105STATEMENT OF THE ISSUE
109The issue in this case is whether statements contained in
119RespondentÓs letter dated March 4, 2008, an attachment thereto, 2 /
130and comments made during a hearing on January 5 through 8, and
142February 22, 2016 , constitute a rule as defined by section
152120 .52(16) .
155PRELIMINARY STATEMENT
157On February 9, 2016, Bayou Shores SNF, LLC , d/b/a
166Re habilitation Center of St. Pete (Bayou Shores) , filed a
176Petition to Determine Invalidity of Agency Statements
183(Petition) . In the Petition, Bayou Shores asserted that the
193Agency for Health Care Administration (AHCA) is the Ðregulatory
202authority responsible for licensure of nursing homes and
210enforcement of applicable fe deral regulations, state statutes,
218and state rules governing skilled nursing facilities pursuant to
227the Omnibus Reconciliation Act of 1986, Title IV, Subtitle C (as
238amended), c hapters 400, Part II, and 408, Part II, Florida
249Stat ute [s] , and c hapter 59A - 4, F .A.C.Ñ Bayou Shores further
263asserted that the Department of Children and Families is the
273state agency charged with regulating nursing home facilities in
282Florida, a nd with enforcement of c hapter 415, Florida Statutes.
293Bayou Shores asserted that under sect ion 415.101, the intent of
304the chapter was Ðto provide for the detection and correction of
315abuse, neglect, and exploitation through social services and
323criminal investigations and to establish a program of protective
332services for all vulnerable adults in n eed of them.Ñ Bayou
343Shores also alleged that a March 4, 2008 , letter attempted to
354Ðresolve some of the questions that have arisen about abuse and
365neglect.Ñ Bayou Shores asserted that statements made by an AHCA
375witness during an administrativ e hearing inv olving Bayou Shores
385constituted an unpromulgated rule. Bayou Shores requested a
393ÐFinal Order be entered determining that the agency statement
402described inÑ the Petition constituted an unpromulgated rule.
410AHCA responded to the Petition by filing a Motion to
420Dismiss Petition to Determine Invalidity of Agency Statements on
429February 12, 2016, 3/ and on February 18, 2016, AHCA filed its
441Motion for Sum mary Final Order. Bayou Shores has not filed a
453Response to the Motion for Summary Final Order, and the time in
465which to file a response has expired.
472Having reviewed the Petition (including the exhibits) ,
479AHCAÓs motion (including the exhibits) and the record, it has
489been determined that there are no genuine issues as to any
500material fact, and this matter is decided on the written
510submissions.
511FINDINGS OF FACT
514Based on the entire record of this proceeding, the
523following facts are undisputed and found to be true:
5321. Bayou Shores is a skilled licensed nursing home located
542in Saint Petersburg, Florida.
5462. On January 5 through 8 and February 22, 2016, a hearing
558was he ld regarding consolidated DOAH Case No s . 15 - 0619 and
57215 - 5469. Original DOAH Case No. 15 - 0 619 involved A HC A Ós
588January 15, 2015, Notice of Intent to Deny Renewal Application
598pursuant to sections 400.121(1) an d (3) , Florida Statute s . 4/
610Original DOAH Cas e No. 15 - 5469 involved an eight - co unt
624Administrative Complaint.
6263. During the consolidated hearing, one of AHCAÓs
634witnesses testified about the state requirements a s related to
644abuse reporting. The pertinent recitation by AHCAÓs witness
652follows:
653Q. [S]o without regard to policies, is
660there another requirement that any
665allegation of abuse be reported to AHCA?
672A. Okay, There are requirements that
678allegations of abuse have to be reported to
686the state agency. I know it is in federal
695law and IÓd be glad to look and see where it
706might be in the state law.
712Q. Well Î
715A. State requirements.
718Q. But you donÓt know off hand what they
727are.
728A. Offhand, no.
7314. Bayou Shores provided other statements by the witn ess
741in an attempt to demonstrate her statements constituted a rule
751of AHCA. The witness testified as to her understanding of the
762obligations imposed; however, t aken in total, the witnessÓ s
772unders ta nding did not establish an agency rule.
7815. On March 4, 20 08, AHCA issued a letter with an
793attachment to administrators, 5/ which provided in part, the
802following:
803In an attempt to resolve some of the
811questions that have arisen about abuse and
818neglect and the understanding and reporting
824of resident to resident alte rcations, the
831Centers for Medicare and Medicaid Services
837(CMS) has clarified this issue in a release
845about accidents and supervision. Please
850refer to CMS Ref: S&C - 07 - 25. As this
861clarification impacts the Federal
865Immediate/5 - Day Reporting System, we are
872t aking this opportunity to redistribute
878definitions, guidance for a thorough
883investigation, and the suggested reporting
888form with instructions for its completion.
8946. The March 4 letter was an attempt by AHCA to clarify
906federal CMS issues relating to repor ting abuse requirements. It
916does not establish an agency rule, nor does it provide a
927statement that amounts to a rule.
9337. The Petition does not provide the text of a statement
944or a description of the statement sufficient to show that the
955statement cons titutes a rule. See Aloha U tilities, Inc. v.
966Public Serv. Com mÓn , 723 So. 2d 919 (Fla. 1st DCA 1999).
978CONCLUSIONS OF LAW
9818. The Division of Administrative Hearings has
988jurisdiction over the parties to and the subject matter of this
999proceeding. § 120.56, Fla. Stat.
10049. Section 120.52(16), Florida Statutes, defines a rule as
1013follows:
1014ÐRuleÑ means each agency statement of
1020general applicability that implements,
1024interprets, or prescribes law or policy or
1031describes the procedure or practice
1036requirements of an agency and includes any
1043form which imposes any requirement or
1049solicits any information not specifically
1054required by statute or by an existing rule.
1062The term also includes the amendment or
1069repeal of a rule. The term does not include:
1078(a) Internal manageme nt memoranda which do
1085not affect either the private interests of
1092any person or any plan or procedure
1099important to the public and which have no
1107application outside the agency issuing the
1113memorandum.
1114(b) Legal memoranda or opinions issued to
1121an agency by t he Attorney General or agency
1130legal opinions prior to their use in
1137connection with an agency action.
1142(c) The preparation or modification of:
11481. Agency budgets.
11512. Statements, memoranda, or instructions
1156to state agencies issued by the Chief
1163Financial Officer or Comptroller as chief
1169fiscal officer of the state and relating or
1177pertaining to claims for payment submitted
1183by state agencies to the Chief Financial
1190Officer or Comptroller.
11933. Contractual provisions reached as a
1199result of collective bargaining .
12044. Memoranda issued by the Executive Office
1211of the Governor relating to information
1217resources management.
121910. Section 120.56(4), Florida Statutes , provides in
1226pertinent part:
1228(a) Any person substantially affected by an
1235agency statement may seek an administrative
1241determination that the statement violates
1246s. 120.54(1)(a). The petition shall include
1252the text of the statement or a description
1260of the statement and shall state with
1267particularity facts sufficient to show that
1273the statement constitutes a r ule under
1280s. 120.52 and that the agency has not
1288adopted the statement by the rulemaking
1294procedure provided by s. 120.54.
129911. The testimony by the AHCA witness during the
1308consolidated hearing does not constitute an agency statement,
1316much less an agency ru le. The March 4 letter provides
1327information regarding federal reporting requirements and is not
1335an agency rule.
1338ORDER
1339Based on the foregoing Findings of Fact and Conclusions of
1349Law, it is ORDERED that the Petition to Determine Invalidity of
1360Agency Stateme nts is dismissed.
