106Whether just cause exists to terminate Respondent from her
115employment with the Lee County School Board.
122PRELIMINARY STATEMENT
124By correspondence dated December 17, 2015, Tarlisha D avis
133(Respondent) was informed by Gregory K. Adkins, superintendent of
142Lee County Schools (Superintendent), that a recommendation
149seeking the termination of Respondent's employment would be
157submitted to Petitioner, Lee County School Board
164(Petitioner/Schoo l Board), for appropriate action. In response
172to the correspondence of December 17, 2015, Respondent timely
181filed a Request for Administrative Hearing. By correspondence
189dated January 28, 2016, the matter was forwarded to the Division
200of Administrative H earings for a disputed - fact hearing.
210Petitioner offered the testimony of Andrew Brown, the
218director of professional standards and equity. Respondent
225testified on her own behalf and called no other witnesses to
236testify. Petitioner's Exhibits 1 through 9 w ere admitted into
246evidence. Respondent's Exhibits 1 and 2 were also admitted into
256evidence.
257A Transcript of the disputed - fact hearing was filed with the
269Division of Administrative Hearings on April 4, 2016. The
278parties timely filed proposed recommended orders, which have been
287considered in the preparation of this Recommended Order.
295FINDING S OF FACT
2991. Petitioner is responsible for hiring, terminating, and
307overseeing all employees in the school district.
3142. Respondent has been employed by Peti tioner sin ce
324December 13, 2010. She is currently assigned as a school bus
335attendant in PetitionerÓs transportation department.
3403. RespondentÓs employment is governed by the collective
348bargaining agreement between the Support Personnel Association of
356Lee County (SP ALC) and the School Board.
3644. The Petition for Termination alleges that on July 6,
3742015, PetitionerÓs Department of Professional Standards and
381Equity was notified that Respondent was arrested on June 26,
3912015, and charged with four felony counts of public aid fraud in
403excess of $200.00 .
4075. Andrew Brown testified that he received a ÐhitÑ
416notification from the Florida Department of Law Enforcement
424informing the District that Respondent had been arrested.
4326. Respondent obtained public assistance of $200 or more
441through false statements, misrepresentation, impersonation or
447other fraudulent means. The offenses were committed from :
456December 1, 2011 , to May 31, 2012; October 1, 2012 , to May 31,
4692013; October 1, 2013 , to September 30, 2014; and August 1, 2013 ,
481t o December 31, 2013.
4867. All of the foregoing offenses occurred during
494RespondentÓs period of employment with Petitioner.
5008. Respondent was arrested for the foregoing offenses on
509June 26, 2015.
5129. On November 24, 2015, Respondent pled guilty to four
522coun ts of engaging in public aid fraud, all felonies, and was
534sentenced to 36 months of probation and ordered to pay $8,483.29
546in restitution to the Florida Department of Children and
555Families.
55610. The evidence demonstrates that Respondent, on
563November 24, 2 015, knowingly pled guilty to public aid fraud.
57411. School Board policy 5.04 permits Petitioner to
582terminate the employment of an employee who commits a crime
592during their employment , if the crime would otherwise disqualify
601the employee from initial emplo yment with the S chool B oard.
613Public aid fraud is such a crime. Paragraph (7)(a) and (b) of
625policy 5.04 provides that the School Board will not hire an
636individual who has committed welfare and/or unemployment fraud
644within 10 years of the offense.
65012. Pol icy 5.04 also provides that an individual who is on
662probation may also be ineligible for employment.
66913. School Board policies 5.02, 5.03 , and 5.29 all include
679language that mandate compliance with applicable laws, and
687require that employees maintain high ethical standards and good
696moral character. Respondent has failed those mandates.
70314. The credible evidence establishes that Petitioner has
711just cause to terminate RespondentÓs employment with the School
720Board.
721CONCLUSIONS OF LAW
72415. The Division of Ad ministrative Hearings has
732jurisdiction over the parties and subject matter of this
741proceeding. §§ 120.569 and 120.57(1), Fla. Stat. (2015). 1/
750Petitioner seeks to terminate Respondent's employment.
75616. Petitioner bears the burden of proving by a
765preponder ance of the evidence that just cause exists for the
776termination of Respondent's employment. McNeill v. Pinellas
783Cnty. Sch. Bd. , 678 So. 2d 476, 477 (Fla. 2d DCA 1996); Dileo v.
797Sch. Bd. of Dade Cnty. , 569 So. 2d 883 (Fla. 3d DCA 1990).
81017. The S uperinten dent for the School Board has the
821authority to recommend to the School Board that an employee be
832suspended or dismissed from employment. §§ 1012.22(1)(f) and
8401012.33(6), Fla. Stat.
84318. Provision 7.10 of the SPALC agreement states, Ð[a]ny
852discipline durin g the contract year, that constitutes a verbal
862warning, letter of warning, letter of reprimand, suspension,
870demotion or termination shall be for just cause.Ñ
87819. RespondentÓs actions constitute misconduct in office
885pursuant to section 1012.33(1)(a), Flori da Statutes, as defined
894by Florida Administrative Code Rule 6A - 5.056(2). RespondentÓs
903actions violate School Board policy 5.02, Professional Standards,
911which requires dedication to high ethical standards.
918RespondentÓs actions violate School Board polic y 5.03, General
927Requirements for Appointment and Employment, which requires that
935an emplo yee be of good moral character. Re spondentÓs actions
946violate School Board policy 5.04, Fingerprinting and Background
954Screening, by violating the School BoardÓs Hiring /Employment
962Guidelines. RespondentÓs actions violate School Board p olicy
9705.29, Complaints Relating to Employees, which requires all
978employees exemplify conduct that is lawful and professional. Due
987to the foregoing violations, just cause exists for the
996te rmination of RespondentÓs employment.
1001RECOMMENDATION
1002Based on the foregoing Findings of Fact and Conclusions of
1012Law, it is RECOMMENDED that the Lee County School Board enter a
1024final order terminating RespondentÓs employment.
