancer surgery in July 2013, but
791had to cancel the surgery due to an unexpected addition to her
803family.
8046. On July 22, 2013, Petitioner requested t o break her
815lease when she reported to the Housing Authority what she
825considered to be Ðlife - threateningÑ conditions in her apartment,
835as well as the harassment of her children when they played
846outside. Petitioner had to go up the Housing AuthorityÓs chai n -
858of - command to get assistance; however , her apartment was
868inspected. As a result of the inspection, PetitionerÓs landlord
877advised the Housing Authority that there were additional people
886living in PetitionerÓs apartment.
8907. Base d on the landlordÓs observ ation of unauthorized
900persons living in the apartment, the Housing Authority
908instituted a fraud investigation.
9128. Detective Gutierrez is a Hialeah police officer
920assigned to the Housing Authority as an investigator. Detective
929Gutierrez conducts investi gations into alleged violations of
937section 414.39 , Florida Stat ute s (fraud).
9449. On August 13, 2013, Detective Gutierrez knocked on
953PetitionerÓs front door. Petitioner opened the door and enga ged
963in a conversation with the d etective. While standing at
973P etitionerÓs front door, Detective Gutierrez observed two adult
982males in PetitionerÓs apartment. Jose Varona, PetitionerÓs
989uncle, was released to Petitioner on July 24, 2013, 4/ and was
1001living in PetitionerÓs apartment. Lazaro Gomez, PetitionerÓs
1008boyfriend , was also living in PetitionerÓs apartment. 5/
101610. Once his conversation was completed, Detective
1023Gutierrez returned to his office and reviewed PetitionerÓs
1031section 8 personal declaration form. On the form, Detective
1040Gutierrez noted that Petitioner sta ted that she had never been
1051arrested. Detective Gutierrez researched police records and
1058determined that Petitioner had, in fact, been arrested in April
10682013 for making a threat against an individual. Additionally,
1077Detective Gutierrez noted that Petitione rÓs stated income on the
1087declaration form did not support the purchase of an automobile
1097via a loan agreement.
110111. On August 13, 2013, Petitioner submitted to the
1110Housing Authority an incom plete application for a live - in aide
1122to assist her. The Housing A uthorityÓs application is seven
1132pages long and Petitioner failed to submit two pages that
1142provided information from her treating physician.
114812. The Housing AuthorityÓs process to deter mine whether
1157to grant a live - in aide request involves a three step pr ocess:
1171the verification that the requesting individual is disabled
1179(meets the definition of a disabled person via a physicianÓs
1189confirmation); that the individual needs the assistance of
1197another person (which is also determined by a physicianÓs
1206documentat ion); and that the live - in - aide qualifies as a live - in
1222aide. On August 22, the Housing Authority denied PetitionerÓs
1231app lication for a live - in aide, but notified her that she could
1245supplement her request with additional documentation, including
1252the doctor Ós verification. Petitioner did not supplement her
1261application.
126213. Petitioner also claimed she filed a request to allow a
1273family member, Mr. Varona, to move in with her family.
1283Petitioner discussed with the Housing Authority personnel about
1291adding he r uncle to her contract. However, the Housing
1301Authority never received a written request for Mr. Varona to be
1312added to PetitionerÓs voucher. It is the Housing AuthorityÓs
1321policy that it does not add adult family members to a voucher
1333contract except via m arriage or legal guardianship. Although
1342Petitioner holds the power of attorney for Mr. Varona, she is
1353not his legal guardian.
135714. Detective Gutier rez completed his investigation and
1365filed his re port with the Housing Authority. On August 26, the
1377Housing Authority notified Petitioner that her participation in
1385the section 8 Housing Choice Voucher Program was terminated,
1394effective September 30. The basis given for PetitionerÓs
1402housing termination were listed as: engaging in criminal
1410activity and failing to disclose it to the Housing Authority in
1421her personal declaration in July 2013 (verification that
1429Petitioner had been arrested on April 30, 2013) ; and allowing an
1440unauthorized person to reside in the apartment.
144715. Petitioner timely requested an administr ative hearing
1455regarding the termination of her housing voucher. The hearing
1464was originally scheduled for October 30, 2013; however, o n
1474October 28, Petitioner requested a continuance of the hearing
1483based on her physical condition. The request was granted and
1493the hearing was continued to December 3.
150016. In early November 2013, Petitioner asked the Housing
1509Authority for a reasonable accommodation for an apartment with
1518accessible features. The Housing Authority did not approve or
1527deny this request , as it d oes not own the apartments, but
1539offered to send her a list of accessible units known to the
1551Housing Authority. Petitioner never contacted the Housing
1558Authority for additional information.
156217. Petitioner was represented by an attorney at the
1571Housing A utho rityÓs December 3 hearing. As a result of this
1583hearing, PetitionerÓs termination of participation in the
1590section 8 program was upheld.
159518. That said, Petitioner failed to present any credible
1604evidence that other residents in the community were treated
1613di fferently.
1615CONCLUSIONS OF LAW
161819. The Division has juris diction over the parties to and
1629the subject matter of this proceeding pursuant to sections
1638120.569 and 120.57(1), Florida Statutes.
164320. Petitioner has the burden of proving by a
1652preponderance of the evidence that the Housing Authority
1660violated the Act by discriminating against her. The Act is
1670codified in sections 760.20 through 760.37. Section 760.23
1678reads in pertinent part:
1682Discrimination in the sale or rental of
1689housing and other prohibited pr actices. Ï
1696* * *
1699(2) It is unlawful to discriminate against
1706any person in the terms, conditions, or
1713privileges of sale or rental of a dwelling,
1721or in the provision of services or
1728facilities in connection therewith, because
1733of race, color, national origin, sex,
1739handicap, familial status, or religion.
174421. The preponderance of the evidence standard requires
1752proof by "the greater weight of the evidence," Black's Law
1762Dictionary , 1201 (7th ed. 1999), or evidence that "more likely
1772than not" tends to prove a cer tain proposition. See Gross v.
1784Lyons , 763 So. 2d 276, 289 n.1 (Fla. 2000).
179322. Failure to establish a prima facie case of
1802discrimination ends the inquiry. See Ratliff v. State , 666
1811So. 2d 1008, 1013, n.7 (Fla. 1st DCA 1996), aff'd , 679 So. 2d
18241183 (Fla . 1996). If, however, the complainant establishes a
1834prima facie case, the burden then shifts to the respondent to
1845articulate some legitimate, nondiscriminatory reason for its
1852action. If the respondent satisfies this burden, then the
1861complainant must esta blish by a preponderance of the evidence
1871that the reason asserted by the respondent is, in fact, merely a
1883pretext for discrimination. See Massaro v. Mainlands Section 1
1892& 2 Civic Ass'n, Inc. , 3 F.3d 1472, 1476, n.6 (11th Cir. 1993),
1905cert. denied , 513 U.S. 808 (1994) (fair housing discrimination
1914cases are subject to the three - part test articulated in
1925McDonnell Douglas Corp. v. Green , 411 U.S. 792 (1973)).
193423. There is no credible evidence in the record to support
1945the allegation of discrimination based on P etitionerÓs race or
1955disability. There is no evidence that Petitioner was
1963discriminated against by the Housing Authority. Petitioner
1970failed to meet her burden of demonstrating that the Housing
1980Authority discriminated against her.
1984RECOMMENDATION
1985Based on the foregoing Findings of Fact and Conclusions of
1995Law, it is RECOMMENDED that a final order be entered by the
2007Florida Commission on Human Relations dismissing the Petition
2015for Relief filed by Petitioner in its entirety.
