151Whether notice was accorded the patient, as contemplated by

196PRELIMINARY STATEMENT
198On May 27, 2016 , Latoya John son, on behalf of and as
210parent and natural guardian of R hyÓLee Wilson, a minor, filed
221a Petition for Benefits (Pet ition) with DOAH alleging that
231RhyÓLee Wilson suffered brain damage as a result of a birth -
243related neurological injury and requesting benefits available
250under section 766.301, et seq. , Florida Statute s .
259On July 29, 2016, Intervenors, Orlando Health, Inc . (OHI) ,
269and Ronald Eason, M.D. (Dr. Eason) , filed a motion to intervene,
280which was granted by Order dated August 11, 2016.
289On October 13, 2016, Respondent, Florida Birth - Related
298Neurological Injury Compensation Association (NICA) , responded
304to the Petiti on for Benefits. Therein , NICA asserted its
314determination that the claim was compensable, based upon the
323opinions of Dr. Willis and Dr. Sigurdardottir, whose reports and
333expert medical opinions were provided therewith.
339A Notice of Hearing was issued on December 1, 2016,
349scheduling the final hearing for June 1, 2017.
357Following written discovery exchanged between the parties,
364NICA filed a Motion for Summary Final Order on March 8, 2017 ,
376seeking an order establishing that RhyÓLee Wilson had suffered a
386bi rth - related neurological injury as defined by section
396766.302(2). As Petitioner failed to timely disclose any
404expert(s) or opinions of expert(s) to rebut the opinions of
414NICAÓs experts and failed to timely respond to expert discovery
424served by NICA, Respo ndent also filed a Motion for Protective
435Order to prevent the depositions of NICAÓs experts (which had
445been requested by PetitionerÓs counsel) from going forward.
453A motion hearing was held on March 15, 2017 , and an Order
465on Pending Motions was subsequen tly issued by ALJ Barbara Staros
476on March 16, 2017. Said O rder denied NICAÓs Motion for
487Protective Order (and required the depositions of NICAÓs experts
496to go forward), reserved ruling on NICAÓs Motion for Summary
506Final Order, and required Petitioner to Ð indicate whether or not
517she [would] be challenging the issue of compensability at the
527final hearing, and if so, . . . disclose the names(s) and
539business address(s) of any expert whose testimony and opinion
548she intend [ed] to rely on at hearingÑ no later tha n May 1, 2017.
563Following the depositions of NICAÓs experts, Dr. Willis and
572Dr. Sigurdardottir, NICA filed a Renewed Motion for Summary
581Final Order, once again requesting an Order establishing that
590RhyÓLee Wilson had suffered a birth - related neurological i njury
601as defined by section 766.302(2). This motion was granted and a
612Partial Summary Final Order was entered on June 30, 2017. In
623the June 30, 2017 Order, the undersigned determined that RhyÓLee
633Wilson was born on August 5, 2014 , at Winnie Palmer Hospit al,
645that RhyÓLee Wilson weighed in excess of 2,500 grams at birth,
657and that RhyÓ Lee Wilson was delivered by Dr. Eason, who was a
670plan - participating physician at the time of RhyÓLee WilsonÓs
680birth. The undersigned also determined that based upon the
689credit ed and unrefuted opinions of Dr. Willis and
698Dr. Sigurdardottir, RhyÓLee Wilson sustained an injury to her
707brain during labor, delivery, and continuing into the immediate
716post - delivery period due to oxygen deprivation, which resulted
726in brain injury renderi ng RhyÓLee Wilson permanently and
735substantially mentally and physically impaired. Jurisdiction
741was reserved to determine whether the notice requirements of
750section 766.316 were satisfied and concerning the issue of an
760award pursuant to section 766.31. Th e Partial Summary Final
770Order is adopted by, and incorporated in, this Final Order as
781though restated in its entirety.
786On June 30, 2017, the undersigned also issued an Amended
796Notice of Hearing , which clarified that the issues to be heard
807at the hearing o n October 10, 2017 , were whether notice was
819accorded the patient, as contemplated by section 766.316, or
828whether the failure to give notice was excused because the
838patient had an emergency medical condition, as defined in
847section 395.002(8), or the giving of notice was not practicable.
857On July 7, 2017, Petitioner filed a Motion for
866Reconsideration/Rehearing regarding the Partial Summary Final
872Order entered June 30, 2017 , or in the alternative, a Motion to
884Set Aside the Partial Summary Final Order of June 30, 2017.
895Respondent filed its Response and Opposition to PetitionerÓs
903motion on July 14, 2017 , and Petitioner filed a Reply to
914RespondentÓs Response and Opposition on July 24, 2017. By Order
924dated July 26, 2017, the undersigned denied PetitionerÓs Moti on
934for Reconsideration. Petitioner then filed an appeal of the
943June 30, 2017 , Order with the Fifth District Court of Appeal
954(DCA) on July 31, 2017. Said appeal was ultimately dismissed as
965premature by the Fifth DCA on September 19, 2017.
974On August 28, 2 017, Petitioner filed her Motion for Summary
985Final Order regarding Notice. PetitionerÓs motion was based
993upon the deposition testimony of Petitioner , that it was not her
1004signature on the Notice of NICA participation by Orlando Health,
1014Inc. (on its own beh alf and on behalf of its employed
1026physicians, etc.) , dated May 11, 2014. Intervenor filed a
1035Response in Opposition to PetitionerÓs Motion for Summary Final
1044Order on September 7, 2017 , which Petitioner replied to on
1054September 14, 2017. By Order dated Sept ember 19, 2017,
1064PetitionerÓs Motion for Summary Final Order regarding Notice was
1073denied.
1074Petitioner filed her Motion for Reconsideration of Order
1082Denying Summary Judgment on September 27, 2017 , and a Renewed
1092Motion for Summary Final Order Regarding Noti ce on September 29,
11032017. A motion hearing was held on October 3, 2017 , and
1114thereafter, on October 25, 2017, this Court entered an Order
1124Denying PetitionerÓs Motion for Reconsideration of Order Denying
1132Summary Judgment, and an Order Denying PetitionerÓs R enewed
1141Motion for Summary Final Order. On that same date , the
1151undersigned also entered an Order granting in part PetitionerÓs
1160motion to permit the testimony of Thomas Vastrick at the final
1171hearing and allowing Intervenors time to obtain a handwriting
1180expe rt and to conduct discovery pertaining to PetitionerÓs
1189handwriting expert.
1191A Notice of Hearing was issued on November 22, 2017. Said
1202notice established that the final hearing would go forward on
1212January 18, 2018 , and that the issues to be determined were
1223whether notice was accorded the patient, as contemplated by
1232section 766.316, or whether the failure to give notice was
1242excused because the patient had an emergency medical condition,
1251as defined in section 395.002(8), or the giving of notice was
1262not practi cable.
1265On December 22, 2017, Intervenor filed a Motion to Compel
1275(PetitionerÓs) Expert Discovery (responses), a Motion to Compel
1283Earlier Deposition of Thomas Vastrick, and a Motion to Strike
1293Thomas Vastrick (as a witness for Petitioner). On December 26 ,
13032017, Petitioner filed a Response in Opposition to IntervenorÓs
1312Motion to Compel and Motion to Strike , as well as a Motion for
1325Protective Order regarding Thomas Vastrick.
1330On January 5, 2018, Intervenor filed a Motion for Partial
1340Summary Final Order as to Dr. Eas onÓs Duty to Provide Notice
1352and Supporting Memorandum of Law. NICA filed a Notice of
1362Joinder in IntervenorÓs Motion for Partial Summary Final Order

1698day.
1699The Fifth DCA denied PetitionerÓs Emergency Motion for Stay
1708Pending Certio rari Review and Emergency Motion for Review of
1718Order Denying Stay Pending Certiorari by Order dated January 17,
17282018. The Fifth DCA also dismissed PetitionerÓs Writ of
1737Certiorari, by Order dated February 8, 2018.
1744Given the rulings by the appellate court, the formal
1753hearing went forward on the issue of notice on January 18, 2018,
1765as scheduled. Despite having notice of the final hearing,
1774neither Petitioner, her counsel, nor any representative thereof
1782appeared. At hearing, the undersigned received into evi dence
1791IntervenorÓs exhibits, and heard the sworn testimony of Dean
1800Ritchey, Ronald Eason, M.D., Marlene Wooley, Theresa Dean,
1808Bridget Walters, and Donald Willis, M.D. Specifically relevant
1816to the issue of an emergency medical condition excusing notice
1826of NICA participation by Dr. Eason, the undersigned heard the
1836live testimony of Dr. Eason , and the deposition testimony of
1846Dr. Willis was published in the record.
1853At hearing the undersigned also heard argument of counsel
1862on IntervenorsÓ Motion to S trike Tho mas Vastrick, IntervenorsÓ
1872Motion for Summary Final Ord er on Notice with regard to
1883Dr. Eason, and RespondentÓs Motion to Compel PetitionerÓs
1891counsel to pay Dr. Willis for his deposition.
1899As to the Motion for Sum mary Final Order on Notice with
1911regard to D r. Eason, In tervenors argue that although a health
1923care provider is requi red to provide notice of his or her
1935participation in NICA, an exception exists under section 766.316
1944when a patient has an emergency medical condition as defined by
1955section 395.002(8) (b) or when notice is not practicable.
1964Respondent contends that based upon the medical records of
1973Petitioner, the deposition testimony of Petitioner, the
1980deposition testimony of Dr. Willis, and the hearing testimony of
1990Dr. Eason, at the time Petitioner pr esented to the hospital on
2002August 5, 2014, an emergency medical condition existed which
2011excused Dr. EasonÓs provision of notice of his participation in
2021NICA. Although Respondent takes no position on the factual
2030issue of whether notice of participation in NICA was given to
2041Petitioner, Respondent agrees with Intervenor that provision of
2049notice to Petitioner of Dr. EasonÓs participation in NICA should
2059be excused due to an emergency medical condition.
2067At hearing the undersigned ruled that IntervenorsÓ Motio n
2076to Strike Thomas Vastrick was rendered moot since Thomas
2085Vastrick was not called to testify at the hearing by Petitioner
2096or PetitionerÓs counsel. Ruling was reserved on IntervenorsÓ
2104Motion for Summary Final Order with regard to Dr. Eason and
2115RespondentÓ s Motion to Compel.
2120Th e undersigned issued a Notice of Right to File Proposed
2131Final Or ders on January 19, 2018. The T ranscript of the final
2144hearing was filed by Respondent on February 9, 2018.
2153Thereafter, on January 19, 2018 , both Respondent and
2161Inter venors filed Proposed Final Orders. Petitioner did not
2170file a p roposed f inal o rder.
2178FINDINGS OF FACT
2181Based upon the demeanor and credibility of the witnesses,
2190other evidence presented at the final hearing, and on the entire
2201record of this proceeding, th e following Findings of Fact are
2212made:
22131 . Petitioner, Latoya Johnson, is the mother/natural
2221guardian of Rhy'Lee Wilson.
22252 . Rhy'Lee was born at Winnie Palmer Hospital for Women &
2237Babies, a licensed Florida hospital, in Orlando, Florida , on
2246August 5, 2011.
22493 . The physician providing obstetric services at the time
2259of birth was Ronald Eason, M.D.
22654 . Rhy'Lee was delivered via stat cesarean - section,
2275necessitated by a placental abruption.
22805 . Rhy'Lee suffered from oxygen deprivation prior to
2289delivery, during d elivery, and in the immediate post - delivery
2300resuscitative period, as determined pursuant to the
2307undersignedÓs June 30, 2017 , Partial Summary Final Order.
23156 . Rhy'Lee is substantially and permanently mentally and
2324physically impaired, as determined pursuant to the undersigned's
2332June 30, 2017 , Partial Summary Final Order.
23397 . Intervenors, OHI and Ronald Eason, M.D., are NICA
2349participants.
2350Facts Relating to OHI's Compliance with NICA Notice Requirements
23598 . On May 11, 2014, Ms. Johnson presented to the Emergenc y
2372Department of Winnie Palmer Hospital for Women and Babies with
2382complaints of vaginal pain with swelling. She was noted to be
239324.1 weeks pregnant.
23969 . During the May 11, 2014 , visit, Ms. Johnson signed the
2408NICA acknowledgement form dated May 11, 2014. T he form,
2418entitled "Florida Birth - Related Neurological Injury Compensation
2426Plan Acknowledgement of Patient Receipt of Notice Hospital,"
2434provided the following acknowledgement:
2438I have been advised that Orlando Health,
2445Inc. and its employed physicians, reside nts,
2452mid - wives and physician assistants, as well
2460as any participating physician on our
2466medical staff credentialed to provide
2471obstetrical services, are members in the
2477Florida Birth - Related Neurological Injury
2483Compensation Plan (NICA). This Plan
2488provides th at certain limited compensation
2494is available in the event certain birth -
2502related neurological injuries may occur
2507during labor, delivery or post - delivery
2514resuscitation, irrespective of fault. For
2519specifics on the Plan, I understand I can
2527contact the Florida Birth - Related
2533Neurological Injury Compensation Association
2537(NICA), Post Office Box 14567, Tallahassee,
2543FL 32317 - 4567, 904.488.8191 /800.398.2129 .
2550I further acknowledge I have received from
2557Orlando Health, Inc., a copy of the form
2565brochure regarding the P lan. The form
2572brochure is prepared and furnished by the
2579Florida Birth - Related Neurological Injury
2585Compensation Association (NICA).
258810 . Ms. Johnson's signature and initials on the NICA
2598acknowledgement form , dated May 11, 2014 , were witnessed by
2607Marlene W oolley. At the time, Ms. Woolley was a f inancial
2619c ounselor employed by OHI. Her job was to handle the
2630preregistration of patients for upcoming surgeries and for
2638emergency registrations.
264011 . During Ms. Woolley's depos ition, she testified that
2650she did not recall t he night that she witnessed Ms. Johnson's
2662signature. Nevertheless, she testified that she definitively
2669was present while Ms. Johnson signed the NICA acknowledgement
2678form, and that the signature on the form bel onged to
2689Ms. Johnson, because Ms. Woo lley's signature appears on the form
2700under the witness line. Ms. Woolley further testified as
2709follows r egarding her encounter with Ms. Johnson and her routine
2720practice at Winnie Palmer Hospital:
2725 On May 11, 2014, at 9:07 p.m., the NICA
2735acknowledgement form was printed by the
2741financial counselor in triage, prior to it
2748being presented to Ms. Johnson for
2754signature.
2755 At 9:15 p. m., Ms. Woolley went to see
2765Ms. Johnson. She walked into her room and
2773verif ied that she was Ms. Johnson by
2781askin g for her name. A copy of
2789Ms. Johnson's driver's license had been
2795previously collected by triage.
2799 Ms. Woolley is typically in the patient's
2807room for two to three minutes, so she
2815knows that Ms. Johnson signed the NICA
2822acknowledgement form within two to three
2828minutes of 9:15 p.m .
2833 After Ms. Johnson signed the NICA
2840acknowledgement form, Ms. Woolley went to
2846the back room, put the documents next to
2854her computer, and then went to see the
2862next patient.
2864 No one else would have handled the
2872documents containing Ms. Johnson's
2876signature wh ile Ms. Woolley was seeing
2883other patients, and no one else would have
2891handled the documents from the time they
2898were signed by Ms. Johnson at
2904ap proximately 9:15 p.m. until Ms. Woolley
2911scanned and then shredded the documents at
2918approximately 11:20 p.m.
2921 At 1 1:20 p.m., Ms. Woolley entered her
2930account notes into the computer stating
2936that Ms. Johnson signed the NICA form and
2944that Ms. Woolley sent the scanned forms to
2952Health Information Management.
2955 Ms. Woolley had no reason to doubt that
2964the signature which appe ars on the NICA
2972acknowledgement form belongs to a patient
2978by the name of Latoya Johnson, and she was
2987confi dent that the signature was
2993Ms. Johnson's signature because
2997Ms. Woolley was there, she witnessed it,
3004and he r own signature was there.
3011Ms. Woolley wou ld actually hold the
3018clipboard while the patients signed the
3024forms, so she would literally watch them
3031sign while she was there. Her eyes would
3039be on the patient while signing.
3045 If a patient refused to sign the NICA
3054acknowledgement form, Ms. Woolley would
3059write "refused to sign" on the form and it
3068would get scanned into the system. She
3075would also note in the account notes that
3083the patient refused to sign. The fact
3090that Ms. Woolley's account notes state
3096that the patient signed means that she
3103accepted the N ICA pamphlet.
310812 . Bridget Walters, OHI's c orporate d irector of Patient
3119Accounting, was deposed as OHI's c orporate r epresentative on the
3130issue of notice. During Ms. Walter's deposition, she testified
3139as follows regarding OHI's routine practices for provi ding NICA
3149notice to patients at Winnie Palmer Hospital in 2014:
3158 The hospital (Winnie Palmer Hospital)
3164requires that all pregnant patients sign
3170the NICA form even if they state that they
3179are not going to deliver at Winnie Palmer
3187Hospital.
3188 If the patient re fuses to sign the form,
3198another team member would witness that the
3205patient refused to sign.
3209 Ms. Walters is not aware of any instance
3218in which a patient's signature has been
3225forged by anyone at OHI.
3230 Ms. Walters has no reason to believe that
3239the signature on the May 11, 2014 , NICA
3247acknowledgement form was forged.
3251 OHI team members are trained to enter
3259notes into the patient's account after
3265they have completed the registration with
3271the patient.
3273 In this case, the account notes of
328111:2 0 p.m. on May 11, 2014 , reflect that
3290the patient signed the NICA form and that
3298it was sent to Health Information
3304Management.
330513 . Intervenors also presented the testimony of their
3314forensic handwriting expert, Theresa Dean, via video conference.
3322Ms. Dean is qualified to render opinions as a forensic
3332handwriting expert by virtue of her training through the Secret
3342Service basic and advanced training programs, the North Carolina
3351Justice Academy's training program in document forensics, the
3359Bradley document forensics training progra m, and the
3367International Graphoanalysis Society's course of study in
3374graphoanalytic technique. Ms. Dean's full credentials are
3381summarized in her Curriculum Vitae, which was received in
3390evidence.
339114 . Ms. Dean testified that she was retained by counsel
3402for Intervenors to look at the questioned document, which was
3412described as the NICA acknowledgment form dated May 11, 2014,
3422and to determine whether or not the handwritten signature on
3432that document was written by Ms. Johnson. In addition to
3442reviewing the NI CA acknowledgme nt form dated May 11, 2014,
3453Ms. Dean reviewed 77 other documents which were identified as
3463documents containing the signatures of Ms. Johnson from April of
34732013 through December of 2015. Ms. Dean also reviewed portions
3483of Ms. JohnsonÓs depos ition transcript.
348915 . Ms. Dean created two c omparison charts to assist
3500with her analysis of the signatures. The comparison charts
3509allow for a side - by - side comparison of the similarities and
3522dissimilarities of the signatures.
352616 . Ms. Dean offered the fol lowing opinions based on her
3538review:
3539 Based on a reasonable degree of certainty,
3547it is highly probable that the NICA
3554acknowledgement form dated May 11, 2014 ,
3560was signed by Ms. Johnson.
3565 Ms. Johnson has "quite a range of
3573variation" when she signs her signatu re,
3580and at least five different signature
3586styles were identified in the writings
3592dating from 2013 through 2015.
3597 The most common of the five signature
3605styles was the one used on the NICA
3613acknowledgement form dated May 11, 2014.
3619The signature style contain s a clockwise
3626motion in the initial stroke.
3631 Several factors can cause variation in a
3639person's signature, including stress
3643level, their position, emotional upset or
3649trauma.
3650 The signature on the May 11, 2014 , NICA
3659acknowledgement form w ould have been very
3666difficult to duplicate by a forger. The
3673signatu re contains no indications of a
3680forgery su ch as evidence of hesitation, a
3688drawn look to the writing, or tremors.
3695Rather, the signature has smooth
3700directional changes and the lower loop is
3707nice and smooth. T here is no blotching or
3716blobs of ink, or pooling of ink, or any
3725angularity that would call into question
3731the authenticity of the signature.
37361 7 . The unrebutted credible evidence of record established
3746that Ms. Johnson signed the NICA acknowledgement form s ometime
3756between 9:07 p.m. and 11:20 p.m. , on May 11, 2014.
3766Dr. Eason's Excusal from Providing Notice due to Emergency
3775Circumstances :
37771 8 . Dr. Eason is a board - c ertified
3788o bstetrician/ g ynecologist, who joined the medical education
3797group at OHI in 2007. As ev idenced by NICA Certificate
3808No. 25687, Dr. Eason was a participant in the Florida Birth -
3820Related Neurological Injury Compensation Plan from January 1,
38282014 , to December 31, 2014.
38331 9 . On August 5, 2014, Ms. Johnson became Dr. Eason's
3845patient during her a dmission to Winnie Palmer Hospital.
3854Ms. Johnson was admitted to Winnie Palmer Hospital at
386312:23 a.m. , on August 5, 2014.
386920 . Ms. Johnson's complaint s at the time of admission
3880were extreme pain, weakness and some nausea. She had low
3890blood pressure and th e fetal heart rate was determined to be
3902extremely low. It appeared Ms. Johnson was suffering a
3911placental separation or placental abruption. She was admitted
3919and quickly transferred to an operating room for an emergency
3929cesarean section.
39312 1 . Placental ab ruption is the premature separation of the
3943placenta from its attachment to the inside wall of the uterus,
3954which compromises the blood flow to the baby and thereby
3964compromises oxygen to the baby and creates an urgent fetal
3974distress condition.
39762 2 . A normal heart rate fo r a n unborn, late - term baby is
3993between 110 and 160 beats per minute. In Ms. Johnson's case,
4004hospital clinicians were initially unable to find the fetal
4013heart rate, and when it was found it was between 30 and 60 beats
4027per minute, which is dang erously low.
40342 3 . Ms. Johnson was very quickly transported upstairs for
4045an emergency cesarean sec tion which was performed by Dr. Eason
4056at 12:55 a.m. on August 5, 2014. The baby was breach and was
4069delivered quickly and appeared very flaccid with lack of to ne
4080and no respiratory effort. The baby was quickly handed to the
4091neonatal respiratory team which was in the operating room. The
4101team initiated resuscitation efforts. The cesarean - section
4109confirmed the initial diagnosis of placental abruption.
41162 4 . Ms. J ohnson presented to Dr. Eason with an emergency
4129medical condition on August 5, 2014, and there was inadequate
4139time to have e ffected a safe transfer to another hospital prior
4151to delivery. Emergency treatment was indicated and it would
4160have been medically i nappropriate to transfer her to another
4170facility. According to the credible testimony of Dr. Eason, had
4180a transfer been attempted, it would have caused a threat to the
4192health and safety of Ms. Johnson and her fetus. With a high
4204degree of probability, the baby would have died, and quite
4214possibly the patient would have succumbed to the hemorrhage.
42232 5 . Dr. Eason was not Ms. Johnson's private obstetrician
4234and he did not provide her with any prenatal care prior to his
4247first encounter with her on August 5, 201 4.
42562 6 . It would not have been practicable for Dr. Eason to
4269provide notice to Ms. Johnson of his participation in NICA on
4280August 5, 2014, because of her emergency situation when time was
4291of the essence and the primary focus was on getting care for the
4304pat ient and her unborn baby as quickly as possible.
43142 7 . It would not have been practicable for Dr. Eason to
4327provide notice to Ms. Johnson of his participation in NICA prior
4338to August 5, 2014, because he did not know her as a patient
4351prior to her emergency pr esentation in the emergency department.
4361Payment of Dr. WillisÓ s Deposition Fee
43682 8 . By letter dated December 29, 2016, PetitionerÓs
4378counsel requested to take the deposition of Dr. Willis.
4387Thereafter the deposition of Dr. Willis was coordinated with all
4397c ounsel, and PetitionerÓs counsel issued a Notice of Taking
4407Deposition Duces Tecum of Dr. Willis on January 31, 2017, and
4418again on March 15, 2017. There is no indication that the matter
4430of payment for Dr. WillisÓ s time for his deposition was broached
4442by co unsel for Respondent.
44472 9 . After the deposition w ent forward as noticed on
4459March 16, 2017, Dr. Willis sent PetitionerÓs counsel his invoice
4469for his time for his deposition in the amount of $500.00.
4480Having received no payment from PetitionerÓs counsel, D r. Willis
4490subsequently reissued his $500 invoice to PetitionerÓs counsel
4498on June 15, 2017 ; July 26, 2017 ; and November 3, 2017. Counsel
4510for Respondent also resubmitted Dr. WillisÓ s $500 invoice to
4520counsel for Petitioner on November 15, 2017 , and December 1,
45302017.
453130 . There is no evidence of record, or allegation in
4542RespondentÓs Motion to Compel Payment, that there was any
4551advance agreement between Petitioner and Respondent for the
4559payment of Dr. WillisÓ s invoice. It also appears that there was
4571ample tim e for such agreement to be reached from the time
4583Dr. Willis was first noticed for deposition, and when his
4593deposition was actually taken.
4597CONCLUSIONS OF LAW
46003 1 . The Division of Administrative Hearings has
4609jurisdiction over the parties and the subject matt er of these
4620proceedings. §§ 766.301 - 766.316, Fla. Stat.
46273 2 . The Florida Birth - Related Neurological Injury
4637Compensation Plan (Plan) was established by the legislature "for
4646the purpose of providing compensation, irrespective of fault,
4654for birth - related neu rological injury claims" relating to births
4665occurring on or after January 1, 1989. § 766.301(1), Fla. Stat.
46763 3 . The injured "infant, his personal representatives,
4685parents, dependents and next of kin" may seek compensation under
4695the Plan by filing a clai m for compensation with DOAH within
4707five (5) y ears of the infant's birth. §§ 766.302( 3),
4718766.303(2), 766.305(1) , and 766.313, Fla. Stat. N ICA, which
4727administers the Plan, has "forty - five (45) days from the date of
4740service of a complete claim . . . in whi ch to file a response to
4756the Petition and to submit relevant information relating to the
4766issue of whether the injury is a birth - r elated neurological
4778injury . " § 766.305(3), Fla. Stat.
47843 4 . If NICA determines that the injury alleged in a claim
4797is a compensa ble birth - related neurological injury, it may award
4809compensation to the Claimant, provided that the award is
4818approved by the ALJ to which the claim has been assigned.
4829§ 766.305(6), Fla. Stat. The ALJ has exclusive jurisdiction to
4839determine whether a clai m filed under the Plan is compensable.
4850§ 766.304, Fla. Stat.
48543 5 . In discharging this responsibility, the ALJ must make
4865the following determinations based upon the available evidence:
4873 Whether the injury claimed is a birth -
4882related neurological injury. If the
4887Claimant has demonstrated, to the
4892satisfaction of the ALJ, that the infant
4899has sustained a brain or spinal cord
4906injury caused by oxygen deprivation or
4912mechanical injury and that the infant
4918was thereby rendered permanently and
4923substantially mentally and physically
4927impaired, a rebuttable presumption shall
4932arise that the injury is a birth - related
4941neur ological injury as defined in
4947§ 766.302(2).
4949 Whether obstetrical services were
4954delivered by a participating physician
4959in the course of labor, delivery or
4966resu scitation in the immediate post -
4973delivery period in a hospital; or by a
4981certified nurse mid - wife in a teaching
4989hospital supervised by a participating
4994physician in the course of labor, delivery
5001or resuscitation in the immediate post -
5008delivery period in a hosp ital .
5015 Whether, if raised by the Claimant or
5023other party, the factual determinations
5028regardi ng the notice requirements in
5034§ 766.316 are satisfied. The ALJ has the
5042exclusive jurisdiction to make these
5047factual determinations.
5049§ 766.309(1), Fla. Stat.
50533 6 . The only issue to be determined at the final hearing
5066was whether notice was provided by OHI and Dr. Eason, or whether
5078the requirement to provide notice was excused, pursuant to
5087section 766.316, which provides:
5091Notice to obstetrical patients of
5096particip ation in the plan. -- Each hospital
5104with a participating physician on its staff
5111and each participating physician, other than
5117residents, assistant residents, and interns
5122deemed to be participating physicians under
5128s. 766.314(4)(c), under the Florida Birth -
5135Rel ated Neurological Injury Compensation
5140Plan shall provide notice to the obstetrical
5147patients as to the limited no - fault
5155alternative for birth - related neurological
5161injuries. Such notice shall be provided on
5168forms furnished by the association and shall
5175inclu de a clear and concise explanation of a
5184patientÓs rights and limitations under the
5190plan. The hospital or the participating
5196physician may elect to have the patie nt sign
5205a form acknowledging receipt of the notice
5212form. Signature of the patient
5217acknowledgin g receipt of the notice form
5224raises a rebuttable presumption that the
5230notice requirements of this section have
5236been met. Notice need not be given to a
5245patient when the patient has an emergency
5252med ical condition as defined in
5258s. 395.002(8)(b) or when notic e is not
5266practicable.
52673 7 . Section 766.309(1)(d) provides in relevant part:
5276(1) The administrative law judge shall make
5283the following determinations based upon all
5289available evidence:
5291* * *
5294(d) Whethe r, if raised by the claimant or
5303other party, the factual determinations
5308regardin g the notice requirements in
5314s. 766.316 are satisfied. The
5319administrative law judge has the exclusive
5325jur isdiction to make these factual
5331determinations.
53323 8 . Petitioner contends that OHI did not give notice
5343pursuant to sec tion 766.316. In tervenor, OHI, contends that it
5354provided sufficient notice pursuant to section 766.316.
5361Intervenor, Dr. Eason, contends that the requirement to provide
5370notice was excused due to the emergency medical condition
5379exception. As the proponent s of the proposition that
5388appropriate notice was given or that notice was not required,
5398the burden on the issue of notice is upon the Intervenors. Tabb
5410v. Fla. Birth - Related Neurological Injury Comp. Ass'n. , 880 So.
54212d 1253, 1257 (Fla. 1st DCA 2004).
54283 9 . Although Ms. Woolley did not independently remember
5438her encounter with Ms. Johnson on May 11, 2014, she follows her
5450normal routine and practice when registering obstetrical
5457patients, which includes giving the NICA brochure to the patient
5467and having the p atient sign the acknowledgment form. "Evidence
5477of the routine practice of an organization, whether corroborated
5486or not and regardless of the presence of eyewitnesses, is
5496admissible to prove the conduct of the organization on a
5506particular occasion was in c onfor mity with routine practice."
5516§ 90.406, Fla. Stat.; see also Tabb , 880 So. 2d at 1259.
5528Ms. Woolley's Account Notes of May 11, 2014 , further corroborate
5538the fact that Ms. Johnson was provided with a NICA brochure
5549during that visit and that Ms. Johnson signed the acknowledgment
5559form.
556040 . Although Petitioner denies having been given a NICA
5570brochure at any time, her signature on the NICA acknowledgment
5580form dated May 11, 2014, raises the statutory rebuttable
5589presumption provided by section 766.316 that she not only
5598received the NICA brochure provided to her on that date, but
5609also that the notice requirements of section 766.316 were met by
5620OHI. Based upon the totality of the evidence admitted, the
5630undersigned finds by a preponderance of the evidence that
5639Petitioner has not rebutted the statutory presumption.
56464 1 . In Weeks v. Florida Birth - Related Neurological Injury
5658Compensation Association , 977 So. 2d 616, 618 - 619 (Fla. 5th DCA
56702008), the court stated:
5674[T]he formation of the provider - obstetrical
5681patient relationship is what triggers the
5687obligation to furnish the notice. The
5693determination of when this relationship
5698commences is a question of fact. Once the
5706relationship commences, because [section
5710766.316] is silent on the time period within
5718which notice must be furnished, under well -
5726established principles of statutory
5730construction, the law implies that notice
5736must be given within a reasonable time."
5743Burnsed v. Seaboard Coastline R. Co. , 290
5750So . 2d 13, 19 (Fla. 1974); Concerned
5758Citizens of Putnam County v . St. Johns River
5767Water Mgmt. Dist. , 622 So. 2d 520, 523 (Fla.
57765th DCA 1993). The determination depends on
5783the circumstances, but a central
5788consideration should be whether the patient
5794received the notice in sufficient time to
5801make a meaningful choice of w hether to
5809select another provider prior to delivery,
5815which is the primary purpose of the notice
5823requirement.
58244 2 . In this case, Ms. Johnson received notice of OHI's
5836participation in NICA nearly three months prior to her delivery,
5846which provided her with more than sufficient time to select a
5857different hospital prior to delivery, had she wished to do so.
58684 3 . The signature of Ms. Johnson on the form acknowledging
5880receipt of the NICA brochure raises a rebuttable presumption
5889that the notice requirements of N ICA have been met. See
5900§ 766.316, Fla. Stat.
59044 4 . In addition to the presumption, the facts as found
5916herein support the conclusion that Ms. Johnson was appropriately
5925provided predelivery notice of NICA participation by OHI. As
5934such, Petitioner did not ov ercome the rebuttable presumption in
5944favor of OHI that the NICA notice requirements were met.
59544 5 . As to Dr. Eason, the unrefuted evidence supports a
5966finding that providing notice of his participation in NICA was
5976not practicable during his only encounter w ith Ms. Johnson on
5987August 5, 2014 , or any time prior, as Ms. Johnson presented with
5999a clear emergency medical condition, a placental abruption
6007resulting in the continuous loss of oxygen to the fetus. The
6018clear emergency resulted in inadequate time to tran sfer the
6028patient to another facility prior to delivery, as severe harm or
6039death to Ms. Johnson and her fetus would have resulted had a
6051transfer to another facility been attempted.
60574 6 . While chapter 766 does not define Ðemergency medical
6068condition , Ñ sectio n 395.002(8)(b) defines Ðemergency medical
6076conditionÑ with respect to a pregnant woman as follows:
60851. That there is inadequate time to effect
6093safe transfer to another hospital prior to
6100delivery;
61012. That a transfer may pose a threat to the
6111health and saf ety of the patient or fetus;
6120or
61213. That there is evidence of the onset and
6130persistence of uterine contractions or
6135rupture of the membranes.
61394 7 . Dr. Eason did not provide care to Ms. Johnson during
6152her May 11, 2014 , visit to OHI, and he did not establish a
6165physician - patient relationship with Ms. Johnson until he first
6175came in contact with her on August 5, 2014 , less than 32 minutes
6188prior to the emergent delivery of Rhy'Lee Wilson. During these
6198brief minutes, Ms. Johnson presented with a statutorily defin ed
"6208emergency medical condition." Delivery was imminent and
6215necessary to prevent the death of the fetus in utero and to
6227prevent severe injury to Ms. Johnson. Ms. Johnson could not
6237have been safely transferred to another hospital for delivery by
6247a new obs tetrician.
62514 8 . In this case, the evidence proved that Dr. Eason had
6264not established a physicia n - patient relationship with
6273Ms. Johnson until Ms. Johnson presented with an emergency
6282medical condition on August 5, 2015. Thus, Dr. Eason was
6292excused from prov iding notice of his NICA participation.
63014 9 . Finally, with regard to the payment of Dr. WillisÓ s
6314invoice for time spent giving a deposition, Florida Rule of
6324Civil Procedure 1.390 provides in pertinent part:
6331(c) Fee. An expert or skilled witness
6338whose de position is taken shall be allowed a
6347witness fee in such reasonable amount as the
6355court may determine. The court shall also
6362determine a reasonable time within which
6368payment must be made, if the deponent and
6376party cannot agree. All parties and the
6383deponen t sha ll be served with notice of
6392any hearing to determine the fee. Any
6399reasonable fee paid to an expert or skilled
6407witness may be taxed as costs.
641350 . While the above provision authorizes the payment of an
6424expert witness fee for deposition, it also impl icitly recognizes
6434that there must be coordination between the parties with respect
6444to arrangements for the payment of the fee. There is no
6455indication that such discussions took place in this instance.
64645 1 . Respondent cites a DOAH Order entered in Jimenez and
6476Franco v. Florida Birth - Related Neurological Injury Compensation
6485Association, et al. , DOAH Case No. 16 - 3531N, in support of its
6498motion to compel payment . However, in ordering that the
6508requesting party must pay the d eposition fee of an expert
6519(Dr. Wil lis), ALJ Todd Resavage was informed by Respondent in
6530that case that:
6533D uring the scheduling process, and prior to
6541taking the deposition, the undersigned
6546counsel's office specifically notified all
6551other counsel, and in particular counsel for
6558the Petitioners , that Petitioners' counsel
6563office needed to contact the doctors
6569regarding their fees for deposition [see
6575attached email dated April 4, 2017, attached
6582hereto as Exhibit "1"]. Thereafter, a
6589second email was sent to Petitioners'
6595counsel on April 17th, speci fically
6601referencing that Dr. Willis's fees for
6607services would be $500.00 an hour, and as a
6616courtesy, he would not require payment up
6623front [see attached email dated April 17,
6630attached hereto as Exhibit "2"]. Following
6637that notification, Counsel for the
6642Pe titioners s ent a confirming email on
6650April 18th, and served a Notice of
6657Deposition [see attached email dated
6662April 18th, attached hereto as Composite
6668Exhibit "3"]. [2/]
6672(Motion to Compel PetitionersÓ Counsel to Pay Dr. Willis for
6682Deposition, para. 4, Nove mber 10, 2017) .
66905 2 . Thus, in the Jimenez case, unlike the matter sub
6702judice , Petitioners were notified in advance that they would be
6712responsible for the payment of Dr. WillisÓ s deposition fee, and
6723were informed of his hourly rate for giving a deposition.
6733Having been put on notice that Petitioners would be responsible
6743for Dr. WillisÓ s deposition fee, and standing silent as to their
6755responsibility for, and the amount of the fee, Petitioners
6764became obliged to pay the fee when they went forward and took
6776the deposition. Those circumstances are not present in this
6785case.
6786ORDER
6787Based on the foregoing F indings of F act and C onclusions of
6800L aw, it is ORDERED:
68051. The claim for compensation filed by Petitioner, as
6814parent and natural guardian of Rhy'Lee Wilson, a mino r, is
6825compensable and is APPROVED. 3/
68302. Intervenor, OHI, complied with the statutory Notice
6838requirements of the NICA plan pursuant to section 766.316,
6847Florida Statutes.
68493. Intervenor, Dr. Eason, was excused from the statutory
6858Notice requirements of the N ICA P lan pursuant to section
6869766.316, Florida Statutes, due to the emergency medical
6877condition exception.
68794. RespondentÓs M otion to C ompel PetitionerÓs C ounsel to
6890P ay Dr. Willis for D eposition is DENIED.
68995. Within thirty (30) days of the date of this Ord er,
6911Petitioner shall inform the undersigned in writing whether
6919Petitioner accepts an award of NICA benefits.
69266. If Petitioner accepts an award for NICA benefits, and
6936absent a stipulation of the parties, a separate hearing will be
6947scheduled to determine th e amount and terms of the award
6958pursuant to section 766.31, Florida Statutes.
