57This came before the undersigned upon Respondent , Florida
65Birth - Related Neurolog ical Injury Compensation AssociationÓs
73(NICA), Unopposed Motion for Summary Final Order, filed on
82January 2, 2018. Concurrently with the filing of the motion,
92Respondent filed medical records relating to the birth of
101Huntley Clay Martin, deposition transc ripts of two phy sicians,
111and a list of all NICA - participating physicians in the year
1232012. The motion represents that Petitioners do not oppose the
133granting of the motion, and that Intervenor takes no position on
144the motion.
146STATEMENT OF THE CASE
150The iss ue in this case is whether Huntley Clay Martin
161(Huntley) suffered a birth - related injury as defined by section
172766.302(2), Florida Statutes, for which compensation should be
180awarded under the Florida Birth - Related Neurological Injury
189Compensation Plan (the Plan).
193PRELIMINARY STATEMENT
195On July 18, 2016, Petitioners filed a Petition for Benefits
205(Petition), alleging that Huntley suffered brain damage as a
214result of a birth - related neurological injury, and requesting
224for themselves and their minor child benef its available under
234the Plan. The Petition also asserted that the physicians
243providing obstetric services who were present at the birth of
253Huntley included Dr. David Guerra (Dr. Guerra) and Dr. Nasim
263Khan (Dr. Khan) .
267The Division of Administrative Hearing s served NICA ,
275Dr. Khan , Dr. Guerra, and Highlands Regional Medical Center
284(Highlands Regional), with a copy of the original claim under
294cover letter dated July 21, 2016. On August 4, 2016 , Highlands
305Regional moved to intervene, and on August 19, 2016 , an Order
316was entered granting Highlands RegionalÓs intervention.
322On December 19, 2016, NICA responded to the Petition for
332Benefits and gave notice that NICA was of the view that the
344claim was not compensable because Huntley had not suffered a
354birth - related n eurological injury as defined by section
364766.302(2).
365On January 18, 2017, Administrative Law Judge Barbara J.
374Staros entered a Notice of Hearing and Order of Pre - hearing
386Instructions. Said n otice set the final hearing of this matter
397via video teleconferen ce for August 8, 2017, with locations in
408Tampa and Tallahassee, Florida. The final hearing was continued
417upon stipulation of the parties.
422On January 2, 2018, Respondent filed an Unopposed Motion
431for Summary Final Order with the aforementioned medical reco rds
441in support of the Motion for Summary Final Order.
450FINDINGS OF FACT
4531 . Huntley was born on June 11, 2012, at Highlands
464Regional, 3600 South Highlands Avenue, Sebring, Florida. The
472pregnancy, labor, and delivery of his mother, Amy Martin, were
482manage d by employees of Highlands Regional and Dr. Guerra.
4922 . Hospital delivery records indicate that Dr. Guerra was
502the delivering physician. Th e records also reflect that
511Dr. Guerra was the sole admitting, attending, delivering , and
520discharging physician for Amy Martin on June 11, 2012. In
530addition, nursing notes reveal that no other physicians other
539than Dr. Rivabem (anesthesiologist) and Dr. Guerra were present
548for the birth of Huntley.
5533 . The deposition of Dr. Khan was taken on October 17,
5652017 , and th e deposition of Dr. Guerra was taken on November 27,
5782017. Dr. Khan testified in pertinent part that she was not
589present in the room for the labor, delivery , or post -
600resuscitative period and that she was not otherwise involved
609therein. Dr. Guerra testifi ed in pertinent part that Dr. Khan
620was not present with him during the birth of Huntley and that he
633had no recollection of Dr. Khan having otherwise participated in
643the labor, delivery , or post - delivery resuscitation of Huntley.
6534 . Section 766.309 provide s that the A dministrative L aw
665J udge ÐshallÑ determine , based on all available evidence, inter
675alia, Ð[w]hether obstetrical services were delivered by a
683participating physician in the course of labor, delivery, or
692resuscitation in the immediate post deliver y period in a
702hospital. Ñ
7045 . Section 766.302(7) defines Ðparticipating physicianÑ
711as:
712[A] physician licensed in Florida to
718practice medicine who practices obstetrics
723or performs obstetrical services either full
729time or part time and who had paid or was
739ex empted from payment at the time of the
748injury the assessment required for
753participation in the birth - related
759neurological injury compensation plan for
764the year in which the injury occurred.
7716 . A listing of all NICA - participating physicians for the
783year 20 12 was attached to RespondentÓs motion. Dr. Guerra is
794not listed as a NICA - participating physician in 2012.
804Accordingly, it is found that Dr. Guerra was not a
814Ðparticipating physicianÑ at the time of HuntleyÓs delivery.
822CONCLUSIONS OF LAW
8257 . The Divisio n of Administrative Hearings has
834jurisdiction over the parties to and the subject matter of this
845proceeding. §§ 766.301 - 766.316, Fla. Stat. (2016).
8538 . The Plan was established by the Legislature "to provide
864compensation on a no - fault basis, for a limited class of
876catastrophic injuries that result in unusually high costs for
885custodial care and rehabilitation." § 766.301, Fla. Stat. The
894Plan applies only to a birth - related neurological injury, which
905is defined in section 766.302(2) as follows:
"912Birth - rela ted neurological injury" means
919injury to the brain or spinal cord of a live
929infant weighing at least 2,500 grams for a
938single gestation or, in the case of a
946multiple gestation, a live infant weighing
952at least 2,000 grams at birth caused by
961oxygen deprivati on or mechanical injury
967occurring in the course of labor, delivery,
974or resuscitation in the immediate
979postdelivery period in a hospital, which
985renders the infant permanently and
990substantially mentally and physically
994impaired . This definition shall apply t o
1002live births only and shall not include
1009disability or death caused by genetic or
1016congenital abnormality.
1018(emphasis added).
10209 . The injured infant, her or his personal representative,
1030parents, dependents, and next of kin, may seek compensation
1039under the Plan by filing a claim for compensation with DOAH.
1050§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1058which administers the Plan, has "45 days from the date of
1069service of a complete claim . . . in which to file a response to
1084the petition and submit relevant written information relating to
1093the issue of whether the injury is a birth - related neurological
1105injury." § 766.305(4), Fla. Stat.
111010 . If NICA determines that the injury alleged in a claim
1122is a compensable birth - related neurological injur y, it may award
1134compensation to the claimant, provided that the award is
1143approved by the Administrative Law Judge to whom the claim has
1154been assigned. § 766.305(7), Fla. Stat. If, on the other hand,
1165NICA disputes the claim, as it has in the instant case, the
1177dispute must be resolved by the assigned Administrative Law
1186Judge in accordance with the provisions of chapter 120, Florida
1196Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.
120411 . In discharging this responsibility, the Administrative
1212Law Judge mu st make the following determinations based upon all
1223available evidence:
1225(a) Whether the injury claimed is a birth -
1234related neurological injury. If the
1239claimant has demonstrated, to the
1244satisfaction of the administrative law
1249judge, that the infant has sust ained a brain
1258or spinal cord injury caused by oxygen
1265deprivation or mechanical injury and that
1271the infant was thereby rendered permanently
1277and substantially mentally and physically
1282impaired, a rebuttable presumption shall
1287arise that the injury is a birth - r elated
1297neurological injury as defined in
1302s. 766.302(2).
1304(b) Whether obstetrical services were
1309delivered by a participating physician in
1315the course of labor, delivery, or
1321resuscitation in the immediate postdelivery
1326period in a hospital; or by a certified
1334nurse midwife in a teaching hospital
1340supervised by a participating physician in
1346the course of labor, delivery, or
1352resuscitation in the immediate postdelivery
1357period in a hospital.
1361§ 766.309(1), Fla. Stat. An award may be sustained only if the
1373Administrat ive Law Judge concludes that the "infant has
1382sustained a birth - related neurological injury and that
1391obstetrical services were delivered by a participating physician
1399at birth." § 766.31(1), Fla. Stat.
14051 2. In the instant case , it is unnecessary for the
1416und ersigned to determine whether Huntley suffered a birth -
1426related neurological injury, since it is uncontroverted that
1434obstetrical services were not delivered by a participating
1442physician at birth. Accordingly, section 766.31(1) precludes
1449approving an award under the Plan.
1455CONCLUSION
1456Based on the foregoing Findings of Fact and Conclusions of
1466Law, it is ORDERED that the Petition filed by Sean Martin and
1478Amy Martin, on behalf of and as parents and natural guardians of
1490Huntley Clay Martin, is dismissed with prej udice.
