146STATEMENT OF THE ISSUE
150The issue is whether Florida Housing and Finance
158Corporation 's intended decision to award low income housing tax
168credits for an affordable housing development in Miami - Dade
178County to Rio at F lagler, LP (Rio) , was contrary to solicitation
190specifications , and if so, whether that determination was
198clearly erroneous or contrary to competition .
205PRELIMINARY STATEMENT
207On November 21, 2014, Florida Housing Finance Corporation
215(Florida Housing or agency) issued Request for Applications
2232014 - 116 (RFA) , which solicited applications to compete for
233federal low - income housing tax credit funding (tax credits) for
244affordable hou sing developments in Miami - Dade County.
253A ppl ications were submitted in response to the RFA by a number
266of developers , including Rio and Pinnacle Heights, LLC
274(Pinnacle) . On May 8, 2015, Florida Housing posted a notice of
286its intended decision to award fu nding for family and elderly
297affordable housing to Rio and two other applicant s not relevant
308here, whose application s w ere deemed to be eligible . Although
320Pinnacle's application was also determined to be eligible, Rio
329had a lower tiebreaking lottery numbe r than Pinnacle , and Rio
340was awarded the tax credits.
345P ursuant to section 120.57(3), Florida Statutes (201 5 ),
355P innacle timely filed a notice of intent to protest, followed by
367a formal written protest . In its formal written protest,
377Pinnacle alleged tha t but for Florida Housing erroneously
386scoring Rio's application, it would have received the requested
395funding. The matter was referred to DOAH to resolve the
405dispute. Prior to the hearing, Florida Housing changed its
414position and now contends that Rio's application was incorrectly
423scored and that Pinnacle, rather than Rio, should receive the
433funding.
434At the final hearing, P etitioner presented the testimony of
444one witness. Petitioner 's Exhibit 5 was accepted in evidence.
454Rio presented the testimony of one witnes s. Rio's Exhibits 2
465through 4, 6, and 7 were accepted in evidence. Joint Exhibits 1
477through 8 were also accepted in evidence.
484A one - volume Transcript of the hearing was prepared . All
496parties filed p roposed r ecommended o rders, which have bee n
508considered in the preparation of this Recommended Order.
516FINDINGS OF FACT
5191. Florida Housing is a public corporation created
527pursuant to section 420.504. One of its responsibilities is to
537award low - income housing tax credits, which developers use to
548fi nance the construction of affordable housing. Tax credits are
558made available to states annually by the United States Treasury
568Department and are then awarded pursuant to a competitive cycle
578that starts with Florida Housing's issuance of a RFA.
5872. In thi s case, the RFA was issued on November 21 , 2014,
600modified slightly on January 30, 2015 , and required the filing
610of applications by February 10, 2015 . According to the RFA,
621Florida Housing is expected to award up to an estimated
631$4,367,107 of housing cred its for the following demographic set -
644aside : housing projects targeted for either the family or
654elderly population in Miami - Dade County. The credits w ill be
666awarded to the applica nts with the highest total scores .
6773 . Pinnacle submitted Application No. 2 015 - 211C seeking
688$2,560,000.00 in annual allocation of housing credits to finance
699the construction of a 104 - unit residential rental development to
710be known as Pinnacle Heights. Rio submitted Application No.
7192015 - 217C seeking $1,940,000.00 in annual alloca tion of housing
732credits to finance the construction of a 76 - unit residential
743development to be known as Rio at Flagler.
7514 . The agency's Executive Director appointed a review
760committee comprised of Florida Housing staff to evaluate the
769applications for e ligibility and scoring. Fifty - three
778applications were received, processed, deemed eligible or
785ineligible, scored, and ranked pursuant to the terms of the RFA,
796administrative rules, and applicable federal regulations.
802Applications are considered for fundi ng only if they are deemed
"813eligible," based on whether the application complies with
821various content requirements. Of the 53 applications filed in
830response to the RFA , 43 were found to be eligible, and ten were
843found ineligible. Both Pinnacle and Rio we re found eligible for
854the family/elderly demographic .
8585 . The RFA specifies a sorting order for funding eligible
869applicants. All eligible applicants in the family/elderly
876demographic, including Pinnacle and Rio, achieved the maximum
884score of 23 based on criteria in the RFA . Recognizing that
896there would be more applications than available credits, Florida
905Housing established an order for funding for applicants with
914tied scores using a sequence of six tiebreakers, with the last
925being a lottery number assi gned by the luck of the draw.
937Applications with lower lottery numbers (closer to zero) are
946selected before those with higher lottery numbers.
9536 . B oth Pinnacle and Rio received the maximum 23 points
965and met all tiebreaker criteria. In other words, both h ad so -
978called "perfect" applications. The ultimate deciding factor for
986perfect applications is a randomly generated lottery number that
995is assigned at the time each application is filed. Rio's number
1006is four, while Pinnacle's number is six. B ecause Rio h ad a
1019lower lottery number than Pinnacle, Florida Housing issued its
1028notice of intent to award tax credits to Rio and ano ther
1040applicant (with a lower lottery number) not relevant here .
10507. Pinnacle timely filed a formal written protest. As
1059amended, Pinna cle's protest is narrowed to a single issue --
1070whether the bus stop identified in Rio's application is a Public
1081Bus Transfer Stop, as defined in the RFA. A failure to comply
1093with th is provision would lower Rio's total proximity score and
1104make it ineligibl e to receive tax credit funding.
11138. The RFA specifies two Point Items in the family/elderly
1123demographic category. The first Point Item is "Local Government
1132Contributions," for which a maximum of five points could be
1142awarded. The second is "Proximity to Transit and Community
1151Services," for which points are awarded based on the distance
1161between the proposed development and the selected transit and
1170community service. A maximum of six proximity points are
1179allowed for Transit Services , while a maximum of 12 proximity
1189points are allowed for Community Services for a total maximum of
120018 proximity points. Under the terms of the RFA, if a n
1212applicant achieve s a minimum of 12.25 proximity points for
1222Community Service s and Transit Service s , a "point boost" up to
1234the maximum total score of 18 proximity points is added to the
1246applicant's score . Rio's transit score of six points is the
1257focus of th is dispute.
12629 . T he RFA lists five types of Tran sit S ervices that an
1277applicant can self - select to obtain proximity points, i ncluding
1288Public Bus Stop (maximum two points) and Public Bus Transfer
1298Stop (maximum six points). Applicants may select only one type
1308of transit services on which to base their transit score .
1319Depending on the type of t ransit s ervice selected, an applicant
1331may receive up to a maximum of six points for Transit Services .
1344To verify the information in the application, a n applicant must
1355submit a Surveyor Certification Form , which is completed and
1364signed by a licensed surveyor. In making its preliminary
1373decisio n to award tax credits , Florida Housing relies on the
1384information provided in the form and does not second - guess the
1396surveyor. Issues regarding the accuracy of th e information in
1406the form are presented through challenges by other applicants.
14151 0 . Because Rio had only ten points for proximity to
1427Community Services, it needed at least 2.25 transit points in
1437order to obtain the minimum 1 2 .25 proximity points necessary to
1449achieve a point boost up to 18 points and be in the running for
1463funding. Accordingly, Ri o's application sought six points for
1472the project site's proximity to a Public Bus Transfer Stop . A
1484Public Bus Transfer S top is defined on page 19 of the RFA as
1498follows:
1499This service may be selected by Family and
1507Elderly Demographic Applicants. For
1511purpo ses of proximity points, a Public Bus
1519Transfer Stop means a fixed location at
1526which passengers may access at least three
1533routes of public transportation via buses.
1539Each qualifying route must have a scheduled
1546stop at the Public Bus Transfer Stop at
1554least h ourly during the times of 7 a.m. to
15649 a.m. and also during the times of 4 p.m.
1574to 6 p.m. Monday through Friday, excluding
1581holidays, on a year - round basis. This would
1590include both bus stations (i.e. hubs) and
1597bus stops with multiple routes. Bus routes
1604mu st be established or approved by a Local
1613Government department that manages public
1618transportation. Buses that travel between
1623states will not be considered.
16281 1 . In sum , a Public Bus Transfer Stop is a fixed location
1642at which passengers may access "at lea st three routes of public
1654transportation via buses , " with each route having a scheduled
1663stop at th at loca tion at least hourly during morning and
1675afternoon rush hours, Monday through Friday , on a year - round
1686basis .
16881 2 . To comply with th is requirement , and based upon oral
1701information provided by customer service at Miami - Dade Transit
1711Authority (Authority) , Rio selected a bus stop located at West
1721Flagler Street and Northwest 8th Avenue. Rio represented that
1730th is location was served by three qualifying route s: Route 6
1742(Coconut Grove), Route 11 (Florida International University -
1750University Park Campus), and Route 208 (Little Havana
1758Circulator).
17591 3 . The RFA requires that a bus route be established or
1772approved by the " local government department " that manages
1780public transportation, in this case the Authority. Florida
1788Housing defers to the local government in determining whether a
1798selected bus route is a qualifying bus route within the meaning
1809of the RFA .
181314 . The head of th e local government department that
1824manages public transportation is Gerald Bryan, the chief of
1833service planning and scheduling. By deposition, Mr. Bryan
1841testified that the location selected by Rio has only two
1851qualifying routes: 11 and 208. Route 6, the third route relied
1862upon by Rio, d oes not run hourly during the requisite rush hour
1875times as required by the RFA and therefore is not a qualifying
1887route. With only two qualifying routes, the transit service
1896selected by Rio is a P ublic B us S top for which only two points,
1912rather than six, c an be awarded. Had this information been
1923available to Florida Housing when it reviewed Rio's application,
1932Rio's proximity score would have been less than 12.25, making it
1943ineligible to receive a point boost and achieve the maximum
1953total score of 18 proxim ity points.
196015 . Because Rio is ineligible for funding , the next
1970applicant in line is Pinnacle, as it has the next lowest lottery
1982number among the eligible applications that received 23 points.
199116 . Rio does not dispute that Route 6 fails to make the
2004r equisite stops during rush hours to be considered a qualifying
2015route. However, it contends that Route 11 functionally serves
2024as two distinct routes b ecause it has two separate destinations:
2035the Mall of the Americas and Florida International University
2044Pa rk Campus . But whether Route 11 is a single route or two
2058routes is a determination that must be made by the local
2069government , and not the applicant. Mr. Bryan testified that the
2079Authority established Route 11 as a single route with two
2089separate terminati on points . He further explained that it is a
2101standard practice for a single route , such as Route 11, to have
2113more than one terminus in order to provide a higher level of
2125customer service. Because Florida Housing does not second guess
2134the determination of the local government, the undersigned has
2143rejected Rio 's assertion that the bus stop is a Public Bus
2155Transfer Stop. Without the inclus ion of the six proximity
2165points for this type of t ransit s ervice , Rio's application is
2177not eligible for funding in this cycle .
2185CONCLUSIONS OF LAW
218817 . P innacle's protest to Florida Housing's proposed
2197contract award is governed by section 120.57(3)(f), as follows:
2206In a competitive - procurement protest, other
2213than a rejection of all bids, proposals, or
2221replies, the administr ative law judge shall
2228conduct a de novo proceeding to determine
2235whether the agency's proposed action is
2241contrary to the agency's governing statutes,
2247the agency's rules or policies, or the
2254solicitation specifications. The standard
2258of proof for such proceed ings shall be
2266whether the proposed agency action was
2272clearly erroneous, contrary to competition,
2277arbitrary, or capricious.
228018 . Pinnacle has the burden of proof to establish that
2291Florida Housing's proposed action is : (1) contrary to its
2301governing statute s , (2) contrary to its rules or policies, or
2312(3) contrary to the RF A specifications. Pinnacle's formal
2321protest alleges that the scoring of Rio's application is
2330contrary to the RFA specifications.
233519 . To prevail, P innacle must prove , by a preponderance of
2347the evidence, that Florida Housing's proposed action is: (1)
2356clearly erroneous; (2) contrary to competition; or (3) arbitrary
2365or capricious, that is, an abuse of discretion. See, e.g. ,
2375R.N. Expertise, Inc. v. Miami - Dade Cnty. Sch. Bd. , Case
2386No. 01 - 2663BID (Fla. DOAH Feb. 4, 2002; Sch. Bd. Miami - Dade
2400Mar. 20, 2002). The formal protest asserts that the proposed
2410action is clearly erroneous and contrary to competition.
24182 0 . Agency action will be found to be clearly erroneous if
2431it is without ration al support and , consequently, the
2440Administrative Law Judge has a "definite and firm conviction
2449that a mistake has been committed." U.S. v. U.S. Gypsum Co. ,
2460333 U.S. 364, 395 (1948).
24652 1 . An act is contrary to competition if it (1) creates
2478the appearance o f opportunity for favoritism; (2) erodes public
2488confidence that contracts are awarded equitably and
2495economically; (3) causes the procurement process to be genuinely
2504unfair or unreasonably exclusive; or (4) is unethical,
2512dishonest, illegal, or fraudulent. Syslogic Tech. Servs., Inc.
2520v. S. Fla. Water Mgmt. Dist. , Case No 01 - 4385BID (Fla. DOAH
2533Jan. 18, 2002), modified in part , Case No. 2002 - 051 (SFWMD
2545Mar. 6, 2002).
25482 2 . For the reasons previously found, t he proximity
2559scoring for Rio upon which the prelimi nary allocation was based
2570i s clearly erroneous and contrary to the RFA specifications.
2580The deviation from specifications is not a minor irregularity.
2589To allow the initial scoring for Rio to stand would not only be
2602contrary to the RFA, it would be contrar y to competition and
2614give Rio a competitive advantage . The agency itself agrees that
2625the preliminary scoring of Rio's application was incorrect.
2633Pinnacle has satisfied its burden of proof.
26402 3 . With the correction of scoring, Rio is ineligible for
2652fundin g, and Pinnacle should be moved into the funding range.
2663RECOMMENDATION
2664Based on the foregoing Findings of Fact and Conclusions of
2674Law, it is
2677RECOMMENDED that the Florida Housing Finance Corporation
2684enter a final order finding that Rio 's application is inel igible
2696for funding and that Pinnacle's application should be selected
2705for funding under RFA 2014 - 116.
