94STATEMENT OF THE CASE

98On May 12 , 201 6 , Petitioner s , Justin and Jade Wiles , on

110behalf of and as parents and natural guardians of Lennox Wiles

121(Lennox), a minor, filed a Petition for Benefits Pursuant to

131Florida Statute Section 766.301 et seq. (Petition) , with the

140Division of Administrative Hearings (DOAH) for a determination of

149compensability under the Florida Birth - Related Neurological

157Injury Compensation Plan (Plan). The Petition was filed pro se.

167The Petition named A.J. Brickler , M.D., as the physician who

177provided obstetric services at the birth of Lennox on Ma y 11 ,

189201 4 , at Tallahassee Me morial Hospital in Tallahassee , Florida.

199DOAH served NICA and A.J. Brickler, M.D., with a copy of the

211Petition on June 28 , 201 6 . DOAH served Tallahassee Memorial

222Hospital (TMH) with a copy of the Petition on June 30, 2016.

234On August 2, 2016 , Alexander J. Brickler, M.D., and North

244Florida WomenÓs Care filed a Petition for Leave to Intervene,

254which was granted by Order dated August 1 6 , 201 6 . On Novem ber 1,

2702016 , TMH filed a Mo tion for Leave to Intervene, which was

282granted by Order dated Novem ber 2 , 201 6 .

292Notices of Appearance were filed by attorneys on behalf of

302Petitioners on August 24, 2016. Petitioners, now represented by

311counsel, filed a Motion for Leave to Amend Petition, which was

322granted. An Amended Petition Under Protest was filed.

330On January 24 , 201 7 , NICA filed a Motion for Summary Final

342Order , asserting that Lennox did not sustain a birth - related

353neurological injury. TMH and Dr. Brickler requested and received

362an extension of time in which to respond to NICAÓs Motion.

373Dr. Brickler and Nor th Florida WomenÓs Care filed a Withdrawal of

385Motion to Defer Ruling or Hearing on NICAÓs Motion for Summary

396Final Order on March 8, 2017. The following day, TMH filed a

408Notice of Withdrawal of Opposition to NICAÓs Motion for Summary

418Final Order. Petitio ners did not file a response to NICAÓs

429Motion for Summary Final Order. However, PetitionersÓ Amended

437Petition Under Protest seeks an order finding that the claim is

448not compensable under the NICA statutes. Consequently, there is

457no longer opposition to N ICAÓs Motion, and a hearing is no longer

470necessary.

471FINDINGS OF FACT

4741. Lennox Wiles was born on Ma y 11 , 201 4 , at Tallahassee

487Memorial Hospital located in Tallahassee , Florida. Lennox

494weighed in excess of 2,500 grams at birth.

5032. Donald Willis, M.D. ( Dr. Willis), was requested by NICA

514to review the medical records for Lennox, to determine whether an

525injury occurred to the brain or spinal cord caused by oxygen

536deprivation or mechanical injury occurring in the course of

545labor, delivery, or resuscitation in the immediate post - delivery

555period. In an affidavit dated January 23, 2017, Dr. Willis set

566forth his findings and opinion in pertinent part as follows:

576It is my opinion the mother was not in labor,

586so the injury did not occur during labor.

594Delivery wa s by Cesarean section, so hypoxic

602brain injury did not occur during delivery.

609The baby was crying at birth, again

616suggesting there was no significant brain

622injury during delivery. Respiratory distress

627occurred shortly after delivery and required

633bag and mask ventilation for 30 seconds.

640Apgar score was 9 by 5 minutes. Spontaneous

648respiratory activity resumed and the baby was

655left with the Labor and Delivery staff. Once

663the NICU staff left the baby with the L & D

674staff, this would indicate the baby was

681s table and would end the immediate post -

690delivery period. It would be unlikely that

697significant hypoxic brain injury occurred

702during post - delivery period, which would be

710the brief period from delivery until the baby

718was left with the L & D staff. Based on this

729information, it does not appear this child

736suffered oxygen deprivation sufficient to

741cause brain injury during the labor, delivery

748or the immediate post delivery period.

754In conclusion, there was no apparent

760obstetrical event that resulted in loss of

767oxygen or mechanical trauma to the babyÓs

774brain during labor, delivery or the immediate

781post delivery period.

7843. NICA retained Laufey Y. Sigurdardottir, M.D.

791(Dr. Sigurdardottir), a pediatric neurologist, to examine Lennox

799and to review his medical recor ds. Dr. Sigurdardottir examined

809Lennox on October 19, 2016. In an affidavit dated January 19,

8202017, Dr. Sigurdardottir summarized her findings from the medical

829evaluation and opined as follows:

834Lennox is found to have substantial motor and

842mental impairm ent at this time. At the age

851of [2 - 1/2], he is dependent on his caretakers

861for all care and although he can grab toys

870and indicate wants and needs in a very simple

879manner, he has what seem to be significant

887cognitive delays. His motor disability is

893signi ficant.

895There is evidence of decreased fetal movement

902and nonreassuring fetal heart rate. This led

909to his cesarean section. The patient did

916have signs of ischemia including coagulopathy

922at birth and went into a persistent pulmonary

930hypertension suggesti ve of fetal distress.

936His current clinical picture is that of

943cerebral palsy. The injury is likely to have

951occurred prenatally, prompting decreased

955fetal movements. The mother was however not

962in active labor at time of delivery.

969At this time, LennoxÓs prognosis for life

976expectancy is excellent, but for full

982recovery is extremely guarded as he has

989substantial mental and physical impairment

994and is not sitting at this time.

1001In light of the above details, and the

1009absence of active labor at time of delivery ,

1017I do not recommend Lennox being included in

1025the Neurologic Injury Compensation

1029Association Program.

10314. A review of the file in this case reveals that there

1043have been no expert opinions filed that are contrary to the

1054opinion of Dr. Willis that there was no apparent obstetrical

1064event that resulted in loss of oxygen or mechanical trauma to the

1076babyÓs brain during labor, delivery or the immediate post -

1086delivery period. Dr. WillisÓ opinion is credited. There are no

1096expert opinions filed that are contrary to Dr. SigurdardottirÓs

1105opinion that while Lennox has substantial motor and mental

1114impairment, LennoxÓs cerebral palsy is likely to have occurred

1123prenatally and there was no active labor at the time of delivery.

1135Dr. SigurdardottirÓs opinion is credited.

1140CONCLUSIONS OF LAW

11435. The Division of Administrative Hearings has jurisdiction

1151over the parties to and the subject matter of these proceedings.

1162§§ 766.301 - 766.316, Fla. Stat.

11686. The Plan was established by the Legislature "for the

1178purpose of providin g compensation, irrespective of fault, for

1187birth - related neurological injury claims" relating to births

1196occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

12077. The injured infant, her or his personal representative,

1216parents, dependents, and ne xt of kin may seek compensation under

1227the Plan by filing a claim for compensation with DOAH.

1237§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1245which administers the Plan, has "45 days from the date of service

1257of a complete claim . . . in which to file a response to the

1272petition and to submit relevant written information relating to

1281the issue of whether the injury is a birth - related neurological

1293injury." § 766.305(4), Fla. Stat.

12988. If NICA determines that the injury alleged in a claim i s

1311a compensable birth - related neurological injury, it may award

1321compensation to the claimant, provided that the award is approved

1331by the administrative law judge to whom the claim has been

1342assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1353di sputes the claim, as it has in the instant case, the dispute

1366must be resolved by the assigned administrative law judge in

1376accordance with the provisions of chapter 120, Florida Statutes.

1385§§ 766.304, 766.309, and 766.31, Fla. Stat.

13929. In discharging this responsibility, the administrative

1399law judge must make the following determination based upon the

1409available evidence:

1411(a) Whether the injury claimed is a birth -

1420related neurological injury. If the claimant

1426has demonstrated, to the satisfaction of the

1433adm inistrative law judge, that the infant has

1441sustained a brain or spinal cord injury

1448caused by oxygen deprivation or mechanical

1454injury and that the infant was thereby

1461rendered permanently and substantially

1465mentally and physically impaired, a

1470rebuttable presu mption shall arise that the

1477injury is a birth - related neurological injury

1485as defined in s. 766.303(2).

1490(b) Whether obstetrical services were

1495delivered by a participating physician in the

1502course of labor, delivery, or resuscitation

1508in the immediate postd elivery period in a

1516hospital; or by a certified nurse midwife in

1524a teaching hospital supervised by a

1530participating physician in the course of

1536labor, delivery, or resuscitation in the

1542immediate postdelivery period in a hospital.

1548§ 766.309(1), Fla. Stat. An award may be sustained only if the

1560administrative law judge concludes that the "infant has sustained

1569a birth - related neurological injury and that obstetrical services

1579were delivered by a participating physician at birth."

1587§ 766.31(1), Fla. Stat.

159110. The term "birth - related neurological injury" is defined

1601in section 766.302(2) as follows:

"1606Birth - related neurological injury" means

1612injury to the brain or spinal cord of a live

1622infant weighing at least 2,500 grams for a

1631single gestation or, in the case of a

1639multiple gestation, a live infant weighing at

1646least 2,000 grams at birth caused by oxygen

1655deprivation or mechanical injury occurring in

1661the course of labor, delivery, or

1667resuscitation in the immediate postdelivery

1672period in a hospital, which renders the

1679infant permanently and substantially mentally

1684and physically impaired.

168711. The evidence, which is not refuted by any contrary

1697expert opinions, established that Lennox did not sustain an

1706injury to the brain or spinal cord caused by oxygen deprivation

1717or mechanical injury in the course of labor, delivery, or

1727resuscitation in the immediate post - delivery period. Therefore,

1736Lennox is not eligible for benefits under the Plan.

1745§§ 766.302(2) and 766.309(1), Fla. Stat.

1751CONCLUSION

1752Based upon the foregoing Fi ndings of Fact and Conclusions of

1763Law, it is ORDERED that the Amended Petition Under Protest filed

1774by Justin Wiles and Jade Wiles, on behalf of and as parents and

1787natural guardians of Lennox Wiles, a minor, is dismissed with

1797prejudice. The final hearing s cheduled for April 20, 2017, is

1808cancelled.
