119Whether the Petitioner correctly cited the Respondent with

127a Class I violation when the Respondent left an unscreened

137individual to supervise children in the Respondent Ós care , and ,

161termination of the Respondent Ós Gold Seal designation.

169PRELIMINARY STATEMENT

171By Administrative Complaint dated March 17, 2015, the

179Petitioner , Department of Children and Families ( " Department"),

188informed KinderKids Learning Center and Preschool , II

195( " KinderKids " ) , of its C lass I violation. The complaint stated

207that " during a complaint inspection on 3/12/2015, the child care

217facility was cited for a Class I violation of Standard #5,

228Supervision Rule, as an unscreened individual, M. Perez was left

238alone to supervise children in care. The fine imposed fo r this

250Class I violation of 3/12/2015 is $100.00. " The Department also

260notified KinderKids that it was terminating its Gold Seal

269d esignation.

271KinderKids requested a hearing to contest the

278Administrative Complaint . On July 1, 2015 , the Department

287referred the matter to DOAH to conduct the hearing. The hearing

298was set for October 9, 2015. It was rescheduled to December 18,

3102015 , upon KinderKids ' agreed - to motion to continue. The

321hearing proceeded as rescheduled .

326A t the hearing, the Department presented the testimony of

336Yessenia Plata, family services counselor supervisor and former

344family services counselor. The Petitioner 's Exhibits 1 through

3534 were received into evidence. KinderKids presented the

361testimony of four witnesses: Fatima Zaldiba, KinderKids ' owner

370and d irect or; Elsita Jalil, KinderKids ' pre - kindergarten ( " pre -

384K " ) age three teacher ; Ra i my Coipel, KinderKids ' pre - K age four

400teacher ; and Tashie de Olma, KinderKids ' pre - K age four teacher .

414The proceedings of the hearing were recorded and

422transcribed. The one - volume Transcript was filed at DOAH on

433January 8, 2016. The parties stipulated to an extension of

443their proposed recommended order deadline, which the undersigned

451granted. Both parti es fil ed timely proposed recommended o rders.

462FINDINGS OF FACT

4651. KinderKids is a child care facility licensed by the

475Department as License No. C11MD1905 . KinderKids is located at

48526049 South Dixie Highway , Naranja, Florida 33032 .

4932. Fatima Zaldiba ("Zaldiba") owns and operates

502KinderKids . KinderKids has been in operation since January 1,

5122011. The Department awarded KinderKids a Gold Seal on July 11,

5232012 .

5253. KinderKids offers a full readiness program , infant

533care , and an aftercare program .

5394. On March 12, 2015, Zaldiba informed Raimy Coipel

548("Coipel"), the pre - K age four teacher and afternoon director ,

561that a volunteer was coming to the school. Zaldiba instructed

571Coipel to train and supervise the volunteer with the four - year -

584olds for two hours.

5885. Zaldiba introduced Coipel to the volunteer, Marilys

596Perez ("Perez"). Coipel took her 12 four - year - old children to

611the playground area with Perez around four thirty in the

621afternoon .

6236. Coipel left her 12 four - year - old children with Perez

636on the playground to go meet in the KinderKids ' office with

648Yessenia Plata ( " Plata " ), the DepartmentÓs then family service

658c ounselor . Coipel asked Elsita Jalil ("Jalil"), a background -

671screened pre - K teacher , to supervise Perez and her class while

683she went to the office. Jali l agreed to watch the volunteer and

696CoipelÓs class.

6987. Plata was assigned to conduct a complaint inspection at

708KinderKids regarding a child who allegedly cut his hand. Plata

718arriv ed at the school after four oÓclock in the afternoon . Upon

731her arrival, Plata met with Coipel and Zaldiba regarding the

741abuse complaint. Plata briefed them about the complaint and

750took their statements regard ing the complaint.

7578. Afterwards, Plata procee ded to walk the facility

766inspecting the center , go ing class - by - class checking the ratios

779of children. Plata took the ratios of the classes inside the

790building first.

7929. That same day Plata also checked the ratios of the

803children on the playground and Coipel escorted her around.

812Plata met Perez , the volunteer, who was outside on the

822playground watching CoipelÓs four - year - old class. Plata

832questioned Perez about the abuse complaint.

83810. Jalil met Perez for the first time on March 12, 2015,

850when Coipel asked Jalil to supervise Perez and her classroom

860outside on the playground. Jalil never left Perez or the four -

872year - olds alone. Jalil remained on the playground at the same

884time with her three - year - old class supervising Perez and the

897four - year - old class the whole time Perez was with the children

911while Coipel was away . 1 /

91811. After checking the ratios, Plata and Coipel returned

927to the KinderKids ' office . Plata requested the employee files

938for Coipel and Perez, the two new individuals working at

948KinderKids who had not been there at the time of the last

960inspection , so that she could update their background screening

969and training .

97212. Zaldiba provided Plata Coipel's file , including the

980requested background screening . Zaldiba informed Plata that she

989did not have a background screening for Perez because she was on

1001a trial period. Zaldiba even explained that she was n o t sure if

1015she was going to keep her. Plata responded by telling Zaldiba

1026that Perez had to leave the day care facility im mediately

1037because she did not have a background screening and that Coipel

1048should take over the care of the four - year - olds. Zaldiba

1061followed Plata's instructions and had Perez leave immediately .

107013. Plata informed Zaldiba th at she was going to give her

1082a C lass I violation for having an unscreened person left with

1094the children . Zaldiba explained to Plata that Perez was a

1105volunteer she was trying out to determine if she was going to

1117hire her at KinderKids . Zaldiba also tried to provide Plata

1128with PerezÓs Volunteer Acknowledgement Form , but Plata would not

1137accept it . 2/ Instead, Plata repeatedly requested a background

1147screening document for Perez, which Zaldiba did not have for

1157Perez.

115814. Since Plata had Zaldiba send Perez away from the

1168facility , Plata was unable to verify Perez's position with her

1178in person . Zaldiba tried to find PerezÓ s information and to

1190make contact with Perez in front of Plata but was not able to do

1204so .

120615. Plata requested a D epartment specialist in background

1215screening to run Perez Ós name and three individuals name d

1226Marilys Perez were found , but none of them looked like the

1237person she had talked to on the playground earlier.

124616. Plata determined that no indicators existed for the

1255abuse complaint and closed the case.

126117. Howe ver, Plata believed that Zaldiba came up with a

1272story about Perez being a volunteer and that it was never proven

1284to her , so she cited KinderKids wit h a C lass I violation.

129718. Perez was never paid for her volunteer work.

130619. On March 17, 2015, t he Department issued KinderKids an

1317Administrative C omplaint, citing the Respondent with a Class I

1327violation of Standard #5, Supervision Rule, charging the

1335facility with having Perez as an unscreened individual, left

1344alone to supervise children in their care . The Administrative

1354Complaint also terminated KinderKids Gold Seal designation.

136120. KinderKids contested the Administrative Complaint and

1368requested a hearing.

1371CONCLUSIONS OF LAW

137421. DOAH has jurisdiction over the parties to and the

1384subject matter of this proceeding pursuant to sections 120.569

1393and 120.57(1), Florida Statutes (2015) . 3/

140022. The Legislature has charged the Department with the

1409responsibility of licensing child care facilitie s , including the

1418administration of the Gold Seal Quality designation program.

1426§ 402.281, Fla. Stat.

143023. In a proceeding, such as this one where the Department

1441seeks to discipline the Respondent Ós license and/or to impose an

1452administrative fine, the Depar tment has the burden of proving

1462the allegations charged in the Administrative Complaint by clear

1471and convincing evidence. Dep't of Banking & Fin., Div. of Sec.

1482& Investor Prot. v. Osborne Stern & Co. , 670 So. 2d 932 (Fla.

14951996).

149624. The clear and convincing standard of proof has been

1506described by the Florida Supreme Court, as follows:

1514Clear and convincing evidence requires that

1520evidence must be found to be credible; the

1528facts to which the witnesses testify must be

1536distinctly remember ed; the testimony must be

1543precise and explicit and the witnesses must

1550be lacking in confusion as to the facts in

1559issue. The evidence must be of such weight

1567that it produces in the mind of the trier of

1577fact a firm belief or conviction, without

1584hesitancy, a s to the truth of the

1592allegations sought to be established.

1597In re Davey , 645 So. 2d 398, 404 (Fla. 1994) (quoting Slomowitz

1609v. Walker , 429 So. 2d 797, 800 (Fla. 4th DCA 1983)).

162025. At a minimum, the Department requires all child care

1630personnel to have a Level 2 background screening. The

1639Respondent is charged with a Class I violation and is alleged

1650to have violated the following s ection 402.305(2)(a) , Florida

1659Statutes , and Florida Administrative Code Rule 65C -

166722.006(4)(d)1 .

166926. Section 402.305(2)(a) provides in pertinent part :

1677(2) PERSONNEL. Ï Minimum standards for child

1684care personnel shall include minimum

1689requirements as to:

1692(a) Good moral character based upon

1698screening. This screening shall be

1703conducted as provided in chapter 435, using

1710the level 2 standards for screening set

1717forth in that chapter.

172127 . Rule 65C - 22.006(4)(d)1 . provides in pertinent part :

1733(d) Initial Screening. Screening

1737information must be documented on CF - FSP

1745Form 5131, July 2012, Background Screening

1751and Personnel File Requirements, which is

1757incorporated by reference and may be

1763obtained from the departmentÓs website

?1777No=Ref - 0303 0 . Screening includes the

1785following:

17861. Le vel 2 screening as defined in Section

1795435.04, F.S. For the purpose of issuing a

1803license, any out - of - state criminal offense,

1812which if committed in Florida, would

1818constitute a disqualifying felony offense,

1823shall be treated as a disqualifying felony

1830offense for screening purposes under this

1836rule.

183728. Rule 65C - 22.010(1)(d)1 . defines Class 1 violation and

1848provides in pertinent part:

1852(d) " Violation " means a finding of

1858noncompliance by the department or local

1864licensing authority of a licensing standard.

18701. " Class I Violation " is an incident of

1878noncompliance with a Class I standard as

1885described on CF - FSP Form 5316, July 2012.

? 1931No=Ref - 03034 . The effective date of a

1940termination of a providerÓs Gold Seal

1946Quality Care designation is the date of the

1954departmentÓs written notification to the

1959provider. Class I violations are the most

1966serious in nature, pose an imminent threat

1973to a child including ab use or neglect and

1982which could or does result in death or

1990serious harm to the health, safety or well -

1999being of a child.

200329. Section 402.281(4)(a) provides grou nds to terminate

2011the Gold Seal designation for a C lass I violation and states in

2024pertinent part:

2026(4) In order to obtain and maintain a

2034designation as a Gold Seal Quality Care

2041provider, a child care facility, large

2047family child care home, or family day care

2055home must meet the following additional

2061criteria:

2062(a) The child care provider must not have

2070had any class I violations, as defined by

2078rule, within the 2 years preceding its

2085application for designation as a Gold Seal

2092Quality Care provider. Commission of a

2098class I violation shall be grounds for

2105termination of the designation as a Gold

2112Seal Quality Care provider until the

2118provider has no class I violations for a

2126period of 2 years.

213030. In this case, the Department failed to prove by clear

2141and convincing evidence that Perez was an unscreened person

2150supervising children alone . Instead , the record demonstrates

2158that Perez was a volunteer under constant supervision by either

2168Coipel o r Jalil, two trained background - screened teachers, while

2179with the four - year - olds and not left alone. Therefore , the

2192record lacks any persuasive evidence that any imminent threat

2201existed for any of the children under volunteer PerezÓs

2210supervised care . Accordingly, Kin derKids did not commit a

2220Class I violation , and the record is void of evidence for the

2232termination of KinderKidsÓ Gold Seal designation.

2238RECOMMENDED

2239Based on the forgoing Findings of Fact and Conclusions

2248of Law, it is R E COMMENDED that the Petitioner , Department

2259of Children and Families, find KinderKids not guilty of

2268Violation 1: Class I violation Standard #5 , Supervision

2276Rule , and dismiss the Administrative Complaint.
