89STATEMENT OF THE CASE

93On February 12, 2016, Petitioner, Deanna Brayboy,

100individually and as parent of Mya Brayboy (Mya), a minor, filed a

112Petition for Determination of Compensability Pursuant to Florida

120Statute Section 766.301 et seq. (Petition), with the Division of

130Administrative Hearings (DOAH) for a determination of

137compensability under the Florida Birth - Related Neurological Injury

146Compensation Plan (Plan) . The Petition alleged that Mya suffered

156permanent and substantial physical and mental impairment as the

165result of oxygen deprivation during labor and delivery .

174The Petition named Pamela Cates - Smith, M.D ., as the physician

186providing obstetric services at the birth of Mya at Winnie Palmer

197Hospital, located in Orlando, Florida, on March 6, 2014.

206DOAH served NICA with a copy of the Petition on February 23,

2182016. DOAH served Pamela Cates - Smith, M.D., and Win nie P almer

231Hospital with a copy of the Petition on February 22, 2016.

242A Petition to Intervene was filed by Dorothy J. Odom, M.D. ;

253Physician Associates , LLC ; and Orlando Health, Inc., d/b/a Winnie

262Palmer Hospital, which was granted by Order dated April 7, 2016.

273On May 10, 2016, NICA filed a Response to Petition for

284Benefits , giving notice that the injury does not "meet the

294definition of a 'birth - related neurological injury'Ñ as that term

305is defined in section 766.302(2), Florida Statutes, which

313speci fically requires that the injury render Ðthe infant

322permanently and substantially medically and physically impaired.Ñ

329NICA requested that a hearing be scheduled to resolve whether the

340claim was compensable.

343On February 10, 201 7 , NICA filed a Status Repor t i ndicating

356that the parties were in agreement that a hearing to determine

367compensability will not be necessary and that a motion for summary

378final order would be forthcoming.

383On February 13, 2017, NICA filed an Unopposed Motion for

393Summary Final Order, asserting that Mya did not sustain a birth -

405related neurological injury as that term is defined in section

415766.302(2). The Motion states that Petitioner and Intervenors

423have no objection to the Motion.

429FINDINGS OF FACT

4321. Mya Brayboy was born on March 6, 2014, at Winnie Palmer

444Hospital, located in Orlando, Florida.

4492. Donald Willis, M.D. (Dr. Willis), was requested by NICA

459to review the medical records for Mya. In a medical report dated

471March 21, 2016, Dr. Willis described his findings in pertinent

481pa rt as follows:

485In summary, this was a twin pregnancy with

493vaginal delivery of the first baby followed

500by Cesarean section for the second baby due

508to footling breech presentation and fetal

514bradycardia (fetal distress). Fetus B (Mya

520Brayboy) was depressed a t birth and had a

529blood gas pH of 6.86, consistent with

536acidosis. The newborn hospital course was

542complicated by multi - system organ failure.

549EEG was abnormal and consistent with a

556history of HIE. However, the MRI on DOL 8

565was reported as unremarkable.

569There was an apparent obstetrical event that

576resulted in loss of oxygen to the babyÓs

584brain during labor, delivery and continuing

590into the immediate post delivery period. The

597oxygen deprivation resulted in some degree of

604brain injury based on the abnorm al EEG . I am

615unable to determine the severity of any

622possible injury.

6243. Dr. WillisÓ opinion that there was an apparent

633obstetrical event that resulted in loss of oxygen to the babyÓs

644brain during labor, delivery and continuing into the immediate

653post - delivery period is credited.

6594. Respondent retained Laufey Sigurdardottir, M.D.

665(Dr. Sigurdardottir), a pediatric neurologist, to evaluate Mya.

673Dr. Sigurdardottir reviewed MyaÓs medical records, and performed

681an independent medical examination on her on April 27, 2016. In

692a neurology evaluation based upon this examination and a medical

702records review, Dr. Sigurdardottir made the following findings

710and summarized her evaluation as follows:

716In summary: This is a 2 - year - old, ex - 36 - week

731twin with signific ant intrapartum bradycardia

737resulting in an emergent C - section. Patient

745had a neonatal neurologic syndrome including

751hypotonia, little respiratory drive with

756multisystem abnormalities including a

760metabolic acidosis, hypotension, elevated

764creatinine, eleva ted coagulation studies,

769elevated LFTs, and poor urine input. The

776patientÓs Apgar scores were 2 after 1 minute,

7842 after 5 minutes and 3 after 10 minutes and

794the patient required a 9 - day NICU stay.

803Fortunately, her EEG was reassuring and her

810MRI did not s how definite signs of acute

819ischemic injury. Her neurologic exam during

825this examination is normal, indicating good

831motor function for her age. A full language

839evaluation could not be performed, but as per

847report from mother, she is on target for

855normal language development. No autistic

860features were noted.

863Therefore, my results within reasonable

868degree of medical certainty are the

874following:

875Results as to Question 1: The patient is

883found to have no permanent mental or physical

891impairment.

892Result s as to Question 2: There is evidence

901of complications during MyaÓs birth that

907resulted in hypoxic ischemic encephalopathy,

912although her recovery has been favorable.

918Based on record review the timing of her

926hypoxic event is intrapartum.

930Results as to Question 3: We would expect

938full life expectancy and an excellent

944prognosis for both motor and mental skills.

951In light of the above - mentioned details, I do

961not recommend Mya to be included into the

969Neurologic Injury Compensation Association

973(NICA) and w ould be happy to answer

981additional questions.

9835. In order for a birth - related injury to be compensable

995under the NICA Plan, the injury must meet the definition of a

1007birth - related neurological injury and the injury must have caused

1018both permanent and subs tantial mental and physical impairment.

1027Dr. SigurdardottirÓs opinion that Mya does not have a permanent

1037physical or mental impairment is credited.

10436. A review of the file in this case reveals that there

1055have been no expert opinions filed that are contrar y to the

1067opinion of Dr. Sigurdardottir that Mya does not have a permanent

1078physical or mental impairment.

1082CONCLUSIONS OF LAW

10857. The Division of Administrative Hearings has jurisdiction

1093over the parties to and the subject matter of this proceeding.

1104§§ 766 .301 - 766.316, Fla. Stat. (2014).

11128. The Plan was established by the Legislature "to provide

1122compensation on a no - fault basis, for a limited class of

1134catastrophic injuries that result in unusually high costs for

1143custodial care and rehabilitation." § 766. 301, Fla. Stat. The

1153Plan applies only to a birth - related neurological injury, which is

1165defined in section 766.302(2) as follows:

"1171Birth - related neurological injury" means

1177injury to the brain or spinal cord of a live

1187infant weighing at least 2,500 grams f or a

1197single gestation or, in the case of a multiple

1206gestation, a live infant weighing at least

12132,000 grams at birth caused by oxygen

1221deprivation or mechanical injury occurring in

1227the course of labor, delivery, or

1233resuscitation in the immediate postdelivery

1238period in a hospital, which renders the infant

1246permanently and substantially mentally and

1251physically impaired . This definition shall

1257apply to live births only and shall not

1265include disability or death caused by genetic

1272or congenital abnormality. (emphas is added).

12789. The injured infant, her or his personal representative,

1287parents, dependents, and next of kin, may seek compensation under

1297the Plan by filing a claim for compensation with DOAH.

1307§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA, which

1316administers the Plan, has "45 days from the date of service of a

1329complete claim . . . in which to file a response to the petition

1343and submit relevant written information relating to the issue of

1353whether the injury is a birth - related neurological inju ry."

1364§ 766.305(4), Fla. Stat.

136810. If NICA determines that the injury alleged in a claim is

1380a compensable birth - related neurological injury, it may award

1390compensation to the claimant, provided that the award is approved

1400by the Administrative Law Judge to whom the claim has been

1411assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1422disputes the claim, as it has in the instant case, the dispute

1434must be resolved by the assigned Administrative Law Judge in

1444accordance with the provisions of chapter 120, Florida Statutes.

1453§§ 766.304, 766.309, and 766.31, Fla. Stat.

146011. In discharging this responsibility, the Administrative

1467Law Judge must make the following determinations based upon all

1477available evidence:

1479(a) Whether the injury claimed is a birth -

1488related neurological injury. If the claimant

1494has demonstrated, to the satisfaction of the

1501administrative law judge, that the infant has

1508sustained a brain or spinal cord injury caused

1516by oxygen deprivation or mechanical injury and

1523that the infant was ther eby rendered

1530permanently and substantially mentally and

1535physically impaired, a rebuttable presumption

1540shall arise that the injury is a birth - related

1550neurological injury as defined in

1555s. 766.302(2).

1557(b) Whether obstetrical services were

1562delivered by a p articipating physician in the

1570course of labor, delivery, or resuscitation in

1577the immediate postdelivery period in a

1583hospital; or by a certified nurse midwife in a

1592teaching hospital supervised by a

1597participating physician in the course of

1603labor, delivery, o r resuscitation in the

1610immediate postdelivery period in a hospital.

1616§ 766.309(1), Fla. Stat. An award may be sustained only if the

1628Administrative Law Judge concludes that the "infant has sustained

1637a birth - related neurological injury and that obstetrical services

1647were delivered by a participating physician at birth."

1655§ 766.31(1), Fla. Stat.

165912. In the instant case, Petitioner filed a claim alleging

1669that Mya did suffer permanent and substantial physical and mental

1679impairment as a result of oxygen depriva tion during labor and

1690delivery . As the proponent of the issue of compensability, the

1701burden of proof is upon Petitioner. § 766.309(1)(a), Fla. Stat.

1722So. 2d 349, 350 (Fla. 1st DCA 1977)("[T] he burden of proof, apart

1736from statute, is on the party asserting the affirmative of an

1747issue before an administrative tribunal.").

175313. To be compensable under the NICA Plan, there must have

1764been an obstetrical event which resulted in loss of oxygen to th e

1777babyÓs brain during labor, delivery, and continuing into the

1786immediate post - delivery period, resulting in a permanent and

1796substantial mental impairment and a permanent and substantial

1804physical impairment, inasmuch as both are required to establish

1813compen sability. Fla. Birth - Related Neurological Injury Comp.

1822Ass'n v. Div. of Admin. Hearings , 686 So. 2d 1349 (Fla. 1997).

183414. The evidence, which is not refuted, established that Mya

1844does not have a permanent mental or physical impairment. Thus,

1854Mya is n ot entitled to benefits under the Plan.

1864CONCLUSION

1865Based on the foregoing Findings of Fact and Conclusions of

1875Law, it is ORDERED:

1879That the Petition filed by Deanna Brayboy, individually and

1888as parent of Mya Brayboy, is dismissed with prejudice.
