238Statement s . The petition seeks a ruling th at the document known
251as " CMSN Clinical Eligibility Screening Guide (Version 12), " is
260an unadopted rule. On June 30, 2015, the undersigned was
270assigned t his case.
274On July 1, 2015, a telephonic status conference was held
284with counsel for the parties . Du ring the conference, good cause
296was established to allow for the set ting of the final hearing
308date more than 30 days after the assignment of this matter to the

874(1) Eligibili ty for the Children ' s Medical
883Services program is based on the diagnosis of
891one or more chronic and serious medical
898conditions and the family ' s need for
906specialized services.
908(2) The following individuals are eligible
914to receive services through the prog ram:
921(a) A high - risk pregnant female who is
930enrolled in Medicaid.
933(b) Children with serious special health
939care needs from birth to 21 years of age who
949are enrolled in Medicaid.
953(c) Children with serious special health
959care needs from birth to 19 y ears of age who
970are enrolled in a program under Title XXI of
979the Social Security Act.
983(3) Subject to the availability of funds,
990the following individuals may receive
995services through the program:
999(a) Children with serious special health
1005care needs fr om birth to 21 years of age who
1016do not qualify for Medicaid or Title XXI of
1025the Social Security Act but who are unable to
1034access, due to lack of providers or lack of
1043financial resources, specialized services
1047that are medically necessary or essential
1053family support services. Families shall
1058participate financially in the cost of care
1065based on a sliding fee scale established by
1073the department.
1075( b) Children with special health care needs
1083from birth to 21 years of age, as provided in
1093Title V of the Social Se curity Act.
1101(c) An infant who receives an award of
1109compensation under s. 766.31(1). The Florida
1115Birth - Related Neurological Injury
1120Compensation Association shall reimburse the
1125Children ' s Medical Services Network the
1132state ' s share of funding, which must
1140thereafter be used to obtain matching federal
1147funds under Title XXI of the Social Security
1155Act.
1156(4) Any child who has been provided with
1164surgical or medical care or treatment under
1171this act prior to being adopted and has
1179serious and chronic special heal th needs
1186shall continue to be eligible to be provided
1194with such care or treatment after his or her
1203adoption, regardless of the financial ability

4910CONCLUSIONS OF LAW
49133 3 . DOAH has jurisdiction over the parties and subject
4924matter of this proceeding pursuant to section 120.56(4 ) , Florida
4934Statutes.
49353 4 . Section 120.56(4)(a) authorizes any person who is
4945substantially affected by an agency statement to seek an
4954administrative determination that the statement is actually a
4962rule whose existence violates section 120.54(1)(a) because the
4970a gency has not formally adopted the statement. Section
4979120.54(1)(a) declares that " [r]ulemaking is not a matter of
4988agency discretion " and directs that " [e]ach agency statement
4996defined as a rule by s. 120.52 shall be adopted by the rulemaking
5009procedure prov ided by this section as soon as feasible and
5020practicable. "
502135 . Section 120.52(16) defines the term " rule , " in
5030pertinent part, as :
5034each agency statement of general
5039applicability that implements, interprets, or
5044prescribes law or policy or describes the
5051p rocedure or practice requirements of an
5058agency and includes any form which imposes
5065any requirement or solicits any information
5071not specifically required by s tatute or by an
5080existing rule.
50823 6 . To be a rule, a statement of general applicability must
5095operat e in the manner of a law. Thus, a n agency statement is
" 5109generally applicable " if it is intended by its own effect to
5120create rights, or to require compliance, or otherwise to have the
5131direct and consistent effect of law. Coventry First, LLC v. Off .
5143of Ins . Reg . , 38 So. 3d 200 , 203 (Fla. 1st DCA 2010); Jenkins v.
5159State , 855 So. 2d 1219 , 1225 (Fla. 1st DCA 2003) .
517037. Section 120.56(4)(c) authorizes the administrative law
5177judge ("ALJ") to enter a final order determining that all or part
5191of a challenged state ment violates section 120.54(1)(a). The ALJ
5201is not authorized to decide, however, whether the statement is an
5212invalid exercise of delegated legislative authority as defined in
5221section 120.52(8)(b) through (f). Thus, in a section 120.56(4)
5230proceeding, it is not necessary or even appropriate for the ALJ to
5242decide whether an unadopted rule exceeds the agency ' s grant of
5254rulemaking authority, for example, or whether it enlarges,
5262modifies, or contravenes the specific provisions of law
5270implemented, or is otherwi se " substantively " an invalid exercise
5279of delegated legislative authority.
52833 8 . Section 120.56(4) is forward - looking in its approach.
5295It is designed to prevent future or recurring agency action based
5306on an unadopted rule, not to provide relief from final agency
5317action that has already occurred. Thus, if a violation is found,
5328the agency must, pursuant to section 120.56(4)(d), " immediately
5336discontinue all reliance upon the statement or any substantially -
5346similar statement as a basis for agency action. " See, e.g. , Ag.
5357for Health Care Admin. v. HHCI Ltd. , 865 So. 2d 593, 596 (Fla.
53701st DCA 2004).
537339. In Jenkins v. State , 855 So. 2d 1219 (Fla. 1st DCA
53852003) , the Florida Department of Law Enforcement ' s ( " FDLE " )
5397certificate of accuracy ( " COA " ) form that contained standards for
5408the proper concentrations of alcohol breathalyzer testing
5415solutions was challenged as an unadopted rule. The court held
5425that the creation and use of the COA form was an unadopted rule
5438because it included definitive policies of general appli cation
5447utilized by FDLE in determining the accuracy of stock solutions
5457which, in turn, affect ed the rights of DUI defendants. Id . at
54701225.
547140 . In Dep artment of Bus iness Reg ulation v. Martin County
5484Liquors , 574 So. 2d 170 (Fla. 1st DCA 1991), the Departme nt of
5497Business Regulation, Division of Alcoholic Beverages and Tobacco
5505( " DABT " ), required applicants for an alcoholic beverage license to
5516complete an application, consisting of eight questions which could
5525be answered yes or no regarding the type of busines s premises, its
5538location and ownership. The application also required the
5546submission of information regarding any rental, lease, or sublease
5555agreements and documents to support the financial arrangements for
5564the premises at which the license would be util ized.
55744 1 . Although a statute gave DABT the authority to
5585investigate applications both as to the qualifications of
5593applicants and as to the premises and location to be licensed,
5604there was no specific stat utory authority explicitly requiring an
5614applicant to provide right - of - occupancy information or submit
5625documentation supporting financial arrangements. Id . at 173.
5633Accordingly, the court held that DABT ' s requirement that an
5644applicant file right - of - occupancy information and submit
5654documentation verifying any financial arrangements met the
5661definition of a rule, and was illegal because it was not adopted
5673through formal rulemaking procedures. Id .
56794 2 . In Dep artment of Rev enue v. Vanjaria Enters , 675 So. 2d
5694252 (Fla. 5th DCA 1996), the Department of Revenue ( " DOR " )
5706purported to subject a taxpayer to sales tax based on calculations
5717pursuant to a procedure set forth in its sale s and use tax
5730training manual. The court held that DOR ' s tax assessment
5741procedure was a " rule " because it was a " statement of general
5752ap plicability that implements, interprets, or prescribes law or
5761policy. " Id . at 255. Specifically, the court found that DOR ' s
5774tax assessment procedure created its entitlement to taxes while
5783adversely affecting property owners, with the training manual
5791bein g the sole guide for auditors in their assessment of multiple -
5804use properties. In determining exempt versus nonexempt uses of
5813multiple - use properties, DOR ' s auditors strictly complied with the
5825procedure set forth in the training manual for all audits
5835perfo rmed. Moreover, DOR auditors were not afforded any
5844discretion to take action outside the scope of the training
5854manual . Id .
58584 3 . Turning to the instant case, the undisputed facts
5869demonstrate that the Screening Tool meets the definition of a
5879rule because i t is a statement of general applicability that
5890implements, interprets, or pr e scribes law or policy. Th e
5901undisputed facts demonstrate that the Department created the
5909Screening Tool to ensure that children enrolled in the CMSN Plan
5920meet the clinical criteri a for participation in the plan. The
5931Screening Tool sets forth specific criteria to determine
5939eligibility. The Screening Tool is the primary instrument used
5948to determine ongoing CMSN eligibility ; yet , it has not been
5958adopted through rulemaking procedures .
59634 4 . A ll current and potential participants in the CMSN Plan
5976must be screened to determine their clinical eligibility for the
5986CMSN Plan using the Screening To o l . The questions in the
5999Screening Tool cannot be altered or amended in any way by the
6011n urse c a re c oordinators.
60184 5 . Because the Screening Tool determines clinical
6027eligibility for all current and potential participants in the
6036CMSN Plan, the tool directly affects the rights of such persons.
60474 6 . In its P roposed Final Order, t he Department does not
6061ar gue that the Screening Tool is not a rule . Nor does the
6075Department contend that rulemaking is not feasible or
6083practica b l e .
60884 7 . Instead, the Department contends there is no need for
6100it to engage in rulemaking , because the Screening Tool is exempt
6111from the rulemaking requirements in c hapter 120.
61194 8 . According to the Department , because the Contract is
6130exempt from rulemaking pursuant to section 409.961, and the
6139Contract requires the creation and use of an AHCA - approved
6150screening tool for determining Medicai d eligibility for the CMSN
6160Plan , it therefore follows that the Screening Tool is exempt from
6171rulemaking.
617249 . The Department ' s reliance on section 409.961 is
6183misplaced. Section 409.961 provides as follows:
6189409.961 Statutory construction;
6192applicability ; rules . --
6196It is the intent of the Legislature that if
6205any conflict exists between the provisions
6211contained in this part and in other parts of
6220this chapter, the provisions in this part
6227control. Sections 409 . 961 - 409.985 apply only
6236to the Medicaid managed medical assistance
6242program and long - term care managed care
6250program, as provided in this part. The
6257agency shall adopt any rules necessary to
6264comply with or administer this part and all
6272rules necessary to comply with federal
6278requirements. In addition, the department
6283shall adopt and accept the transfer of any
6291rules necessary to carry out the department ' s
6300responsibilities for receiving and processing
6305Medicaid applications and determining
6309Medicaid eligibility and for ensuring
6314compliance with and administering this part,
6320as those rules relate to the department ' s
6329responsibilit ies, and any other provisions
6335related to the department's responsibility
6340for the determination of Medicaid
6345eligibility. Contracts with the agency and a
6352person or entity, including Medicaid
6357providers and managed care plans, necessary
6363to administer the Medicaid program are not
6370rules and a re not subject to chapter 120.
63795 0 . Co ntrary to the Department ' s contention, the exemption
6392from rulemaking with regard to the C ontract itself does not
6403extend to statements of general applicability (which meet the
6412definition of a rule) required to be created by th e C ontract.
6425There is a distinction between a rule and a contract, which the
6437Legislature envisioned when it enacted section 409.961. 2/
6445ORDER
6446Based on the foregoing Findings of Fact and Conclusions of
6456Law, it is ORDERED that the Children ' s Medical Services Network
6468( " CMSN " ) Clinical Eligibility Screening Guide (Version 12)
6477constitutes an unadopted rule whose existence violates
6484section 120.54(1) ( a), Flori da Statutes, because the statement has
6495not been adopted through formal rulemaking procedures.
6502Respondent, D epartment of Health , is hereby ordered to
6511immediately cease using the Screening Tool as a method of
6521determining eligibility.
