193P RELIMINARY S TATEMENT
197On Ju ly 10, 2015, Petitioner s filed a Petition Under Prote st Pursuant to
212Florida Statute Section 766.301 et seq. (Petition) with the DOAH for a
224determination of compensability under the Florida Birth - Related
233Neurological In jury Compensation Plan (Plan). The matter was initially
243assigned to Administrative Law Judg e (ALJ) Barbara J. Staros.
253The Petition named Franklyn Christensen, M.D. , and Athena
261Theodosatos, D.O., as the physicians who provided obstetric services at the birth of Jacob Frybarger (Jacob) on January 18, 2008, at Florida Hospital South/Orlando in Orl ando, Florida.
289On July 16, 2015, DOAH mailed a copy of the Petition to Respondent,
302Dr. Theodosatos, Dr. Christensen, and Florida Hospital Orlando by certified
312mail. Respondent was served with the Petition on or before July 17, 2015.
325On September 14, 2 015, Intervenors, Adventist Health Systems/Sunbelt,
334Inc., d/b/a Florida Hospital Orlando (Adventist Health) and Athena
343Theodosatos, M.D. filed a petition for leave to intervene, which was granted
355by Order dated September 24, 2015. On September 21, 2015, Fl orida
367Physicians Medical Group, Inc., d/b/a Center for Neonatal Care, Lewis Otero,
378M.D., Eduardo Lugo, M.D., D. Jim Rawlings, M.D., Winslade Bowen, M.D.,
389Hilton Bernstein, M.D., Ruth Bartleson, ARNP, and Dinorah Rodriguez - Warren, ARNP (Florida Physicians), filed a petition for leave to intervene,
410which was granted by Order dated October 2, 2015.
419Following several extensions of time to respond to the Petition, on
430October 28, 2015, Respondent filed its Response to the Petition. Respondent suggested that, ba sed on its review of the claim, Jacob had not suffered a
456birth - related neurological injury a s defined in section 766.302(2) and,
468therefore, the claim was not compensable under the Plan. Thereafter, on
479November 17, 2015, ALJ Staros issued a Notice of Hear ing wherein the final
493hearing was scheduled for May 24 and 25, 2016.
502On March 23, 2016, Petitioners filed a Motion for Summary Final Order.
514Said motion was denied on March 31, 2016. On April 21, 2016, the final
528hearing was rescheduled to February 8 and 9, 2017; and again rescheduled
540on December 5, 2016, to June 7 and 8, 2017.
550On February 14, 2017, Petitioners renewed their Motion for Summary
560Final Order , which, on February 23, 2017, was denied, without prejudice. On
572April 14, 2017, the parties filed an Agreed Motion to Reset the Final Hearing,
586which was granted on April 17, 2017. Ultimately, the final hearing was
598rescheduled to February 8 and 9, 2018.
605On September 5, 2017, the matter was reassigned to the undersigned for
617all further proceedings. Follo wing a telephonic case management conference
627conducted on February 2, 2018, based on the stipulation of the parties that
640additional time was necessary to complete discovery, the final hearing
650scheduled for February 8 and 9, 2018, was cancelled.
659The parti es thereafter continued to engage in extensive discovery.
669Intervenors Adventist Health filed a Motion for Partial Summary Final
679Order and Petitioners filed an Incorporated Motion for Summary Final Order
690on April 27 and May 22, 2018, respectively. Both moti ons were denied on
704June 6, 2018. The final hearing was rescheduled for July 23 through 25,
7172019, and then, on July 9, 20 19 , rescheduled for January 7 and 8, 2020.
732The final hearing proceeded, as scheduled, on January 7 and 8, 2020. The
745final hearing Trans cript was filed on February 4, 2020. The identity of the
759witnesses and exhibits and rulings regarding each, as well as pre - hearing

781At the conclusion of the final hearing, the parties stipulated to submitting

861F INDINGS O F F ACT
8671. Petitioners are the parents and natural guardians of Jacob.
8772. Jacob was born a live infant on January 18, 2008, at Adventist Health,
891a hospital located in Orlando, Florida. At the time of delivery, M rs. Frybarger
905was 33 weeks and four days pregnant.
9123. Franklyn Christensen, M.D., provided obstetrical services in the course
922of Jacobs del ivery, and during resuscitation in the immediate post - delivery
9351 Intervenors objected to the testimony of Ronald Davis, M .D., and subsequently filed a post -
952hearing Motion to Strike Petitioners Testimony of Witness Ronald Davis, M.D. The motion is
966granted in part and denied in part. The undersigned will not consider the testimony of
981Dr. Davis regarding his treatment of Jaco b from February 16, 2017 , through November 25,
9962019, as Intervenors would suffer prejudice as they were unaware of said treatment u ntil
1011after Intervenors case - in - chief had concluded. The undersigned will consider, however,
1025Dr. Daviss observations and op inions as to Jacobs mental impairment, and the undersigned
1039concludes that Intervenors suffer no prejudice as a result. Finally, the undersigned will
1052consider Dr. Daviss treatment record from November 25, 2019, and Respondents Exhibit 6
1065is admitted into evidence. The undersigned concludes Intervenors will not suffer prejudice as
1078a result.
1080period. Dr. Christensen was a participating physician in the Plan on the date
1093of delivery.
10954. Athena Theodosatos, M.D., assisted in the delivery. Dr. Theodosatos
1105was a resident physician at t he time of delivery, and is deemed a
1119participating physician in the Plan at the time she rendered obstetrical
1130services.
11315. Jacob was delivered via C aesarean - s ection delivery. The delivery took
1145approximately 51 minutes to complete. At some point during the procedure,
1156the placenta was cut , which resulted in bleeding. Accordingly, there was
1167blood loss to the placenta and to Mrs. Frybarger. As a result, there was also
1182blood loss to Jacob during the process of delivery and in the immediate post -
1197delivery period. The blood loss, in turn, resulted in oxygen deprivation to
1209Jacob during the delivery and resuscitation in the immediate post - delivery
1221period.
12226. Jacob was a single gestation weighing over 2,500 grams at birth.
12357. Jacob suffered an injury to his brain c aused by mechanical injury
1248leading to oxygen deprivation that occurred in the course of delivery and
1260resuscitation in the immediate post - delivery period in the hospital.
12718. There is no known genetic or congenital abnormality that resulted in
1283Jacobs brain injury.
12869. The injury to Jacob rendered him permanently and substantially
1296physically impaired.
129810. There is no dispute that the injury to Jacob rendered him permanently
1311mentally impaired. At issue is whether the injury to Jacobs brain rendered
1323him sub stantially mentally impaired. Petitioners and Respondent contend
1332that the brain injury impairment does not rise to the level of substantial.
1345Intervenors conten d the brain injury did render him substantially mentally
1356impaired. 2
1358Intervenors Experts
136011. I ntervenors offered the testimony of Anthony Mancuso, M.D.
1370Dr. Mancuso is board - certified in diagnostic radiology, with a subspecialty in
1383neuroradiology. Dr. Mancuso practices at University of Florida Health, and is
1394the Chairman of the Radiology Department at the University of Florida
1405College of Medicine.
14081 2 . Dr. Mancuso reviewed MRI imaging of Jacobs brain from February
14212009 and June 2012, as well as Jacobs medical records. He opined that Jacob did suffer a hypoxic ischemic injury to his brain based on the imaging
1448findings and the circumstances surrounding the delivery and the
1457resuscitation of Jacob following a difficult delivery. Dr. Mancuso testified that
1468the MRI imaging demonstrated a pattern that was entirely consistent with a
1480hypoxic ischemic injury and that the imaging showed a substantial amount of
1492permanent injury to the brain that would reasonably result in substantial
1503mental and physical neurologic deficits.
150813 . In terms of the front al lobe s , the parietal, the occipital lobes, the
1524corpus callosu m , and to a lesser degree the temporal lobes of Jacobs brain ,
1538based upon the images of Jacob from approx imately one year after birth and
1552when he was approximately four years old, Dr. Mancuso opin ed that the
1565imaging evidence is predictive of and supports s ubstantial mental and

1590original parties to a pending proceeding whose substantial interests will be affecte d by the
1605proceeding and who desire to become parties may move the presiding officer for leave to
1620intervene. The undersigned acknowledges that an intervenors rights are subordinate to the
1632rights of the parties and an intervenors status exists only so lon g as the litigation continues
1649between the parties and is lost altogether if the parties decided to settle the case or
1665voluntarily dismiss it. Louis Del Favero Orchids, Inc. v. Fla. Dept of Health , 2020 Fla. App.
1681LEXIS 1531 at *5 (Fla. 1st DCA 2020) quo ting Environmental Confederation of S.W. Fla, Inc.
1697v. IMC Phosphates, Inc. , 857 So. 2d 207 (Fla. 1st DCA 2003). Here, Petitioners filed their
1713Petition under protest, asserting they were not claimants and not seeking NICA
1726compensation. Notwithstanding, as Respondent disputes the compensability of the injury,
1736the undersigned m ust, in its present posture, determine the claim. §§ 766.304, 766.309,
1750766.301(1) and 766.31, Fla. Stat.
1755physical neurological deficits . Dr. Mancuso further opined that , based on the
1767imaging, the corpus ca llosum, the white matter that connects the lobes, was
1780diminished, leading to a highly disconnected brain.
17871 4 . Dr. Mancuso opined that the brain injury, as demonstrated on
1800imaging, would be predictive of impaired cognitive functioning as measured
1810by intelligence tests, i mpair ed expressive and receptive language skills , the
1822necessity of substantial accommodations in school , below average cognitive or
1832academic skills , impaired perceptual and processing abilities , and the
1841necessity of special assistance to learn and develop intellectually to reach his
1853full potential . He further opined that the diminished corpus c a llosum would
1867be predictive o f Jacobs inability to transfer his cognitive skills into adequ ate
1881learning in a normal manner and that h is ultimate vocational options would
1894be limited by these neurologic deficits.
19001 5 . Dr. Mancuso, who had never seen Jacob nor treated him, credibly
1914ackn owledged that his opinions would require confirmation by physical
1924examination and neuropsychiatric testing. The undersigned finds
1931Dr. Mancusos opinions, as set forth above, credible and persuasive.
19411 6 . Intervenors also offered the testimony of Russel l A ddeo, Ph.D.
1955Dr. Addeo received his Ph.D. in neuropsychology from the University of Florida and is a board certified clinical neuropsychologist. He is the Director of Behavioral Medicine at Brooks Rehabilitation. As a neuropsychologist,
1987Dr. Addeo makes de terminations, on a daily basis, with respect to a patients
2001degree of mental impairment.
200517 . On March 21, 2019, when Jacob was 11 years, two months old, a
2020Compulsory Neuropsychological Examination of Jacob was conducted at Brooks Rehabilitation. A Forens ic Neuropsychological Evaluation Report was
2037generated after the neuropsychological evaluation, assessment, and record
2045review. Dr. Addeos opinions and report are based on the results of the
2058standardized testing conducted, his analysis of depositions in thi s matter,
2069review of Jacobs educational records, medical records, and past
2078neuropsychological exams. The criteria he considered in rendering his opinion
2088included an analysis of cognitive function ; an analysis of intelligence tests ;
2099analysis of language ski lls ; whether special accommodations were necessary ;
2109Jacobs perceptual and processing abilities ; whether J acob can learn and
2120develop intellectually without substantial accommodations ; whether he can
2128translate his cognitive abilities into adequate learning ; an analysis of J acob s
2141social and vocational developments ; and the degree to which he is impaired.
215318 . Dr. Addeo testified and explained the neuropsychological exam and
2164results in detail. His neuropsychological exam was conducted over a period of
2176approx imately seven hours. The results of the examination are fairly
2187summarized in the 30 page report, which was admitted in to evidence and
2200addressed at length during the hearing.
220619 . Dr. Addeos ultimate opinion is that Jacob is substantially mentally
2218impaired. In reaching this opinion, inter alia, Dr. Addeo relied upon
2229Steadmans Medical Dictionary for informing himself as to what the terms
2240substantial and mental im pairment refer to. He testified that the general
2252definition of the term substantial means significantly considerable in
2263q uantity and significantly great.
226820 . Dr. Addeo testified that mental impairment t o him is really a
2282disorder characterized by the display of an intellectual defect as determined by things like diminished cognitive, interpe rsonal, social and vocational
2303effectiveness and by psychological exam and assessment.
23102 1 . With respect to the testing, Dr. Addeo a ssessed Jacobs full scale IQ to
2327be a 52. This score, which falls in the severely impaired category, places
2340Jacob at the .01 percentile, meaning 99.9 percent of the populations scores
2352are above his. In the subcomponent of verbal IQ, Jacob scored an 81. Jacobs
2366verbal IQ is a relative strength for him, and, if standing alone, would place
2380him in the mildly impaired category. Jac obs performance IQ resulted in a
2393score of 45, placing him in the severely impaired category.
24032 2 . Dr. Addeo acknowledged that Jacob has significant visual and fine
2416motor skill deficits and the difficulties that the same present:
2426Its true, but some of it is difficult to establish, you
2437know, to separate (visual and motor deficits from
2445cognitive) but I tried to give tests and tried to look
2456at how hes doing cognitively. I dont want to say
2466that J acob has got substantial mental impairment
2474when in fact it jus t may be that he has some visual
2487difficulty o r that he has motor difficulty.
24952 3 . Dr. Addeo was aware that Jacob is legally blind and, at times, utilizes
2511a magnifier in the classroom. Jacob has nystagmus, an involuntary eye
2522movement that makes it difficult to focus vision, which was observed during
2534the testing. Indeed , Jacobs eyes were observed darting up and to the right
2547several times per minute. Dr. Addeo credibly opined that this condition most likely would affect his ability to focus and visualize ma terials. During the
2572testing, Jacob did not utilize a magnifier, and, while not precluded from doing
2585so, did not have the assistance of a paraprofessional (as he has at school).
25992 4 . During the testing, Dr. Addeo attempted to remove from consideration
2612diffi culties that might be introduced due to Jacobs visual and motor deficits.
2625As an example, Dr. Addeo described two tests where vision is not a factor and
2640yet Jacob still performed poorly. On one t est , Jacob was asked if there were
2655three ducks on a lake and one flies away, to state how many remained.
2669Jacobs answer was four. Even when told that was incorrect, Jacob would
2681repeat that answer. He also had difficulty with determining the value of money.
26942 5 . The results of the examination revealed the following sc ores: for the
2709w orking memory index , f luid reasoning index , and v isuospatial index he
2722score d in the .1 percentile or lower . I n the v erbal comprehension index , a
2739relative area of strength for Jacob, he scored in the 10th p ercentile . In math
2755and reading, he s cored at the .05 percentile (95 percent of the population
2769bett er than him in academic skills).
27762 6 . With respect to a ttention and concentration , Jacob scored poorly. His
2790score on the a bility to repeat digits forward and backward and sequence them
2804was in th e 1st percentile , and in the a uditory attention response test , he
2819scored in the 2nd percentile. Dr. Addeo testified that ne ither of these tests is
2834affect ed by visual/motor deficiencies. In the Auditory Response Set
2844Correction , Jacob scored in the .1 perce ntile (99.9 percent of the pop ulation
2858scored higher).
28602 7 . Jacob performed relatively we ll on verbal executive skills: similarities
2873(25 percent ), letter fluency (9 percent ), category switching (16 percent ), total
2887set loss errors (37 percent ), and total rep etition errors (5 percent ). In matrix
2903reasoning, however, where Jacob was presented with a square composed of
2914four red triangles , and one was missing, he could not correctly solve the
2927problem. Notwithstanding his visual deficiencies, Dr. Addeo testified th at
2937Jacob would could see and make out the shapes and colors.
29482 8 . With respect to language and verbal reasoning, Jacob scored in the .5
2963percentile in expressive vocabulary and at the 1st percentile in categorical
2974fluency (the a bility to tell category name s of things: girls names, animals,
2988and etc .). Jacob did relatively better in similarities, scoring in the 25th
3001percentile.
30022 9 . Jacob had a difficult time with comprehension of instructions, which
3015included no visual or motor skills for the most part, obt aining a score of .1
3031percentile. Not surprising, based on his visual and fine motor deficits, Jacob
3043performed poorly on spatial and visual reasoning, scoring in the .1 percentile
3055or below.
305730 . Dr. Addeo noted that Jacobs verbal memory for stories and for list s of
3073items was in the low average to average range . He further noted that Jacob
3088performed better on verbal memory on this occasion than on the prior testing
3101performed with Dr. Kanter (discussed below).
31073 1 . Jacobs educational history is discussed, in detail, in a separate section
3121of this Order below. Dr. Addeo in formulating his ultimate opinion, in part,
3134considered Jacobs education records. Accordingly, his opinions on the matter
3144are set forth here. As Jacob has been determined as a student with a
3158disability pursuant to the Individuals with Disabilities Education Act (IDEA), he has an individualized educational program (IEP). Dr. Addeo reviewed
3178J acob s IEPs over the years. In doing so, Dr. Addeo observed that Jacob is
3194enrolled in an access points curriculum for English/language arts,
3203mathematics, social studies , and science. Accordingly, the grading is different
3213from courses following the general curriculum and Jacob d oes not have to
3226take the same standardized tests as other children.
32343 2 . Jacobs IEPs document multiple accommodations and services that he
3246receives on a daily basis while in school. Dr. Addeo credibly opined that Jacob
3260will always require these services and accommodations to learn and develop
3271intellectually. While some of Jacobs lan guage skills are better than others ,
3283he has significant difficulty with expressiv e and receptive language skills and
3295impaired perceptual and processing abilities. Dr. Addeo opined that d espite substantial accommodations in school, he has not achieved avera ge cognitive
3317or precognitive skills. While Jacobs memory i n some areas is a relative
3330strength, he has difficulty with translating his cognitive abilities into normal
3341learning.
33423 3 . With respect to his future, Dr. Addeo opined that while Jacob can
3357speak, c ommunicate, and conduct a conversation, his social and vocational
3368development has been drastically impaired and that his probability of
3378employment, outside of a benevolent employer, is not very high . Dr. Addeo
3392agreed that Jacob might be able to be employ ed in the future answering
3406phones.
340734 . The undersigned finds that Dr. Addeos opinions, as set forth above,
3420and the findings set forth in the report , to be credible and persuasive.
343335 . Intervenors also presented the testimony of Stewart Ater, M.D.
3444Dr. A t er is a board certified pediatrician and neurologist with special
3457qualifications in child neurology. In 2016, Intervenors retained Dr. Ater to
3468conduct a neurological examination of Jacob. The examination was conducted
3478on June 17, 2016, in Orlando, Florida, when Jacob was eight years, four
3491months old. While Dr. Ater spent approximately 10 hours reviewing Jacobs
3502medical and educational records prior to the examination, the examination
3512spanned approximately one hour.
351636 . Dr. Aters ultimate opinion in this m atter is that Jacob does have
3531substantial neurological problems, cognitive as well as cerebral palsy motor
3541problems and that Jacob satisfies the criteria for a birth - related neurological
3554injury. Dr. Ater credibly testified, based on his training and expe rience,
3566review of the available records and physical examination , that Jacob
3576sustained a hypoxicischemic brain injury during the course of delivery and
3587the post - delivery period.
359237 . Dr. Ater testified that, upon examination, he found Jacobs intellectual
3604and executive functions were o bviously and severely impaired. In support of
3616this position, Dr. Ater explained that Jacob, at the age of eight , misspelled
3629his own last name, could not accurately identify his birth month or date , and
3643could not read the word father.
36493 8 . Dr. Ater conceded that, during the examination, Jacob was able to
3663answer questions regarding his grade, his teacher, his favorite subjects and
3674the reasons therefore. Jacob also demonstrated some ability to follow some directions correctly a nd spontaneously commented upon when his counsel left
3696and returned to the room during examination. Jacob also informed Dr. Ater that he (in the past) would advise his parents when he felt a seizure coming on and recalled the name of his seizure medication. Due to his visual deficits,
3737it appears that Jacob had some degree of difficulty in reading the print
3750provided during the examination.
37543 9 . According to Dr. Ater, J acob has impaired cognitive functioning as
3768measured by intelligence tests and , following h is evaluation, recommended
3778that Jacob undergo a neuropsychological evaluation. Dr. Ater opined that
3788more recent psychoeducational or neuro - psychoeducational testing is more
3798reliable than similar testing performed at a young age as [a] reas of the
3813brain . . . need to develop more complex functions as children grow and get
3828older, that children typically grow into their deficits and [t] hat is as the
3843other people in their classes learn more and more complex things, these kids
3856f all farther and farther behind. Accordingly, Dr. Ater opines that IQ scores
3870generally tend to be more accurate at an older age than a younger age.
388440 . Based upon document review and examination, Dr. Ater opined that
3896Jacob clearly has problems with both expressive and receptive languag e, but
3908the same are not as damaged as other cognitive areas. Based upon his review
3922of Jacob s educational records, he opined that, d espite substantial
3933accommodations in school, he has not achieved average cognitive or pre -
3945academic skills. Jacob, in his opi nion, has impaired perceptual and
3956processing abilities and requires s ubstantial educational help in an
3966exceptional student education (ESE) program and is not able to translate his cognitive capabilities into adequate learning in a normal manner.
39874 1 . With respect to his future, Dr. Ater opines that Jacobs social and
4002vocational development has been drastically impaired. Dr. Ater testified that
4012Jacob is n ot likely to be employed in meaningful competitive work and will
4026not be able to live independently.
40324 2 . The undersigned finds that Dr. Aters opinions with respect to whether
4046Jacob sustained a hypoxic - ischemic brain injury during the course of delivery
4059and the post - delivery period to be credible and persuasive. The undersigned
4072further credits and finds persu asive Dr. Aters opinions regarding the
4083reliability of more recent psychoeducational or neuro - psychoeducational
4092testing and that that IQ scores generally tend to be more accurate at an older
4107age than a younger age.
41124 3 . The undersigned finds, however, that Dr. Aters testimony regarding
4124the interpretation of MRI studies and the exercise of matching damage d lobes
4137of the brain to distinct cognitive functions less persuasive than that of
4149Dr. Man cuso, d ue, in part, to the limi ted duration of the examination. T he
4166undersigned finds Dr. Aters opinions concerning Jacobs potential
4174educational and vocational opportunities less persuasive.
4180Respondents Experts
41824 4 . Respondent retained Laufey Sigurdardottir, M.D., to review the
4193available medical records, conduct a neu rological examination, and opine as
4204to whether Jacob met the criteria for a birth - related neurological injury and
4218should be eligible for compensation under the Plan. Dr. Sigurdardottir is a
4230board certified child neurologist and epileptologist.
42364 5 . Dr. Sig urdardottir conducted an examination of Jacob on O ctober 7,
42512015, when Jacob was seven years, eight months old. A report was drafted on
4265the date of the examination after a review of the medical records, full
4278physical, and thorough neurological examination. She drafted an addendum
4287to her report, dated September 8, 2017, following the review of additional
4299MRI imaging studies and medical records. The results of her examination are
4311fairly summarized in her report, and were admitted into evidence and
4322addressed a t the hearing.
43274 6 . Dr. Siguardardottirs ultimate opinion in this matter is that Jacob
4340does not have a substantial mental impairment, but rather, a mild mental impairment. As noted in her evaluative report, Jacobs [o]verall
4361developmental assessment does suggest some delays in language and
4370comprehension as well as expressive language, but overall skills that are higher than his motor abilities. She concluded that, [t]he patient is found to have a permanent substantial physical impairment, but to have mi ld mental
4406impairment with areas of strength in verbal realms.
44144 7 . Dr. Sigurdardottir testified regarding the motor impairments that
4425Jacob has that would make s tandardized testing difficult: quadriplegic
4435cerebral palsy ; diff iculties with fine motor skills ; multiple vision
4445abnormalities; abnormal eye movement where he has a difficult time keeping
4456his gaze f ocused on what he is looking at; difficulty sweeping his eyes when
4471attempts to read; and he is considered legally blind, even with corrective
4483lenses. Ind eed, Dr. Sigurdardottir testified that, visual disturbance, hearing
4493impairment and motor disability is one [sic] of the hardest things to overcome
4506in testing true intelligence.
451048 . Dr. Sigurdardottir reviewed several prior assessments in formulating
4520her opinions and testified regarding the same. Her review of the Battelle
4532Inventory administered to Jacob at age eight months sho w ed his lowest areas
4546were in motor development (79) , but all other scores ( adaptive skills, personal
4559and social development, commu nication and cognitive function ) were within
4570no rmal limits (84).
45744 9 . She also reviewed prior neuropsychological testing from the Volusia
4586County School District. With respect to a neuropsychological assessment
4595performed in 2011, she noted Jacob obtained t he following scores:
4606d evelopmental quotient (78); personal/social ( 83 ); communication ( 94 ); and
4619motor skills ( 68 ). Dr. Sigurdardottir explained that 78 is borderline , 83 is o n
4637the cusp of completely normal , and 94 is completely normal . With respect
4652to a psychoeducation assessment completed in 2017, she noted Jacob was
4663only given the verbal part of the W echsler Intelligence Scale Children, Firth
4676Edition (WISC - V) , wherein he obtained a score of 76. She explained that an
469185 is within normal limits; 71 - 85 is borderline; and 70 and below would be
4707considered impaired.
470950. Dr. Sigurdardottir also discussed the 2013 evaluation conducted by
4719Dr. Kanter. She noted that, pursuant to his evaluation, Jacobs full scale IQ was a 63; however, the verbal component of the assessment was an 83.
4745Dr. Sigurdardottir opines that, when there is a large discrepancy in areas of
4758strength and other areas that are very difficult to test (due to motor and
4772visual deficiencies), the lower scores do not reflect Jacobs true abilit ies.
4784Similarly, she opined that the testing performed by Dr. Addeo is unreliable
4796because the performance IQ portion, particularly those components that
4805rated Jacobs visual and motor dexterity, would underestimate his true
4815abilities.
48165 1 . Dr. Sigurdardott ir opine d that intellectual disability is not merely
4830comprised of IQ, but rather, one must look at the individuals adaptive skills.
4843Accordingly, if one merely looked to Jacobs verbal and adaptive skills upon
4855testing, he would fall into the borderline ca tegory, and not that of an
4870intellectual disability.
487252 . In es sence, Dr. Sigurdardottir opined that to the extent any cognitive
4886testing requires vision or fine motor skill components, the same would be
4898unreliable as it would underestimate Jacobs true abi lities. As a corollary, she
4911opined that purely verbal testing and assessment is the most accurate
4922method to determine his true mental abilities.
49295 3 . The undersigned finds that Dr. Sigurdardottir possesses significant
4940educ ation, training, and expertise and is well - qualified and credentialed to
4953render the above - noted opinions. The undersigned, however, finds her
4964opinions with respect to limiting cognitive testing to purely verbal as less
4976persuasive and overly restrictive.
49805 4 . Respondent also retained Ronald Willis, M.D., a board certified
4992obstetrician and gynecologist specializing in maternal - fetal medicine, to
5002review Jacobs medical records and opine as to whether Jacob sustained an
5014injury to his brain in the course of labor, delivery, or in the immediate p ost -
5031delivery period due to oxygen deprivation or mechanical injury. Dr. Willis
5042conducted his review and authored a report on September 15, 2015, and a subsequent report on January 14, 2016, both of which contain his findings
5067and opinions. Dr. Willis was al so deposed on July 25, 2017, and his deposition
5082was admitted into evidence without objection. Dr. Willis testified that, in his
5094opinion, Jacob sustained an injury to his brain due to oxygen deprivation
5106during the immediate post - delivery period. He offered no opinions on the
5119degree or permanency of the brain injury. Dr. Williss opinions are credited.
51315 5 . Respondent also re tained Tushar Chandra, M.D., a board - certified
5145radiologist, to review and opine on the previously obtained MRI images (2009
5157and 2012) of Jacobs brain. Of relevance to the primary issue in this
5170proceeding, Dr. Chandra could not provide an opinion or predict whether or
5182not Jacob has a permanent and substantial mental or physical impairment
5193based on the imaging alone. As Dr. Chandra explaine d in his deposition of
5207February 8, 2018:
5210Because because what Im looking at is anatomy,
5219and theres no clear correlation of anatomy with
5227function. So to comment on that, you need a good
5237clinical neurological examination to look at his
5244cranial nerves, mo tor tests, sensory tests. For all
5253that, you need a clinical examination.
5259** *
5261What my specialty is, is to say whether or not this
5272is a normal scan. If not normal, then based on my
5283experience, what has been the kind of injury and
5292when, and then I usually try to say to make my
5303recommendations. . . . But in no capacity does my
5313expertise allow me to comment on how this kid will do clinically, because theres no way I can know
5332that.
53335 6 . The undersigned finds that the above - noted opinions of Dr. Chandra
5348are c redible and persuasive.
5353Petitioners Experts
53555 7 . On March 14, 2011, prior to the filing of the instant Petition,
5370Petitioners counsel referred Jacob to Robert F. Cullen, Jr., M.D., a
5381neurologist at Miami Childrens Hospital, for a neurological evaluation. Jacob
5391was three years, two months old at the time of the evaluation. A report was
5406generated following the evaluation, which was admitted without objection. In
5416the summary section of his report, Dr. Cullen noted , inter alia , that: 1) Jacob
5430had some speech articulation difficulties and would need ongoing speech
5440therapy; 2) was at risk for seizures over and above the general population;
54533) had cognitive delays and was behind in terms of naming pictures and
5466colors; 4) would require special educational help in school; and 5) that his
5479employability will certainly be limited.
54845 8 . On June 12, 2013, prior to the filing of the instant Petition,
5499Petitioners counsel referred Jacob for a neuropsychological evaluation by
5508Geoffrey Kanter, Ph.D. Jacob was five years, fo ur months old at the time of
5523evaluation. A report was generated following the evaluation, which was
5533admitted without objection. Dr. Kanter did not offer testimony in this matter.
55455 9 . Dr. Kanter documented that, at the time of the evaluation, Jacob was
5560una ble to dress himself, walk without assistance, tie his shoelaces, correctly
5572say the alphabet, read, button his clothing, and name coins. Dr. Kanter also
5585documented that, upon examination, Jacobs visual acuity problems were
5594quite evident. Specifically, h e documented as follows:
5602Jacobs eyes would frequently roll upwards
5608involuntarily. On all visual tasks, he required
5615assistance and prompting to focus on the visual
5623stimuli in front of him. He would focus on a
5633particular area directed by the examiner, his e yes
5642would roll upwards, and then he would need redirection again to focus back on the particular
5658location on the stimulus he was previously looking
5666at. With this type of assistance, he was able to focus on and view particular areas of visual stimuli in ord er to comprehend the task and make a
5695response. However, his performance was likely
5701clearly impacted.
570360 . Dr. Kanter further observed that Jacobs fine motor skills were also
5716obviously impacted, and that his fine motor dysfunction clearly impacted
5727the test results on tasks with high fine motor demand. Finally, he noted that
5741[o]ther fine - motor tasks were beyond his capabilities and not administered.
575361 . Jacobs general intellectual functioning was documented by Dr. Kanter
5764as follows:
5766On the WPPSI - III [Wechsler Pre - School and
5776Primary Scale of Intelligence - III], Jacob obtained a
5785Full Scale I.Q. score of 63 which falls within the
5795Extremely Low ra n ge (1 st percentile) at a Moderate
5806level of impairment. Sub - indices were variable with
5815a significant strength in terms of verbal reasoning
5823ability (Verbal I.Q. =83, 13th percentile, Low
5830Average, Mildly impaired) versus a significant
5836weakness in visual - spatial and visual - motor ability
5846(performance IQ=53, .1 Percentile, Extremely Low, Severely impaired).
58546 2 . The I mpressions and Conclusions section of Dr. Kanters report is set
5869forth , in full , below :
5874The pattern and severity of cognitiv e test scores
5883across this evaluation are consistent with the
5890electroencephalographic and neuroradiological test findings of grossly impaired neurological
5899functioning on a di ffuse and localized b asis. The
5909EEG pointed more toward a right hemisphere locus
5917of the seizure disorder which is consi stent with
5926relatively more spared ( b ut still impaired) left
5935hemispheric, verbal/language areas. The neurological dysfunction would certainly be
5944expected to impact his cognitive capacities in the
5952areas of processing speed, memory, and speec h/ language functioning to some degree. Visual
5966s k ills are a ffected not only due to visual acuity
5978issues (i.e., hav ing to hold small images close to his
5989face) but also likely visual processing problems. To some degree, it is difficult to parcel out which factor
6007may be primary although from a functional
6014standpoint, it does not matter. Impaired visual
6021acuity would certai nly be expected to cause visual -
6031spatial and visualmotor processing speed problems.
6037The parent qu e stionnaire results from the
6045Vineland - II and BASC - 2 are consistent with the
6056cognitive test findings in terms of how his
6064cognitive, visual, and motor problems si gnificantly
6071impact his ability to engage in functional communication and functional activities.
6082Overall, consistent with M RI and EEG results, it is
6092evident that multiple areas of Jacob's brain were
6100damaged, with bot h hemispheres a ffe cted, as well
6110as cort ical and subcortical components wi th global
6119and specific cognitive and behavioral consequences.
6125It is also important to note that at Jacob's age,
6135cer tain neuro - cognitive functions have not yet
6144developed (such as higher level executive
6150functioning related t o frontal lobe development)
6157and as such , more specific impairments are li kely
6166to emerge as he reaches adolescence and beyond
6174when cognitive, educational, and life tasks will present increased complexity and demand for more
6188independent problem - solving.
6192T he severity of t he cognitive and functional
6201impairments clearly impacts his ability to function
6208normally within an educational setting, family setting, and social setting. The impact of the
6222pattern and severity of cognitive deficits will result
6230in t h e need f or special education services
6240throughout Jacob's educational career and will
6246greatly impact his capacity for vocational employment.
625363 . Dr. Kanters prognosis and recommendations for Jacob, as documented
6264in his report, are set out in pertinent part, as fo llows:
6276Jacob will continue to need significant assistance
6283throughout his educational career, into adulthood,
6289and throughout his life. While h e may develop some
6299adaptive compensat ory strategies, t h e severity of
6308his areas of deficit in language, memory, and
6316visual - motor areas in particular will not likely
6325change i n a significant functional manner. He will
6334require special educati on assistance throughout
6340school. The likelihood of Jacob successfully
6346completing a 4 - year regular college or even a 2 - year
6359college i s extremely minimal .
6365The probability for Jacob to obtain and maintain
6373competitive employment on a fu ll - time basis is
6383minimal. Given the pattern and severity of deficits in the visual, cognitive, and academic realms, his
6399employment choices will be extremel y limited. It is
6408li kely that he will qua lify for and require Social
6419Security Disability. He would likely require a
6426limited type of job placement which does not
6434require a high degree of concentration and
6441attention, memory, verbal expressive abilities, fine -
6448motor s kills , physical mobility, visual acumen, or
6456writing capacity, and only under circu mstances
6463with very significant assistance and
6468accommodations. It is unknown what type of
6475employment setting would be able to meet such
6483requirements. He may be able to obtain a volunteer position on a part time basis as a productive
6501activity but we still need a great deal of direct
6511supervision.
6512After reaching his majority, Jacob will continue to
6520need significant assistance with regard to most
6527aspects of his life w hich i ncludes:
6535¤ financial management and decision - making
6542¤ paying rent and utility bills
6548¤ decisions concerning cos t s, benefits, advantages,
6556and disadvantages of residential location
6561¤ decisions concerning social and intimate relations h ips
6570¤ emotional coping w ith his disability
6577Non - medical professionals who will need to become
6586involved in his life include an accountant, a
6594lawyer, and financial manager, and case manager. As he gets older, there may be a potential increase
6611in emotional and be havioral problems wh ich may
6620require more assistance in understanding and
6626dealing with his emotions and behavior. Psychotherapy on a wee kly basis s hould be
6641initiated immediately to p rovide assistance to
6648Jacob and Mr. and. Mrs. F r ybarger, and his school
6659to help him develop adap tive coping strategies to
6668deal with understanding his impairments and disab ility. Psychotherapy on an as needed basis
6682will be requir e d from now through adulthood.
6691Issues with physical disability (quadriplegia, visual dysfunction) as well as cognitive dysf unction will
6705certainly eliminate Jacob's ability to drive. He will
6713need an aide to help transport him as he gets
6723older. He will need assistance for other functional
6731activiti es such as shopping. Given the
6738combination of cognitive as well physical disability ,
6745he will likely require assistance for co oking and
6754cleaning once he reaches his majority. Overall,
6761taking into account all the areas of impairment, it
6770is likely that he will require approximately 24 hour
6779seven day p e r week prof e ssional aide assistance if
6791his parents are unable to care for him and provide
6801for all of his needs. So long as he is with his
6813parents, he will still need assis t ance for the time be
6825is outside of the house whet her within a very
6835structured school setting, sheltered vocational
6840setting, or within any other environment.
6846Finally, as noted, Jacob will continue to require
6854professional speech therapy, physical therapy,
6859occupational therapy services, and counseling beyond that which the school provides.
687064 . Petitioner offered the testimony o f one of Jacobs treating physicians,
6883Ronald Davis, M.D. Dr. Davis is board certified in general pediatrics, adult
6895and pediatric neurology, and has a special qualification in epilepsy. Jacob
6906was presented to Dr. Davis in 2012 for a second opinion. Followin g the initial
6921evaluation, Dr. Davis confirmed the diagnosis of spastic quadriplegic cerebral
6931palsy and partial epilepsy. Dr. Davis most recently treated Jacob on
6942November 25, 2019.
69456 5 . Dr. Davis testified that this treatment of Jacob focused on seizure -
6960related issues, developmental aspects, and in particular for that is the spastic cerebral palsy, so treatment approaches to try to improve range of motion,
6984functionality of motor skills . . . . Based upon his care and treatment,
6999Dr. Davis opined that Jaco b does not have a substantial mental impairment.
7012He reported that Jacob was doing well cognitively, noting that he was making passing grades in his ESE classes and was conversational in speech.
703666 . Dr. Davis explained that Jacob is not a total care pati ent -- that is a
7054patient who requires total care and who is not interactive. Dr. Davis
7066explained that a total care patient would have a substantial mental
7077impairment. Dr. Davis testified that he anticipates Jacob to progress in the
7089future, both mentally and physically, if he continues treatment.
70986 7 . The undersigned finds that Dr. Davis possesses significant education,
7110training, and expertise and is well - qualified and credentialed to render the
7123above - noted testimony as one of Jacobs treating physicians. The undersigned
7135finds his ultimate opinion with respect to whether Jacob has a substantial
7147mental i mpairment to be less persuasive; however, as his methodology for
7159arriving at the opinion is overly restrictive.
7166Family testimony:
71686 8 . Jacob testified on his beh alf and was able to provide limited, but
7184primarily appropriate, responses to questions concerning his family
7192(members, pets, parents employment), his favorite educational topics and
7201teachers, his current grades, his ability to use technology, and hobbies.
72126 9 . Jacob, who was almost 12 years old at t he time of the hearing,
7229attended the entire hearing at counsels table. Jacob was observed to have a
7242very pleasant and friendly demeanor. Throughout the hearing, Jacob was observed to be calm, compliant, cordial and respectful of the proceeding. The
7264undersigned was able to hear and comprehend Jacobs speech. He was
7275observed providing limited, but appropriate, greetings and responses;
7283communicating on occasion with his legal counsel; and expressing his basic needs and wants.
729770 . Petitioners mother, Shannon Frybarger, testified that Jacob is not
7308impulsive, but rather, mature, independent , and responsible. In comparing
7317Jacob to her elder son, she opined that Jacob is the more mature of the two.
7333Mrs. Frybarger testi fied that he is able to stay home alone, for a period of
7349time, and independently recalls when he is required to take medication. She
7361opined that Jacob has consistently and successfully progressed in school and
7372is confident the he will ultimately matriculat e to college, and then to a career.
7387Educational history
738971 . As noted above, Jacob has been identified, evaluated, and determined
7401to be a student with a disability under the IDEA. The evidentiary record
7414indicates that he was evaluated by Child Find service s through the Volusia
7427County School District on January 10, 2011, when he was just under three
7440years old. There, he was served through the Early Steps program for
7452occupational therapy (OT), physical therapy (PT), and communication
7460therapies. At that time, his primary exceptionality was noted, in his IEP, to
7473be orthopedically impaired, with secondary exceptionalities including OT, PT,
7482and other health impaired (OHI).
74877 2 . When Jacob entered kindergarten, he participated in the general
7499education curriculum wi th accommodations and intensive support in
7508language arts, math, communication, social skills, and independent function.
7517He was placed in a separate class educational setting, wherein he was with non - exceptional students less than 40 percent of the school day. He received
7544specialized instruction, daily, in language arts, math, social studies, social
7554skills, communication, and independent functioning. He also received
7562supplemental aids and services such as text, picture and/or object support for
7574communicati on and learning; digital text; and adapted computer access.
758473 . The following year, he began receiving, in addition to prior services,
7597special instruction for 30 minutes per week in a visually impaired setting. At that time, it was determined that he would be able to participate in state and
7625district - wide assessment programs with a number of test accommodations.
76367 4 . On November 30, 2016 , through January 11, 2017, Jacob was referred
7650to Cynthia M. Fraser, Ph.D., a school psychologist with the School District of
7663Volusia County. The documented referral was to obtain measures of his intellectual ability, academic achievement, and adaptive behavior. At the time, Jacob was in third grade.
76897 5 . Dr. Fraser documented that Jacob was receiving ESE services under
7703the exceptionalities of Orthopedically Impaired, Occupational Therapy,
7710Physical Therapy, Visually Impaired, and Other Health Impaired. Jacob is
7720diagnosed with Cerebral Palsy, Seizure Disorder, Optic Atrophy in both eyes,
7731Myopia, Nystagmus, disorder of eye move ment, and Astigmatism. She also
7743documented that he uses either a wheelchair or walker and requires adult
7756assistance to navigate around campus. He also receives ESE services from
7767the vision teacher. Dr. Frasers summary and recommendation are set out in
7780full, as follows:
7783Jacob is an 8 year, 11 - month old boy in the third
7796grade that was referred for reevaluation by the
7804ESE Reevaluation Committee to provide an
7810updated measure of updated measures of his intellectual ability, academic achievement, and
7822adaptive behavior.
7824Due to Jacob's significant physical limitations and
7831vision deficits only the Verbal Comprehension
7837subtests of the WISC - V were administered. His
7846score of 76 fell within the low range. Jacob received
7856the following scores on the WJ - IV: Reading (<4>4>
7866Math (51), and Written Language (<40).>40).>
7872achievement test was administered with
7877accommodations and modifications for his physical
7883and visual deficits including enlarging items and assistance from the vision teacher.
7895Results from the ABAS - III (Teache r GAC = 72,
7906Parent GAC = 70) fell below average. A strength was noted on the Social Domain while the
7923Conceptual and Practical Domains were areas of
7930weakness.
79317 6 . An IEP meeting was conducted for Jacob on March 9, 2017, when
7946Jacob was in the third grade. T he IEP team was comprised of Petitioners
7960mother and the following school based members: an E SE teacher; a vision
7973teacher; a primary teacher ; a school psychologist ; a speech therapist ; a social
7985worker ; a behavior specialist ; the local educational authority representative ;
7994and an evaluation interpreter. At that time, the IEP team, in discharging its
8007duty, was required to determine Jacobs participation in the statewide
8017standardized assessment program. In making that determination, the IEP
8026team, including Pet itioners mother, proceeded through the following
8035analysis, as documented on the IEP:
8041In determining the appropriate assessment for a
8048student, the IEP team should consider the
8055students present level of educational performance
8061in reference to the Florida S tandards and the Next
8071Generation Sunshine State Standards. The IEP
8077team should also be knowledgeable of guidelines
8084and the use of appropriate testing accommodations.
8091To facilitate informed and equitable decision
8097making, the IEP team should answer each of t he
8107following questions when determining the appropriate course of instruction and assessment.
81181) Does the student have a significant cognitive
8126disability ?
81272) Even with appropriate and allowable instructional accommodations, assistive technology, or acce ssible instructional materials, does the
8144student require modifications, as defined in Rule
81516A - 6.03411(1)(z), F.A.C., to the grade - level general
8161state content standards pursuant to Rule 6A -
81691.09041, F.A.C.?
81713) Does the student require direct instruction in
8179academic areas of English Language Arts (ELA), mathematics, social studies, and science based on Access Points in order to acquire, generalize, and transfer skills across settings?
8205If the IEP team answers no to any of these three questions, the student should be instructed in general education courses and participate in the general statewide standardized assessment with
8235accommodations, as appropriate.
8238If the IEP teams answers yes to all three questions, the student should be enrolled in access
8255course s and participate in the Florida Standards
8263Alternate Assessment - Performance Task.
82687 7 . The IEP team conducted the above - cited analysis, concluded that
8282Jacob has a significant cognitive disability, and answered the remaining
8292questions in the affirmative. U ltimately, the IEP team concluded that Jacob
8304will participate in the Florida Standards Alternate Assessment - Performance
8314Task. Jacobs most recent IEP in evidence, dated April 23, 2019, documents
8326that Jacob continues to participate in access courses and par ticipate s in the
8340Florida Standards Alternate Assessment - Performance Task.
83477 8 . The undersigned, based upon review of the record evidence, is
8360unaware of any evidence that Petitioners declined to provide parental
8370consent for Jacobs participation in either t he access points curriculum or the
8383Florida Standards Alternate Assessment - Performance Task.
8390Notice
83917 9 . On August 7, 2007, Mrs. Frybarger, signed a document entitled
8404Notice to Obstetric Patient (See Section 766.316, Florida Statutes). This
8414document provi des as follows:
8419I have been furnished information by Fetal
8426Diagnostic Center of Orlando, Inc. prepared by the
8434Florida Birth - Related Neurological Injury
8440Compensation Association (NICA), and have been
8446advised that Ahmed Al - Malt , M.D. and Franklyn

852780 . On December 16, 2007, Petitioner, Shannon Frybarger, signed a
8538document entitled Notice to Obstetric Patient Pursuant to Florida
8547Statute 766.315. Said document provided as follows:
8554I have been furnished with information by Florida
8562Hospital that was prepared by the Florida Birth
8570Related Neurological Injury Compensation
8574Association (NICA). Under the Associations NICA
8580program, certain limited compensation is available
8586in the event that certain neurological injury may
8594occur to my infant during labor, delivery or
8602resuscitation. I have also b een informed that
8610Florida Hospital, its related or affiliated
8616organizations, and their employed physicians are
8622participants in the NICA program.
8627I acknowledge and understand that my personal
8634physician, or an on - call physician who I have been
8645assigned to, may or may not participate in the
8654NICA program. I understand that I may seek clarification from my physician as to his/her
8669participation in the NICA program. I understand it
8677is my responsibility to discuss this with my
8685physician.
8686For specifics on the pro gram, I understand that I

8813C ONCLUSIONS O F L AW
88198 2 . DOAH has jurisdiction over the parties to and the subjec t matter of
8835these proceedings. §§ 766.301 - 766.316, Fla. Stat.
88438 3 . The Plan was established by the Legislature for the purpose of
8857providing compensation, irrespective o f fault, for birth - related neurological
8868injury claims relating to births occurring on or after January 1, 1989.
8880§ 766.303(1), Fla. Stat.
88848 4 . Section 766.301(2) provides that it is the intent of the Legislature to
8899provide compensation, on a no - fault basi s, for a limited class of catastrophic
8914injuries that result in unusually high costs for custodial care and
8925rehabilitation.
89268 5 . The injured infant, her or his personal representative, parents,
8938dependents, and next of kin may seek compensation under the Pl an by
8951filing a cla im for compensation with DOAH. §§ 766.302(3), 766.303( 2),
8963and 766.305(1), Fla. Stat. NICA, which administers the Plan, has 45 days from the date of service of a complete claim . . . in which to file a response to
8994the petition and to su bmit relevant written information relating to the issue
9007of whether the injury is a birth - related neurological injury. § 766.305(4), Fla.
9021Stat.
90228 6 . If Respondent determines that the injury alleged is a claim that is a
9038compensable birth - related neurologic al injury, it may award compensation to
9050the claimant, provided that the award is approved by the ALJ to whom the claim has been assigned. § 766.305(7), Fla. Stat. If, on the other hand, Respondent disputes the claims, as here, the dispute must be resolved by the
9090assigned ALJ in accordance with the provisions of chapter 120, Florida
9101Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.
91098 7 . Section 766.313 provides that any claim for compensation under
9121sections 766.301 through 766.316 that is filed more th an 5 years after the
9135birth of an infant alleged to have a birth - related neurological injury shall be
9150barred. Jacob was born January 18, 2008. The Petition was filed July 10,
91632015, well past the five - year limitation in section 766.313. While the Petition
9177w as untimely filed mo re than five years after Jacobs birth, whether the claim
9192presented is compensable must still be determined. University of Miami v.
9203Exposito ex rel. Gonzalez , 87 So. 3d 803 (Fla. 3d DCA 2012).
92158 8 . In its present posture, the undersigne d i s required to make the
9231following threshold determination s based upon the available evidence:
9240(a) Whether the injury claimed is a birt h - related
9251neurological injury. If the claimant has
9257demonstrated, to the satisfaction of the
9263administrative law judge, th at the infant has
9271sustained a brain or spinal cord injury caused by
9280oxygen deprivation or mechanical injury and that the infant was thereby rendered permanently and
9294substantially mentally and physically impaired, a
9300rebuttable presumption shall arise that t he injury
9308is a birth - related neurological injury as defined in
9318s. 766.303(2).
9320(b) Whether obstetrical services were delivered by
9327a participating physician in the course of labor,
9335delivery, or resuscitation in the immediate
9341postdelivery period in a hospit al; or by a certified
9351nurse midwife in a teaching hospital supervised by
9359a participating physician in the course of labor,
9367delivery, or resuscitation in the immediate
9373postdelivery period in a hospital.
9378* * *
9381(d) Whether, if raised by the claimant or oth er
9391party, the factual determinations regarding the
9397notice requirements in s. 766.316 are satisfied. The
9405administ rative law judge has the exclusive
9412jurisdiction to make these factual determinations.
9418§ 766.309(1), Fla. Stat. An award may be sustained only if the ALJ concludes
9432that the infant has sustained a birth - related neurological injury. . . .
9446§ 766.31(1), Fl a. Stat.
94518 9 . The term birth - related neurological injury is defined in
9464section 766.302(2) as follows:
9468Birth - related neurological injury means injury to
9476the brain or spinal cord of a live infant weighing at
9487least 2,500 grams for a single gestation o r, in the
9499case of a multiple gestation, a live infant weighing
9508at least 2,000 grams at birth caused by oxygen
9518deprivation or mechanical injury occurring in the course of labor, delivery, or resuscitation in the immediate postdelivery period in a hospital, which
9540renders the infant permanently and substantially
9546mentally and physically impaired.
95509 0 . The phrase substantial mental impairment is neither defined by
9562statue nor present rule. In Florida Birth - Related Neurological Injury
9573Compensation Ass ociation v . Florida Div ision of Admin istration Hearings ,
9585686 So. 2d 1348 (Fla. 1997) [hereinafter Bernie ], the court was asked to
9599resolved the certified question as to whether, under the Plan, an infant must
9612suffer both substantial mental and physical impairment, or can the definition
9623be construed to require only substantial impairment, mental and/or physical.
9633In resolving the question, the Bernie court explained that [w]here, as here,
9645the legislature has not defined the words used in a phrase, the language
9658should u sually be given its plain and ordinary meaning. Bernie , at 1354, citing Southeaster n Fisheries Assn , Inc. v. Dep t Nat . Res . , 453 So. 2d 1351
9688(Fla. 1984). Nevertheless, consideration must be accorded not only to the literal and usual meaning of the wor ds, but also to their meaning and effect
9714on the objectives and purposes of the statues enactment. Id .
97259 1 . The Bernie court concluded that the NICA statute is written in the
9740conjunctive and requires a permanent and substantial impairment to both
9750the phys ical and mental elements. Id . at 1356. The Bernie court did not
9765establish a definition or test for the determination of substantial mental
9776impairment, but found that the underlying decision by the ALJ must be
9789supported by competent and substantial eviden ce.
979692 . In Adventist He alth System/Sunbelt, Inc. v. Florida Birth - Related
9809Neurological Injury , 865 So. 2d 561 (5th DCA 2004) [hereinafter Shoaf ], the
9822Fifth District Court of Appeals likewise rejected setting forth a formulaic
9833approach to the resolution of the term substantial mental impairment.
9843Addressing the argument that Be rnie had created a definition, the Shoaf
9855court countered:
9857It is apparent, however, that the Be rnie court did
9867not define or redefine substantial mental
9873impairment. They simply said that the decision of
9881the ALJ was supported by competent substantial
9888evidence. All this language in Bernie suggests is
9896that, under NICA, the identification of a substantial mental impairment may include not
9909only significant cognitive deficiencies but can
9915i nclude, in a proper case, additional circumstances
9923such as significant barriers to learning and social development.
9932Shoaf , at 567.
99359 3 . The Shoaf court again reiterated that, as the legislature did not define
9950the terms used in the test for NICA qualificat ion, these terms are to be given
9966their ordinary meanings. Id . at 568. Indeed, the Shoaf court further directed
9979that:
9980The legislature left the application of the terms they used to the administrative law judges designated by statute to hear these claims and to
10004apply the expertise they develop in carrying out this task to determine from the evidence adduced
10020in each case whether these for NICA is met.
10029* * *
10032In cases such as the one before us, the ALJ, as fact finder, brings his own background, training,
10050expe rience and expertise to the task of weighing
10059and evaluating very sophisticated evidence. The childs advocate likewise brings his own
10071communication and strategic skills to the fact -
10079finding process; and finally, the evidence in each
10087case will vary in its po wer to persuade. This will be
10099especially true in cases where the opinions of
10107experts are concerned.
10110Id ., at 568 - 569.
101169 4 . Finally, the Shoaf court, in concluding that the underlying decision by
10130the ALJ was supported by competent substantial evidence, adv ised that the
10142term substantial mental impairment is broad enough to encompass more
10152than just damage to cognitive capacity and more than merely the inability to
10165translate cognitive capabilities into adequate learning in a normal manner or
10176impairment of so cial and vocational development. Id. at 569.
101869 5 . Against this backdrop, the undersigned concludes that sufficient
10197evidence was presented, or otherwise stipulated or admitted by the parties, to establish that: Petitioners, Shannon Frybarger and Steven Fryba rger, are the
10220parents and natural guardians of Jacob, a minor; that Jacob was born a live
10234infant on January 18, 2008, at Adventist Health System/Sunbelt, Inc., d/b/a
10245Florida Hospital Orlando, a hospital located in Orlando, Florida; and that
10256Jacob was a sin gle gestation, weighing over 2,500 grams at birth.
1026996 . It is further concluded that sufficient evidence was presented, or
10281otherwise stipulated or admitted by the parties, to establish that obstetrical services were delivered by participating physicians, D r. Christensen and
10302Dr. Theodosatos, in the course of labor, delivery, or resuscitation in the
10314immediate post - delivery period in a hospital .
103239 7 . The undersigned further concludes that the evidence establishes that
10335Jacob suffered an injury to his brain cau sed by mechanical injury leading to
10349oxygen deprivation in the course of labor, delivery, or resuscitation in the
10361immediate post - delivery period i n the hospital. Jacobs injury wa s not caused
10376by genetic or congenit al abnormality or due to infection. The und ersigned
10389concludes that the evidence further establishes that Jacobs injury rendered
10399him permanently and substantially physically impaired, and permanently
10407mentally impaired.
1040998 . Each of the parties to this proceeding presented one or more experts to
10424sup port their respective position as to whether Jacob is substantially
10435mentally impaired. All of the experts presented were well - qualified,
10446credentialed, and possessed extensive and significant training and experience
10455in their respective discipline or area of expertise. Having thoroughly reviewed
10466and weighed the considered expert opinions and evidence, the undersigned
10476concludes that the better evidence supports the conclusion that Jacobs injury
10487at issue, based on the Findings of Fact above, rendered him subst antially
10500mentally impaired. The undersigned concludes that Jacobs brain injury is
10510substantial, as evidenced by his mo re recent cognitive assessments; his
10521significant educational barriers (discussed in greater detail below) ; and his
10531social, vocational, and independent functioning prognoses.
105379 9 . As discussed in the Findings of Fact above, Jacob has been previously
10552evaluated and determined as a student with a disability under the IDEA, 20
10565U.S.C. § 1400, et seq . , for which he is entitled to receive ESE servi ces. In
10582enacting the IDEA, Congress sought to ensure that all children with
10593disabilities have available to them a free appropriate public education (FAPE) that emphasized special education and related services designed to
10613meet their unique needs and prepa re them for further education,
10624employment, and independent living. 20 U.S.C. § 1400(d)(1)(A); Phillip C. v. Jefferson Cty. Bd. of Educ. , 701 F.3d 691, 694 (11th. Cir. 2012). The statute
10649was intended to address the inadequate educational services offered t o
10660children with disabilities and to combat the exclusion of such children from the public school system. 20 U.S.C. § 1400(c)(2)(A) - (B). To accomplish these
10685objectives, the federal government provides funding to participating state and local educational age ncies, which is contingent on the agencys compliance
10706with the IDEAs procedural and substantive requirements. Doe v. Ala . State
10718Dept of Educ. , 915 F.2d 651, 654 (11th Cir. 1990).
10728100 . Parents and children with disabilities are accorded substantial
10738proc edural safeguards to ensure that the purposes of the IDEA are fully
10751realized. See Bd. of Educ. of Hendrick Hudson Cent. Sch. Dist. v. Rowley , 458
10765U.S. 176, 205 - 06 (1982). Among other protections, parents are entitled to
10778examine their childs records and pa rticipate in meetings concerning their
10789childs education; receive written notice prior to any proposed change in the
10801educational placement of their child; and file an administrative due process
10812complaint with respect to any matter relating to the identifi cation,
10823evaluation, or educational placement of [their] child, or the provision of a free appropriate public education [FAPE] to such child. 20 U.S.C. § 1415(b)(1),
10847(b)(3), (b)(6).
1084910 1 . Local school systems must satisfy the IDEAs substantive
10860requirement s by providing all eligible students with FAPE, which is defined
10872as:
10873Special education services that -- (A) have been
10881provided at public expense, under public
10887supervision and direction, and without charge; (B)
10894meet the standards of the State educational age ncy; (C) include an appropriate preschool, elementary
10909school, or secondary school education in the State
10917involved; and (D) are provided in conformity 21 with the individualized education program required under [20 U.S.C. § 1414(d)].
1093620 U.S.C. § 1401(9).
10940102 . The components of FAPE are recorded in an IEP, which, among other
10954things, identifies the childs present levels of academic achievement and
10964functional performance; establishes measurable annual goals; addresses the
10972services and accommodations to be provided to the child, and whether the
10984child will attend mainstream classes; and specifies the measurement tools
10994and periodic reports that will be used to evaluate the childs progress. 20
11007U.S.C. § 1414(d)(1)(A)(i); 34 C.F.R. § 300.320. Not less frequent ly than
11019annually, the IEP team must review and, as appropriate, revise the IEP. 20
11033U.S.C. § 1414(d)(4)(A)(i).
1103610 3 . Section 1003.5715 , Florida Statutes, delineates two specific actions
11047that require the Department of Education to adopt separate consent form s
11059with respect to an IEP. One such action is if a school district determines that
11074there is a need to change an exceptional students IEP as it relates to the
11089administration of an alternate assessment pursuant to section 1008.22 ,
11098Florida Statutes, and to pr ovide instruction in the state standards access
11110points curriculum. If so, the school must hold an IEP team meeting that
11123includes the parent to discuss the reason for the change. The school is
11136required to provide written notice of the meeting to the parent at least 10
11150days before the meeting, indicating the purpose, time, and location of the
11162meeting and who, by title or position, will attend the meeting. § 1003.5715(1)
11175and (4) , Fla. Stat .
11180104 . Section 1003.5717(5) further provides that the school district ma y not
11193implement the change (alternate assessment and access points curriculum)
11202without parental consent unless the school district documents reasonable efforts to obtain the parents consent and the childs parent has failed to
11224respond or the school distri ct obtains approval through a due process hearing.
1123710 5 . Here, the IEP team convened, as set forth in the Findings of Fact
11253above, and made a change in Jacobs IEP with respect to the alternate
11266assessment and access points curriculum. There is no evidence i n the record
11279to suggest that his parents failed to provide consent for the same or that the
11294Volusia County School District was required to initiate a due process hearing seeking approval of the change.
1131110 6 . The significance of this IEP change with respect to the present
11325proceeding (and specifically to whether Jacob is substantially mentally
11334impaired), is that it could not have occurred without the IEP teams
11346consensus that, as an initial matter, Jacob is a student with a significant cognitive disability. This phrase, like substantially mentally impaired, is
11369not defined by statue or rule. Rather the interpretation is left to the IEP team
11384when discharging their duty.
1138810 7 . Florida Administrative Code Rule 6A - 1.0943, entitled Statewide
11400Assessment for Stud ent with Disabilities provides, in pertinent part, as
11411follows:
11412(3) All students with disabilities will participate in
11420the statewide standardized assessment program
11425based on state standards, pursuant to Rule 6A -
114341.09401, F.A.C., without accommodations unles s
11440the individual educational plan (IEP) team, or the
11448team that develops the plan required under Section
11456504 of the Rehabilitation Act, determines and
11463documents that the student requires allowable
11469accommodations during instruction and for
11474participation in a statewide standardized
11479assessment.
11480* * *
11483(5) Participation in the Statewide, Standardized
11489Alternate Assessment. The decision that a student
11496with a significant cognitive disability will participate in the Statewide, Standardized Alternate Assessment as d efined in Section
115141008.22(3)(c), F.S., is made by the IEP team and recorded on the IEP. The provisions with regard to parental consent for participation in the Statewide, Standardized Alternate Assessment in accordance
11544with subsection 6A - 6.0331(10), F.A.C. , must be
11552followed. The following criteria must be met:
11559(a ) Even with appropriate and allowable
11566instructional accommodations, assistive technology
11570or accessible instructional materials, the student
11576requires modifications, as defined in paragraph 6A -
115846.0341 1(1)(z), F.A.C., to the grade - level general
11593state content standards pursuant to Rule 6A -
116011.09401, F.A.C. ; and,
11604(b) The student requires direct instruction in academic areas of English language arts, math, social studies and science based on access points,
11626pursuant to Rule 6A - 1.09401, F.A.C., in order to
11636acquire, generalize, and transfer skills across
11642settings.
1164310 8 . Having determined that Jacob is a student with a significant
11656cognitive disability, Jacob was enrolled in the access points curriculum, with
11667par ental consent, and is to be administered the FSAA - Performance Task,
11680based on the access points curriculum.
1168610 9 . The access point curriculum provides access to the general education
11699curriculum for students with significant cognitive disabilities. Fla. Ad min.
11709Code R. 6A - 1.09401(1). The standards, benchmarks, and access points are
11721contained in publications incorporated by reference and made a part of rule
117336A - 1.09401. An instructive history and explanation of access points is set
11746forth in the incorporated p ublication and provides, in pertinent part, as follows:
11759History of the Access Points
11764Beginning in 2006, access points became the means
11772through which students with a significant cognitive
11779disability have accessed the general education content found in the Next Generation Sunshine State Standards (NGSSS). Access points were developed for all standards with three complexity
11805levels that represented a continuum of
11811understanding (participatory, supported and independent). Courses containing these standards, also known as access courses, were developed to
11828support access for all students to the general education standards. These courses are setting neutral, which means a student working on access points can attend classes with non - disabled peers
11859in general educatio n courses. Students with a
11867significant cognitive disability work on a parallel curriculum that is aligned to the general education content but delivered at the individual level of complexity needed for the student to be successful. When the State Board o f Education adopted the
11907new Florida Standards in March 2014, it became necessary to develop new access points that are appropriate for Floridas students. As is the case
11931with the NGSSS, these new access points for
11939students with a significant cognitive disa bility fully
11947align with the Florida Standards. Moving forward,
11954access courses for students with significant
11960cognitive disabilities will be revised to contain
11967these new access points. This way, all students can continue to access the general education stand ards
11984in a way that promotes high expectations and encourages inclusive learning environments for students with a significant cognitive disability.
12003New Access Points Aligned to the Florida
12010Standards
12011Making the content of the Florida Standards
12018personally relevant and accessible to students with
12025a significant cognitive disability begins by articulating the general education content through
12037access points. The new access points in
12044English/Language Arts identify the most salient grade - level, core academic cont ent for students
12059with a significant cognitive disability. It is
12066important to note that the access points are NOT
12075extensions to the standards, but rather they
12082illustrate the necessary core content, knowledge and skills students with a significant cognitiv e
12096disability need at each grade to promote success in
12105the next grade. Essential Understandings, or EUs,
12112are supports and scaffolds that unpack the access points to assist in the teaching and learning of the standards.
12131Fla. Admin. Code R. 6A - 1.09401(1)(l).
121381 1 0. The undersigned, in construing the ordinary meaning of the word
12151substantial , agrees with Dr. Addeos interpretation that the word means
12162 significant or c onsiderable in q uantity and significantly great. In reaching
12176the conclusion that Jacob is s ubstantially mentally impaired, the
12186undersigned finds persuasive the IEP teams determination, with parental
12195consent, that Jacob is significantly cognitively disabled. That determination
12204was not arrived at by paid expert witnesses in anticipation of litiga tion, but
12218rather, by professional public educators and professionals, together with
12227parental consent.
122291 1 1 . These decision makers possess significant and frequent access to
12242Jacobs cognitive and adaptive functioning, diagnostic information, and
12250academic pe rformance data. Moreover, these individuals have the ability to
12261observe Jacobs independent functioning, social behavior, and communication skills and how the same impact him globally. The undersigned finds that
12281Jacobs status as significantly cognitively disabled in the educational setting
12291is complimentary and supportive of the conclusion that he is substantially
12302mentally impaired for purposes of determining NICA compensability.
12310112 . The undersigned concludes that Intervenors have met their burden of
12322est ablishing that Jacobs injury at issue rendered him substantially mentally
12333impaired. Having met the other criteria, the undersigned concludes that the
12344Intervenors met their burden of establishing that Jacob sustained a birth -
12356related neurological injury, as that term is defined in section 766.302(2).
1236711 3 . During the course of this litigation, the issue was raised as to
12382whether the notic e requirements set forth in s ection 766.316 were met . With
12397respect to the notice issue, a s the proponents of the proposition that
12410appropriate notice was given or that notice was not required, the burden on this issue of notice is upon the Intervenors. Tabb v. Fla. Birth - Related
12437Neurological Injury Comp. Ass'n. , 880 So. 2d 1253, 1257 (Fla. 1st DCA 2004).
12450Section 766.316, entitled Notice to obstetrical patients of participation in the plan, provides as follows:
12466Each hospital with a part icipating physician on its
12475staff and each participating physician, other than
12482residents, assistant residents, and interns deemed
12488to be participating physicians under
12493s. 766.314 (4)(c), under the Florida Birth - Related
12502Neurological Injury Compensation Plan sh all
12508provide notice to the obstetrical patients as to the
12517limited no - fault alternative for birth - related
12526neurological injuries. Such notice shall be provided
12533on forms furnished by the association and shall
12541include a clear and concise explanation of a
12549patien ts rights and limitations under the plan. The
12558hospital or the participating physician may elect to
12566have the patient sign a form acknowledging receipt
12574of the notice form. Signature of the patient
12582acknowledging receipt of the notice form raises a
12590rebuttable presumption that the notice
12595requirements of this section have been met. Notice
12603need not be given to a patient when the patient has
12614an emergency medical condition as defined in
12621s. 395.002 (8)(b) or when notice is not practicable.
1263011 4 . Here, Intervenors pre sented unrefuted evidence that Florida
12641Hospital Orlando and Dr. Christensen satisfied the notice requirements of
12651section 766.316. Dr. Theodosatos, a resident physician at the time of Jacobs
12663birth, was exempted from the notice requirements.
12670C ONCLUSION
12672B as ed on the foregoing Findings of Fact and Conclusions of Law, it is
12687O RDERED that:
126901. Jacob sustained a birth - related neurological injury, as defined in
12703section 766.302(2).
127052. Obstetrical services were delivered by participating physicians,
