50This cause came on for consideration upon a Motion for
60Summary Final Order filed by Respondent, Florida Birth - Related
70Neurological Injury Comp ensation Association (NICA), on May 31,
792016.
80STATEMENT OF THE CASE
84On November 24, 2015, Petitioners, Crystal Sumpter and
92Peter Davis, on behalf of and as parents and natural guardians of
104Luke Z. Davis (Luke), a minor, filed a Petition for Determination
115of Compensability of Injuries Pursuant to Florida Statute 766.301
124et seq. (Petition) with the Division of Administrative Hearings
133(DOAH) for a determination of compensability under the Florida
142Birth - Related Neurological Injury Compensation Plan (Plan). Th e
152Petition named Patrick Duff, M.D., as the physician providing
161obstetrical services at the birth of Luke on March 27, 2014, at
173Shands at the University of Florida (Shands), Gainesville,
181Florida.
182DOAH served NICA with a copy of the Petition on December 11,
1942015. DOAH served Patrick Duff, M.D., with a copy of the
205Petition on January 4, 2016. A copy of the Petition was sent via
218certified mail to Shands on December 3, 2015 , and again on
229May 19, 2016. On June 22, 2016, DOAH received a return receipt
241from the United States Post Office showing that Shands had been
252served with a copy of the Petition.
259On April 13, 2016, Respondent filed its Response to Petition
269for Benefits, suggesting that the subject claim is not
278compensable, and requesting that a hearing be sc heduled to
288address such issue.
291On April 19, 2016, the undersigned entered an Order
300instructing the parties to confer and advise the undersigned in
310writing as to the need for a hearing, if any, and if a hearing is
325needed, stating when they will be prepared to proceed to hearing;
336the issue(s) still in dispute; their estimate of the time
346required for hearing; and their choice of venue.
354On May 18, 2016, Petitioners filed a Response to Order
364Entered on April 19, 2016, stating that Petitioners, after
373consultation with counsel and a review of the records , have
383elected not to proceed with a final administrative hearing, and
393accept the findings of the NICA experts as to the lack of both
406permanent and substantial mental and physical impairment.
413On May 31, 2016, NICA f iled a Motion for Summary Final
425Order, asserting that Luke did not sustain a "birth - related
436neurological injury" as that term is defined in section
445766.302(2), Florida Statutes. The motion was served by United
454States Mail to Petitioners on May 31, 2016. As of the date of
467this Summary Final Order of Dismissal, no response has been filed
478to the Motion for Summary Final Order.
485FINDINGS OF FACT
4881. Luke Z . Davis was born on March 27, 2014, at Shands at
502the University of Florida, Gainesville, Florida. Lu ke weighed
5114,060 grams at birth.
5162. Donald Willis, M.D. (Dr. Willis), was requested by NICA
526to review the medical records for Luke, to determine whether an
537injury occurred to the brain or spinal cord caused by oxygen
548deprivation or mechanical injury occur ring in the course of
558labor, delivery, or resuscitation in the immediate post - delivery
568period. In a medical report dated February 25, 2016, Dr. Willis
579described his findings in part as follows:
586There was an apparent obstetrical event,
592shoulder dystocia th at resulted in loss of
600oxygen to the baby's brain during delivery
607and continuing into the immediate post
613delivery period. There was no trauma to the
621spinal cord. The oxygen deprivation to the
628brain resulted in some degree of brain
635injury, as identified b y brain hemorrhage on
643MRI. The MRI reported no evidence of
650global brain injury. I am not able to
658comment about the severity of the brain
665injury.
6663. Dr. Willis reaffirmed his opinion in an affidavit dated
676May 25, 2016.
6794. NICA retained Laufey Sigurdard ottir, M.D.
686(Dr. Sigurdardottir), a pediatric neurologist, to examine Luke
694and to review his medical records. Dr. Sigurdardottir examined
703Luke on March 30, 2016. In h er report dated March 30, 2016,
716Dr. S igurdardottir opined in pertinent part as follows:
725Summary: Here we have a 2 - year - old with a
737difficult birth due to shoulder dystocia
743leading to an acute hypoxic event lasting 13
751minutes. The patient did receive cooling
757protocol, had evidence of a brain injury on
765MRI, although not severe, and is left wit h a
775significant motor impairment from a flaccid
781right arm, as well as expressive language
788delay . . . .
793[ T ] he patient is found to have substantial
803physical impairment, as his right upper
809extremity has little to no functional use.
816There is a possible mild mental impairment
823due to language delay, but his delays do not
832seem substantial at this time.
837[ T ] here is evidence of a hypoxic ischemic
847event occurring at birth resulting in
853neurologic depression at birth, as well as
860mechanical injury resulting in a sever e
867paresis of right upper extremity. Both his
874hypoxic events, as well as his mechanical
881brachial plexopathy is birth related.
8865. A review of the file in this case reveals that there
898have been no expert opinions filed that are contrary to the
909opinion of D r. Willis that there was no evidence of global brain
922injury or injury to the spinal cord. Dr. WillisÓ opinion is
933credited. There are no expert opinions filed that are contrary
943to Dr. SigurdardottirÓs opinion that Luke does not suffer from a
954substantial m ental impairment. Dr. SigurdardottirÓs opinion is
962credited.
963CONCLUSIONS OF LAW
9666. The Division of Administrative Hearings has jurisdiction
974over the parties to and the subject matter of these proceedings.
985§§ 766.301 - 766.316, Fla. Stat.
9917. The Plan was established by the Legislature "for the
1001purpose of providing compensation, irrespective of fault, for
1009birth - related neurological injury claims" relating to births
1018occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
10298. The injured infant, her or his personal representative,
1038parents, dependents, and next of kin may seek compensation under
1048the Plan by filing a claim for compensation with DOAH.
1058§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1066which administers the Plan, has "4 5 days from the date of service
1079of a complete claim . . . in which to file a response to the
1094petition and to submit relevant written information relating to
1103the issue of whether the injury is a birth - related neurological
1115injury." § 766.305(4), Fla. Stat.
11209. If NICA determines that the injury alleged in a claim is
1132a compensable birth - related neurological injury, it may award
1142compensation to the claimant, provided that the award is approved
1152by the administrative law judge to whom the claim has been
1163assigne d. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1175disputes the claim, as it has in the instant case, the dispute
1187must be resolved by the assigned administrative law judge in
1197accordance with the provisions of chapter 120, Florida Statutes.
1206§§ 766.3 04, 766.309, and 766.31, Fla. Stat.
121410. In discharging this responsibility, the administrative
1221law judge must make the following determination based upon the
1231available evidence:
1233(a) Whether the injury claimed is a birth -
1242related neurological injury. If the claimant
1248has demonstrated, to the satisfaction of the
1255administrative law judge, that the infant has
1262sustained a brain or spinal cord injury
1269caused by oxygen deprivation or mechanical
1275injury and that the infant was thereby
1282rendered permanently and subst antially
1287mentally and physically impaired, a
1292rebuttable presumption shall arise that the
1298injury is a birth - related neurological injury
1306as defined in s. 766.303(2).
1311(b) Whether obstetrical services were
1316delivered by a participating physician in the
1323cours e of labor, delivery, or resuscitation
1330in the immediate postdelivery period in a
1337hospital; or by a certified nurse midwife in
1345a teaching hospital supervised by a
1351participating physician in the course of
1357labor, delivery, or resuscitation in the
1363immediate po stdelivery period in a hospital.
1370§ 766.309(1), Fla. Stat. An award may be sustained only if the
1382administrative law judge concludes that the "infant has sustained
1391a birth - related neurological injury and that obstetrical services
1401were delivered by a parti cipating physician at birth."
1410§ 766.31(1), Fla. Stat.
141411. The term "birth - related neurological injury" is defined
1424in section 766.302(2) as follows:
"1429Birth - related neurological injury" means
1435injury to the brain or spinal cord of a live
1445infant weighing a t least 2,500 grams for a
1455single gestation or, in the case of a
1463multiple gestation, a live infant weighing at
1470least 2,000 grams at birth caused by oxygen
1479deprivation or mechanical injury occurring in
1485the course of labor, delivery, or
1491resuscitation in the i mmediate postdelivery
1497period in a hospital, which renders the
1504infant permanently and substantially mentally
1509and physically impaired.
151212. While Dr. Willis established that there was an apparent
1522obstetrical event which resulted in loss of oxygen to the ba byÓs
1534brain during delivery, and continuing into the immediate post
1543delivery period, the remaining issue to be determined is whether
1553the injury resulted in a permanent and substantial mental
1562impairment and a permanent and substantial physical impairment,
1570in asmuch as both are required to establish compensability. Fla.
1580Birth - Related Neurological Injury Comp. Ass'n v. Div. of Admin.
1591Hearings , 686 So. 2d 1349 (Fla. 1997).
159813. The evidence, which is not refuted by any contrary
1608expert opinions, established that Luke does not suffer from a
1618substantial mental impairment. Therefore, Luke is not eligible
1626for benefits under the Plan. §§ 766.302(2) and 766.309(1), Fla.
1636Stat.
1637CONCLUSION
1638Based upon the foregoing Findings of Fact and Conclusions of
1648Law, it is ORDERED that the Petition filed by Crystal Sumpter and
1660Peter Davis, on behalf of and as parents and natural guardians of
1672Luke Z. Davis, is dismissed with prejudice.
