95STATEMENT OF THE ISSUE

99The issue in this procee ding is whether Petitioner is

109entitled to change his dental benefit election in the State

119Group Insurance Program for the 2016 plan year.

127PRELIMINARY STATEMENT

129In a letter dated February 2, 2016, Respondent notified

138Petitioner that it had rejected his req uest to change his dental

150insurance coverage for the 2016 plan year without a Qualifying

160Status Change (QSC) e vent. 1/ In relevant part, the

170correspondence provided:

172I am writing to let you know that the

181Division of State Group Insurance (DSGI) has

188made a determination regarding your Level II

195Appeal. You are requesting to change your

202dental insurance coverage.

205In response to your appeal, DSGI requested

212detailed information and records from the

218People First Service Center, including call

224notes. We reviewe d those call notes and

232other documentation, along with your letter

238and information.

240The State Group Health Insurance Plan rules

247governing the plan, specifically Rule 60P -

2546.0068, Florida Administrative Code, states

259that an election made under the Pretax

266Pr emium Plan shall be irrevocable during the

274Plan Year except when a participant

280experiences a Qualifying Status Change (QSC)

286event. These rules and section 125 of the

294Internal Revenue Code, which applies to

300pretax benefit plans, limit our ability to

307allow enrollment or coverage changes.

312After carefully reviewing your appeal

317documents and based upon the facts above, we

325must deny your Level II Appeal because you

333have not experienced a QSC event that would

341allow you to change your dental benefits at

349this ti me.

352Dissatisfied with RespondentÓs decision, Petitioner timely

358requested a formal administrative hearing. On March 3, 2016,

367Respondent referred the matter to the Division of Administrative

376Hearings (the Division) to assign an A dministrative L aw J udge t o

390conduct the final hearing.

394The final hearing was held on May 4, 2016, during which

405Petitioner testified on his own behalf and introduced the

414testimony of Alison Bonnell and Heather Cleary. PetitionerÓs

422E xhibits P1 (composite) through P6 were admitted in evidence.

432Respondent presented the test imony of Sandie Wade and

441Dwayne Purifoy, and introduced E xhibits R1, R3, R4, and R6,

452which were admitted in evidence. The undersigned granted

460RespondentÓs Motion for Official Recognition of various rules

468and statut es governing the State Group Insurance Program, as

478well as orders of the Division and sections of the Internal

489Revenue Code and the Code of Federal Regulations.

497Although a court reporter was present during the final

506hearing, no transcript of the proceedi ngs was ordered. Both

516parties timely submitted Proposed Recommended Orders, which have

524been considered in the preparation of this Recommended Order.

533All references herein to the Florida Statutes are to the

5432015 version.

545FINDING S OF FACT

5491. At all times relevant hereto, Petitioner was an

558employee of the Department of Management Services (DMS) and was

568a participant in the S tate G roup I nsurance P rogram. 2/ Petitioner

582was enrolled in dental benefit coverage for the 2015 plan year.

5932. Each year during open enrollment, program participants

601m a y elect new benefits or change benefits for which they are

614enrolled. Open enrollment usually occurs during a two - week

624period in the fall of each year.

6313. Benefits, including insurance plans, are administered

638by a priva te contractor, Northgate Arinso, through an online

648system known as ÐPeople First.Ñ

6534. Petitioner intended to change his dental insurance

661coverage during the open enrollment period for the 2016 plan

671year.

6725. On October 21, 2015, P etitioner logged on to the

683People First website and viewed the ÐChange My BenefitsÑ screen.

693Petitioner had researched the various coverages available well

701in advance of enrollment, and knew he wanted to enroll in a

713preferred provider plan offered by Humana. Petitioner found t he

723plan he was seeking and selected ÐnextÑ from prompts on the

734computer screen.

7366. Petitioner remembers next selecting ÐconfirmÑ from the

744screen prompts, and reported that the next, and last, computer

754screen he saw was the People First home screen.

7637. Petitioner did not review a confirmation of benefits

772statement confirming his intended change in dental benefits.

7808. Petitioner then viewed the page displaying his current

789benefits, which showed the same dental coverage he had for the

8002015 plan year.

8039. Petitioner asked his co - worker, Alison Bonnell, when

813the system would reflect his change in dental coverage, and she

824replied that it would not change until January 2016.

83310. Petitioner asked his supervisor, Heather Cleary, how

841he could view the cha nge he had made. Ms. Cleary, who was new

855to DMS, stated she did not know, but suggested Petitioner

865contact human resources if he needed assistance.

87211. Petitioner made no further inquiries regarding his

880dental benefits until January 1, 2016, when he log ged in to

892People First and viewed the ÐMy BenefitsÑ page, which showed the

903same dental coverage in which he was enrolled for the 2015 plan

915year.

91612. Petitioner alleges that he effectively changed his

924dental coverage for the 2016 plan year, but that, due to an

936error in the People First system, his election was not saved.

947Petitioner now seeks to change his dental benefit effective for

957the 2016 plan year.

96113. During open enrollment for the 2016 plan year, the

971People First website required all eligible pa rticipants to first

981complete a process verifying their mailing and email addresses,

990then certifying their dependents.

99414. Following completion of that confirmation and

1001verification process, the system presented participants with the

1009home screen from wh ich participants could choose from a number

1020of tabs, including ÐHealth & Insurance.Ñ The Health & Insurance

1030page provided the following options:

110615. If a participant selected ÐChange My Benefits,Ñ the

1116participant was presente d with a screen to choose the event

1127triggering enrollment -- new hire or open enrollment. Selecting

1136Ðopen enrollmentÑ revealed an enrollment summary screen with a

1145chart listing the categories of Ðhealth,Ñ Ðbasic life,Ñ

1155Ðoptional life,Ñ Ðdental,Ñ and Ðvision Ñ coverage in the left -

1168hand column. If the participant was enrolled in one of the

1179options, the chart listed the name of the plan in which they are

1192enrolled in the middle column, and , in a column titled Ðmake a

1204change,Ñ the participant could select Ðcancel Ñ to cancel that

1215coverage. For all other options, the participant could select

1224ÐaddÑ in the Ðmake a changeÑ column to enroll in a plan.

123616. If a participant selected the option to ÐaddÑ a plan,

1247they were navigated to a screen which displayed all the cho ices

1259for that type of coverage, in this case dental coverage. Once a

1271coverage plan was selected, the program prompted the participant

1280to Ðcomplete enrollment.Ñ

128317. At the bottom of the enrollment summary screen,

1292participants were presented with the fo llowing statement:

1300By selecting ÐComplete Enrollment,Ñ I hereby

1307certify that the information entered is true

1314and correct and that all dependents listed

1321above are eligible. I understand that my

1328elections can only be changed during Open

1335Enrollment or as the result of a Qualifying

1343State Change event as defined by the

1350Internal Revenue Code and/or the Florida

1356Administrative Code. I agree to notify

1362People First of any QSC events within the

1370prescribed time frame and to supply the

1377appropriate supporting documenta tion upon

1382request; otherwise, any requested changes

1387will not be allowed. If any dependent is

1395determined to be ineligible or I fail to

1403notify People First of a loss of elibility

1411or any supporting documentation is not

1417provided upon request, I understand tha t I

1425may be liable for any and all claims paid

1434for any dependent deemed ineligible.

1439Following this statement was a box in which the participant must

1450enter his or her password and select ÐComplete Enrollment.Ñ

145918. Upon selecting ÐComplete Enrollment,Ñ par ticipant s

1468w ere notified that a confirmation statement was available in the

1479People First system for his or her review. A participant must

1490have returned to the home screen and selected ÐConfirmation

1499StatementÑ to view the statement to confirm any change in his or

1511her elections.

151319. Petitioner testified that he did not enter his People

1523First password to complete his enrollment on October 21, 2015.

1533Rather, Petitioner reported that, because he was redirected to

1542the People First home screen after selecting th e dental plan

1553option he was seeking, he was not prompted to complete his

1564enrollment.

156520. Petitioner did not select the ÐConfirmation StatementÑ

1573tab and review any statements in the system for his account.

158421. Petitioner did select the ÐMy BenefitsÑ tab , which

1593confirmed the same dental coverage which he had selected for the

16042015 plan year.

160722. Petitioner did not contact the People First service

1616center for assistance.

161923. Dwayne Purifoy has served as operations manager for

1628Northgate Arinso for 12 year s. Mr. Purifoy oversees the

1638operation of the People First program.

164424. Mr. Purifoy admitted that if the People First program

1654Ðtimed outÑ during the selection process, the participant would

1663not receive a notification to that affect, and any changes the

1674p articipant made would not be saved.

168125. The People First program records participant

1688interactions with the system, including when a participant logs

1697in, views benefits, and changes benefits. The system record

1706shows that Petitioner logged in to the ÐChan ge My BenefitsÑ page

1718on October 21, 2015. The system does not contain a record that

1730Petitioner changed any of his selected benefits during the open

1740enrollment period.

174226. The preponderance of the evidence supports a finding

1751that Petitioner, despite his intentions to the contrary, did not

1761complete a change to his dental benefit election under the S tate

1773G roup I nsurance Program for the 2016 plan year.

178327. Petitioner did not experience any QSC event during the

17932016 plan year.

1796CONCLUSIONS OF LAW

179928. The Di vision has jurisdiction over the parties to and

1810subject matter of this cause, pursuant to section 120.57(1),

1819Florida Statutes.

182129. Enrollment in the state group insurance program is

1830governed by Florida Administrative Code Rule 60P - 2.002(1), which

1840provide s:

1842(1) An employee or state officer may apply

1850for enrollment in the Health Program [3/] . . . .

1861(a) During the first sixty (60) calendar

1868days of state employment or a new term of

1877office;

1878(b) During open enrollment;

1882(c) Within thirty - one (31) days of a

1891[qualifying status change] of losing other

1897group health coverage;

1900(d) Within thirty - one (31) days of a

1909[qualifying status change] of an increase in

1916the number of work hours for an employee;

1924(e) Within thirty - one days prior to

1932termination of employment and before the

1938effective date of retirement.

194230. Rule 60P - 6.0068 governs changes in participation by

1952program participants, and provides that Ð[a]n election made

1960under the Pretax Premium Plan shall be irrevocable during the

1970Plan Year except when a parti cipant experiences a [qualifying

1980status change] event.Ñ

198331. Petitioner's sole contention in this proceeding is

1991that he utilized People First to change his dental benefit

2001election during the open enrollment period for the 2016 plan

2011year, but, due to an er ror in the program, his change was not

2025saved. As such, Petitioner requests Respondent immediately

2032enroll him in the Humana dental benefit plan in which he

2043intended to enroll.

204632. As the party asserting the affirmative of the issue,

2056Petitioner bears th e burden of demonstrating, by a preponderance

2066of the evidence, that he took the required steps -- prior to the

2079expiration of the open enrollment period -- to make his

2089selections. See Fla. Dep't of Transp. v. J.W.C. Co., Inc. ,

2099396 So. 2d 7 78, 788 (Fla. 1st DCA 1981) (holding that Ðthe burden

2113of proof, apart from statute, is on the party asserting the

2124affirmative of an issue before an administrative tribunalÑ);

2132§ 120.57(1)(j) , Fla. Stat. (ÐFindings of fact shall be based

2142upon a preponderance of the evidence, exce pt in penal or

2153licensure disciplinary proceedings or except as otherwise

2160provided by statuteÑ); Gross v. Lyons , 763 So. 2d 276, 280 n.1

2172(Fla. 2000)(explaining that Ð[a] preponderance of the evidence

2180is defined as the greater weight of the evidence . . . or

2193evidence that more likely than not tends to prove a certain

2204propositionÑ)(internal quotations and citations omitted).

220933. Pursuant to the F indings of F act contained herein,

2220Petitioner failed to demonstrate by a greater weight of the

2230evidence that he correctly utilized the People First system to

2240change his dental benefit for the 2016 plan year. Even if

2251Petitioner had proven that the People First system Ðtimed outÑ

2261while he was attempting to change his benefit election, that

2271would not support a find ing that Petitioner had successfully

2281completed the election change. It may not be fair that the

2292system would not have notified Petitioner of a Ðtime outÑ and

2303informed him that he needed to start over with his election

2314process. However, it is not a legal basis on which to require a

2327change in PetitionerÓs benefit election during the plan year

2336absent a QSC event.

234034. Accordingly, the undersigned must recommend that

2347Respondent enter a final order denying Petitioner's request to

2356change his dental coverage election for the 2016 plan year.

236635. As admitted by Petitioner at the final hearing, the

2376open enrollment period for the 2017 plan year is rapidly

2386approaching, and Petitioner may elect to change his dental

2395coverage at that time. See Fla. Admin. Code R. 6 0P - 2.002(1).

2408RECOMMENDATION

2409Based on the foregoing Findings of Fact and Conclusions of

2419Law, it is RECOMMENDED that the Department of Management

2428Services, Division of State Group Insurance, enter a final order

2438denying Petitioner's request to change his de ntal benefit

2447coverage in the State Group Insurance Program for the 2016 plan

2458year.
