40The State of Florida Commission on Ethics, meeting in public session on July 24, 2015,
55adopted the Joint Stipulation of Fact, Law, and Recommended Order entered into between the
69Advocate for the Commission and the Respondent in this matter.
79In accordance with the Stipulation, which is attached hereto and incorporated by
91reference, the Commission finds that the Respondent, as a candidate for Miami-Dade
103Community Council, violated Section 112.3145, Florida Statutes, by failing to disclose real
115property on his CE Form 1, Statement of Financial Interests, for the year 2013.
129For the violation, in accordance with the Stipulation, the Commission hereby
140recommends public censure and reprimand and a civil penalty in the total amount of $500.00,
155penalties which the Respondent has agreed to be subjected to and to pay.

236Respondent, Steven Miro and the Advocate for the Florida Commission on Ethics enter
249into this Joint Stipulation of Fact, Law, and Recommended Order with respect to the above
264styled Complaint. Subject to acceptance by the Commission on Ethics, the parties agree that
278they enter into this stipulated settlement in lieu of further hearings in this cause. The parties
294stipulate as follows:
297STIPULATED FINDINGS OF FACT
3011. At all times material to this Complaint, Respondent was a candidate for Miami-
315Dade Community Council, and as such was subject to the provisions of the Code of Ethics for
332Public Officers and Employees, Part m, Chapter 112, Florida Statutes.
3422. On August 27, 2014, a sworn Complaint was filed with the Commission on Ethics
357alleging that Respondent had violated the Code of Ethics.
3663. Pursuant to Section 112.322, Florida Statutes, the Executive Director of the
378Commission on Ethics found that the Complaint was legally sufficient and ordered a preliminary
392investigation of the Complaint for a probable cause determination of whether Respondent had
405violated the Code of Ethics. The Report of Investigation was released on January 16,2015.
4204. On March 6, 2015 the Commission on Ethics found probable cause to believe
434Respondent had violated Section 1123145, Florida Statutes. The allegation is:
444Respondent violated Section 112.3145, Florida Statutes, by failing to
453disclose real property on his CE Fonn 1, "Statement of Financial
464Interests," for the year 2013.
4695. Respondent admits the facts as set forth in the Report of Investigation, which is
484specifically incorporated by reference in this Joint Stipulation.
492STIPULATED CONCLUSIONS OF LAW
4966. Respondent is subject to the provisions of Part III, Chapter 112, Florida Statutes,
510the Code of Ethics for Public Officers and Employees.
5197. The Commission on Ethics has jurisdiction over the Complaint as filed in this
533proceeding and over Respondent
5378. Respondent violated Section 112.3145, Florida Statutes, by failing to disclose real
549property on his CE Fonn 1, "Statement of Financial Interests,., for the year 2013.
5649. Respondent admits the allegation as set forth in paragraph four (4) of the
578Stipulated Findings of Fact, above.
583STIPULATED RECOMMENDED ORDER
58610. The Advocate accepts Respondenfs stipulation in this proceeding.
59511. The Advocate and Respondent have entered into this Joint Stipulation and urge
608the Commission on Ethics to approve it in lieu of further hearings before the Commission in this
625cause.
62612. Therefore, the Advocate recommends that:
632(a) The Commission on Ethics approve this Joint Stipulation, embodying the
643stipulations, admissions, and recommendations of the parties; and
651(b) The Commission on Ethics enter a Final Order and Public Report
663consistent with this Stipulation finding that Respondent violated Section 112.3145,
673Florida Statutes, by failing to disclose real property on his CE Fonn I, "Statement of
688Financial Interests," for the year 2013 and recommending:
696(1) Public censure and reprimand ofRespondent; and
703(2) A civil penalty of$500.00
708FURTHER STIPULATIONS
71013. Respondent and the Advocate stipulate and covenant that they have freely and
723voluntarily entered into this Joint Stipulation of Fact, Law, and Recommended Order with full
737knowledge and understanding of its contents. Respondent and the Advocate ftnther stipulate and
750covenant that this Joint Stipulation constitutes the full agreement of the parties and that there are
766no oral or written understandings between the parties other than those contained in this Joint
781Stipulation of Fact, and Recommended Order.
787I 4. Respondent and the Advocate stipulate and covenant that. in consideration of the
801provisions of this Joint Stipulation of Fact, Law, and Recommended Order, Respondent and the
815Advocate accept and will comply with the above-referenced Final Order and Public Report of the
830Commission on Ethics.
83315. Respondent and the Advocate stipulate that this Joint Stipulation of Fact, Law,
846and Recommended Order is submitted to the Commission on Ethics for its consideration and
860ratification. In the event that it is not approved by the Commission on Ethics as this
876document shall be of no purpose and effeet and shall not be deemed an admission by
892Respondent
89316. Effective upon approval of this Joint Stipulation of Fact, Law, and Recommended
906Order by the Commission on Ethics, Respondent waives all time, notice, and hearing rights,
920requirements, and entitlements, as to all subsequent hearings in this proceeding.
