163Whether notice was accorded the patient, as contemplated by
172section 766.316, Florida Statutes, or whether the failure to give
182notice was excused because the patient had an emergency medical
192condition, as defined in section 395.002(8), or the giving of

206STATEMENT OF THE CASE
210On June 22, 2016, Petitioners, Luis Arturo Jimenez and
219Priscilla Franco, a s parents of Dallas Jimenez (Dallas), a mi nor,
231filed an Amended Petition Under Protest Pursuant to Florida
240Statute Section 766.301 et seq. (Petition) with DOAH for a
250determination of compensability under the Florida Birth - Related
259Neurological Injury Compen sation Plan (Plan). The Petition named
268Sabriya Ishoof, M.D., as the physician who provided obstetric
277services at the birth of Dallas on April 8, 2014, at South Miami
290Hospital, d/b/a Baptist Health South Florida (South Miami), in
299Miami, Florida.
301On August 3, 2016, South Miami filed a Petition for Leave to
313Intervene, which was granted by Order dated August 11, 2016. On
324June 22, 2017, the undersigned conducted a telephonic status
333conference with the parties. During said conference,
340PetitionersÓ counsel rep resented that Petitioners were not
348contesting that PetitionersÓ claim was compensable under the
356Plan. Thereafter, on June 28, 2017, Respondent filed a Renewed
366Motion for Summary Final Order (RespondentÓs Motion), addressing
374the issue of compensability.
378On July 20, 2017, a Partial Summary Final Order was entered,
389finding that Dallas had sustained a birth - related neurological
399injury and finding PetitionersÓ claim to be compensable.
407Jurisdiction was retained on the issues of whether the notice
417requirements of section 766.316 were satisfied and to determine
426an award pursuant to section 766.31 .
433On November 1, 2017, the undersigned issued an Order
442Requiring Response, directing the parties to provide a written
451status report as to the remaining issues and whet her a final
463hearing was required. In response, on November 8, 2017,
472Petitioner s represented that Intervenor failed to provide
480adequate notice pursuant to section 766.316, and requested a
489final hearing.
491The final hearing was scheduled for April 17, 2017. On
501April 11 , 2018, the parties filed a Joint Pretrial Stipulation
511wherein the parties stipulated that Petitioner, Priscilla Franco,
519delivered her son, Dallas, at South Miami on April 8, 2014. The
531final hearing proceeded as noticed. The final hearing Tr anscript
541was filed on May 7, 2018. The identity of the witnesses and
553exhibits and the rulings regarding each are as set forth in the
565Transcript.
566Based upon the partiesÓ stipulation at the conclusion of the
576hearing, the partiesÓ proposed orders were to b e submitted 30
587days after the Transcript was filed. Ultimately, after granting
596two extensions, the proposed orders were to be filed on or before
608June 22, 2018. The parties timely submitted the proposed orders ,
618which have been considered in issuing this S ummary Final Order.
629FINDINGS OF FACT
6321. On April 8, 2014, at approximately 7:33 a.m.,
641Petitioner, Priscilla Franco, presented to FishermanÓs Community
648Hospital (FishermanÓs) in Marathon, Florida. At the time, she
657was 33 weeks and 6 days pregnant. Her primary complaint at
668FishermanÓs was abdominal pain. It was noted that her lower
678abdominal pain was sharp and had begun at 4:00 a.m.
688At 7:40 a.m., her pain was noted to be a 5 out of 10 on a
70410 - point pain scale.
7092. At 7:51 a.m., Ms. Franco was diagnosed at FishermanÓs
719with Ðactive labor, premature.Ñ 1 / As FishermanÓs does not have
730obstetrical services available, a transfer was initiated. At
738approximately 8:45 a.m., Sabrya Ishoof, M.D., accepted the
746transfer of Ms. Franco to South Miami.
7533. Dr . Ishoof is a self - employed obstetrician/gynecologist.
763At all times relevant to this proceeding, she held staff
773privileges at South Miami . On April 8, 2014, she was called in
786to treat Ms. Franco as the on - call emergency obstetrician. Prior
798to this date, Dr. Ishoof and Petitioner did not have a physician -
811patient relationship for obstetrical services. Similarly,
817Ms. Franco did not have such a relationship with South Miami.
8284. At approximately 9:54 a.m., Ms. Franco was transported
837via helicopter provid ed by Lifenet from FishermanÓs to South
847Miami, where she arrived at approximately 11:15 a.m. Upon
856arrival, Ms. Franco was taken to the antepartum unit, where she
867was initially assessed and examined by Carmen Davis, R.N. , and
877Melissa Luna, R.N. The initia l assessments included, inter alia,
887placing an external fetal monitor on Ms. Franco and performing a
898vaginal examination. The vaginal examination revealed that
905Ms. FrancoÓs cervix was 3 cm dialated and had thinned to
91660 percent effacement.
9195. At appr oximately 11:37, Nurse Luna documented that
928Ms. Franco was having u terine contractions, lasting 30 to 60
939seconds. The contractions resulted in cramping abdominal pain.
947The pain w as described as a 5 - 6 on the 10 - point pain scale.
964At 11:38 a.m., this ass essment was communicated to Dr. Ishoof.
975Two minutes later, Dr. Ishoof issued her Admission Order , wherein
985she admitted Ms. Franco to the antepartum unit and ordered
995magnesium, antibiotics, insulin, as well as an ultrasound. The
1004decision to admit Ms. Fran co was based upon the following:
1015Ms. FrancoÓs prior history of a preterm Cesarean delivery,
1024cervical dil ation, and uterine contractions -- being in active
1034labor.
10356. At 12:06 p.m., Nurse Luna documented that Ms. Franco was
1046having uterine contractions las ting 50 to 60 seconds.
1055At 12:13 p.m., Nurse Davis contacted Dr. Ishoof regarding the
1065external fetal monitoring interpretation, the contraction
1071pattern, pain assessment, and interventions performed.
10777. Nurse Davis, at approximately 12:14 p.m., proceede d with
1087admission paperwork with Ms. Franco. A packet of information was
1097provided to Ms. Franco, which, inter alia, included a NICA
1107brochure, entitled ÐA Peace of Mind for an Unexpected Problem,Ñ
1118and a form acknowledging receipt of the brochure, entitled
1127Ð Notice to Obstetric Patient.Ñ The notice language, which is
1137contained on a document bearing the label for South Miami,
1147provides as follows:
1150NOTICE TO OBSTETRIC PATIENT
1154I have been furnished information by the
1161hospital prepared by the Florida Birth
1167Relat ed Neurological Injury Compensation
1172Association, and have been advised that my
1179doctor may be a participating physician in
1186that program, wherein certain limited
1191compensation is available in the event
1197certain neurological injury may occur during
1203labor, deliv ery, or resuscitation. For
1209specifics on the program, I understand I can
1217contact the Florida Birth Related
1222Neurological Injury Compensation Association
1226(NICA), P.O. Box 14567, Tallahassee, Florida
123232317 - 4567, (800) 398 - 2129. I further
1241acknowledge that I h ave received a copy of
1250the brochure prepared by NICA.
12558. Nurse Davis credibly testified that, while she does not
1265have a specific recollection of Ms. Franco, her routine practice
1275was to provide the NICA brochure and notice acknowledging receipt
1285to h er patients upon admission. Specifically, Nurse Davis
1294testified that she would provide the documents and request the
1304patient to sign the same. Nurse Davis would then sign the
1315document acknowledging the patientÓs signature and receipt. In
1323this matter, Ms . FrancoÓs signature appears under the above -
1334referenced notice. The document further bears the signature of
1343Nurse Davis as a witness to Ms. FrancoÓs signature.
13529. While Ms. Franco testified that she did not receive the
1363NICA brochure, Ms. FrancoÓs testimony on this fact is not
1373credited. The better evidence establishes that Ms. Franco was
1382provided the NICA brochure as described by Nurse Davis and
1392acknowledged by Ms. FrancoÓs signature.
139710. At 12:34 p.m., Dr. Ishoof ordered Ms. Franco to be
1408p repared for a Cesarean section delivery. Dallas was delivered
1418at 1:51 p.m. It is undisputed that Dr. Ishoof was the physician
1430providing obstetric services at DallasÓs birth. The evidence
1438established that Dr. Ishoof was a Plan - participating physician at
1449that time. The evidence further established that South Miami was
1459a Plan - participating hospital at the time of DallasÓs birth.
1470CONCLUSIONS OF LAW
147311. DOAH has jurisdiction over the parties to and the
1483subject matter of this proceeding. §§ 766.301 - 766.31 6, Fla.
1494Stat.
149512. The issue to be determined at this juncture is whether
1506notice was provided pursuant to section 766.316, which provides:
1515Notice to obstetrical patients of
1520participation in the plan . Ï Each hospital with
1529a participating physician on its s taff and
1537each participating physician, other than
1542residents, assistant residents, and interns
1547deemed to be participating physicians under
1553s. 766.314 (4)(c), under the Florida Birth -
1561Related Neurological Injury Compensation Plan
1566shall provide notice to the obstetrical
1572patients as to the limited no - fault
1580alternative for birth - related neurological
1586injuries. Such notice s hall be provided on
1594forms furnished by the association and shall
1601include a clear and concise explanation of a
1609patientÓs rights and limitations under the
1615plan. The hospital or the participating
1621physician may elect to have the patient sign
1629a form acknowledg ing receipt of the notice
1637form. Signature of the patient acknowledging
1643receipt of the notice form raises a
1650rebuttable presumption that the notice
1655requirements of this section have been met.
1662Notice need not be given to a patient when
1671the patient has an eme rgency medical
1678condition as defined in s. 395.002 (8)(b) or
1686when notice is not practicable.
169113. Section 39 5.002(8)(b), Florida Statutes, defines
1698Ðemergency medical conditionÑ as follows:
1703(8) ÐEmergency medical conditionÑ means:
1708* * *
1711(b) With respect to a pregnant woman:
17181. That there is inadequate time to effect
1726safe transfer to another hospital prior to
1733delivery;
17342. That a transfer may pose a threat to the
1744health and safety of the patient or fetus; or
17533. That there is evidence of the onset and
1762persistence of uterine contractions or
1767rupture of the membranes.
177114. Ms. Franco signed an acknowled gement form stating that
1781she received a NICA brochure. The form was signed within
1791approximately one hour upon first arriving at South Miami. Her
1801signature raises a rebuttable presumption that the notice
1809requirements of section 766.316 have been met by In tervenor.
181915. Intervenor contends that Petitioners were provided with
1827proper notice pursuant to section 766.316 and, in any event,
1837notice was not required to be given due to Ms. FrancoÓs emergency
1849medical condition as defined in section 395.002(8)( b), upon
1858arrival at South Miami on April 8, 2014, the day Dallas was born.
1871As the proponents of the proposition that appropriate notice was
1881given or excused, the burden on this issue of notice is upon
1893Intervenor. Tabb v. Fla. Birth - Related Neurological I njury Comp.
1904AssÓn , 880 So. 2d 1253, 1257 (Fla. 1st DCA 2004).
191416. Intervenor has met its burden on the issue of notice.
1925The evidence clearly establishes that, when Ms. Franco presented
1934to South Miami, on April 8, 2014, she had an emergency medical
1946condition as defined in section 395.002(8)(b)3. Specifically,
1953the undisputed evidence establishes that Ms. Franco was
1961experiencing persistent uterine contractions upon her arrival and
1969subsequent admission to the hospital. Accordingly, neither
1976Dr. Ishoo f nor South Miami Hospital was required to provide NICA
1988notice pursuant to section 766.316.
1993CONCLUSION
1994Based on the foregoing Findings of Fact and Conclusions of
2004Law, it is
2007ORDERED that Intervenor and Sabriya Ishoof, M.D., we re not
2017obligated to provide notice pursuant to section 766.316, because
2026P etitioner , Priscilla Franco, presented to South Miami in an
2036emergency medical condition as defined in section 395.002(8)(b).
2044It is further ORDERED that the parties are accorded 30 days
2055from the date of this Or der to resolve, subject to approval of
2068the ALJ, the amount and manner of payment of an award to
2080Petitioner; the reasonable expenses incurred in connection with
2088the filing of the claim, including reasonable attorneyÓs fees and
2098costs; and the amount owing fo r expenses previously incurred. If
2109not resolved within such period, the parties shall so advise the
2120ALJ, and a hearing will be scheduled to resolve such issues.
2131Once resolved, an award will be made consistent with
2140section 766.31.
