81STATEMENT OF THE CASE

85On April 29, 2016, Petitioners, Gary and Ra c quel Donaldson,

96on behalf of and as parents and natural guardians of Harmony

107Donaldson (Harmony), a minor, fi led a Petition for Benefits

117Pursuant to Florida Statute Section 766.301 et seq. (Petition),

126with the Division of Administrative Hearings (DOAH) for a

135determination of compensability under the Florida Birth - Related

144Neurological Injury Compensation Plan (Pla n) . The Petition

153alleged that Harmony suffered brain damage as a result of a birth -

166related neurological injury.

169The Petition named Jennifer Daif - Parker, M.D., as the

179physician providing obstetric services at the birth of Harmony at

189Bethesda Memorial Hospi tal in Boynton Beach, Florida.

197DOAH served Bethesda Memorial Hospital on May 6, 2016. On

207May 9, 2016, DOAH received a return receipt from the United States

219Postal Service showing that Jennifer Daif - Parker, M.D., had been

230served with a copy of the Petition . DOAH served NICA with a copy

244of the Petition on June 5, 2016.

251Bethesda Hospital, Inc., filed a Petition to Intervene, which

260was granted by Order dated July 25 , 2016. As of this date,

272Dr. Daif - Parker has not petitioned to intervene in this

283proceeding.

284On August 24, 2016, NICA filed a response to the Petition,

295giving notice that the injury does not "meet the definition of a

307'birth - related neurological injury' as defined in section

316766.302(2), Florida Statutes. Ñ NICA requested that a hearing be

326schedule d to resolve whether the claim was compensable.

335On September 7, 2016, NICA filed a Motion for Summary Final

346Order, asserting that Harmony did not sustain a Ðbirth - related

357neurological injuryÑ as that term is defined in section

366766.302(2), Florida Statutes . The motion was served by U.S. mail

377on September 7, 2016. No response to the Motion was filed by

389Petitioners.

390On September 20, 2016, an Order to Show Cause was entered

401which allowed Petitioners until October 5, 2016, to inform the

411undersigned as to why a Summary Final Order of Dismissal should

422not be entered and the case closed. To date, no response has

434been filed to the Motion for Summary Final Order or to the Order

447to Show Cause.

450FINDINGS OF FACT

4531. Harmony Donaldson was born on February 22, 2016, at

463Bethesda Memorial Hospital in Boynton Beach, Florida. Harmony

471weighed in excess of 2,500 grams at birth.

4802. NICA retained Donald C. Willis, M.D. (Dr. Willis), to

490review HarmonyÓs medical records. In an affidavit dated

498September 16, 2016, Dr. Willis made the following findings and

508expressed the following opinion:

5125. In summary, this child was delivered by

520what appears to be an uncomplicated vaginal

527birth. The baby was not depressed at birth.

535Apgar scores were 9/9. Mother and baby were

543stated to b e stable in the delivery room and

553the baby was taken to the well nursery.

561However, the baby did suffer an intracranial

568hemorrhage, which became clinically apparent

573about 8 hours after birth. The brain does not

582appear to be a birth related hypoxic or

590trau matic event.

5936. There was no apparent obstetrical event

600that resulted in loss of oxygen or mechanical

608trauma to the babyÓs brain during labor,

615delivery or the immediate post delivery

621period.

6223. Dr. WillisÓ opinion that there was no apparent

631obstetrical event that resulted in loss of oxygen or mechanical

641injury to the babyÓs brain during labor, delivery or the

651immediate post - delivery period is credited.

6584. Respondent retained Michael Duchowny, M.D.

664(Dr. Duchowny), a pediatric neurologist, to evaluate Ha rmony.

673Dr. Duchowny reviewed HarmonyÓs medical records and performed an

682independent medical examination on her on August 17, 2016.

691Dr. Duchowny made the following findings and summarized his

700evaluation as follows:

703IN SUMMARY HarmonyÓs neurological exam ination

709today reveals no specific focal or

715lateralizing findings. She appeared

719cognitively intact and her motor development

725is proceeding at age level. There is no

733evidence of oromotor dysfunction and her

739clavicular fracture has obviously healed

744well.

745I have not yet had an opportunity to review

754medical records and I will issue a final

762report once the review process is complete.

7695. After reviewing HarmonyÓs medical records, Dr. Duchowny

777wrote an addendum to his earlier report in which he stated:

788ADDE NDUM : Review of medical records reveals

796that Harmony was born at term and had 1 and 5

807minute Apgar scores of 9 and 9.

814Desaturations thought to be seizures

819(accompanied by right arm and leg jerking)

826occurred at 8 hours of age. Her PTT was

835slightly prolon ged but INR and fibrinogen was

843normal, and there was no evidence clinically

850of DIC. Factors 7, 10 and 13 levels were

859normal. A head ultrasound on March 5, 2016

867revealed haziness of the thalami which was

874not observed on an MRI scan after the

882transfer to N CH. This later study did

890however reveal bilateral parietal

894intraparenchymal hemorrhage , hemorrhage in

898the frontal gray - white interface and punctate

906hemorrhage in the sylvian aqueduct. The

912basal ganglia were normal; MRA and MRV were

920likewise WNL.

922Based o n review of the medical records and

931the neurological evaluation, I do not believe

938that Harmony has a substantial mental or

945motor impairment, and did not suffer from

952substantial intrapartum oxygen deprivation or

957mechanical injury. I am therefore not

963recomm ending H armony for inclusion in the

971NICA program.

9736 . Dr. Duchowny stated his ultimate o pinion in an affidavit

985dated September 7, 2016 , in which he opined, ÐI do not believe

997that HARMONY h as a substantial mental or motor impairment and did

1009not suffer fro m substantial intrapartum oxygen deprivation or

1018mechanical injury.Ñ

10207 . Dr. DuchownyÓs opinion that Harmony does not have a

1031substantial mental or motor impairment and did not suffer from

1041substantial intrapartum oxygen deprivation or mechanical injury

1048is cr edited.

10518. A review of the file in this case reveals that there

1063have been no expert opinions filed that are contrary to the

1074opinion of Dr. Willis that there was no apparent obstetrical

1084event that resulted in loss of oxygen or mechanical trauma to the

1096baby Ós brain during labor, delivery or the immediate post -

1107delivery period. There are no expert opinions filed that are

1117contrary to Dr. DuchownyÓs opinion that Harmony does not have a

1128substantial mental or motor impairment.

1133CONCLUSIONS OF LAW

11369. The Division of Administrative Hearings has jurisdiction

1144over the parties to and the subject matter of this proceeding.

1155§§ 766.301 - 766.316, Fla. Stat. (2014).

116210. The Plan was established by the Legislature "to provide

1172compensation on a no - fault basis, for a limited class of

1184catastrophic injuries that result in unusually high costs for

1193custodial care and rehabilitation." § 766.301, Fla. Stat. The

1202Plan applies only to a birth - related neurological injury, which is

1214defined in section 766.302(2) as follows:

"1220Birth - rel ated neurological injury" means

1227injury to the brain or spinal cord of a live

1237infant weighing at least 2,500 grams for a

1246single gestation or, in the case of a multiple

1255gestation, a live infant weighing at least

12622,000 grams at birth caused by oxygen

1270deprivat ion or mechanical injury occurring in

1277the course of labor, delivery, or

1283resuscitation in the immediate postdelivery

1288period in a hospital, which renders the infant

1296permanently and substantially mentally and

1301physically impaired . This definition shall

1307apply to live births only and shall not

1315include disability or death caused by genetic

1322or congenital abnormality. (emphasis added).

132711. The injured infant, her or his personal representative,

1336parents, dependents, and next of kin, may seek compensation under

1346th e P lan by filing a claim for compensation with DOAH.

1358§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. The Florida

1367Birth - Related Neurological Injury Compensation Association, which

1375administers the Plan, has "45 days from the date of service of a

1388comp lete claim . . . in which to file a response to the petition

1403and submit relevant written information relating to the issue of

1413whether the injury is a birth - related neurological injury."

1423§ 766.305(4), Fla. Stat.

142712. If NICA determines that the injury all eged in a claim is

1440a compensable birth - related neurological injury, it may award

1450compensation to the claimant, provided that the award is approved

1460by the Administrative Law Judge to whom the claim has been

1471assigned. § 766.305(7), Fla. Stat. If, on the ot her hand, NICA

1483disputes the claim, as it has in the instant case, the dispute

1495must be resolved by the assigned Administrative Law Judge in

1505accordance with the provisions of chapter 120, Florida Statutes.

1514§§ 766.304, 766.309, and 766.31, Fla. Stat.

152113. I n discharging this responsibility, the Administrative

1529Law Judge must make the following determinations based upon all

1539available evidence:

1541(a) Whether the injury claimed is a birth -

1550related neurological injury. If the claimant

1556has demonstrated, to the sat isfaction of the

1564administrative law judge, that the infant has

1571sustained a brain or spinal cord injury caused

1579by oxygen deprivation or mechanical injury and

1586that the infant was thereby rendered

1592permanently and substantially mentally and

1597physically impaired , a rebuttable presumption

1602shall arise that the injury is a birth - related

1612neurological injury as defined in s.

1618766.302(2).

1619(b) Whether obstetrical services were

1624delivered by a participating physician in the

1631course of labor, delivery, or resuscitation i n

1639the immediate postdelivery period in a

1645hospital; or by a certified nurse midwife in a

1654teaching hospital supervised by a

1659participating physician in the course of

1665labor, delivery, or resuscitation in the

1671immediate postdelivery period in a hospital.

1677§ 766 .309(1), Fla. Stat. An award may be sustained only if the

1690Administrative Law Judge concludes that the "infant has sustained

1699a birth - related neurological injury and that obstetrical services

1709were delivered by a participating physician at birth."

1717§ 766.31(1 ), Fla. Stat.

172214. In the instant case, Petitioners filed a claim alleging

1732that Harmony did sustain a birth - related neurological injury that

1743is compensable under the NICA P lan. As the proponent of the issue

1756of compensability, the burden of proof is upon Petitioners.

1765§ 766.309(1)(a), Fla. Stat. See also Balino v. Dep't of Health &

1777Rehab. Servs. , 348 So. 2d 349, 350 (Fla. 1st DCA 1977)("[T]he

1789burden of proof, apart from statute, is on the party asserting the

1801affirmative of an issue before an administrati ve tribunal.").

181115. The evidence, which is not refuted, established that

1820Harmony did not sustain an injury to the brain or spinal cord

1832caused by oxygen deprivation or mechanical injury in the course of

1843labor, delivery or resuscitation in the immediate pos t - delivery

1854period which rendered her permanently and substantially mentally

1862and physically impaired. Thus, Harmony is not entitled to

1871benefits under the Plan.

1875CONCLUSION

1876Based on the foregoing Findings of Fact and Conclusions of

1886Law, it is ORDERED:

1890That the Petition filed by Gary and Ra c quel Donaldson, on

1902behalf of and as parents and natural guardians of Harmony

1912Donaldson, is dismissed with prejudice.

1917DONE AND ORDERED this 11th day of October , 2016 , in
