74This cause came on for consideration upon a Motion for

103STATEMENT OF THE CASE
107On December 31, 2015, Petitioners, Emerson Cardichon and
115Rose Loudes Cardichon, on behalf of and as parents and natural
126guardians of Jedediah Jacques - Rodson Cardichon (Jedediah), a
135minor, filed a Petition for Benefits Pursuant to Florida Statute
145Section 766.301 et seq. (Petition) with the Division of
154Administrative Hearings (DOAH) for a determination of
161compensability under the Florida Birth - Related Neurological
169Injury Compensation Plan (Plan). The Petition named
176Carlos Barri o nuevo, M.D., as the physician providing obstetrical
186services at the birth of Jedediah on December 7, 2014, at Broward
198Health Coral Springs located in Coral Springs, Florida.
206DOAH served Carlos Barrionuevo, M.D., with a copy of the
216Petition on January 19, 2016. DOAH served N ICA and Broward
227Health Coral Springs with a copy of the Petition on January 20,
2392016.
240On February 3, 2016, North Broward Hospital, d/b/a Broward
249Health Coral Springs, filed a Petition for Leave to Intervene
259which was granted by Order dated February 4, 2016. On
269February 17, 2016, Carlos Barrionuevo, M.D., and Comprehensive
277OBGYN, LLC, filed a Motion to Intervene which was granted by
288Order dated March 1, 2016.
293On May 4, 2016, NICA filed a Motion for Summary Final Order,
305asserting that Jedediah did not s ustain a "birth - related
316neurological injury" as that term is defined in section
325766.302(2), Florida Statutes. The motion was served by United
334States Mail to Petitioners and by e - mail to NICA and Intervenors
347on May 4, 2016. An Order to Show Cause was ente red on May 17,
3622016, which allowed Petitioners until May 31, 2016, to inform the
373undersigned in writing why RespondentÓs Motion for Summary Final
382Order should not be granted. As of the date of this Summary
394Final Order of Dismissal, no response has been fi led to the
406Motion for Summary Final Order or to the Order to Show Cause.
418FINDINGS OF FACT
4211. Jedediah Cardichon was born on December 7, 2014, at
431Broward Health Coral Springs located in Coral Springs, Florida.
440Jedediah weighed 4,720 grams at birth.
4472 . Donald Willis, M.D. (Dr. Willis), was requested by NICA
458to review the medical records for Jedediah, to determine whether
468an injury occurred to the brain or spinal cord caused by oxygen
480deprivation or mechanical injury occurring in the course of
489labor, d elivery, or resuscitation in the immediate post - delivery
500period. In a medical report dated April 12, 2016, Dr. Willis
511described his findings in part as follows:
518Vaginal delivery was assisted by vacuum
524extraction. Although the baby suffered a
530brachial ple xus injury, the delivery note by
538the Obstetrician stated the delivery occurred
544with no complications. Birth weight was
5504,720 grams, which would be large for
558gestational age.
560Apgar scores were 5/9. No umbilical cord
567blood gas was done. Respiratory depres sion
574at birth required bag and mask ventilation
581for 2 to 3 minutes with Ðgood response . Ñ The
592baby was transported to the NICU for
599respiratory depression. Chest X - Ray was
606consistent with Transient Tachypnea of the
612Newborn (TTN). Intubation was not requir ed.
619Respiratory depression worsened soon after
624birth and was managed with high frequency
631nasal canula oxygen.
634Intravenous glucose was given for
639hypoglycemia. Cardiac ECHO findings were
644consistent Hypertrophic Cardiomyopathy, which
648is generally related to maternal Diabetes.
654This was managed with a short course of
662Propranolol. Antibiotics were started for
667R/O sepsis. Cultures were negative.
672Physical exam of the newborn identified
678decreased movement of the left arm. Brachial
685plexus palsy was diagnosed. There was no
692report of seizure activity. Imaging of the
699brain, CT or MRI was apparently not done.
707In summary, pregnancy was complicated by
713insulin dependent Gestational Diabetes with
718resulting fetal macrosomia. The baby
723suffered a brachial plexus injury , ErbÓs
729palsy, most likely related to macrosomia.
735The newborn had respiratory distress, but
741never required intubation. Chest X - Ray was
749consistent with TTN.
752There was an obstetrical event that resulted
759in a brachial plexus injury, but medical
766records d o not support related hypoxic injury
774or trauma to the brain or spinal cord.
7823. Dr. Willis reaffirmed his opinion in an affidavit dated
792April 21, 2016.
7954. NICA retained Michael S. Duchowny, M.D. (Dr. Duchowny),
804a pediatric neurologist, to examine Jededi ah and to review his
815medical records. Dr. Duchowny examined Jedediah on April 6,
8242016. In an affidavit dated April 28, 2016, Dr. Duchowny opined
835in pertinent part as follows:
8405. In summary, JedediahÓs neurological
845examination reveals findings consistent with
850left upper extremity ErbÓs palsy. These
856findings are restricted to movement of the
863proximal left upper extremity musculature and
869do not involve the central nervous system
876(brain and spinal cord). Furthermore,
881JedediahÓs examination does not reveal either
887a substantial mental or motor impairment and
894the findings point to compromise only in the
902peripheral nervous system.
9056. JedediahÓs medical records confirm his
911motherÓs information and detail both the
917gestational diabetes mellitus and fetal
922macroso mia. Jedediah was delivered vaginally
928with vacuum assist and weight 4720 grams (10
936pounds 6 ounces) at birth. Apgar scores were
9445 and 9 at one and five minutes. No cord
954gases were obtained. He required ventilator
960support for several minutes after deliv ery
967but his neonatal course subsequently
972stabilized.
973Based upon my evaluation and record review, I
981am not recommending Jedediah for inclusion
987within the NICA program.
9915. A review of the file in this case reveals that there
1003have been no expert opinions filed that are contrary to the
1014opinion of Dr. Willis that there was an apparent obstetrical
1024event that resulted in brachial injury, but medical records do
1034not support a birth related hypoxic injury or trauma to the brain
1046or spinal cord. Dr. WillisÓ opini on is credited. There are no
1058expert opinions filed that are contrary to Dr. DuchownyÓs opinion
1068that JedediahÓs ErbÓs palsy does not involve the central nervous
1078system (brain or spinal cord) and that his examination does not
1089reveal either a substantial men tal or motor impairment.
1098Dr. DuchownyÓs opinion is credited.
1103CONCLUSIONS OF LAW
11066. The Division of Administrative Hearings has jurisdiction
1114over the parties to and the subject matter of these proceedings.
1125§§ 766.301 - 766.316, Fla. Stat.
11317. The Plan wa s established by the Legislature "for the
1142purpose of providing compensation, irrespective of fault, for
1150birth - related neurological injury claims" relating to births
1159occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
11708. The injured infant, he r or his personal representative,
1180parents, dependents, and next of kin may seek compensation under
1190the Plan by filing a claim for compensation with DOAH.
1200§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1208which administers the Plan, has " 45 days from the date of service
1220of a complete claim . . . in which to file a response to the
1235petition and to submit relevant written information relating to
1244the issue of whether the injury is a birth - related neurological
1256injury." § 766.305(4), Fla. Stat.
12619. If NICA determines that the injury alleged in a claim is
1273a compensable birth - related neurological injury, it may award
1283compensation to the claimant, provided that the award is approved
1293by the administrative law judge to whom the claim has been
1304assign ed. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1316disputes the claim, as it has in the instant case, the dispute
1328must be resolved by the assigned administrative law judge in
1338accordance with the provisions of chapter 120, Florida Statutes.
1347§§ 766. 304, 766.309, and 766.31, Fla. Stat.
135510. In discharging this responsibility, the administrative
1362law judge must make the following determination based upon the
1372available evidence:
1374(a) Whether the injury claimed is a birth -
1383related neurological injury. If the claimant
1389has demonstrated, to the satisfaction of the
1396administrative law judge, that the infant has
1403sustained a brain or spinal cord injury
1410caused by oxygen deprivation or mechanical
1416injury and that the infant was thereby
1423rendered permanently and subs tantially
1428mentally and physically impaired, a
1433rebuttable presumption shall arise that the
1439injury is a birth - related neurological injury
1447as defined in s. 766.303(2).
1452(b) Whether obstetrical services were
1457delivered by a participating physician in the
1464cour se of labor, delivery, or resuscitation
1471in the immediate postdelivery period in a
1478hospital; or by a certified nurse midwife in
1486a teaching hospital supervised by a
1492participating physician in the course of
1498labor, delivery, or resuscitation in the
1504immediate p ostdelivery period in a hospital.
1511§ 766.309(1), Fla. Stat. An award may be sustained only if the
1523administrative law judge concludes that the "infant has sustained
1532a birth - related neurological injury and that obstetrical services
1542were delivered by a part icipating physician at birth."
1551§ 766.31(1), Fla. Stat.
155511. The term "birth - related neurological injury" is defined
1565in section 766.302(2) as follows:
"1570Birth - related neurological injury" means
1576injury to the brain or spinal cord of a live
1586infant weighing at least 2,500 grams for a
1595single gestation or, in the case of a
1603multiple gestation, a live infant weighing at
1610least 2,000 grams at birth caused by oxygen
1619deprivation or mechanical injury occurring in
1625the course of labor, delivery, or
1631resuscitation in the immediate postdelivery
1636period in a hospital, which renders the
1643infant permanently and substantially mentally
1648and physically impaired.
165112. The evidence, which is not refuted by any contrary
1661expert opinions, established that Jedediah did not sustain an
1670in jury to the brain or spinal cord caused by oxygen deprivation
1682or mechanical injury in the course of labor and delivery.
1692Moreover, his ErbÓs palsy does not constitute a substantial
1701mental or motor impairment. Therefore, Jedediah is not eligible
1710for benefit s under the Plan. §§ 766.302(2) and 766.309(1), Fla.
1721Stat.
1722CONCLUSION
1723Based upon the foregoing Findings of Fact and Conclusions of
1733Law, it is ORDERED that the Petition filed by Emerson Cardichon
1744and Rose Loudes Cardichon, on behalf of and as parents an d
1756natural guardians of Jedediah Jacques - Rodson Cardichon, is
1765dismissed with prejudice.
