89STATEMENT OF THE CASE

93On April 27, 2015, Petitioner, Amanda Bragg, individually

101and as parent of Bentley Bragg (Bentley ), a minor, filed a

113Petition for Determination of Compensability Pursuant to Florida

121Statute Section 766.301 et seq. (Petition) with the Division of

131Administrative Hearings (DOAH) for a determination of

138compensability under the Florida Birth - Related Neurol ogical

147Injury Compensation Plan (Plan). The Petition named

154Gregory Allan Zittel, M.D . , as the physician who provided

164obstetrical services at the birth of Bentley on May 9, 2013, at

176Winnie Palmer Hospital located in Orlando, Florida.

183DOAH served NICA with a copy of the Petition on May 9, 2015.

196DOAH served Gregory Allan Zittel, M.D . , with a copy of the

208Petition on May 7, 2015. The docket reflects that a copy of the

221Petition was mailed to Winnie Palmer Hospital on May 5, 2015.

232On May 27, 2015, Orlando Heal th, Inc., d/b/a Winnie Palmer

243Hospital for Women & Babies and Gregory A. Zittel, M.D., filed a

255Petition for Leave to Intervene, which was granted by Order dated

266June 9 , 2015.

269On December 10, 2015, NICA filed a Motion for Summary Final

280Order, asserting that Bentley did not sustain a "birth - related

291neurological injury" as that term is defined in section

300766.302(2), Florida Statutes. In its Motion for Summary Final

309Order, NICA represents that Intervenors do not oppose the Motion.

319During a telephone heari ng on December 15, 2015, Petitioner was

330afforded additional time to respond to NICAÓs Motion for Summary

340Final Order. As of the date of this Summary Final Order of

352Dismissal, which is after the additional time granted, no

361response has been filed to the Mo tion for Summary Final Order by

374Petitioner.

375FINDINGS OF FACT

3781. Bentley Bragg was born on May 9, 2013, at Winnie Palmer

390Hospital located in Orlando, Florida. Bentley weighed 4,233

399grams at birth.

4022. Donald Willis, M.D. (Dr. Willis), was requested by NICA

412to review the medical records for Bentley. In a medical report

423dated July 23, 2015, Dr. Willis opined as follows:

432Delivery was complicated by a shoulder

438dystocia, resulting in about a one minute

445delay in delivery. The baby was eventually

452delivered after extension of an episiotomy

458and rotation of the posterior arm. Birth

465weight was 4,233 grams (9 lbs 5 ozÓs). This

475would be large - for - gestational age (LGA).

484Apgar scores were 3/8. Bag and mask

491ventilation was given for about 80 seconds.

498The baby had no movement of the left arm.

507Left brachial plexus injury was diagnosed.

513Newborn exam and hospital course were

519otherwise benign. The baby had significant

525bruising and was evaluated by Hematology and

532monitored for bilirubin levels.

536There were not EEGÓs or imaging studies of

544the brain.

546In summary, delivery of the LGA baby was

554complicated by a shoulder dystocia which

560resulted in a brachial plexus injury.

566Hospital and medical records did not suggest

573oxygen deprivation or brain injury. MRI of

580the cervical sp ine after hospital discharge

587was reported as a Ðnormal cervical spine.Ñ

594There was no apparent obstetrical event that

601resulted in loss of oxygen or mechanical

608trauma to the babyÓs brain or spinal cord

616during labor, delivery or the immediate post

623delivery p eriod.

6263. NICA retained Laufey Y. Sigurdardottir, M.D.

633(Dr. Sigurdardottir), a pediatric neurologist, to examine Bentley

641and to review his medical records. Dr. Sigurdardottir examined

650Bentley on September 2, 2015. In a medical report regarding her

661ind ependent medical examination of Bentley, Dr. Sigurdardottir

669opined as follows:

672Overall assessment, here we have a 2 - year 4 -

683month - old male with a severe upper brachial

692plexus injury, which has required muscle and

699tendon transfer surgery because of an

705increa sing deformity of shoulder and shoulder

712contraction. He does have fairly sustained

718functional abilities, although not complete.

723Bentley also has an expressive language delay

730that is not felt to relate to his physical

739brachial plexus injury which definitel y is

746birth related. Mild depression at birth with

753an Apgar score of 3 did show prompt recovery

762and a cord pH that was within normal limits.

771Result as to question 1: The child is found

780to have a permanent physical impairment, but

787no obvious mental impair ment. His mild

794expressive language delay does not

799substantiate a profound mental impairment.

804* * *

807Due to the fact that BentleyÓs disability

814only relates to physical impairment and no

821clear mental impairment related to birth -

828related neurologic injury can be found, I am

836not recommending Bentley to be included into

843the Neurologic Injury Compensation

847Association (NICA) program and would be happy

854to answer additional questions.

8584. A review of the file in this case reveals that there

870have been no expert o pinions filed that are contrary to the

882opinion of Dr. Willis that there was no apparent obstetrical

892event that resulted in loss of oxygen or mechanical trauma to the

904baby's brain or spinal cord during labor, delivery or the

914immediate post - delivery period. Dr. WillisÓ opinion is credited.

924There ha ve been no expert opinions filed that are contrary to

936Dr. SigurdardottirÓs opinion that Bentley is not found to have a

947substantial mental impairment. Dr. SigurdardottirÓs opinion is

954credited.

9555. Moreover, in res ponse to an interrogatory served to

965Petitioner by NICA, Petitioner acknowledged that she does not

974contend that Bentley suffers from a permanent and substantial

983mental impairment.

985CONCLUSIONS OF LAW

9886 . The Division of Administrative Hearings has jurisdict ion

998over the parties to and the subject matter of these proceedings.

1009§§ 766.301 - 766.316, Fla. Stat.

10157 . The Plan was established by the Legislature "for the

1026purpose of providing compensation, irrespective of fault, for

1034birth - related neurological injury c laims" relating to births

1044occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

10558 . The injured infant, her or his personal representative,

1065parents, dependents, and next of kin may seek compensation under

1075the Plan by filing a claim for compensat ion with DOAH.

1086§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1094which administers the Plan, has "45 days from the date of service

1106of a complete claim . . . in which to file a response to the

1121petition and to submit relevant written information relating to

1130the issue of whether the injury is a birth - related neurological

1142injury." § 766.305(4), Fla. Stat.

11479 . If NICA determines that the injury alleged in a claim is

1160a compensable birth - related neurological injury, it may award

1170compensation to the c laimant, provided that the award is approved

1181by the administrative law judge to whom the claim has been

1192assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1203disputes the claim, as it has in the instant case, the dispute

1215must be resolved by the assigned administrative law judge in

1225accordance with the provisions of chapter 120, Florida Statutes.

1234§§ 766.304, 766.309, and 766.31, Fla. Stat.

12411 0 . In discharging this responsibility, the administrative

1250law judge must make the following determination based upon the

1260available evidence:

1262(a) Whether the injury claimed is a birth -

1271related neurological injury. If the claimant

1277has demonstrated, to the satisfaction of the

1284administrative law judge, that the infant has

1291sustained a brain or spinal cord injury

1298c aused by oxygen deprivation or mechanical

1305injury and that the infant was thereby

1312rendered permanently and substantially

1316mentally and physically impaired, a

1321rebuttable presumption shall arise that the

1327injury is a birth - related neurological injury

1335as defined in s. 766.303(2).

1340(b) Whether obstetrical services were

1345delivered by a participating physician in the

1352course of labor, delivery, or resuscitation

1358in the immediate postdelivery period in a

1365hospital; or by a certified nurse midwife in

1373a teaching hospital supervised by a

1379participating physician in the course of

1385labor, delivery, or resuscitation in the

1391immediate postdelivery period in a hospital.

1397§ 766.309(1), Fla. Stat. An award may be sustained only if the

1409administrative law judge concludes that the "i nfant has sustained

1419a birth - related neurological injury and that obstetrical services

1429were delivered by a participating physician at birth."

1437§ 766.31(1), Fla. Stat.

14411 1 . The term "birth - related neurological injury" is defined

1453in section 766.302(2) as fol lows:

"1459Birth - related neurological injury" means

1465injury to the brain or spinal cord of a live

1475infant weighing at least 2,500 grams for a

1484single gestation or, in the case of a

1492multiple gestation, a live infant weighing at

1499least 2,000 grams at birth caused b y oxygen

1509deprivation or mechanical injury occurring in

1515the course of labor, delivery, or

1521resuscitation in the immediate postdelivery

1526period in a hospital, which renders the

1533infant permanently and substantially mentally

1538and physically impaired.

15411 2 . ÐThe statute is written in the conjunctive and can only

1554be interpreted to require permanent and substantial impairment

1562that has both physical and mental elements.Ñ Fla. Birth - Related

1573Neurological Injury Comp. Ass Ó n. v. Fla. Div. of Admin. Hearings ,

1585686 So. 2d 1349, 1356 (Fla. 1997).

15921 3 . The evidence, which is not refuted, established that

1603Bentley did not sustain an injury to the brain or spinal cord

1615caused by oxygen deprivation or mechanical injury in the course

1625of labor, delivery, or resuscitation in the imme diate post -

1636delivery period in a hospital which rendered him permanently and

1646substantially mentally and physically impaired. Therefore,

1652Bentley is not eligible for benefits under the Plan.

1661CONCLUSION

1662Based upon the foregoing Findings of Fact and Conclusio ns of

1673Law, it is ORDERED that the Petition filed by Amanda Bragg,

1684individually and as parent of Bentley Bragg, is dismissed with

1694prejudice.
