94STATEMENT OF THE CASE

98On March 28, 2016, Petitioner, Chayanni Martin, on behalf of

108and as parent and natural guardian of Jaciel Jael Baez Martin

119(Jaciel), a minor, filed a Petition for Benefits Pursuant to

129Florida Statute Section 766.301 et seq. (Petition) with the

138Division of Administrative Hearings (DOAH) for a determination of

147compensabil ity under the Florida Birth - Related Neurological

156Injury Compensation Plan (Plan).

160The Petition named Eliza Gallo Bruscato, M.D., as the

169physician who provided obstetric services at the birth of Jaciel

179on January 13, 2016, at Winnie Palmer Hospital for Wo men located

191in Orlando, Florida.

194DOAH served Winnie Palmer Hospital with a copy of the

204Petition on April 4, 2016. DOAH served NICA with a copy of the

217Petition on April 6, 2016. On April 25, 2016, Eliza Gallo

228Bruscato, M.D., Tullie Ramirez, M.D., and Orla ndo Health, Inc.,

238d/b/a Winnie Palmer Hospital, filed a Petition for Leave to

248Intervene, which was granted.

252On March 30, 2017, NICA filed a Response to Petition for

263Benefits, asserting that Jaciel did not sustain a "birth - related

274neurological injury" as that term is defined in section

283766.302(2), Florida Statutes, and requested that a hearing be

292scheduled to determine compensability.

296On May 2, 2017, Respondent filed a Motion for Summary Final

307Order, stating that Intervenors did not intend to contest N ICAÓs

318decision that the claim is not compensable. Petitioner did not

328file a response to NICAÓs Motion.

334On May 16, 2017, an Order to Show Cause was entered which

346allowed Petitioner until June 1, 2017, to inform the undersigned

356in writing as to why the moti on should not be granted and a

370summary final order be entered finding PetitionerÓs claim is not

380compensable. To date, no response has been filed by Petitioner

390to NICAÓs Motion for Summary Final Order or to the Order to Show

403Cause.

404FINDINGS OF FACT

4071 . Jaciel Martin was born on January 13, 2016, at Winnie

419Palmer Hospital, located in Orlando, Florida.

4252. Donald Willis, M.D. (Dr. Willis), was requested by NICA

435to review the medical records for Jaciel. In a medical report

446dated June 6, 2016, Dr. Will is summarized his findings and opined

458in pertinent part as follows:

463In summary, labor was complicated by

469prolonged rupture of the membranes and

475suspected chorioamnionitis. The FHR tracing

480was not available for review, but medical

487records describe minimal variability and

492tachycardia. Delivery was complicated by a

498shoulder dystocia. The baby was

503significantly depressed and [sic] birth and

509the depression continued with an Apgar score

516of only 5 at twenty minutes. Cord blood gas

525was consistent with acidosis (pH 6.98). The

532newborn hospital course was complicated with

538multi - system organ failures, consistent with

545hypoxic birth injury. Head ultrasound

550identified multifocal hemorrhage.

553There was an apparent obstetrical event that

560resulted in loss of oxygen to the babyÓs

568brain during labor, delivery, and continuing

574into the immediate post delivery period. The

581oxygen deprivation appears to have resulted

587in brain injury. I am unable to comment

595about the severity of the injury.

6013. NICA retained Laufey Y. Sigur dardottir, M.D.

609(Dr. Sigurdardottir), a pediatric neurologist, to examine Jaciel

617and to review his medical records. Dr. Sigurdardottir examined

626Jaciel on March 15, 2017. In a medical report dated February 15,

6382017, Dr. Sigurdardottir summarized her exami nation of Jaciel and

648opined in pertinent part as follows:

654Summary: Jaciel is a 14 - month - old with

664hypoxic ischemic event at birth, requiring a

671cooling protocol, as well as left arm

678weakness. There has been very favorable

684recovery. On neurologic exam toda y he is

692normal, both with motor skills and cognition

699and language development. There are no signs

706of autistic features.

709Result as to question 1: Jaciel is not found

718to have substantial physical or mental

724impairment at this time.

728Results as to question 2: In review of

736available documents, he does have the

742clinical picture of an acute birth - related

750hypoxic injury, as well as reversible

756neurologic impairment from mechanical injury

761of brachial plexus.

764Result as to question 3: The prognosis for

772full mot or and mental recovery is excellent

780and his life expectancy is full.

786In light of his normal cognitive abilities

793and normal neurologic exam, I do not feel

801that Jaciel should be included in the NICA

809program. If needed, I will be happy to

817answer additiona l questions.

8214. A review of the file in this case reveals that there

833have been no expert opinions filed that are contrary to the

844opinion of Dr. Willis that there was an apparent obstetrical

854event that resulted in loss of oxygen to the baby's brain during

866labor, delivery , and the post - delivery period which resulted in

877brain injury. Dr. WillisÓ opinion is credited. There are no

887expert opinions filed that are contrary to Dr. SigurdardottirÓs

896opinion that Jaciel does not have a substantial physical or

906menta l impairment. Dr. SigurdardottirÓs opinion is credited.

9145. Dr. Sigurdardottir reaffirmed her opinions in an

922affidavit dated April 24, 2017.

927CONCLUSIONS OF LAW

9306. The Division of Administrative Hearings has jurisdiction

938over the parties to and the subjec t matter of these proceedings.

950§§ 766.301 - 766.316, Fla. Stat.

9567. The Plan was established by the Legislature "for the

966purpose of providing compensation, irrespective of fault, for

974birth - related neurological injury claims" relating to births

983occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

9948. The injured infant, her or his personal representative,

1003parents, dependents, and next of kin may seek compensation under

1013the Plan by filing a claim for compensation with DOAH.

1023§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1031which administers the Plan, has "45 days from the date of service

1043of a complete claim . . . in which to file a response to the

1058petition and to submit relevant written information relating to

1067the issue of whethe r the injury is a birth - related neurological

1080injury." § 766.305(4), Fla. Stat.

10859. If NICA determines that the injury alleged in a claim is

1097a compensable birth - related neurological injury, it may award

1107compensation to the claimant, provided that the awar d is approved

1118by the administrative law judge to whom the claim has been

1129assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1140disputes the claim, as it has in the instant case, the dispute

1152must be resolved by the assigned administrative law jud ge in

1163accordance with the provisions of chapter 120, Florida Statutes.

1172§§ 766.304, 766.309, and 766.31, Fla. Stat.

117910. In discharging this responsibility, the administrative

1186law judge must make the following determination based upon the

1196available eviden ce:

1199(a) Whether the injury claimed is a birth -

1208related neurological injury. If the claimant

1214has demonstrated, to the satisfaction of the

1221administrative law judge, that the infant has

1228sustained a brain or spinal cord injury

1235caused by oxygen deprivation or mechanical

1241injury and that the infant was thereby

1248rendered permanently and substantially

1252mentally and physically impaired, a

1257rebuttable presumption shall arise that the

1263injury is a birth - related neurological injury

1271as defined in s. 766.303(2).

1276(b) Wheth er obstetrical services were

1282delivered by a participating physician in the

1289course of labor, delivery, or resuscitation

1295in the immediate postdelivery period in a

1302hospital; or by a certified nurse midwife in

1310a teaching hospital supervised by a

1316participating physician in the course of

1322labor, delivery, or resuscitation in the

1328immediate postdelivery period in a hospital.

1334§ 766.309(1), Fla. Stat. An award may be sustained only if the

1346administrative law judge concludes that the "infant has sustained

1355a birth - rel ated neurological injury and that obstetrical services

1366were delivered by a participating physician at birth."

1374§ 766.31(1), Fla. Stat.

137811. The term "birth - related neurological injury" is defined

1388in section 766.302(2) as follows:

"1393Birth - related neurologi cal injury" means

1400injury to the brain or spinal cord of a live

1410infant weighing at least 2,500 grams for a

1419single gestation or, in the case of a

1427multiple gestation, a live infant weighing at

1434least 2,000 grams at birth caused by oxygen

1443deprivation or mechani cal injury occurring in

1450the course of labor, delivery, or

1456resuscitation in the immediate postdelivery

1461period in a hospital, which renders the

1468infant permanently and substantially mentally

1473and physically impaired.

147612. To be compensable under the NICA Pla n, there must have

1488been an obstetrical event which resulted in loss of oxygen to the

1500babyÓs brain during labor, delivery, or resuscitation in the

1509immediate post - delivery period resulting in a permanent and

1519substantial mental impairment and a permanent and substantial

1527physical impairment, inasmuch as both are required to establish

1536compensability. Fla. Birth - Related Neurological Injury Comp.

1544AssÓn v. Div. of Admin. Hearings , 686 So. 2d 1349 (Fla. 1997).

155613. The evidence, which is not refuted, established th at

1566Jaciel does not have a permanent and substantial mental or

1576physical impairment. Therefore, Jaciel is not eligible for

1584benefits under the Plan.

1588CONCLUSION

1589Based on the Findings of Fact and the Conclusions of Law, it

1601is ORDERED that:

1604The Petition filed b y Chayanni Martin, on behalf of and as

1616parent of Jaciel Jael Baez Martin, is dismissed with prejudice.
