48This cause came on for consideration upon a Motion for
58Summary Final Order filed by Respondent, Florida Birth - Related
68Neurological Associa tion (NICA), on June 20, 2016.
76STATEMENT OF THE CASE
80On November 18, 2015, Petitioners, Erika L. Guerrero and
89Vinicio Concepcion, individually and on behalf of
96Xavier Concepcion (Xavier), a minor, filed a Petition Under
105Protest Pursuant to Florida Statute Section 766.301 et seq.
114(Petition), with the Division of Administrative Hearings (DOAH).
122The Petition requested a determination that XavierÓs injuries are
131not compensable under the NICA Plan.
137The Petition named Stefan Novac, M.D., as the physician
146providi ng obstetric services at the birth of Xavier at Memorial
157Hospital West in Pembroke Pines, Florida , on September 16, 2014.
167DOAH served NICA with a copy of the Petition on December 1,
1792015. On December 7, 2015, DOAH received a return receipt from
190the United States Post Office showing that Memorial Hospital West
200had been served with a copy of the Petition. On January 14, 2016,
213DOAH received a return receipt from the United States Post Office
224showing that Stefan Novac, M.D., had been served with a copy of
236the Petition. To date, neither Memorial Hospital West nor
245Dr. Novac has petitioned to intervene in this proceeding.
254On June 9, 2016, NICA filed a Notice of Non - compensability
266and Request for Evidentiary Hearing on Compensability, giving
274notice that the injur y does not "meet the definition of a 'birth -
288related neurological injury' as defined in section 766.302(2),
296Florida Statutes, which specifically requires that the injury
304render 'the infant permanently and substantially mentally and
312physically impaired.'" N ICA requested that a hearing be scheduled
322to resolve whether the claim was compensable.
329On June 1 6, 2016, NICA and Petitioners filed a Response to
341Order indicating that neither NICA nor the Petitioners thought a
351hearing was necessary. On June 20, 2016, N ICA filed a Motion for
364Summary Final Order, asserting that Xavier did not sustain a
374birth - related neurological injury as that term is defined in
385section 766.302(2), Florida Statutes. The Motion stated that
393Petitioners agreed that a hearing was not necessa ry and that the
405case could be disposed of pursuant to a Summary Final Order.
416FINDINGS OF FACT
4191. Xavier Concepcion was born on September 16, 2014, at
429Memorial Hospital West in Pembroke Pines, Florida.
4362. NICA retained Donald C. Willis, M.D. (Dr. Willis ), to
447review XavierÓs medical records. In a medical report dated
456January 20, 2016, Dr. Willis made the following findings and
466expressed the following opinion:
470In summary, labor was complicated by maternal
477infection (chorioamnionitis) and a non -
483reassuring FHR pattern prior to birth. The
490baby was depressed at birth with a cord blood
499pH of < 6.9.="" seizure="" activity="">
501shortly after birth. MRI was consistent with
508acute brain infarction.
511There was an apparent obstetrical event that
518resulted in loss of oxygen to the babyÓs brain
527during labor, delivery and continuing into the
534immediate post delivery period. It is
540possible the brain injury from oxygen
546deprivation was worsened by infection. I am
553unable to comment about the severity of the
561brain injury.
5633 . Dr. WillisÓ opinion that there was an obstetrical event
574that resulted in loss of oxygen to the babyÓs brain during labor,
586delivery and continuing into the immediate post delivery period
595is credited.
5974. Respondent retained Michael Duchowny, M.D.
603(Dr. Du chowny), a pediatric neurologist, to evaluate Xavier.
612Dr. Duchowny reviewed XavierÓs medical records, and performed an
621independent medical examination on him on May 25, 2016.
630Dr. Duchowny made the following findings and summarized his
639evaluation as follo ws:
643Motor examination reveals symmetric muscle
648strength, bulk and tone. There are no
655adventitious movements and no focal weakness
661or atrophy. Xavier does not evidence
667dystonic postures or hypertonicity. He has
673full range of motion at all joints.
680Coord ination : Xavier walks in a stable
688fashion and does not fall. He can arise from
697the floor without difficulty. His balance is
704good and he has well - developed axial and
713peripheral balance. He grasps with both
719hand[s] and moved objects between hands
725without difficulty. He did not fall and his
733head control is good.
737* * *
740In Summary, XavierÓs neurological examination
745discloses no significant findings. He is
751developmentally appropriate with no focal or
757lateralizing features to suggest a structural
763brain abn ormality.
766Review of the medical records reveals that
773Xavier was born at Memorial West Hospital at
781term and transferred to Joe DiMaggio
787ChildrenÓs Hospital. Maternal membranes were
792ruptured 30 hours prior to delivery, and
799maternal chorioamnionitis and fev er were
805treated with penicillin. Xavier was born
811vaginally and was pale, cyanotic, flaccid and
818unresponsive. A tight nuchal cord was
824removed. He weighed 7 pounds 7 ounces and
832his Apgar scores were 1, 5 and 7 at one,
842five, and ten minutes.
846The records i ndicated that an initial
853arterial pH was 6.95 but the base excess was
862unknown. Xavier was intubated at 3 minutes
869of age, established spontaneous respiration
874at 25 minutes of age and was subsequently
882extubated. His CBC revealed a bandemia of 22
890on Septemb er 22 nd . Seizures were noted on
900the first day of life and there was evidence
909of a mild coagulopathy. The placenta was
916positive for E.coli.
919An MRI scan of the brain revealed multiple
927acute infarcts in the left temporal,
933occipital and superior parietal re gions and
940right thalamus and putamen, and a small
947subdural hematoma.
949Despite XavierÓs difficulties at birth, he
955has developed well and does not evidence
962neurodevelopmental delay. I am therefore not
968recommending Xavier for compensation within
973the NICA pro gram.
9775. In order for a birth - related injury to be compensable
989under the Plan, the injury must meet the definition of a birth -
1002related neurological injury and the injury must have caused both
1012permanent and substantial mental and physical impairment.
10196. Dr. DuchownyÓs opinion that Xavier has developed well
1028and does not evidence neurodevelopmental delay is credited.
10367. A review of the file in this case reveals that there
1048have been no expert opinions filed that are contrary to the
1059opinion of Dr. Duchowny that Xavier has developed well and does
1070not evidence neurodevelopmental delay. There is nothing in
1078Dr. DuchownyÓs report that indicates that Xavier has either a
1088substantial mental or physical impairment. Thus, Xavier does not
1097meet the requirement of havi ng a substantial physical or mental
1108impairment.
1109CONCLUSIONS OF LAW
11128. The Division of Administrative Hearings has jurisdiction
1120over the parties to and the subject matter of this proceeding.
1131§§ 766.301 - 766.316, Fla. Stat. (2014).
11389. The Plan was establ ished by the Legislature "to provide
1149compensation on a no - fault basis, for a limited class of
1161catastrophic injuries that result in unusually high costs for
1170custodial care and rehabilitation." § 766.301, Fla. Stat. The
1179Plan applies only to a birth - related neurological injury, which is
1191defined in section 766.302(2) as follows:
"1197Birth - related neurological injury" means
1203injury to the brain or spinal cord of a live
1213infant weighing at least 2,500 grams for a
1222single gestation or, in the case of a multiple
1231gesta tion, a live infant weighing at least
12392,000 grams at birth caused by oxygen
1247deprivation or mechanical injury occurring in
1253the course of labor, delivery, or
1259resuscitation in the immediate postdelivery
1264period in a hospital, which renders the infant
1272permanent ly and substantially mentally and
1278physically impaired . This definition shall
1284apply to live births only and shall not
1292include disability or death caused by genetic
1299or congenital abnormality. (emphasis added).
130410. The injured infant, her or his personal representative,
1313parents, dependents, and next of kin, may seek compensation under
1323the P lan by filing a claim for compensation with DOAH.
1334§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. The Florida
1343Birth - Related Neurological Injury Compensation Ass ociation, which
1352administers the Plan, has "45 days from the date of service of a
1365complete claim . . . in which to file a response to the petition
1379and submit relevant written information relating to the issue of
1389whether the injury is a birth - related neurolo gical injury."
1400§ 766.305(4), Fla. Stat.
140411. If NICA determines that the injury alleged in a claim is
1416a compensable birth - related neurological injury, it may award
1426compensation to the claimant, provided that the award is approved
1436by the Administrative La w Judge to whom the claim has been
1448assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1459disputes the claim, as it has in the instant case, the dispute
1471must be resolved by the assigned Administrative Law Judge in
1481accordance with the provisions o f chapter 120, Florida Statutes.
1491§§ 766.304, 766.309, and 766.31, Fla. Stat.
149812. In discharging this responsibility, the Administrative
1505Law Judge must make the following determinations based upon all
1515available evidence:
1517(a) Whether the injury claimed is a birth -
1526related neurological injury. If the claimant
1532has demonstrated, to the satisfaction of the
1539administrative law judge, that the infant has
1546sustained a brain or spinal cord injury caused
1554by oxygen deprivation or mechanical injury and
1561that the infan t was thereby rendered
1568permanently and substantially mentally and
1573physically impaired, a rebuttable presumption
1578shall arise that the injury is a birth - related
1588neurological injury as defined in s.
1594766.302(2).
1595(b) Whether obstetrical services were
1600delive red by a participating physician in the
1608course of labor, delivery, or resuscitation in
1615the immediate postdelivery period in a
1621hospital; or by a certified nurse midwife in a
1630teaching hospital supervised by a
1635participating physician in the course of
1641labor, d elivery, or resuscitation in the
1648immediate postdelivery period in a hospital.
1654§ 766.309(1), Fla. Stat. An award may be sustained only if the
1666Administrative Law Judge concludes that the "infant has sustained
1675a birth - related neurological injury and that o bstetrical services
1686were delivered by a participating physician at birth."
1694§ 766.31(1), Fla. Stat.
169813. In the instant case, Petitioners filed a claim for a
1709determination of whether Xavier did sustain a birth - related
1719neurological injury that is compensabl e under the NICA P lan. As
1731the proponent of the issue of compensability, the burden of proof
1742is upon Petitioners. § 766.309(1)(a), Fla. Stat. See also Balino
1752v. Dep't of Health & Rehab. Servs. , 348 So. 2d 349, 350 (Fla. 1st
1766DCA 1977)("[T]he burden of pro of, apart from statute, is on the
1779party asserting the affirmative of an issue before an
1788administrative tribunal.").
179114. While Dr. Willis established that there was an apparent
1801obstetrical event which resulted in loss of oxygen to the babyÓs
1812brain during l abor, delivery, and continuing into the immediate
1822post delivery period, the remaining issue to be determined is
1832whether the injury resulted in a permanent and substantial mental
1842impairment and a permanent and substantial physical impairment,
1850inasmuch as bo th are required to establish compensability. Fla.
1860Birth - Related Neurological Injury Comp. Ass'n v. Div. of Admin.
1871Hearings , 686 So. 2d 1349 (Fla. 1997).
187815. The evidence, which is not refuted, established that
1887Xavier does not have a permanent and subs tantial mental or
1898physical impairment. Thus, Xavier is not entitled to benefits
1907under the Plan.
1910CONCLUSION
1911Based on the foregoing Findings of Fact and Conclusions of
1921Law, it is ORDERED :
1926T hat the P etition filed by Erika L. Guerrero and
1937Vin i cio Concepcion, individually and on behalf of Xavier
1947Concepcion, is dismissed with prejudice.
1952DONE AND ORDERED this 23rd day of June , 2016 , in
