115STATEMENT OF THE ISSUE S
120Whether Petitioner, Gateway Farms, LLC, is entitled to
128payment from Landscape Servi ce Professionals, Inc., and the
137Gray Insurance Company, as Surety, pursuant to sections 604.15
146through 604.34, Florida Statutes (2015), for the purchase of
155trees; and, if so, in what amount.
162PRELIMINARY STATEMENT
164On May 1, 2015, Gateway Farms, LLC (Gateway ), filed an
175Agricultural Products Dealer Clai m Form (claim) with the
184Florida Department of Agriculture and Consumer Services
191(Department), alleging that Landscape Service Professionals,
197Inc. (Landscape) , and its surety, The Gray Insurance Company
206(Insuranc e Company), owed Gateway payment for slas h pine,
216bald cypress, and sable palm trees supplied by Gateway. The
226claim was for a total of $13,462.30, 1/ which included shipping
238costs for the trees and applicable taxes. Gateway is also
248claiming a $50.00 filing fee for filing the claim. The
258Department provided Notice of the claim to Landscape and the
268Insurance Company. Respondent Landscape answered the Complaint
275on June 5 , 2015 . By letter dated June 26 , 2015 , the Department
288referred the matter to the Division to schedule an evidentiary
298hearing.
299The matter was initially sch eduled for hearing on
308September 11, 2015, in Gainesville, Florida. The final hearing
317was continued once, and at the request of Landscape, was
327rescheduled for a video teleconference hearing on December 9 ,
3362015 .
338At the final hearing , Gateway presented the testimony of
347its owner, David Hajos , and offered two exhibits in evidence.
357Respondents presented the testimony of Sandra Benton,
364Guy Michaud, and John Harris, who was accepted as an expert.
375Respondents offered 14 exhibits in evidence.
381At the conclusion of the hearing , the parties agreed that
391proposed recommended orders would be due 10 days following the
401filing of the official hearing transcript at the Division. The
411one - volume final hearing Transcript was filed on January 20,
4222016. Respondents timely filed their P roposed R ecommended O rder
433(PRO) by the established deadline, February 1, 2016. Twe n ty - two
446days later, on February 23, 2016, Petitioner filed its PRO.
456PetitionerÓs PRO was not tim ely filed, and accordingly, has not
467been considered in the preparation of this Recommended Order.

489FINDING S OF FACT
493The Parties
4951 . Gateway is a producer and seller of ag ricultural
506products, including slash pine trees. Gateway operates tree
514farms on 200 acres in five different locations in Columbia,
524Alachua, and Suwannee Counties. David Hajos is the owner and
534principal operator of Gateway.
5382 . Mr. Hajos has 17 years of e xperience in growing,
550harvesting, and selling pine and other species of trees in
560Florida.
5613 . Respondent Landscape is a Florida licensed dealer in
571agricultural products, pursuant to chapter 604. Landscape is a
580full - service landscape business located in Tamarac, Florida.
589Sandy Benton has been the president of Landscape for 18 years.
6004 . Respondent , Insurance Company , filed a denial of the
610claim and was represented at hearing by LandscapeÓs counsel.
6195 . Gateway has been doing business with Landscape f or many
631years, with no indication of prior problems relating to the
641quality of trees provided. Lynn Griffith, LandscapeÓs plant and
650soil expert, considers Gateway to be a competent and
659professional grower.
661The Setting
6636 . At all relevant times, Landscape was a contractor
673responsible for installing landscaping at the Palm Beach County
682Solid Waste Authority (SWA) site on Jog Road in Palm Beach
693County, Florida.
6957 . Pursuant to orders placed by Landscape, Gateway sold a
706total of 148 slash pines for use at th e SWA site. The invoices
720for those pines are dated Januar y 22 and 23, and February 9
733and 16, 2015. Upon their arrival at the site, authorized
743personnel of Landscape received, inspected, and accepted the
751148 slash pine trees. No problems or concerns were expressed
761regarding the delivery or condition of the slash pines.
770The Dispute Giving Rise to this Proceeding
7778 . Between 20 and 30 of the trees ordered from Gateway
789were intended as replacement trees for the approximately
797150 slash pines provided by six o ther vendors that had been
809planted by Landscape, and then died. When the dead trees were
820removed by Landscape , pine beetles were observed infesting the
829trees.
8309 . Within several weeks of planting, 58 of the slash pines
842purchased from Gateway began to show signs of decline, resulting
852in their eventual death. La ndscape consulted with the
861Palm Beach County Extension Service and industry professionals
869as to the cause of the death and decline of the slash pine
882trees, who undertook an investigation into the sam e.
89110 . Slash pine trees are very sensitive and can be easily
903stressed. Stress can be caused by a variety of factors
913including: transplanting; harsh handling; bark exposure to
920sunlight, including superficial wounds to the bark; too much or
930too little wa ter; or planting too deeply. The stress will cause
942a tree to emit chemicals that attract beetles, which inhabit the
953trees and may kill a stressed tree within a week or two of the
967infestation.
96811 . In March 2015, Lynn Griffith, an agricultural
977consultant, conducted an SWA site visit. Mr. Griffith noted
986that a majority of the planted pines were healthy, but there
997were some that were not doing well; some had holes in them
1009indicative of a pine beetle infestation.
101512 . In h is report dated March 12, 2015, M r . Griffith
1029opined on the impact of the ambrosia (pine) beetle infestation
1039on the slash pines:
1043The quantities of boreholes in some of the
1051dead or declining pines would lead me to
1059conclude that borers could be a primary
1066cause of death, but in other cases the
1074number of holes was low, indicating the pine
1082decline was initiated by other factors.
108813 . In an e - mail dated April 24, 2015, Ms. Benton advised
1102Gateway (and JWD Trees, another supplier of slash pines to the
1113SWA site) that the cause of the death and declin e of the
1126slash pine trees w ere because the two suppliers failed to
1137properly prepare them in the nursery, and had sold them to
1148Landscape with root systems inadequate to support the normal
1157performance of the plant.
116114 . At hearing, Ms. BentonÓs opinion regar ding the cause
1172of death of the pines was echoed by John Harris, accepted as an
1185expert in landscape economics and arborism. Mr. HarrisÓ s
1194opinion centered on only one possible explanation for the treesÓ
1204demise: a failure to have an adequate root system or an
1215inability of the roots to generate new growth. Typically, this
1225is caused by improper Ðhardening offÑ of the root system by the
1237grower. However, on cross - examination , Mr. Harris acknowledged
1246that while pine beetles typically infest stressed trees, if t he
1257beetle population builds up enough in an area they will attack
1268otherwise healthy trees.
127115 . At hearing , Mr. Hajos testified that the pine trees he
1283supplied to Landscape had been properly hardened off for a
1293period of six weeks:
1297Hardened off is a process when you dig a
1306tree and you hold it until it starts to
1315regenerate new roots, so instead of just
1322digging it up and selling it we dig it up
1332and hold it under optimal irrigation and
1339nursery conditions before we ship the tree.
134616 . Mr. Hajos further testifie d that any trees that are
1358going to die due to the stress of being dug out of the ground
1372will die during the hardening off process.
137917 . Mr. Hajos attributed the death of the Gateway trees to
1391several factors, including stress caused by improper lifting of
1400t he trees during loading and unloading, stress caused by a delay
1412in planting the trees after they arrived at the SWA site, and
1424the pre - existing pine beetle infestation.
143118 . Mr. Hajos examined a photograph received in evidence
1441and explained that it showed a tree being improperly lifted by
1452Landscape personnel during unloading. The photograph showed the
1460strap around the tree trunk doing the primary lifting. The
1470result is that rather than distributing the pressure between the
1480trunk and the strap on the root b all, the root ball will be
1494loosened , which will stress the tree.
150019 . Mr. Hajos testified that he was aware that the
1511Gateway trees that had been delivered to the SWA site were left
1523on the ground for days before being planted. This testimony was
1534corrobora ted by LandscapeÓs Daily Job Report log which reflected
1544the delivery of the first load of Gateway pines to the SWA site
1557on January 23 and 24, 2015, but that planting of those trees did
1570not begin until January 29 , 2015 .
157720 . On one occasion , a Landscape tru ck that had picked up
1590trees from Gateway , broke down in Ocala on its return trip to
1602Palm Beach County and had to ret urn to the Gateway site in
1615High Springs. There , the trees were unloaded, and then reloaded
1625onto a different truck where they were delivered two days later
1636to the SWA job site. This inordinate delay and additional
1646loading and unloading further stressed the trees.
165321 . Once Landscape became aware that it had a beetle
1664infestation at the SWA site, it began a preventative spray
1674program. However, once a pine beetle has entered the bark of a
1686pine tree preventative spraying will be ineffective at
1694eradicating the pest. Newly planted pine trees at the SWA site
1705were not sprayed on the day of planting, thereby providing the
1716pine beetles an opportunity to infest the new trees.
172522 . Guy Michaud was Landscape Ós job foreman at the
1736SWA site. Mr. Michaud has been in the business of planting
1747trees since 1983, and has worked for Landscape for 14 years.
1758Mr. Michaud could not testify with certainty that the Gat eway
1769trees died of inadequate roots, as opposed to a beetle
1779infestation.
178023 . None of the other species of trees sold by Gateway for
1793use at the SWA site experienced problems.
180024 . Based on the totality of the evidence, it is more
1812likely than not that a com bination of factors contributed to the
1824SWA slash pine deterioration, including delays in planting the
1833trees after delivery, rough handling, and the beetles. None of
1843these causes are attributable to the actions of Gateway.
1852Likewise, the greater weight of the evidence does not support a
1863conclusion that the trees sold by Gateway to Landscape were non -
1875viable nursery stock.
187825 . Subsequent to filing its claim in the amount of
1889$13,462.30 with the Department, Gateway received a payment of
1899$5,528.84 from Landscap e. Thus, the unpaid balance due Gateway
1910for the 58 slash pines is $7,933.46.
191826 . Gateway is entitled to payment in the amount of
1929$7,933.46 for the slash pine trees it provided to Landscape.
1940Besides the amount set forth above, Gateway claims the sum of
1951$ 50.00 paid for the filing of the claim against Landscape and
1963its bond. The total sum owed to Gateway by Landscape is
1974$7,983.46.
1976CONCLUSIONS OF LAW
197927 . The Division has jurisdiction over the parties and the
1990subject matter of this proceeding. §§ 120.569, 120.57(1),
1998and 604.21(6), Fla. Stat.
200228 . The Department is the state agency responsible for
2012licensing dealers in agricultural products and investigating and
2020taking action on complaints against such dealers. §§ 604.15
2029through 604.34, Fla. Stat.
203329 . The d efinition of Ðagricultural productsÑ includes the
2043Ðnatural products of the . . . farm [and] nursery . . . produced
2057in the state[.]Ñ £ 604.15(1), Fla. Stat. The trees produced
2067and sold by Gateway are Ðagricultural productsÑ within the
2076meaning of section 6 04.15(1).
208130 . The definition of a Ðdealer in agricultural productsÑ
2091includes any, Ðcorporation . . . engaged within this state in
2102the business of purchasing, receiving, or soliciting
2109agricultural products from the producer . . . for resale or
2120processing f or sale[.]Ñ £ 604.15(1), Fla. Stat. Landscape is a
2131dealer in agricultural product s within the meaning of
2140section 604.15(1).
214231 . Any business claiming to be damaged by any breach of
2154the conditions of an agreement made with a dealer in
2164agricultural produc ts may file a complaint with the Department
2174against the dealer and against the surety company. See
2183§ 604.21(1)(a), Fla. Stat.
218732 . The burden of proof in an administrative proceeding is
2198on the party asserting the affirmative of an issue. DepÓt of
2209Banking & Fin. v. Osborne, Stern & Co. , 670 So. 2d 932 (Fla.
22221996); Ferris v. Turlington , 510 So. 2d 292 (Fla. 1987);
2232Evans Packing Co. v. DepÓt of Agric. & Consumer Servs. , 550 So.
22442d 112 (Fla. 1st DCA 1989). In this case, Petitioner must prove
2256by a preponderan ce of the evidence that it provided goods or
2268services to Respondent and that Respondent failed to pay for
2278such goods or services.
228233 . Gateway bears the burden of proving the allegations of
2293its complaint by a preponderance of the evidence. See DepÓt of
2304Ba nking & Fin. v. Osborne Stern & Co. , supra (ÐThe general rule
2317is that a party asserting the affirmative of an issue has the
2329burden of presenting evidence as to that issue.Ñ); DepÓt of
2339Transp. v. J.W.C. Co. , 396 So. 2d 778, 788 (Fla. 1st DCA 1981);
2352Vero Bea ch Land Co., LLC v. IMG Citrus, Inc. , Case No. 08 - 5435
2367(Fla. DOAH Mar. 4, 2009; Fla. DACS July 20, 2009), affÓd ,
2378IMG Citrus, Inc. v. Westchester Fire Ins. Co. , 46 So. 3d 1014
2390(Fla. 4th DCA 2010).
239434 . Gateway has satisfied its burden. As set forth in the
2406Findings of Fact, Respondent , Landscape , owes Gateway $7,933.46
2415for 58 slash pine trees.
242035 . Gateway additionally seeks recovery of the filing fee
2430paid to the Department for the claim filed against Respondents
2440on May 1, 2015. Gateway paid a $50 filing fe e, which is
2453specifically recoverable against Respondent. See
2458§ 604.21(1)(a), Fla. Stat. (ÐIn the event the complainant is
2468successful in proving the claim, the dealer in agricultural
2477products shall reimburse the complainant for the $50 filing fee
2487as part o f the settlement of the claim.Ñ).
2496RECOMMENDATION
2497Based on the foregoing Findings of Fact and Conclusions of
2507Law, it is RECOMMENDED that a final order be entered by the
2519Department of Agriculture and Consumer Services a pproving the
2528claim of Gateway Farms, LL C, against Landscape Professional
2537Services, Inc., in the total amount of $7,983.46 ($7,933.46 plus
2549$50 filing fee); and if Landscape Professionals Services, Inc.,
2558fails to timely pay Gateway Farms, LLC, as ordered, that
2568Respondent, The Gray Insurance Compa ny, as Surety, be ordered to
2579pay the Department of Agriculture and Consumer Services as
2588required by section 604.21, Florida Statutes, and the Department
2597reimburse the Petitioner as set out in section 604.21, Florida
2607Statutes.
