36This cause came before the Administrative Law Judge on

45RespondentÓs motion to dismiss. A response in opposition to the

55motion was filed by Petitioner. The motion was denied, but the

66parties were informed that th e case might be resolved if the

78parties could stipulate to a material fact that was not made

89clear in the petition for hearing. The parties then filed a

100joint stipulation. A telephonic hearing was held on November 18,

1102015.

111Petitioner filed a Petit ion for Challenge of Rule. In the

122petition, Petitioner did not state under what statutory authority

131it was filing the challenge. The Clerk of the Division of

142Administrative Hearings determined from a review of the petition

151that it was intended to be a ch allenge to an agency statement

164defined as a rule, which is authorized by section 120.56(4),

174Florida Statutes (2015). The Clerk assigned the suffix ÐRUÑ to

184the case, short for ÐRule Unpromulagated.Ñ The allegations of

193the petition are ambiguous, but Petit ioner is clearly not

203challenging the rule which is the focus of its argument, Florida

214Administrative Code Rule 5E - 1.002(1), because Petitioner likes

223this rule and believes it grants Petitioner a regulatory

232exemption.

233PetitionerÓs claims and arguments demo nstrate that it is

242actually claiming that rule 5E - 1.002(1) was misapplied by

252Respondent. Such a claim is not a rule challenge and, on that

264basis alone, the petition can be dismissed. However, it is also

275explained below why the petition must be dismissed because

284RespondentÓs statement is not an unpromulgated rule.

291Petitioner sells a product it calls Majic Earth, which

300consists of earthworm castings. The agency statement that

308Petitioner objects to is RespondentÓs statement that his product

317is a fertiliz er and cannot be sold without complying with the

329registering and labeling requirements for fertilizers.

335Petitioner contends this agency statement is inconsistent with

343rule 5E - 1.002(1), which Petitioner believes makes his product

353exempt from the registerin g and labeling requirements of chapter

363576, Florida Statutes.

366Rule 5E - 1.002(1) provides an exemption from fertilizer

375registering and labeling requirements for unmanipulated manures

382(such as worm castings) :

387Exemptions. Unmanipulated manures, by

391Section 5 76.011(12), F.S., are exempted from

398the provisions of Chapter 576, F.S., and

405therefore, are not required to be registered,

412labeled or meet any requirements of this

419chapter.

420Section 576.011(12), Florida Statutes, which is cited in the

429rule, is the definiti on of ÐfertilizerÑ:

436ÐFertilizerÑ means any substance which:

441(a) Contains one or more recognized plant

448nutrients and promotes plant growth; or

454(b) Controls soil acidity or alkalinity; or

461(c) Provides other soil enrichment; or

467(d) Provides other corrective measures to the

474soil.

475For the purpose of this chapter, the term

483Ðfertilizer Ñ does not include unmanipulated

489animal or vegetable manures, peat or compost

496which makes no claims as described in

503paragraphs (a) Î (d).

507Under this definition, an unmanipulated manure is a fertil izer

517and is subject to registering and labeling requirements if it

527makes any of the listed claims.

533By joint stipulation, it was established that Petitioner

541uses a product label that claims Majic Earth promotes soil

551aeration and drainage, plant and root g rowth, seed germination,

561reintroduction of vital microbes killed by chemicals, growth with

570natural plant hormones, and water retention. By making these

579claims, Petitioner has made Majic Earth meet the definition of

589fertilizer in section 576.011(12) and ha s made the product

599ineligible for the exemption stated in rule 5E - 1.002(1).

609The issue is not whether Majic Earth is a good product or

621whether the law should be changed. RespondentÓs statement that

630Majic Earth is a fertilizer that must comply with regis tering and

642labeling requirements is consistent with the plain meaning of

651section 576.011(12) and rule 5E - 1.002(1). An agency statement of

662how a statute or rule applies, which adds nothing to the plain

674meaning of the statute or rule, is not a rule because such a

687statement does not have any effect of its own on regulated

698persons. See Amerisure Mutual Ins. Co. v. DepÓt of Fin. Servs. ,

709156 So. 3rd 520, 532 (Fla. 1st DCA 2015). It is rule 5E -

7231.002(1), itself, that has the effect Petitioner objects to.

732T he deficiency in the petition cannot be cured by

742amendment. Accordingly, it is

746ORDERED that the petition for hearing is DISMISSED with

755prejudice.
