106A. Did Respondent, Tonya Shrader , R.N. (Ms. Shrader),

177PRELIMINARY STATEMENT

179Petitioner, Department of Health (Department) , Board of

186Nursing, filed its Administrative Complaint against Ms. Shrader

194on February 25, 2015 . The Complaint alleged that Ms. Shrader

205violated section 464.018(1)(j) by being unable to practice

213nursing with reasonable skill and safety to patients by reason of

224illness or use of alcohol, drugs, narc otics or chemicals or any

236other type of material , or as a result of any mental or physical

249condition. Ms. Shrader requested a formal administrative

256hearing. The Department referred the matter to the Division of

266Administrative Hearings for conduct of the hearing.

273During this proceeding , Ms. Shrader did not respond to

282discovery demands from the Department. She also did not respond

292to or comply with O rders entered.

299The undersigned conducted the hearing , as noticed , on

307June 30, 2015. Ms. Shrader did not attend the hearing. The

318Department ' s Exhibits 1 through 3, 4a, and 5 were admitted in

331evidence. These exhibits include the deposition testimony of

339Patricia Falke and Dr. Mark Sylvester submitted in lieu of live

350testimony.

351A T ranscript of the hearing wa s filed on July 6, 2015. The

365Department timely filed a proposed recommended order.

372Ms. Shrader did not file a proposed recommended order.

381FINDING S OF FACT

3851. Section 20.43 and chapters 456 and 464, Florida

394Statutes, charge the Department of Health, Boar d of Nursing , with

405the licensing and regulation of nurses.

4112. At all times material to the allegations in the

421Administrative Complaint, Ms. Shrader wa s a licensed registered

430nurse in the State of Florida. She h olds license RN 9180605.

4423. Ms. Shrader has a complicated history of psychiatric and

452medical problems that affect her ability to practice nursing with

462the level of skill and safety to patients required in the State

474of Florida.

4764. Ms. Shrader has suffered from depression since

484childhood. Ms. Shrad er treated her depression with a variety of

495medications, including: L ithium, Depakote, Pamelor, Elavil,

502Topamax, Lamictal, and Prozac . In the past five years,

512Ms. Shrader has not received treatment for her depression.

5215. Ms. Shrader also suffers from an xiety . Ms. Shrader is

533not receiving treatment for her anxiety.

5396. In addition to depression and anxiety, Ms. Shrader

548suffers from chronic severe migraines. The cause has not been

558determined despite extensive neurological evaluations .

564Ms. Shrader has be en prescribed Tramadol, Fiorcet, and Clonazepam

574to treat her migraines . At all times material to the

585Department ' s c omplaint, Ms. Shrader was prescribed Fiorcet for

596her migraine symptoms.

5997. Between March 24, 2012, and July 22, 2013, Ms. Shrader

610complaine d of multiple neurological symptoms , including double

618vision, balance and gait instability, and tingling and numbness

627in her hands . Ms. Shrader elected to undergo extensive

637neurological testing to rule out demyelinating disease, multiple

645sclerosis, and pa lsy . The tests provided no indication that

656Ms. Shrader ' s symptoms resulted from a neurological disorder.

6668. At all times material to this proceeding, Ms. Shrader

676worked as a registered nurse in the Neurological and Psychiatric

686Unit at Gulf Coast Medical Center (Gulf Coast).

6949. On December 20, 2013, Ms. Shrader took an excess ive dose

706of four Fiorcet pills . She told her family that she " plans to

719keep overdosing until she dies, " and that she " predicts that

729[she] will be dead by the end of the year. "

73910. Ms. Shrader ' s family contacted the Emergency Medical

749Services . Ms. Shrader was transported to Lehigh Regional Medical

759Center, where she was treated for an overdose.

76711. Ms. Shrader was involuntarily admitted to SalusCare,

775Inc. (SalusCare) , for inpatient psychiatric observation and

782treatment.

78312. On December 20, 201 3 , the Crisis Stabilization Unit

793(CSU) at SalusCare conducted an in - patient psychiatric evaluation

803of Ms. Shrader.

80613. During the evaluation, Ms. Shrader denied past

814psychiatric treatment s or p sychiatric medication . Ms. Shrader

824also denied that her Fiorcet overdose was an attempted suicide .

835Her statements during her SalusCare evaluation contradict her

843medical charting and statements she has made , which indicate that

853she has an extensive histor y of psychiatric illnesses . SalusCare

864discharged Ms. Shrader on December 23, 201 3 .

87314. The director of nursing at Gulf Coast contacted the

883Intervention Project for Nurses (IPN) about Ms. Shrader . IPN is

894an impaired practitioner consultant to the D epartme nt ' s Board of

907Nursing . IPN works with nurses and monitors them for safety to

919practice issues.

92115. IPN contacted Ms. Shrader on January 2, 2014 , to

931discuss her entering the program. Ms. Shrader denied that she

941was impaired or abused any substances . She a dmitted that she was

954depressed . But she said t hat she stopped her depression

965treatment approximately five years earlier.

97016. I PN asked Ms. Shrader to undergo an evaluation to

981determine her fitness to practice nursing . Ms. Shrader scheduled

991an evaluation with Theodore Treese, M.D., an expert in the

1001psychiatric treatment, monitoring, and care of health care

1009practitioners. He conducted the evaluation on January 28, 2014.

101817. Dreese diagnosed Ms. Shrader with severe major

1026depressive disorder; alcohol ab use; opioid abuse; sedative,

1034anxiolytic abuse; relational problems, not otherwise specified;

1041and rule - out polysubstance abuse .

104818. During the evaluation, Ms. Shrader attempted to hide

1057her in - patient psychiatric treatment at SalusCare.

106519. Based on Ms. Shra der ' s diagnoses, Dreese determined

1076that Ms. Shrader was not capable of practicing as a registered

1087nurse with reasonable skill and safety to patients.

109520. Dreese recommended that Ms. Shrader seek treatment

1103at a substance abuse treatment center at a level of at least

1115partial hospitalization.

111721. Ms. Shrader did not agree with Dreese ' s

1127recommendation . IPN gave Ms. Shrader the opportunity to seek a

1138second opinion from another IPN - approved evaluator . IPN informed

1149Ms. Shrader that she needed to eith er obtain a second opinion or

1162enter the recommended treatment before April 14, 2014 ; otherwise ,

1171IPN would close her intake case file .

117922. Ms. Shrader refused to obtain a second opinion or enter

1190into the recommended treatment . IPN closed Ms. Shrader ' s file on

1203April 14, 2014.

120623. On December 2, 2014, Mark Sylvester, M.D., a physician

1216specializing in psychiatry and addiction medicine, evaluated

1223Ms. Shrader pursuant to Department Order.

122924. Dr. Sylvester reviewed Ms. Shrader ' s medical records,

1239the IPN intak e case file, and the Department ' s investigative

1251report . Dr. Sylvester also asked Ms. Shrader to undergo a urine

1263and hair drug screen . Ms. Shrader did not participate in the

1275screens.

127625. Dr. Sylvester diagnosed Ms. Shrader with recurrent

1284major depressive di sorder, opioid abuse, alcohol abuse,

1292benzodiazepine abuse, nicotine dependence, factitious disorder

1298versus malingering, rule - out hypochondriasis, and rule - out

1308conversion disorder.

131026. During the evaluation, Ms. Shrader attempted to conceal

1319her psychiatric history, substance ab use, and symptoms of

1328depression . Ms. Shrader ' s unwillingness to be forthcoming during

1339her evaluation demonstrated denial of her symptoms and presented

1348a significant barrier to her treatment and recovery.

135627. Dr. Sylvester concluded th at Ms. Shrader ' s poor

1367judgment and decision - making detrimentally affected her ability

1376to practice nursing. Specifically, Ms. Shrader ' s judgment in

1386attempting to practice nursing while impaired, her lack of

1395insight into her illnesses, her inability to foll ow treatment

1405recommendations, and her disagreement with medical professionals

1412showed poor judgment . Poor judgment can affect decision - making

1423while practicing nursing, especially in a crisis situation .

143228. Dr. Sylvester concluded that Ms. Shrader was una ble to

1443practice nursing with reasonable skill and safety by reason of

1453her depression, use of alcohol, opioids, and benzodiazepines,

1461lack of insight into her symptoms, and poor judgment.

147029. In order for Ms. Shrader to be able to practice nursing

1482with reaso nable skill and safety to patients, she must: undergo

1493treatment at a residential treatment center ; enter into an IPN

1503monitoring agreement ; and submit to a hair analysis drug

1512screening test.

151430. These steps are essential to Ms. Shrader ' s recovery and

1526to regaining the ability to practice nursing with reasonable

1535skill and safety to patients. There is no evidence that

1545Ms. Shrader has taken any of these steps.

155331. Ms. Shrader is unable to practice nursing with

1562reasonable skill and safety to patients.

1568CONCLU SIONS OF LAW

157232. The Division of Administrative Hearings has

1579jurisdiction over the subject matter and the parties to this

1589action in accordance with sections 120.569 and 120.57(1), Florida

1598Statutes.

159933. This is a proceeding to take disciplinary action

1608again st Ms. Shrader ' s nursing license. Because of the penal

1620nature of these proceedings, the Department bears the burden of

1630proving the allegations in the Administrative Complaint by clear

1639and convincing evidence. Nair v. Dep 't of Bus. & Prof ' l Reg.,

1653Bd. of M ed . , 654 So. 2d 205 (Fla. 1st DCA 1995). As the Supreme

1669Court of Florida stated :

1674Clear and convincing evidence requires that

1680the evidence must be found to be credible; the

1689facts to which the witnesses testify must be

1697distinctly remembered; the testimony must be

1703precise and lacking in confusion as to the

1711facts in issue . The evidence must be of such

1721a weight that it produces in the mind of the

1731trier of fact a firm belief or conviction,

1739without hesitancy, as to the truth of the

1747allegations sought to be esta blished.

1753In re Henson , 913 So. 2d 579, 590 (Fla. 2005) , quoting Slomowitz

1765v. Walker , 429 So. 2d 797, 800 (Fla. 4th DCA 1983).

177634. In disciplinary proceedings, the statutes and rules for

1785which a violation is alleged must be strictly construed in favor

1796of the licensee. Elmariah v. Dep ' t of Prof ' l Reg. , 574 So. 2d

1812164 (Fla. 1st DCA 1990); Taylor v. Dep ' t of Prof ' l Reg. ,

1827534 So. 2d 782, 784 (Fla. 1st DCA 1988).

18363 5 . The clear and convincing evidence prov ed that

1847Ms. Shrader suffered and continues to suffer fr om recurrent major

1858depressive disorder, opioid abuse, alcohol abuse, benzodiazepine

1865abuse, nicotine dependence, factitious disorder versus

1871malingering, rule - out hypochondriasis, and rule - out conversion

1881disorder.

18823 6 . Clear and convincing evidence also estab lished that ,

1893based on Ms. Shrader ' s diagnoses and medical history, she is

1905unable to practice nursing with reasonable skill and safety to

1915patients.

19163 7 . Clear and convincing evidence proved that Ms. Shrader

1927will not be able to practice nursing with reasonabl e skill and

1939safety to patients until she undergoes treatment at a residential

1949treatment center , enters into an IPN monitoring agreement , and

1958submits to a hair analysis drug screening test.

19663 8 . Based on the foregoing, the clear and convincing

1977evidence prove d that Ms. Shrader is in violation of section

1988464.018(1)(j).

19893 9 . Section 456.072(2) permits the Board of Nursing to

2000impose the following penalties: suspension or permanent

2007revocation of a license ; restriction of practice of license ;

2016imposition of an admin istrative fine ; issuance of a reprimand or

2027letter of concern ; placement of the licensee on probation for a

2038period of time ; corrective action ; and/or requirement that the

2047practitioner undergo remedial education.

205140 . Florida Administrative Code Rule 64B9 - 8.0 06(3)(g)

2061provides that the Board of Nursing shall, when it finds a

2072licensee has violated section 464.018(1)(j), impose penalties

2079ranging from a $250 fine, suspension, and an IPN evaluation to a

2091$500 fine and suspension.

20954 1 . Rule 64B9 - 8.006(5)(b) requires c onsidering the

2106following aggravating and mitigating circumstances when imposing

2113a penalty:

2115a . The danger to the public;

2122b . Previous disciplinary action against the

2129licensee in this or any other jurisdiction;

2136c . The length of time the licensee has

2145prac ticed;

2147d . The actual damage, physical or

2154otherwise, caused by the violation;

2159e . The deterrent effect of the penalty

2167imposed;

2168f . Any efforts at rehabilitation;

2174g . Attempts by the licensee to correct or

2183stop violations, or refusal by the licensee

2190to correct or stop violations;

2195h . Cost of treatment;

2200i . Financial hardship; and/or

2205j . Cost of disciplinary proceedings.

221142 . Factors (a), (e), and (g) are relevant in this case.

2223They weigh as aggravating factors because they emphasize the

2232danger to the public and the unlikeliness that Ms. Shrader will

2243change her conduct.

2246RECOMMENDATION

2247Based on the foregoing Findings of Fact and Conclusions of

2257Law, it is RECOMMENDED that Petitioner, Department of Health,

2266Board of Nursing , enter a final order : finding t hat Respondent,

2278Tonya L. Shrader , R.N., violated section 464.018(1)(j); requiring

2286her to undergo an IPN evaluation; imposing a suspension of her

2297license until such time as she undergoes an IPN evaluation;

2307requiring compliance with IPN recommendations, if a ny; requiring

2316the payment of an administrative fine in the amount of $250.00;

2327and awarding costs for the investigation and prosecution of this

2337case, as provided in section 456.072(4) to the Department.
