80STATEMENT OF THE CASE

84On June 23, 2015, Petitioner, Jerra Myrick, individually and

93as natural parent of Jamyrah DeBose (Jamyrah), a minor, filed a

104Petition Under Protest Pursuant to Florida Statutes Section

112766.301 et seq. (Petition) with the Division of Administrative

121Hearings (DOAH) for a determination of compensability under the

130Florida Birth - Related Neurological Injury Compensation Plan

138(Plan). The Petition named Lai la B. Needham, M.D., as the

149physician who provided obstetric services for the birth of

158Jamyrah at Putnam Community Medical Center in Palatka, Florida,

167on March 27, 2014.

171DOAH served NICA with a copy of the Petition on July 1,

1832015. DOAH served a copy of t he Petition on Putnam Community

195Medical Center on July 1, 2015. The website of the United States

207Postal Service shows that Laila B. Needham, M.D., was served a

218copy of the Petition on July 6, 2015.

226On July 15, 2015, Putnam Community Medical Center filed a

236Petition to Intervene, which was granted by Order dated July 24,

2472015. As of the date of the Summary Final Order of Dismissal,

259Dr. Laila B. Needham has not petitioned to intervene in this

270proceeding.

271On November 6, 2015, NICA filed a Motion for Summary F inal

283Order, requesting that a summary final order be entered finding

293that the claim was not compensable because Jamyrah did not meet

304the requisite minimum statutory birth weight as required by

313section 766.302(2), Florida Statutes. On November 18, 2015, a

322Stipulated Motion for Extension of Time to Respond to

331RespondentÓs Motion for Summary Final Order was filed. The

340Motion was granted by Order dated November 18, 2015.

349IntervenorÓs Opposition to RespondentÓs Motion for Summary

356Final Order was filed on Nove mber 24, 2015.

365FINDINGS OF FACT

3681. Jamyrah DeBose was born on March 27, 2014, at Putnam

379Community Medical Center in Palatka, Florida. She was a single

389gestation.

3902. NICA attached to its motion a c ertification of medical

401records signed by the Director of Medical Records from Putnam

411Community Medical Center, and a one - page medical record for

422Jamyrah. The medical record shows that Jamyrah was a single

432gestation and her birth weight was less than 2,500 grams.

4433. A review of the file reveals that no cont rary evidence

455was presented to dispute the medical record from Putnam Community

465Medical Center showing that JamyrahÓs birth weight was less than

4752,500 grams.

4784. It its Opposition to RespondentÓs Motion for Summary

487Final Order, Intervenor acknowledged t hat Jamyrah weighed 2 , 240

497grams at birth.

5005. Intervenor attached to its response in opposition to

509NICAÓs Motion an affidavit of Frederick E. Harlass, M.D., who

519opined that the statutory requirement of a babyÓs birth weight of

5302 , 500 grams is unreasonable and arbitrary, especially in light of

541PetitionerÓs small stature and pre - pregnancy weight of 125

551pounds.

552CONCLUSIONS OF LAW

5556. The Division of Administrative Hearings has jurisdiction

563over the parties to and the subject matter of these proceedings.

574§§ 766.301 - 766.316, Fla. Stat.

5807. The Plan was established by the Legislature "for the

590purpose of providing compensation, irrespective of fault, for

598birth - related neurological injury claims" relating to births

607occurring on or after January 1, 1989. § 766.3 03(1), Fla. Stat.

6198. The injured infant, her or his personal representative,

628parents, dependents, and next of kin may seek compensation under

638the Plan by filing a claim for compensation with DOAH.

648§§ 766.302(3), 766.303(2), and 766.305(1), Fla. St at. NICA,

657which administers the Plan, has "45 days from the date of service

669of a complete claim . . . in which to file a response to the

684petition and to submit relevant written information relating to

693the issue of whether the injury is a birth - related neu rological

706injury." § 766.305(4), Fla. Stat.

7119. NICA has determined that Petitioner does not have a

721claim that is compensable under the Plan and has filed a Motion

733for Summary Final Order, requesting that an order be entered

743finding that the claim is no t compensable.

75110. In ruling on the motion, the a dministrative l aw j udge

764must make the following determination based upon the available

773evidence:

774(a) Whether the injury claimed is a birth -

783related neurological injury. If the claimant

789has demonstrated, to the satisfaction of the

796administrative law judge, that the infant has

803sustained a brain or spinal cord injury

810caused by oxygen deprivation or mechanical

816injury and that the infant was thereby

823rendered permanently and substantially

827mentally and physically impaired, a

832rebuttable presumption shall arise that the

838injury is a birth - related neurological injury

846as defined in s. 766.303(2).

851§ 766.309(1), Fla. Stat.

85511. The term "birth - related neurological injury" is defined

865in section 766.302(2) as follows:

"870Birth - related neurological injury" means

876injury to the brain or spinal cord of a live

886infant weighing at least 2,500 grams for a

895single gestation or, in the case of a

903multiple gestation, a live infant weighing at

910least 2,000 grams at birth caused by oxyge n

920deprivation or mechanical injury occurring in

926the course of labor, delivery, or

932resuscitation in the immediate postdelivery

937period in a hospital, which renders the

944infant permanently and substantially mentally

949and physically impaired.

95212. The evidence , which is not refuted, established that

961Jamyrah was a single gestation and did not weigh at least 2,500

974grams at birth. Thus, Jamyrah did not sustain a birth - related

986neurological injury because s he did not meet the minimum

996statutory weight as set forth i n the definition of "birth - related

1009neurological injury," in section 766.302(2).

101413. Intervenor urges the undersigned should use her

1022Ðexclusive discretionÑ to not strictly adhere to the statutory

1031limitation of 2 , 500 grams, which Intervenor argues is a

1041tech nicality. Intervenor makes, in essence, an equitable

1049argument in that strict adherence to Ðan arbitrary weight limit

1059undermines the intent of the Legislature and the spirit of the

1070Plan, and will preclude a qualified candidate from the assistance

1080she will so desperately need.Ñ

108514. While Intervenor is correct in that the administrative

1094law judge has the exclusive jurisdiction to determine whether a

1104claim is compensable under the Plan, an administrative law judge

1114does not have the discretion to ignore a cle ar, statutory

1125requirement. An administrative agency has only such power as

1134granted by the L egislature and may not expand its jurisdiction.

1145Rinella v. Abifaraj , 908 So. 2d 1126 (Fla. 1 st DCA 2005).

1157Administrative law judges, as employees of an executive br anch

1167agency, have neither equitable powers nor the authority to decide

1177constitutional issues. Palm Harbor Special Fire Control Dist. v.

1186Kelly , 516 So. 2d 249, 250 (Fla. 1987); Dade Cnty. v. Overstreet ,

119859 So. 2d 862 (Fla. 1952).

1204CONCLUSION

1205Based upon t he foregoing Findings of Fact and Conclusions of

1216Law, it is ORDERED that the Petition filed by Jerra Myrick,

1227individually and as natural parent of Jamyrah DeBose, a minor, is

1238dismissed with prejudice.

1241DONE AND ORDERED this 7th day of December , 2015 , in
