93STATEMENT OF THE ISSUE
97Whether the Petitioner , Macia Poole , was subject to an
106unlawful employment practice by Respondent, Westminster Village
113of Pensacola , on account of h er sex or due to retaliation for
126her opposition to an unlawful employment practice in violation
135of s ection 760.10, Florida Statutes.
141PRELIMINARY STATEMENT
143On August 26, 20 14 , Petitioner filed a complaint of
153discrimination w ith the Florida Commission on Human Relations
162(FCHR) which alleged that Respondent violated s ection 760.10, by
172discriminating against h er on the basis of h er sex or as
185retaliation .
187On February 24, 2015 , the FCHR issued a Determinatio n:
197No Cause and a Notice of Determination: No Cause, by which the
209FCHR determined that reasonable cause did not exist to believe
219that an unlawful employment practice occurred. On March 30,
2282015 , Petitioner filed a Petitio n for Relief with the FCHR . The
241Petition was transmitted to the Division of Admini strative
250Hearings to conduct a final h earing.
257T he final hearing was s cheduled for J une 1, 2015, by video
271teleconference in Tallahassee, Florida , and Pensacola , Florida .
279P etitioner failed to appear at the final hearing . After
290waiting for an appropriate period of time, and h a ving received
302no indication that Petitioner intended to make an appearance,
311the final hearing was adjourned .

330FINDINGS OF FACT
3331. On April 3, 2015, PetitionerÓs Employment Complaint of
342Discrimination and Petition for Relief were transmitted to the
351Division of Administrative Hearings by the Florida Commission on
360Human Relat ions for a formal administrative hearing to be held
371in accorda nce with s ection 120.57, Florida Statutes.
3802. On April 10, 2015, a Notice of Hearing by Video
391Teleconference was entered which set the final hearing for
400June 1, 2015, at 9:00 a.m., Central Time , (10:00 a.m., Eastern
411Time), at video teleconference sites in Pensacola , at the Office
421of the Judges of Compensation Claims, Video Teleconferencing
429Room, 700 South Palafox Street, Suite 305 , Pensacola, Florida,
438and in Tallahassee, at the Division of Admin istrative Hearings,
448the DeSoto Building, 1230 Apalachee Parkway , Tallahassee,
455Florida .
4573. On May 4, 2015, one Subpoena Duces Tecum and four
468Subpoenas Ad Testificandum were issued at the request of
477Petitioner.
4784. On May 14, 2015, Petitioner electronically filed her
487Notice of Appearance in this proceeding.
4935 . On May 26, 2015, Petitioner filed a Request to
504Reschedule Video Hearing. The Request made no allegation of an
514inability to attend the hearing, only that her attendance would
524be an Ðinconvenience.Ñ The Request was denied. The filing of
534the Request is convincing evidence that Petitioner knew that the
544final hearing was scheduled to be heard in accordance with the
555Notice of Hearing by Video Teleconference .
5626 . On June 1, 2015, at the scheduled date, t ime, and
575place, the final hearing was convened. Mr. Moran, representing
584Respondent, Westminster Village of Pensacola, made his
591appearance. Petitioner did not appear. The final hearing was
600recessed for twenty minutes to allow Petitioner to appear.
6097 . During the recess, the undersigned confirmed that the
619Division had not received any communication from Petitioner of
628exigent circumstances that may have interfered with her
636appearance at the final hearing.
6418 . After twenty minutes had passed, the final hea ring was
653re - convened. Petitioner was not in attendance. Respondent was
663prepared to proceed, and had its witnesses in attendance at the
674Pensacola video location . Mr. Moran confirmed that he had
684received no emails from Petitioner , that being their normal form
694of communication.
6969 . At 9: 25 a.m., Central Time, (10: 25 a.m., Eastern Time) ,
709the final hearing was adjourned.
71410 . There was no evidence presented at the final hearing
725in support of PetitionerÓs Employment Complaint of
732Discrimination and Petition for Relief.
737CONCLUSIONS OF LAW
74011 . Sections 120.569 and 120.57(1), Flo rida Statutes,
749grant the Division of Administrative Hearings jurisdiction over
757the subject matter of thi s proceeding and the parties.
76712 . The Florida Civil Rights Act of 1992 (ÐFCRAÑ), c hapter
779760, Florida Statutes, prohibits discrimination in the
786workplace.
78713 . With regard to PetitionerÓs claim of discrimination on
797the basis of sex , s ection 760.10 (1) provides, in pertinent part:
809(1) It is an unlawful employment practice
816for an employe r:
820(a) To discharge or to fail or refuse to
829hire any individual, or otherwise to
835discriminate against any individual with
840respect to compensation, terms, conditions,
845or privileges of employment, because of such
852individual's race, color, religion, sex,
857n ational origin, age, handicap, or marital
864status.
86514 . With regard to PetitionerÓs claim of retaliation,
874section 760.10(7) provides, in pertinent part:
880(7 ) It is an unlawful employment practice
888for an employer . . . to discriminate
896against any person because that person has
903opposed any practice which is an unlawful
910employment practice under this section, or
916because that person has made a charge,
923testified, assisted, or participated in any
929manner in an investigation, proceeding, or
935hearing under this section.
93915 . Petitioner ha s the burden of proving by a
950preponderance of the evidence that Respondent committed an
958unlawful employment practice. See St. Louis v. Fla. Int'l
967Univ. , 60 So. 3d 455 (Fla. 3 rd DCA 2011); Fla. Dep't of Transp.
981v. J.W.C. Co. , 396 So. 2d 778 (Fla. 1st DCA 1981).
99216 . Petitioner presented no direct, statistical, or
1000circumstantial evidence of discrimination by Respondent in its
1008pers onnel decisions affecting Petitioner.
101317 . Petitioner presented no direct, statistical, or
1021circumstantial evidence of retaliation by Respondent against
1028Petitioner as a result of PetitionerÓs opposition to acts of
1038discrimination directed against others as a result of their
1047race, color, religion, sex, national origin, age, handicap, or
1056marital status , or as a result of PetitionerÓs participation in
1066an investigation, proceeding, or hearing under section 760.10 .
107518 . Because Petitioner failed to put forth suff icient
1085evidence that Respondent had some discriminatory or retaliatory
1093reason for its personnel decision , her petition must be
1102dismissed.
1103RECOMMENDATION
1104Based on the foregoing Findings of Fact and Conclusions of
1114Law, it is RECOMMENDED that the Florida C ommission on Human
1125Relations issue a final order finding that Respondent,
1133Westminster Village of Pensacola , did not commit an unlawful
1142employment practice as to Petitioner, Macia Poole , and
1150dismissing the Petition for Relief filed in FCHR No. 2014 - 0 1235 .
