88STATEMENT OF THE CASE
92On April 29 , 201 5 , Petitioner s , William F. Arbulu and
103Katherine C. Roman , individually and on behalf of Kathaileen F.
113Arbul u ( Kathaileen ), a minor, filed a Petition Under Protest
125Pursuant to Florida Statute Section 766.301 et seq. (Petition)
134with the Division of Administrative Hearings (DOAH) for a
143determination of compensability under the Florida Birth - Related
152Neurological In jury Compensation Plan (Plan). The Petition named
161Bhupendrakumar M. Patel , M . D. , as the physician who provided
172obstetric services for the birth of Kathaileen on April 27, 2013,
183at Osceola Regional Medical Center in Kissimmee, Florida .
192DOAH served NICA w ith the Petition on May 6, 2015. DOAH
204served Osceola Regional Medical Center a copy of the Petition on
215May 8, 2015. DOAH mailed a copy of the Petition to
226Bhupendrakumar M. Patel, M.D., on May 5, 2015. The envelope was
237returned to DOAH on June 16, 201 5 , marked ÐReturn to Sender,
249Unable to Forward.Ñ DOAH verified Dr. PatelÓs address on the
259Department of HealthÓs website and again mailed a copy of the
270Petition to Dr. Patel on June 24, 201 5 . As of the date of this
286Summary Final Order of Dismissal, Dr. Pate l has not petitioned to
298intervene into this proceeding.
302On August 6, 2015, Osceola Regional Medical Center filed a
312Petition to Intervene, which was granted by Order dated
321August 17, 2015.
324On July 22 , 201 6 , NICA filed a Motion for Summary Final
336Order, req uesting that a s ummary f inal o rder be entered finding
350that the claim was not compensable because Kathaileen did not
360sustain a Ðbirth - related neurological injuryÑ as that term is
371defined in section 766.302(2), Florida Statutes . The Motion
380stated that Inter venor takes no position on the Motion.
390Petitioners did not file a response to the Motion.
399On August 4, 2016, an Order to Show Cause was entered which
411allowed Petitioners until August 19, 2016, to inform the
420undersigned in writing as to why the motion shou ld not be granted
433and a summary final order be entered finding PetitionersÓ claim
443is not compensable. To date, no response has been filed by
454Petitioners to the Motion.
458FINDINGS OF FACT
4611. Kathaileen F. Arbulu was born on April 27 , 2 013 , at
473Osceola Regio nal Medical Center in Kissimmee , Florida.
4812. Donald Willis, M.D. (Dr. Willis), was requested by NICA
491to review the medical records for Kathaileen . In a report dated
503March 9 , 201 6 , Dr. Willis described his findings in pertinent
514part as follows:
517The moth er was admitted to the hospital at 38
527weeks for induction of labor due to
534preeclampsia and a history of Gestational
540Diabetes. Fetal heart rate (FHR) monitor
546tracing during labor did not suggest fetal
553distress. Seizure activity occurred during
558the inducti on. Eclampsia was diagnosed and
565intravenous MgSO4 started for management.
570Cesarean section was done due to Eclampsia.
577The delivery was stated to be uncomplicated.
584Amniotic fluid was clear. There was a loose
592nucal cord. Birth weight was 4,210 grams or
6019 lbs 4 ozÓs.
605The baby was not depressed. Apgar scores
612were 8/8. The infant cried spontaneously at
619delivery. No resuscitation was required.
624The baby was given blow - by oxygen for two -
635minutes and then transferred to the nursery.
642There was no appare nt obstetrical event that
650resulted in loss of oxygen or mechanical
657trauma to the babyÓs brain during labor,
664delivery or the immediate post delivery
670period.
6713. A review of the file reveals that no contrary evidence
682was presented to dispute Dr. WillisÓ f inding that KathaileenÓs
692injuries were not the result of oxygen deprivation or mechanical
702injury during labor, delivery, or the immediate post - delivery
712period. Dr. WillisÓ opinion is credited.
718CONCLUSIONS OF LAW
7214 . The Division of Administrative Hearings has jurisdiction
730over the parties to and the subject matter of these proceedings.
741§§ 766.301 - 766.316, Fla. Stat.
7475 . The Plan was established by the Legislature "for the
758purpose of providing compensation, irrespective of fault, for
766birth - related neurolo gical injury claims" relating to births
776occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
7876 . The injured infant, her or his personal representative,
797parents, dependents, and next of kin may seek compensation under
807the Plan by filing a claim for compensation with DOAH.
817§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
825which administers the Plan, has "45 days from the date of service
837of a complete claim . . . in which to file a response to the
852petition and to submit relevant written information relating to
861the issue of whether the injury is a birth - related neurological
873injury." § 766.305(4), Fla. Stat.
8787 . NICA has determined that Petitioner s do not have a claim
891that is compensable under the Plan and has filed a Motion for
903Summary Final Order, requesting that an order be entered finding
913that the claim is not compensable.
9198 . In ruling on the motion, the a dministrative l aw ju dge
933must make the following determination based upon the available
942evidence:
943(a) Whether the injury claimed is a birth -
952related neurological injury. If the claimant
958has demonstrated, to the satisfaction of the
965administrative law judge, that the infant has
972sustained a brain or spinal cord injury
979caused by oxygen deprivation or mechanical
985injury and that t he infant was thereby
993rendered permanently and substantially
997mentally and physically impaired, a
1002rebuttable presumption shall arise that the
1008injury is a birth - related neurological injury
1016as defined in s. 766.303(2).
1021§ 766.309(1), Fla. Stat.
10259 . The ter m "birth - related neurological injury" is defined
1037in section 766.302(2) as follows:
"1042Birth - related neurological injury" means
1048injury to the brain or spinal cord of a live
1058infant weighing at least 2,500 grams for a
1067single gestation or, in the case of a
1075mult iple gestation, a live infant weighing at
1083least 2,000 grams at birth caused by oxygen
1092deprivation or mechanical injury occurring in
1098the course of labor, delivery, or
1104resuscitation in the immediate postdelivery
1109period in a hospital, which renders the
1116infant permanently and substantially mentally
1121and physically impaired.
112410 . The evidence, which is not refuted, established that
1134there was not an obstetrical event that resulted in loss of
1145oxygen or mechanical trauma to KathaileenÓs brain during labor,
1154deliver y or the immediate post - delivery period. Thus,
1164Kathaileen is not eligible for benefits under the Plan.
1173CONCLUSION
1174Based upon the foregoing Findings of Fact and Conclusions of
1184Law, it is ORDERED that the Petition filed by William F. Arbulu
1196and Katherine C. Roman , individually and on behalf of Kathaileen
1206F. Arbulu , a minor, is dismissed with prejudice.
