98STATEMENT OF THE CASE
102On April 6, 2015, Petitioner, Brittany Isom, on behalf of
112and as parent and natural guardian of Maliyah Jones (Maliyah), a
123minor, filed an Amended Petition for Benefits Pursuant to Florida
133Statute Section 766.301 et seq. (Petition) with the Division of
143Administrative Hearings (DOAH) for a dete rmination of
151compensability under the Florida Birth - Related Neurological
159Injury Compensation Plan (Plan). The Petition named Ronnie Jo
168Stringer, ARNP, CNM, and Gainesville OB/GYN, as the medical
177providers who provided obstetrical services at the birth of
186Maliyah on May 28, 2013, at North Florida Regional Medical Center
197located in Gainesville, Florida.
201DOAH served NICA with a copy of the Petition on April 8,
2132015. DOAH served Ronnie Jo Stringer, ARNP, CNM, and Gainesville
223OB/GYN with a copy of the Petition on April 9, 2015. On
235April 1 3 , 2015, DOAH received a return receipt from the United
247States Postal Service showing that North Florida Regional Medical
256Center had been served with a copy of the Petition.
266On June 2, 2015, Ronnie Jo Stringer, ARNP, CNM, and North
277Florida Woman Care, LLC, d/b/a Gainesville OB/GYN, filed a
286Petition for Leave to Intervene, which was granted by Order dated
297June 9, 2015. On July 2, 2015, North Florida Regional Medical
308Center filed a Petition to Intervene which was granted by Ord er
320dated July 10, 2015.
324On December 10, 2015, NICA filed a Motion for Summary Final
335Order, asserting that Maliyah did not sustain a "birth - related
346neurological injury" as that term is defined in section
355766.302(2), Florida Statutes. As of the date of t his Summary
366Final Order of Dismissal, no response has been filed to the
377Motion for Summary Final Order.
382FINDINGS OF FACT
3851. Maliyah Jones was born on May 28, 2013, at North Florida
397Regional Medical Center located in Gainesville, Florida. Maliyah
405weig hed 3,870 grams at birth.
4122. Donald Willis, M.D. (Dr. Willis), was requested by NICA
422to review the medical records for Maliyah. In a medical report
433dated September 15, 2015, Dr. Willis opined as follows:
442In summary, delivery was complicated by a
449shoulder dystocia, which resulted in an ErbÓs
456palsy. Although depressed at birth, the baby
463had a good response to resuscitation (bag and
471mask ventilation) with an Apgar score of 9 at
480five minutes. The babyÓs condition was
486stated to be stable on admission to the NICU.
495The newborn hospital course was complicated
501only by the ErbÓs palsy. Discharge was on
509DOL 2.
511There was no apparent obstetrical event that
518resulted in loss of oxygen or mechanical
525trauma to the babyÓs brain during labor,
532delivery or the immediate po st delivery
539period.
5403. NICA retained Laufey Y. Sigurdardottir, M.D.
547(Dr. Sigurdardottir), a pediatric neurologist, to examine Maliyah
555and to review her medical records. Dr. Sigurdardottir examined
564Maliyah on October 28, 2015. In a medical report regar ding her
576independent medical examination of Maliyah, Dr. Sigurdardottir
583opined as follows:
586Summary: Maliyah is a 2 - 1/2 year - old born at
598term after an uncomplicated pregnancy with
604shoulder dystocia resulting in a near
610complete ErbÓs palsy. She has require d 2
618surgical procedures and does have significant
624disability as per the Mallet scale and is
632likely to need more surgical procedures to
639enhance her functional abilities in her right
646upper extremity. She is, however,
651functioning well from a cognitive level and
658her gross motor skills are otherwise intact.
665In review of the medical records available,
672it seems clear that her right brachial
679plexopathy did occur at birth due to
686mechanical injury. In light of her favorable
693cognitive and language development our
698f indings are the following:
703Result as to question 1: The patient is
711found to have a permanent physical
717impairment, but to have none or mild delays
725in language development. She is therefore
731not found to have a substantial mental and
739physical impairment at this time.
744* * *
747In light of the above - mentioned details,
755MaliyahÓs restricted motor disability and
760near normal cognitive development, I do not
767recommend Maliyah to be included into the
774Neurologic Injury Compensation Association
778Program and would be h appy to answer
786additional questions or review further
791medical records. In light of her favorable
798mental and developmental state it is doubtful
805that additional records would alter the
811outcome of our review. She is not felt to
820have a substantial mental imp airment at this
828time.
8294. A review of the file in this case reveals that there
841have been no expert opinions filed that are contrary to the
852opinion of Dr. Willis that there was no apparent obstetrical
862event that resulted in loss of oxygen or mechanical tra uma to the
875baby's brain or spinal cord during labor, delivery or the
885immediate post - delivery period. Dr. WillisÓ opinion is credited.
895There are no contrary expert opinions filed that are contrary to
906Dr. SigurdardottirÓs opinion that Maliyah is not found to have a
917substantial mental impairment at this time. Dr. SigurdardottirÓs
925opinion is credited.
928CONCLUSIONS OF LAW
9315. The Division of Administrative Hearings has jurisdiction
939over the parties to and the subject matter of these proceedings.
950§§ 766.301 - 7 66.316, Fla. Stat.
9576. The Plan was established by the Legislature "for the
967purpose of providing compensation, irrespective of fault, for
975birth - related neurological injury claims" relating to births
984occurring on or after January 1, 1989. § 766.303(1), Fl a. Stat.
9967. The injured infant, her or his personal representative,
1005parents, dependents, and next of kin may seek compensation under
1015the Plan by filing a claim for compensation with DOAH.
1025§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA ,
1033which administers the Plan, has "45 days from the date of service
1045of a complete claim . . . in which to file a response to the
1060petition and to submit relevant written information relating to
1069the issue of whether the injury is a birth - related neurological
1081injury." § 766.305(4), Fla. Stat.
10868. If NICA determines that the injury alleged in a claim is
1098a compensable birth - related neurological injury, it may award
1108compensation to the claimant, provided that the award is approved
1118by the administrative law judg e to whom the claim has been
1130assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1141disputes the claim, as it has in the instant case, the dispute
1153must be resolved by the assigned administrative law judge in
1163accordance with the provisions of chap ter 120, Florida Statutes.
1173§§ 766.304, 766.309, and 766.31, Fla. Stat.
11809. In discharging this responsibility, the administrative
1187law judge must make the following determination based upon the
1197available evidence:
1199(a) Whether the injury claimed is a birt h -
1209related neurological injury. If the claimant
1215has demonstrated, to the satisfaction of the
1222administrative law judge, that the infant has
1229sustained a brain or spinal cord injury
1236caused by oxygen deprivation or mechanical
1242injury and that the infant was the reby
1250rendered permanently and substantially
1254mentally and physically impaired, a
1259rebuttable presumption shall arise that the
1265injury is a birth - related neurological injury
1273as defined in s. 766.303(2).
1278(b) Whether obstetrical services were
1283delivered by a p articipating physician in the
1291course of labor, delivery, or resuscitation
1297in the immediate postdelivery period in a
1304hospital; or by a certified nurse midwife in
1312a teaching hospital supervised by a
1318participating physician in the course of
1324labor, delivery, o r resuscitation in the
1331immediate postdelivery period in a hospital.
1337§ 766.309(1), Fla. Stat. An award may be sustained only if the
1349administrative law judge concludes that the "infant has sustained
1358a birth - related neurological injury and that obstetrical services
1368were delivered by a participating physician at birth."
1376§ 766.31(1), Fla. Stat.
138010. The term "birth - related neurological injury" is defined
1390in section 766.302(2) as follows:
"1395Birth - related neurological injury" means
1401injury to the brain or spin al cord of a live
1412infant weighing at least 2,500 grams for a
1421single gestation or, in the case of a
1429multiple gestation, a live infant weighing at
1436least 2,000 grams at birth caused by oxygen
1445deprivation or mechanical injury occurring in
1451the course of labor, delivery, or
1457resuscitation in the immediate postdelivery
1462period in a hospital, which renders the
1469infant permanently and substantially mentally
1474and physically impaired.
147711. The evidence, which is not refuted, established that
1486Maliyah did not sustain an i njury to the brain or spinal cord
1499caused by oxygen deprivation or mechanical injury in the course
1509of labor, delivery, or resuscitation in the immediate post -
1519delivery period in a hospital which rendered her permanently and
1529substantially mentally and physica lly impaired. Therefore,
1536Maliyah is not eligible for benefits under the Plan.
1545CONCLUSION
1546Based upon the foregoing Findings of Fact and Conclusions of
1556Law, it is ORDERED that the Amended Petition filed by
1566Brittany Isom, on behalf of Maliyah Jones, i s dismissed with
1577prejudice.
