130Whether Grandview Landscaping Services, Inc. , is liable to

153PRELIMINARY STATEMENT

155On March 31 , 2015, Petitioner filed a Complaint against

164Grandview Landscaping Services, Inc. (Grandview) ; and Sure Tec

172Insurance Company with the Florida Department of Agriculture and

181Consumer Services (Department) , se eking payment for 27 Live Oak

191trees. The Department provided Notice of the Complaint to

200Grandview and Sure Tec Insurance Company . Respondent Grandview

209answered the Complaint on April 27, 2015 , and complained that

219Grandview had to replace seven of the 27 trees due to health

231issues . O n May 5 , 2014, the Department referred the matter to

244the Division to schedule an evidentiary hearing. Neither

252Guignard Company nor Sure Tec Insurance Company respond ed nor

262did either of those parties appear in these proceedin gs.

272The matter was initially scheduled for hearing on June 30 ,

282201 5 , by video teleconference in Gainesville and Tallahassee,

291Florida. The final hearing was continued at the request of

301Respondent Grandview and rescheduled for September 15 , 201 5 .

311The fina l hearing commenced as re scheduled. Petitioner

320offered the testimony of Keith Lerner and David Lerner, its

330President and Vice President, respectively. PetitionerÓs

336exhibits 1 through 3 were admitted in evidence.

344None of the Respondent s appeared at the fi nal hearing.

355Petitioner did not order a transcript o f the proceedings.

365Petitioner timely filed a Proposed Recommended Order on

388FINDING S OF FACT

3921 . Petitioner, So utheastern Trees, LLC ( Petitioner or

402Southeastern Trees ) , is a Florida L imited Liability Corporation

412located in Gainesville , Florida, engaged in the business of

421commercial tree farming . Keith Lerner is the President of

431Sout h eastern , and David Lerner is th e Vice President .

4432 . Respondent, Grandview Landscaping Services, Inc.

450(Respondent or Grandview ) , is a Florida corporation

458headquartered in Ocala, Florida, engaged in commercial

465landscaping . Grandview is licensed by the Department as a

475dealer in nursery p roducts, flowers, and sod.

4833 . In August 2015, John Sapp, GrandviewÓs owner, visited

493PetitionerÓs tree farm and selected 27 live oak trees to

503pur chase .

5064 . On December 11, 2014, Mr. Sapp returned to Southeastern

517Trees and took possession of the 27 live oa k trees. Mr. Sapp

530used his own equipment to haul the trees.

5385 . Petitioner sent an in voice to Respondent on

548December 11, 2014, in the amount of $5,724.00 for the 27 live

561oak trees. The invoice term was Ðnet 30 , Ñ allowing 30 days for

574Respondent to pay in full.

5796 . After 30 days had elapsed without payment, David Lerner

590contacted Mr. Sapp to request payment. Mr. Lerner also

599requested the location of the trees in order to place a lien

611thereon. According to Mr. Lerner, Mr. Sapp refused to divulge

621the locat ion of the trees.

6277 . After 60 days had elapsed without payment, Keith Lerner

638contacted Mr. Sapp via telephone. According to Keith Lerner, he

648spoke with Mr. Sapp on March 1, 2015, who informed him the trees

661were beautiful and Mr. Sapp would Ðget him a che ck.Ñ

6728 . Keith Lerner attempted to reach Mr. Sapp via telephone

683again on March 10, 2015, and left messages with GrandviewÓs

693office and on Mr . SappÓs personal mobile phone. Mr. Lerner did

705not receive a return call.

7109 . On March 25, 2015, Petitioner sent Respondent, via

720certified mail, a letter requesting payment of $5,724.00 for the

73127 live oak trees and Ðany interest available to us beyond the

74330 days of credit that were extended to you.Ñ The letter was

755delivered to both GrandviewÓs business address an d Mr. SappÓs

765home address.

76710 . The certified mail receipts were returned to

776Southeaster n Trees, signed and dated March 26, 2015.

78511 . Petitioner filed a complaint with the Department on

795March 31, 2015, against Southeastern Trees . Petit i oner paid a

807fi ling fee of $50.00

81212 . As of the date of the hearing, Southeastern Trees had not

825responded to PetitionerÓs request for payment.

831CONCLUSIONS OF LAW

83413 . The Division has jurisdiction over the parties and the

845subject matter of this proceeding. §§ 120.569 & 120.57(1),

854604.21(6), Fla. Stat. (2015 ).

85914 . The Department is the state agency responsible for

869licensing dealers in agricultural products , and investigating

876and taking action on complaints against such dealers. §§ 604.15

886through 604.34, Fla. Stat. (20 14). 2 /

89415 . The definition of Ðagricultural productsÑ includes the

903Ðnatural products of the . . . farm [and] nursery . . . produced

917in the state[.]Ñ £ 604.15(1), Fla. Stat. The trees grown by

928Petitioner are Ðagricultural productsÑ within the meaning of

936s ection 604.15(1).

93916 . The definition of a Ðdealer in agricultural productsÑ

949includes any Ðcorporation . . . engaged within this state in the

961business of purchasing, receiving, or soliciting agricultural

968products from the producer . . . for resale or proce ssing for

981sale[.]Ñ £ 604.15(1), Fla. Stat. Grandview is a dealer in

991agricultural products within the meaning of section 604.15(1).

99917 . Any business claiming to be damaged by any breach of

1011the conditions of an agreement made with a dealer in

1021agricultural products , may file a complaint with the Department

1030against the dealer and against the surety company. See

1039§ 604.21(1)(a), Fla. Stat.

104318 . As the Petitioner, Southeastern bears the burden of

1053proving the allegations of its complaint by a preponderance of

1063the evidence. See DepÓt of Banking & Fin. , Div. of Sec. & Inv.

1076Prot. v. Osborne Stern & Co. , 670 So. 2d 932, 934 (Fla. 1996)

1089(ÐThe general rule is that a party asserting the affirmative of

117019 . Petitioner has satisfied its burden. As set forth in

1181the Findings of Fact, Respondent Grandview owes Petitioner

1189$5,724.00 for 27 live oak trees.

119620 . Petitioner additionally seeks recovery of the filing

1205fee paid to the Depar tment for the compla int filed against

1217Respondents on March 31, 2015. Petitioner paid a $50 filing

1227fee, which is specifically recoverable against Respondent. See

1235£ 604.21(1)(a)(ÐIn the event the complainant is successful in

1244proving the claim, the dealer i n agricultural products shall

1254reimburse the com plainant for the $50 filing fee as part of the

1267settlement of the claim.Ñ)

127121 . Petitioner further seeks interest on the debt owed by

1282Resp ondent from the date the 30 day payment term expired.

1293Nothing in the gov erning statute mentions costs, generally, or

1303interest , particularly. Petitioner has cited no other authority

1311for the undersigned to recommend payment of interest accrued on

1321the debt. Section 55.03(1) , Florida Statutes, Ðprovides only

1329that a Òjudgment or decreeÓ shall bear interest. Such does not

1340include administrative orders.Ñ Bank of Cent. Fl a . v. DepÓt of

1352Banking & Fin. , 470 So. 2d 742 , 746 (Fla. 1st DCA 1985).

1364ÐAlthough administrative orders entered in adjudicatory

1370proceedings are generally regarded as quasi - judicial in nature .

1381. . administrative orders are generally regarded as not having

1391the force or effect of a final judgment or decree of a court.Ñ

140722 . Inasmuch as the governing statute does not address an

1418award of costs , the undersigned has no authority to recommend

1428reimbursement of PetitionerÓs cost incurred in mailing demand

1445RECOMMENDATION

1446Based on the foregoing Findings of Fact and Conclusions of

1456Law, it is RECOMMENDED that th e Department of Agriculture and

1467Consumer Services enter a final order approving the claim of

1477Southeastern Trees, LLC , against Grandview Landscaping Services,

1484Inc. , in the amount of $ 5,774.00 .
