104On November 3 , 201 5 , Petitioner, S hawn E. Ware , individually

115and on behalf of Jordan Ware ( Jordan ), a minor, filed a Petition

139(Petition) with the Division of Administrative Hearings (DOAH)

158Related Neurological Injury Compensation Plan (Plan). The

165Petition named Jayasri Bukkapatnam , M . D. , and Stephanie L.

175Ladowski, M.D., as the physician s who provided obstetric services

185for the birth of Jordan on July 28, 2008, at Winnie Palmer

284Intervene, which was granted by Order dated December 2, 2015.

294On February 16 , 201 6 , NICA filed a n Unopposed Motion for

306Summary Final Order, requesting that a s ummary f inal o rder be

319entered finding that the claim was not compensable because Jordan

329did not sustain a Ðbirth - related neurological injuryÑ as that

340term is defined in section 766.302(2), Florida Statutes .

349FINDINGS OF FACT

3521. Jordan Ware was born on July 28 , 2 008 , at Winnie Palmer

365Hospital in Orlando , Florida.

3692. Donald Willis, M.D. (Dr. Willis), was requested by NICA

379to review the medical records for Jordan . In a report dated

391December 14 , 201 5 , Dr. Willis described his findings in pertinent

402part as follows:

405Cesarean section was uncomplicated. Am niotic

411fluid was clear. Birth weight was 2,914

419grams or 6 lbs 7 ozÓs. The baby was not

429depressed at birth. Apgar scores were normal

436at 9/9. Cord blood gas was normal with a pH

446of 7.25.

448* * *

451Seizures were diagnosed in 2003, at about 5

459years of age. Neurology clinic at 6 years of

468age gives a history of seizures and

475developmental delay. EEGÓs were either read

481as normal, or patterns consistent with

487heightened tendency for seizures.

491CT scan was done at one year of age for

501failure to thrive and was neg ative. MRI in

5102014 identified mesial temporal sclerosis,

515which is a finding consistent with epilepsy.

522In summary, Cesarean section delivery was

528done at 36 weeks due to a non - reassuring FHR

539pattern and reduced amniotic fluid volume.

545The baby was not depr essed at birth. Apgar

554scores were 9/9 and pH was normal at 7.25.

563The baby was described as a healthy newborn.

571The newborn hospital course was benign.

577There was no apparent obstetrical event that

584resulted in loss of oxygen or mechanical

591trauma to the ba byÓs brain during labor,

599delivery or the immediate post delivery

605period.

6063. A review of the file reveals that no contrary evidence

617was presented to dispute Dr. WillisÓ finding that JordanÓs

626injuries were not the result of oxygen deprivation or mechanic al

637injury during labor, delivery, or the immediate post - delivery

647period. Dr. WillisÓ opinion is credited.

6534. The Petition was filed on November 3, 2015, which is

664more than five years after JordanÓs birth.

671CONCLUSIONS OF LAW

6745 . The Division of Administr ative Hearings has jurisdiction

684over the parties to and the subject matter of these proceedings.

695§§ 766.301 - 766.316, Fla. Stat.

7016 . The Plan was established by the Legislature "for the

712purpose of providing compensation, irrespective of fault, for

720birth - r elated neurological injury claims" relating to births

730occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

7417 . The injured infant, her or his personal representative,

751parents, dependents, and next of kin may seek compensation under

761the Plan by filing a claim for compensation with DOAH.

771§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

779which administers the Plan, has "45 days from the date of service

791of a complete claim . . . in which to file a response to the

806petition and to s ubmit relevant written information relating to

816the issue of whether the injury is a birth - related neurological

828injury." § 766.305(4), Fla. Stat.

8338 . NICA has determined that Petitioner do es not have a

845claim that is compensable under the Plan and has fil ed a Motion

858for Summary Final Order, requesting that an order be entered

868finding that the claim is not compensable.

8759 . In ruling on the motion, the a dministrative l aw ju dge

889must make the following determination based upon the available

898evidence:

899(a) Whet her the injury claimed is a birth -

909related neurological injury. If the claimant

915has demonstrated, to the satisfaction of the

922administrative law judge, that the infant has

929sustained a brain or spinal cord injury

936caused by oxygen deprivation or mechanical

942in jury and that the infant was thereby

950rendered permanently and substantially

954mentally and physically impaired, a

959rebuttable presumption shall arise that the

965injury is a birth - related neurological injury

973as defined in s. 766.303(2).

978§ 766.309(1), Fla. Stat .

98310 . The term "birth - related neurological injury" is defined

994in section 766.302(2) as follows:

"999Birth - related neurological injury" means

1005injury to the brain or spinal cord of a live

1015infant weighing at least 2,500 grams for a

1024single gestation or, in th e case of a

1033multiple gestation, a live infant weighing at

1040least 2,000 grams at birth caused by oxygen

1049deprivation or mechanical injury occurring in

1055the course of labor, delivery, or

1061resuscitation in the immediate postdelivery

1066period in a hospital, which re nders the

1074infant permanently and substantially mentally

1079and physically impaired.

108211 . The evidence, which is not refuted, established that

1092there was not an obstetrical event that resulted in loss of

1103oxygen or mechanical trauma to JordanÓs brain during la bor,

1113delivery or the immediate post - delivery period. Thus, Jordan is

1124not eligible for benefits under the Plan.

113112. Moreover, the Petition Under Protest was filed more

1140than five years after the birth of Jordan. This is beyond the

1152five - year statute of l imitations set forth in section 766.313,

1164and is, therefore, barred.

1168CONCLUSION

1169Based upon the foregoing Findings of Fact and Conclusions of

1179Law, it is ORDERED that the Petition filed by Shawn E. Ware ,

1191individually and on behalf of Jordan Ware , a minor, i s dismissed

1203with prejudice.
