136STATEMENT OF THE ISSUE
140Whether Petitioner, David On ess, is eligible to receive the
150remuneration from the 2015 state of Florida Best and Brightest
160Scholarship program.
162PRELIMINARY STATEMENT
164By correspondence dated November 13, 2015, the Sarasota
172County School Board (SCSB or Respondent) informed Mr. Oness th at
183he did Ðnot qualify for the Best and Brightest Scholarship
193because [his] ACT test scores [did] not reflect the 80th
203na tional percentile or higher.Ñ In response to the November 13
214correspondence, Mr. Oness timely requested a hearing before the
223Division. By correspondence dated December 14, the SCSB
231forwarded the hearing request to the Division for a hearing. 1/
242On January 6, 2016, the Florida Department of Education (DOE)
252filed an unopposed motion to intervene, which was granted. The
262final hearing was scheduled for , and he ld on , February 9, 2016.
274Prior to the hearing, the parties, including the
282intervenor, filed a Pre - hearing Stipulation. To the extent
292appropriate, the stipulated facts are found below.
299At the final hearing, Mr. Oness testified on his own
309behalf. Respon dent called Al Harayda, SCSBÓs Employee Relations
318and E quity A dministrator, to testify on its behalf. DOE called
330Brian Dassler, DOE Deputy C hancellor , to testify. Exhibits A
340through F were admitted into evidence without objection.
348T he Transcript of the proceeding was filed with the
358Division on February 25, 2016. 2/ On February 26, a Notice of
370Filing Transcript was issued , wherein the parties were notified
379that their respective proposed recommended orders (PROs) were to
388be filed on Ma rch 7 , before 5:00 p.m . The parties timely
401submitted their PROs. Within RespondentÓs PRO, the issue of
410subject matter jurisdiction was raised as an impediment to the
420Division rendering the Recommended Order.
425On March 9, 2016, Mr. Oness filed his Unoppo sed Motion to
437Supplement Proposed Recommended Order to Address Newly Raised
445Claim of Lack of Jurisdiction. An Order granting the request
455was issued, and the undersigned considered Mr. OnessÓ supplement
464addressing the Ðlack of jurisdictionÑ position.
470On March 22, 2016, Respondent and DOE filed a Joint Notice
481of Supplemental Authority (notice), citing as supple mental
489authority section 25 of c hapter 2016 - 62, Laws of Florida.
501Mr. Oness timely filed a response to the notice. Both pleadings
512have been consid ered.
516Unless otherwise noted, all statutory citations are to the
525Florida Statutes (2015) .
529FINDING S OF FACT
5331. M r. Oness is employed by the SCSB and is in his 11th
547year as a teacher at Sarasota High School.
5552. The 2015 Florida Legislature Appropriation s Act created
564the Best and Brightest Teacher Scho larship Program ( the
574scholarship ), c hapt er 2015 - 232, p. 27, Item 99A. The
587eligibility pre - requisites for applying to and being awarded the
598scholarship (up to $10,000) were established in the scholarship .
6093. The scholarship provided the following:
615Funds in Specific Appropriation 99A are
621provided to implement Florida's Best and
627Brightest Teacher Scholarship Program. The
632funds shall be used to award a maximum of
6414,402 teachers with a $10,000 scholarship
649bas ed on high academic achievement on the
657SAT or ACT. To be eligible for a
665scholarship, a teacher must have scored at
672or above the 80th percentile on either the
680SAT or the ACT based upon the percentile
688ranks in effect when the teacher took the
696assessment and have been evaluated as highly
703effective pursuant to section 1012.34,
708Florida Statutes, or if the teacher is a
716first - year teacher who has not been
724evaluated pursuant to section 1012.34,
729Florida Statutes, must have scored at or
736above the 80th percentile on either the SAT
744or the ACT based upon the percentile ranks
752in effect when the teacher took the
759assessment. In order to demonstrate
764eligibility for an award, an eligible
770teacher must submit to the school district,
777no later than October 1, 2015, an official
785record of his or her SAT or ACT score
794demonstrating that the teacher scored at or
801above the 80th percentile based upon the
808percentile ranks in effect when the teacher
815took the assessment. By December 1, 2015,
822each school district, charter school
827governing board, and the Florida School for
834the Deaf and the Blind shall submit to the
843department the number of eligible teachers
849who qualify for the scholarship. By
855February 1, 2016, the department shall
861disburse s cholarship funds to each school
868district for each eligible teacher to
874receive a scholarship. By April 1, 2016,
881each school district, charter school
886governing board, and the Florida School for
893the Deaf and the Blind shall provide payment
901of the scholarship to each eligible teacher.
908If the number of elig ible teachers exceeds
916the total the department shall prorate the
923per teacher scholarship amount.
9274. Mr. Oness timely filed an application to participate in
937the scholarship .
9405. Mr. Oness was evaluated as Ðhighly effecti veÑ pursuant
950to section 1012.34 , Florida Statutes.
9556. Mr. Oness was raised and educated in Canada. Mr. Oness
966did not take either the ACT 3/ or the SAT 4/ when he went to
981college, as it was not necessary in Canada.
9897. Mr. Oness took the ACT in Las Vegas, Nevada, on
1000September 12, 201 5.
10048. On ÐThe ACT§ Student ReportÑ (pages 6 and 7 of
1015Exhibit A), it recorded Mr. OnessÓs ACT score as: Composite
1025Score 24 U.S. RANK 74%|STATE RANK 81%
10329. No credible testimony or evidence was received from any
1042authoritative figure from the ACT entity or otherwise that
1051clearly establishes what is meant by the ÐSTATE RANKÑ
1060percentile. The form provides:
1064U.S. Rank and State Rank: Your ranks tell
1072you the approximate percentages of recent
1078high school graduates in the U.S. and your
1086state who took the AC T and received scores
1095that are the same as or lower than yours.
1104It remains unclear whether the term ÐSTATE RANKÑ means: the
1114state of Nevada, where Mr. Oness took the ACT; the state of
1126Florida, where Mr. Oness lives and works; or some other state.
113710. On November 13, 2 015, SCSBÓs Human Resources Salary
1147S pecialist, Mary McCurry, advised Mr. Oness that he did not
1158qualify for the scholarship award Ðbecause your ACT test scores
1168do not reflect the 80th national percentile or higher. Ñ
117811. Mr. Oness asked Respo ndent to review the non -
1189qualification determination by e - mail dated November 13, 2015,
1199and received a n e - mail in return from the SCSBÓs E mployee
1213Relations and Equity A dministrator, Al Harayda, advising that
1222the DOE provided Ðthe percentiles that we had to useÑ in
1233determining eligibility.
123512. The DOE pro vided guidance to the SCSB that Ðthe
1246national percentile score should be used to meet eligibility
1255requirements.Ñ
1256CONCLUSIONS OF LAW
125913. The Division of Administrative Hearings has
1266jurisdiction over the part ies and subject matter of this
1276proceeding. §§ 120.569 and 120.57(1), Fla. Stat. 5 /
128514. Petitioner bears the burden of proving by a
1294preponderance of the evidence that he is entitled to the award
1305services. Dep't of Transp. v. J. W. C. Co., Inc. , 396 So. 2d
1318778 (Fla. 1st DCA 1981); § 120.57(1)(j) , Fla. Stat . A
1329preponderance of the evidence is defined as "the greater weight
1339of the evidence," or evidence that "more likely than not" tends
1350to prove a certain proposition. Gross v. Lyons , 763 So. 2d 276,
1362280 n . 1 (Fla. 2000).
136815. Mr. Oness did not sustain his burden of proof .
1379RECOMMENDATION
1380Based on the foregoing Findings of Fact and Conclusions of
1390Law, it is RECOMMENDED that the Saraso ta County School Board
1401enter a final o rder that Petitioner is not eligible for a Best
1414and Brightest Scholarship.
