102STATEMENT OF THE ISSUE
106The issue in this case is whether the Department of
116Financial Services, Division of State Fire Marshal can revoke
125Respondent ' s certification as a firefighter because Respondent
134failed to timely complete the requirements to maintain his
143Firefighter Certificate of Compliance prior to September 30,
1512011, pursuant to section 633.352, Florida Statutes (2010).
159PRELIMINARY STATEMENT
161By correspondence dated July 2, 2015, the Department of
170Financial Services, Division of State Fire Marshal
177( " Department " ), issued Patrick Pointu ( " Respondent " or " Pointu " )
188a Notice of Intent to Revoke Firefighter Certificate of
197Compliance ( " N otice " ) . On or about July 18 , 2015, Respondent
210disputed the Notice and submitted a request for a formal
220hearing.
221On November 2, 2015, t he matter was referred to the
232Division of Administrative Hearings for assignment of an
240administrative law judge to conduct the hearing Respondent
248requested. The undersigned placed the m atter in abeyance after
258the Department requested the case be stayed pending a
267legislative amendment, which directly impacted Respondent ' s
275certifications.
276As noted above, the final hearing was held on June 3 , 2016 .
289At hearing, the Department moved to amend the Notice, which
299proposed to change the legal basis for Respondent ' s revocation
310to section 633.352, Florida Statutes ( 2010). The undersigned
319granted the unopposed motion.
323D uring the hearing, P ointu testified o n his own behalf.
335Respondent called no other witnesses, and submitted Exhibits 1
344through 5 into evidence. The Department presented the testimony
353of Michael Tucker , i nterim c hief for the Bureau of Fire
365Standards and Training , as a witness. The Department introduced
374three exhibits into evidence.
378The proceedings were transcribed, and the parties availed
386themselves of the right to submit proposed recommended orders.
395The one - volume Transcript of the final hearing was filed with
407the Division of Administrative Hearings on July 19, 2016.
416Petitioner and Respondent timely filed proposed recommended
423orders, which have been considered in the preparation of this
433Recommended Order.
435FINDINGS OF FACT
4381. The Department is the state agency charged with th e
449responsibility for certifying firefighters in the State of
457Florida, pursuant to chapter 633, Florida Statutes .
4652. On June 30, 2006, Respondent also obtained
473certification as a fire I nstructor III.
4803. On October 9, 2006, Pointu obtained his Firefighter II
490Certificate of Compliance ("certification").
4964. On September 30, 2008, Respondent stopp ed volunteering
505with Lauderdale - B y - The - Sea Volunteer Fire Department
517("Lauderdale - By - The - Sea").
5265. Prior to July 1, 2010, state certified fire instructors
536were able to maintain their firefighter certification as long as
546their fire instructor certification was current.
5526. On July 1, 2010, the statutory requirements for
561firefighters changed. Section 633.352 was amended to require a
570certified firefighter be a full - time fire instructor or a full -
583time fire inspector to maintain certification.
5897. The 2010 statutory change retained a three - year period
600for firefighters to complete the requirements to maintain
608certification.
6098. It is u ndisputed that between September 30, 2008, and
620September 30, 2011, Pointu did not perform any of the necessary
631requirements to maintain his certification in section 633.352,
639such as retake the Minimum Standards Examination; maintain
647employment as a firefig hter or volunteer firefighter; or work
657full time as an instructor or firesafety inspector.
6659. On April 6, 2012, t he Department distributed a n
676informational bulletin titled " Firesafety Instructors &
682Maintenance of Firefighter Certification. " The bulletin stated
689in bold " The 3 - year period begins on July 1, 2010 for persons
703who held an active instructor certification and an active
712firefig hter certification as of June 30th , 2010. "
72010. Question 7 of the bulletin also provided :
7297. Is the Division of the S tate F ire
739Marshal attempting to amend the State
745Statute to reflect the previous language
751that does not require " full - time employment
759as a fire instructor " ?
763The Division has attempted to amend or
770reinstate this language, however, the
775Statute remains unchang ed, and the Division
782may not be successful in amending the
789language to its previous form.
79411. Pointu received the 2012 bulletin and determined that
803since he held an active instructor certification and active
812firefighter certification as of June 30, 2010, his firefighter
821certification period started July 1, 2010, and expired July 1,
8312013.
83212. On July 1, 2013, section 633.352 was revised amended
842and renumbered legisla ture as section 633.414. The statutory
851amendment also changed the three - year recertification cycle to a
862four - year cycle and remov ed the full - time instructor
874requirement.
87513. Respondent used the 2013 statutory change to calculate
884his certification validation date until 2018.
89014. In 2014, Pointu contacted the Department regarding his
899certification after being told by a county official that his
909certification was not valid . Thereafter , over an approximate
918two - year period, Respondent was informed various and conflicting
928information regarding his certification status and expiration
935dates.
93615. The Department does not have a statutory requirement
945to provide notice to certified individuals of requirements to
954maintain certification.
95616. The Fire College Department of Insurance Continuing
964Education ( " FCDICE " ) database monitors and manages all
973firefighters ' certifications.
97617 . Department ' s interim chief , Michael Tucker ("Tucker") ,
988made the final decision regarding Point u ' s certification.
998Tucker reviewed FCDICE and did not find an y records which
1009demonstrated Pointu ' s renewal o f certification prior to
1019September 29 , 2011.
10221 8 . Tucker correctly determined that the 2010 version of
1033the statute applied to Pointu ' s certification because Respondent
1043left his employment at Lauderdale - By - The - Sea on September 30,
10572008 , which made his three - year period for renewal deadline
1068September 3 0, 2011 , p ursuant to section 633.352 .
107819. Tucker also established that Pointu did not ful fill
1088the minimum requirements to renew his certification prior to
1097September 30, 2011 , because he did not become employed again,
1107volu nteer with a fire department, become a full - time fire
1119inspector or a full - time instructor, or retake the practical
1130portion of the examination.
113420. After evaluating Respondent ' s certification history,
1142Tucker concluded Respondent failed to meet the minimum
1150firefighter requirements and therefore Pointu ' s certification is
1159not valid and should be revoked.
116521. At hearing, Tucker a cknowledged that he was not
1175familiar with the issuance of the April 6, 2012 , bulletin , but ,
1186after reviewing it , he determined there were misstatement s in
1196the bulletin regarding requirements for certification because
1203the Department did not have the authority to waive any statutes.
121422. On June 3, 2011, Petitioner issued an amended N otice
1225that it intend ed to revoke Po intu ' s certification for failure
1238to renew his certification with in three years of employment
1248termination from an organized fire department pursuant to
1256section 633.352.
125823. Pointu contested the notice and requested a hearing.
1267CONCLUSIONS OF LAW
127024. The Division of Administrative Hearings has
1277jurisdiction over this matter pursuant to section 120.57(1),
1285Florida Statutes (2016) . Unless specifically stated otherwise
1293herein, all references to Florida Statutes will be in the 2010
1304version.
130525. Petitioner seeks to take disciplinary action and
1313revoke Respondent ' s firefighter certification. A proceeding to
1322impose discipline against a professional license is penal in
1331nature, and Petitioner bears the burden to prove the allegations
1341in the amended Notice by cle ar and convincing evidence. Dep't
1352of Banking & Fin. v. Osborne Stern & Co. , 670 So. 2d 932 (Fla.
13661996); Ferris v. Turlington , 510 So. 2d 292 (Fla. 1987).
137626. Clear and convincing evidence :
1382[r]equires t hat the evidence must be found
1390to be credible; the facts to which the
1398witnesses testify must be distinctly
1403remembered; the testimony must be precise
1409and explicit and the witnesses must be
1416lacking in confusion as to the facts in
1424issue. The evidence must be of such weight
1432that it produces in the mind of the trier of
1442fact a firm belief or conviction, without
1449hesitancy, as to the truth of the
1456allegations sought to be established.
1461In re Henson , 913 So. 2d 579, 590 (Fla. 2005)(quoting Slomowitz
1472v. Walker , 429 So. 2d 797, 800 (Fla. 4th DCA 1983)).
148327. Section 633. 352 sets forth the minimum standards
1492required for Pointu to maintain his firefighters certification:
1500Retention of firefighter certification. Ï Any
1506certified firefighter who has not been
1512active as a firefighter, or as a volunteer
1520firefighter with an organized fire
1525department, for a period of 3 years shall be
1534required to retake the practical portion of
1541the minimum standards state examination
1546specif ied in rule 69A - 37.056(6)(b), Florida
1554Administrative Code, in order to maintain
1560her or his certification as a firefighter;
1567however, this requirement does not apply to
1574state - certified firefighters who are
1580certified and employed as full - time
1587firesafety inspe ctors or firesafety
1592instructors, regardless of the firefighter ' s
1599employment status. The 3 - year period begins
1607on the date the certificate of compliance is
1615issued or upon termination of service with
1622an organized fire department.
162628. The amended Notice cor rectly charges Respondent with
1635failing to meet the requirements of section 633.352. Pointu
1644contends that the Department's April 6 , 2012 , bulletin dictates
1653that his certification status is valid until July 1, 2013. The
1664undersigned is not persuaded that t he Department ' s bulletin is
1676controlling in th is matter for the bulletin can n either serve as
1689authority nor vary the requirements from the express language of
1699section 633.352 . The record is also void of evidence to
1710demonstrate how a bulletin issued in April 2012, prevented
1719Respondent from completing the requirements of 2011 . On such
1729grounds, the undersigned rejects Respondent ' s estoppel argument.
173829. To that end, t he Department has met its burden and
1750proven that Respondent failed to meet the minimum standards for
1760certification pursuant to section 633.352 because i t is
1769undisputed that between September 30, 2008, and September 30 ,
17782011 , Respondent did not complete any of the necessary
1787certification requirements such as retake the Minimum Sta ndards
1796Examination; have employ ment as a firefighter or volunteer
1805firefighter; or work full time as an instructor or firesafety
1815inspector. Accordingly, it is proper to revoke Respondent ' s
1825certification that is not valid.
1830RE COMMENDATION
1832Based on the foregoing Findings of Fact and Conclusions
1841of Law, it is RECOMMENDED that the Department of Financial
1851Services, Division of State Fire Marshal , enter a final order
1861finding that Respondent, Pa t r ick Pointu, violated section
1871633.252 , Florida Sta tutes . It is further RECOMMENDED that
1881Respondent ' s Firefighter Certificate of C ompliance be revoked.
