90STATEMENT OF THE CASE
94On March 4, 2016, Petitioners, Shannon Breen and Alexandra
103Zayas, on behalf of and as parents and natur al guardians of
115Eleanor Breen Zayas, (Eleanor), a minor, filed a Petition for
125Benefits Pursuant to Florida Statute Section 766.301 et seq.
134(Petition), with the Division of Administrative Hearings (DOAH).
142The Petition alleged that Eleanor suffered brain da mage as the
153result of a birth - related neurological injury.
161The Petition named Scott Riddell, M.D., as the physician
170providing obstetric services at the birth of Eleanor at University
180of South Florida Health , South Tampa Center, in Tampa, Florida, on
191May 8, 2015.
194DOAH served NICA with a copy of the Petition on March 16,
2062016. DOAH served Scott Riddell, M.D., and James Palmer, M.D.,
216with a copy of the Petition on March 17, 2016. On March 21, 2016,
230DOAH received a return receipt from the United States Postal
240Service showing that Tampa General Hospital had been served with a
251copy of the Petition.
255A Motion to Intervene w as filed by the University of South
267Florida Board of Trustees, which was granted by O rder dated
278April 19, 2016. A s of the date of this Summa ry Final Order of
293Dismissal, neither Dr. Riddell nor Dr. Palmer has petitioned to
303intervene in this proceeding.
307On August 24, 2016, NICA filed a Response to Petition, giving
318notice that the injury does not "meet the definition of a 'birth -
331related neurolo gical injury' Ñ as that term is defined in section
343766.302(2), Florida Statutes, which specifically requires that the
351injury render Ðthe infant permanently and substantially med ic ally
361and physically impaired.Ñ NICA requested that a hearing be
370scheduled to resolve whether the claim was compensable.
378On September 7, 2016, NICA filed a letter indicating that the
389parties were in agreement that a hearing to determine
398compensability will not be necessary and that a motion for summary
409final order will be forthcomi ng.
415On November 4, 2016, NICA filed a Motion for Summary Final
426Order, asserting that Eleanor did not sustain a birth - related
437neurological injury as that term is defined in section 766.302(2),
447Florida Statutes.
449The Motion was served by United States mail on November 4,
4602016. An Order to Show Cause was entered on November 17, 2016,
472advising Petitioners to show cause in writing why RespondentÓs
481Motion for Summary Final Order should not be granted. As of
492todayÓs date, no response has been filed to the Motion for
503Summary Final Order or to the Order to Show Cause.
513FINDINGS OF FACT
5161. Eleanor Breen Zayas was born on May 8, 2015, at
527University of South Florida Health , South Tampa Center , in Tampa,
537Florida.
5382. Donald Willis, M.D. (Dr. Willis), was requested by NICA
548to review the medical records for Eleanor . In a n affidavit dated
561October 28 , 201 6 , Dr. Willis described his findings in pertinent
572part as follows:
575In summary, delivery was complicated by a
582prolonged FHR deceleration about 8 hours
588prior to delivery, maternal chrioamnionitis
593and fetal tachycardia. Cesarean section was
599done with thick Meconium present. The baby
606was not depressed at birth. Cord blood gas
614pH was normal (pH 7.36). However, oxygen
621desaturation occurred at 5 hours after birth
628with seizur e activity following shortly
634after. MRI within 24 - hours of birth showed
643acute cerebral infarction.
646The baby suffered a cerebral infarction. The
653exact timing of the infarction is difficult
660to determine. However, it is possible the
667infarction occurred du ring the severe and
674prolonged FHR deceleration 8 hours prior to
681birth. It appears the baby recovered from
688this hypoxic event during the remaining 8
695hours of labor. Therefore, the cord blood
702gas was not abnormal at birth and the baby
711was not depressed at birth. Infection
717(Choriomnionitis) could be a contributing
722factor. The other opinion would be the
729infarct occurred after delivery, primarily
734related to infection.
737There was an apparent obstetrical event that
744may have resulted in loss of oxygen to the
753b abyÓs brain during labor. Oxygen
759deprivation resulted in brain injury. I am
766unable to comment about the severity of the
774injury.
7753. Dr. WillisÓ opinion that there was an apparent
784obstetrical event that may have resulted in loss of oxygen to the
796babyÓs brain during labor is credited.
8024. Respondent retained Laufey Sigurdardottir, M.D.
808(Dr. Sigurdardottir), a pediatric neurologist, to evaluate
815Eleanor. Dr. Sigurdardottir reviewed EleanorÓs medical records,
822and performed an independent medical examinatio n on her on
832August 10, 2016. In a neurology evaluation based upon this
842examination and a medical records review, Dr. Sigurdardottir made
851the following findings and summarized her evaluation as follows:
860Summary: Here we have a 14 - month - old girl
871with a si nus vein thrombosis at birth, focal
880seizures and possible subsequent infarction.
885This is likely a birth related injury. Her
893recovery has been remarkable and neurologic
899exam today is suggestive of mild expressive
906language delay, but no focal motor
912abnorma lities are found.
916Results as to Question 1: The patient is
924found to have no substantial physical or
931mental impairment at this time.
936Results as to Question 2: EleanorÓs injury
943is a neurologic injury to the brain occurred
951[sic] due to oxygen deprivation and is felt
959to be birth related.
963Results as to Question 3: EleanorÓs
969prognosis for full recovery is extremely good
976and mild expressive delays are not likely to
984have any lasting ill effect.
989In light of the above - mentioned details,
997although clear eviden ce is that EleanorÓs
1004infarct and thrombosis was due to a difficult
1012prolonged birth with chrioamnionitis and
1017recurrent decelerations, she has made such
1023good recovery that at this time I do not
1032recommend Eleanor being included into the
1038Neurologic Injury Comp ensation Association
1043(NICA) Program and would be happy to answer
1051additional questions.
10535. In order for a birth - related injury to be compensable
1065under the NICA Plan, the injury must meet the definition of a
1077birth - related neurological injury and the injury must have caused
1088both permanent and substantial mental and physical impairment.
1096Dr. SigurdardottirÓs opinion that Eleanor does not have a
1105substantial physical or mental impairment is credited.
11126. A review of the file in this case reveals that there
1124have been no expert opinions filed that are contrary to the
1135opinion of Dr. Sigurdardottir that Eleanor does not have a
1145substantial physical or mental impairment.
1150CONCLUSIONS OF LAW
11537. The Division of Administrative Hearings has jurisdiction
1161over the parties to and the subject matter of this proceeding.
1172§§ 766.301 - 766.316, Fla. Stat. (2014).
11798. The Plan was established by the Legislature "to provide
1189compensation on a no - fault basis, for a limited class of
1201catastrophic injuries that result in unusually high costs for
1210custodial care and rehabilitation." § 766.301, Fla. Stat. The
1219Plan applies only to a birth - related neurological injury, which is
1231defined in section 766.302(2) as follows:
"1237Birth - related neurological injury" means
1243injury to the brain or spinal cord of a live
1253infant weighing at least 2,500 grams for a
1262single gestation or, in the case of a multiple
1271gestation, a live infant weighing at least
12782,000 grams at birth caused by oxygen
1286deprivation or mechanical injury occurring in
1292the course of labor, del ivery, or
1299resuscitation in the immediate postdelivery
1304period in a hospital, which renders the infant
1312permanently and substantially mentally and
1317physically impaired . This definition shall
1323apply to live births only and shall not
1331include disability or death caused by genetic
1338or congenital abnormality. (emphasis added).
13439. The injured infant, her or his personal representative,
1352parents, dependents, and next of kin, may seek compensation under
1362the Plan by filing a claim for compensation with DOAH.
1372§§ 766.30 2(3), 766.303(2), and 766.305(1), Fla. Stat. NICA , which
1382administers the Plan, has "45 days from the date of service of a
1395complete claim . . . in which to file a response to the petition
1409and submit relevant written information relating to the issue of
1419whe ther the injury is a birth - related neurological injury."
1430§ 766.305(4), Fla. Stat.
143410. If NICA determines that the injury alleged in a claim is
1446a compensable birth - related neurological injury, it may award
1456compensation to the claimant, provided that the award is approved
1466by the Administrative Law Judge to whom the claim has been
1477assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1488disputes the claim, as it has in the instant case, the dispute
1500must be resolved by the assigned Administrative Law Judge in
1510accordance with the provisions of chapter 120, Florida Statutes.
1519§§ 766.304, 766.309, and 766.31, Fla. Stat.
152611. In discharging this responsibility, the Administrative
1533Law Judge must make the following determinations based upon all
1543available e vidence:
1546(a) Whether the injury claimed is a birth -
1555related neurological injury. If the claimant
1561has demonstrated, to the satisfaction of the
1568administrative law judge, that the infant has
1575sustained a brain or spinal cord injury caused
1583by oxygen deprivati on or mechanical injury and
1591that the infant was thereby rendered
1597permanently and substantially mentally and
1602physically impaired, a rebuttable presumption
1607shall arise that the injury is a birth - related
1617neurological injury as defined in
1622s. 766.302(2).
1624(b) Whether obstetrical services were
1629delivered by a participating physician in the
1636course of labor, delivery, or resuscitation in
1643the immediate postdelivery period in a
1649hospital; or by a certified nurse midwife in a
1658teaching hospital supervised by a
1663partici pating physician in the course of
1670labor, delivery, or resuscitation in the
1676immediate postdelivery period in a hospital.
1682§ 766.309(1), Fla. Stat. An award may be sustained only if the
1694Administrative Law Judge concludes that the "infant has sustained
1703a bi rth - related neurological injury and that obstetrical services
1714were delivered by a participating physician at birth."
1722§ 766.31(1), Fla. Stat.
172612. In the instant case, Petitioners filed a claim alleging
1736that Eleanor did suffer a birth - related neurological injury that
1747is compensable under the NICA Plan. As the proponent of the issue
1759of compensability, the burden of proof is upon Petitioners.
1768§ 766.309(1)(a), Fla. Stat. See also Balino v. Dep't of Health &
1780Rehab ilitative Servs. , 348 So. 2d 349, 350 (Fla. 1 st DCA
17921977)("[T]he burden of proof, apart from statute, is on the party
1804asserting the affirmative of an issue before an administrative
1813tribunal.").
181513. To be compensable under the NICA Plan, there must have
1826been an obstetrical event which resulted in los s of oxygen to the
1839babyÓs brain during labor, delivery, and continuing into the
1848immediate post - delivery period, resulting in a permanent and
1858substantial mental impairment and a permanent and substantial
1866physical impairment, inasmuch as both are required to establish
1875compensability. Fla. Birth - Related Neurological Injury Comp.
1883Ass'n v. Div. of Admin. Hearings , 686 So. 2d 1349 (Fla. 1997).
189514. The evidence, which is not refuted, established that
1904Eleanor does not have a substantial mental or physical impa irment.
1915Thus, Eleanor is not entitled to benefits under the Plan.
1925CONCLUSION
1926Based on the foregoing Findings of Fact and Conclusions of
1936Law, it is ORDERED :
1941T hat the P etition filed by Shannon Breen and Alexandra
1952Zayas, on behalf of and parents and natural guardians of
1962Eleanor Breen Zayas, is dismissed with prejudice.
1969DONE AND ORDERED this 9th day of December , 2016 , in
