49This cause came on for consideration upon a Motion for

59Summary Final Order filed by Respondent, Florida Birth - Related

69Neurological Injury Compensatio n Association (NICA), on April 18,

782016.

79STATEMENT OF THE CASE

83On October 9, 2015, Petitioner, Sarah Renee Kobryn, on

92behalf of and as parent and natural guardian of Westin David

103Kobryn (Westin), a minor, filed a Petition for Benefits Pursuant

113to Florida Statute Section 766.301 et seq. (Petition) with the

123Division of Administrative Hearings (DOAH) for a determination of

132compensability under the Florida Birth - Related Neurological

140Injury Compensation Plan (Plan). The Petition named Sharon M.

149Desmarais, M.D. , as the physician who provided obstetrical

157services at the birth of Westin on November 27, 2013, at Baptist

169Medical Center South located in Jacksonville, Florida.

176DOAH served NICA with a copy of the Petition on October 14,

1882015. On October 19, 2015, DOAH received a return receipt from

199the United States Postal Service showing Sharon M. Desmarais,

208M.D., had been served with a copy of the Petition. On

219December 11, 2015, DOAH received a return receipt from the United

230States Postal Office showing that Baptist Medical Center South

239had been served with the Petition.

245As of the date of this Summary Final Order of Dismissal,

256neither Dr. Desmarais nor Baptist Medical Center South has

265petitioned to intervene in this proceeding.

271On April 1, 2016, NICA filed a Respon se to Order Dated

283February 15, 2016, stating in part that Petitioner informed

292counsel for NICA that Petitioner no longer intends to obtain

302legal counsel in this matter and does not intend to contest

313NICAÓs determination that the claim is not compensable.

321On April 18, 2016, NICA filed a Motion for Summary Final

332Order, asserting that Westin did not sustain a "birth - related

343neurological injury" as that term is defined in section

352766.302(2), Florida Statutes. As of the date of this Summary

362Final Order of Di smissal, no response has been filed to the

374Motion for Summary Final Order.

379FINDINGS OF FACT

3821. Westin David Kobryn was born on November 27, 2013, at

393Baptist Medical Center South located in Jacksonville, Florida.

4012. Donald Willis, M.D. (Dr. Willis), was requested by NICA

411to review the medical records for Westin. In an affidavit dated

422April 1, 2016, Dr. Willis opined as follows:

430In summary, labor was induced for post - dates.

439Cesarean section was done for arrest of

446decent. The baby was depressed at bi rth with

455Apgar scores of 1/4/8, required intubation,

461but respiratory distress resolved quickly.

466Cord blood gas was within normal limits (pH

474of 7.11). The baby did not have any

482significant problems during the newborn

487hospital stay. Head imaging studies we re not

495done.

496As such, it is my opinion that there was no

506apparent obstetrical event that resulted in

512loss of oxygen or mechanical trauma to the

520babyÓs brain or spinal cord occurring in the

528course of labor, delivery, or resuscitation

534in the immediate post delivery period.

5403. NICA retained Laufey Y. Sigurdardottir, M.D.

547(Dr. Sigurdardottir), a pediatric neurologist, to examine Westin

555and to review his medical records. Dr. Sigurdardottir examined

564Westin on January 6, 2016. In an affidavit dated April 15, 2016,

576regarding her independent medical examination of Westin,

583Dr. Sigurdardottir opined as follows:

588The summary of the examination is as follows:

596Here we have a 2 - year 1 - month - old with

609documented low Apgar scores of 1 at 1 minute,

6184 at 5 minutes and 8 a t 10 minutes. He

629required endotracheal intubation at birth,

634but was discharged successfully after a rule

641out sepsis admission at 3 days of life. He

650has since then had a very mild delay in motor

660development and a more pronounced delay in

667language developm ent with possible autistic

673features, although he does not carry that

680diagnosis at this time. Language testing has

687revealed normal language comprehension, but a

693mild expressive language delay.

697. . . The patient is found to have no

707substantial physical imp airment and to have a

715mild mental impairment, mainly in areas of

722expressive language and possible autistic

727features.

728. . . There is evidence of a perinatal

737depression (low Apgars) and a mixed metabolic

744and respiratory acidosis that quickly

749resolved and no evidence of neurologic

755impairment or multisystem dysfunction in the

761immediate postnatal period is documented.

766MRI findings from December 2015 show non

773specific white matter abnormalities and a

779congenital abnormality (cavum Septum

783Pellucidum).

784. . . We would expect full life expectancy

793as he has no noticeable motor impairment and

801mild delays in language development. His

807possibly autistic features will need further

813testing. Overall p rognosis in areas of

820cognition are fair.

823As such, it is my opinion tha t the IME and

834record review do not support a finding that

842Westin suffered a birth - related neurological

849injury. I therefore do not recommend

855consideration for inclusion within the NICA

861program.

8624. A review of the file in this case reveals that there

874have been no expert opinions filed that are contrary to the

885opinion of Dr. Willis that there was no apparent obstetrical

895event that resulted in loss of oxygen or mechanical trauma to the

907baby's brain or spinal cord during labor, delivery or

916resuscitation in th e immediate post - delivery period. Dr. WillisÓ

927opinion is credited. There are no expert opinions filed that are

938contrary to Dr. SigurdardottirÓs opinion that Westin has no

947substantial physical impairment and to have a mild mental

956impairment, mainly in are as of expressive language.

964Dr. SigurdardottirÓs opinion is credited.

969CONCLUSIONS OF LAW

9725. The Division of Administrative Hearings has jurisdiction

980over the parties to and the subject matter of these proceedings.

991§§ 766.301 - 766.316, Fla. Stat.

9976. The Plan was established by the Legislature "for the

1007purpose of providing compensation, irrespective of fault, for

1015birth - related neurological injury claims" relating to births

1024occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

10357. The injured in fant, her or his personal representative,

1045parents, dependents, and next of kin may seek compensation under

1055the Plan by filing a claim for compensation with DOAH.

1065§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1073which administers the Pla n, has "45 days from the date of service

1086of a complete claim . . . in which to file a response to the

1101petition and to submit relevant written information relating to

1110the issue of whether the injury is a birth - related neurological

1122injury." § 766.305(4), Fl a. Stat.

11288. If NICA determines that the injury alleged in a claim is

1140a compensable birth - related neurological injury, it may award

1150compensation to the claimant, provided that the award is approved

1160by the administrative law judge to whom the claim has bee n

1172assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1183disputes the claim, as it has in the instant case, the dispute

1195must be resolved by the assigned administrative law judge in

1205accordance with the provisions of chapter 120, Florida Statutes.

1214§§ 766.304, 766.309, and 766.31, Fla. Stat.

12219. In discharging this responsibility, the administrative

1228law judge must make the following determination based upon the

1238available evidence:

1240(a) Whether the injury claimed is a birth -

1249related neurological inju ry. If the claimant

1256has demonstrated, to the satisfaction of the

1263administrative law judge, that the infant has

1270sustained a brain or spinal cord injury

1277caused by oxygen deprivation or mechanical

1283injury and that the infant was thereby

1290rendered permanently a nd substantially

1295mentally and physically impaired, a

1300rebuttable presumption shall arise that the

1306injury is a birth - related neurological injury

1314as defined in s. 766.303(2).

1319(b) Whether obstetrical services were

1324delivered by a participating physician in t he

1332course of labor, delivery, or resuscitation

1338in the immediate postdelivery period in a

1345hospital; or by a certified nurse midwife in

1353a teaching hospital supervised by a

1359participating physician in the course of

1365labor, delivery, or resuscitation in the

1371imme diate postdelivery period in a hospital.

1378§ 766.309(1), Fla. Stat. An award may be sustained only if the

1390administrative law judge concludes that the "infant has sustained

1399a birth - related neurological injury and that obstetrical services

1409were delivered by a participating physician at birth."

1417§ 766.31(1), Fla. Stat.

142110. The term "birth - related neurological injury" is defined

1431in section 766.302(2) as follows:

"1436Birth - related neurological injury" means

1442injury to the brain or spinal cord of a live

1452infant we ighing at least 2,500 grams for a

1462single gestation or, in the case of a

1470multiple gestation, a live infant weighing at

1477least 2,000 grams at birth caused by oxygen

1486deprivation or mechanical injury occurring in

1492the course of labor, delivery, or

1498resuscitation in the immediate postdelivery

1503period in a hospital, which renders the

1510infant permanently and substantially mentally

1515and physically impaired.

151811. The evidence, which is not refuted, established that

1527Westin did not sustain an injury to the brain or spinal cord

1539caused by oxygen deprivation or mechanical injury in the course

1549of labor, delivery, or resuscitation in the immediate post -

1559delivery period in a hospital which rendered him permanently and

1569substantially mentally and physically impaired. Therefore,

1575We stin is not eligible for benefits under the Plan.
