57This cause came on for consideration upon a Motion for
67Summary Final Order filed by Respondent, Florida Birth - Related
77Neurological Association (NICA), on October 19, 2016.
84STATEMENT OF THE CASE
88On July 18, 2016, Petitioner, A ilen Benitez Morales, on
98behalf of and as parent and natural guardian of Dariel Antonio
109Molina Benitez (Dariel) , a minor, filed a Petition for Benefits
119Pursuant to Florida Statute Section 766.301 et seq. (Petition),
128with the Division of Administrative Hearings (DOAH) for a
137determination of compensability under the Florida Birth - Related
146Neurological Injury Compensat ion Plan (Plan). The Petition
154alleged that Dariel suffered brain damage as a result of a
165difficult birth.
167The Petition named Carlos G. Pena, M.D., as the physician
177providing obstetric services at the birth of Dariel at Baptist
187Hospital in Miami, Florida.
191DOAH served NICA with a copy of the Petition on July 22,
2032016. DOAH served Carlos G. Pena, M.D., with a copy of the
215Petition on July 25, 2016. On August 10, 2016, DOAH received a
227return receipt from the United States Postal Service showing that
237Baptist H ospital had been served with a copy of the Petition.
249Baptist Hospital filed a Petition to Intervene, which was
258granted by Order dated September 28, 2016. As of this date,
269Dr. Carlos G. Pena has not petitioned to intervene in this
280proceeding.
281On Octobe r 6, 2016, NICA filed a response to the Petition,
293giving notice that the injury does not "meet the definition of a
305'birth - related neurological injury' as defined in section
314766.302(2), Florida Statutes, which specifically requires that the
322injury render th e infant permanently and substantially impaired.Ñ
331NICA requested that a hearing be scheduled to resolve whether the
342claim was compensable.
345On October 19, 2016, NICA filed a Motion for Summary Final
356Order, asserting that Dariel did not sustain a Ðbirth - re lated
368neurological injuryÑ as that term is defined in section
377766.302(2), Florida Statutes. The motion was served by U.S. mail
387on October 19, 2016. No response to the Motion was filed by
399Petitioner. Intervenor, Baptist Hospital, requested an extension
406o f time in which to notify the undersigned as to whether a hearing
420was necessary. IntervenorÓs request was granted and was ordered
429to respond by November 21, 2016. As of todayÓs date, Intervenor
440has not responded. To date, no response has been filed to t he
453Motion for Summary Final Order by either Petitioner or Intervenor.
463FINDINGS OF FACT
4661. Dariel Antonio Molina Benitez was born on September 29,
4762011, at Baptist Hospital in Miami, Florida. Dariel weighed in
486excess of 2,500 grams at birth.
4932. NICA ret ained Donald C. Willis, M.D. (Dr. Willis), to
504review DarielÓs medical records. In an affidavit dated
512October 17, 2016, Dr. Willis made the following findings and
522expressed the following opinion:
5265. In summary, Cesarean section was done for
534variable FHR decelerations during labor. The
540baby was not depressed at birth. Apgar scores
548were 9/9 and the baby stated to be vigorous
557after birth. The medical records do not
564suggest a birth related hypoxic event.
5706. There was no apparent obstetrical event
577that re sulted in loss of oxygen or mechanical
586trauma to the babyÓs brain during labor,
593delivery or the immediate post delivery
599period.
6003. Dr. WillisÓ opinion that there was no apparent
609obstetrical event that resulted in loss of oxygen or mechanical
619trauma to th e babyÓs brain during labor, delivery or the
630immediate post - delivery period is credited.
6374. Respondent retained Michael Duchowny, M.D.,
643(Dr. Duchowny), a pediatric neurologist, to evaluate Dariel.
651Dr. Duchowny reviewed DarielÓs medical records and perfor med an
661independent medical examination on him on September 21, 2016.
670Dr. Duchowny made the following findings and summarized his
679evaluation as follows:
682IN SUMMARY DarielÓs general, physical and
688neurological examinations today are entirely
693within normal limits. There are no focal or
701lateralizing findings to suggest a structural
707brain injury.
709I have reviewed medical records for Dariel
716sent by your office on September 16, 2016.
724The records are primarily directed at long -
732term follow up and confirm that Da rielÓs
740overall development has proceeded normally
745with a slight expressive language delay. An
752MRI scan of the brain on September 10, 2015,
761apparently revealed mild generalized cortical
766atrophy but was otherwise within normal
772limits. Dariel underwent a ge netic workup
779including a chromosomal microarray that was
785normal. All other laboratory parameters were
791similarly within normal limits. An EEG
797obtained on April 1, 2014 was unremarkable.
804Given DarielÓs normal mental and physical
810status, I am not recommen ding him for
818compensation within the NICA program.
8235. Dr. Duchowny stated his ultimate opinion in an affidavit
833dated October 18, 2016, in which he opined, ÐBased on review of
845the medical records and the neurological evaluation and given
854DarielÓs normal and physical status, Dariel does not have a
864substantial and permanent mental or motor impairment, and I am
874not recommending him for compensation within the NICA program.Ñ
8836. Dr. DuchownyÓs opinion that Dariel does not have a
893substantial and permanent ment al or motor impairment is credited.
9037. A review of the file in this case reveals that there
915have been no expert opinions filed that are contrary to the
926opinion of Dr. Willis that there was no apparent obstetrical
936event that resulted in loss of oxygen or m echanical trauma to the
949babyÓs brain during labor, delivery or the immediate post -
959delivery period. There are no expert opinions filed that are
969contrary to Dr. DuchownyÓs opinion that Dariel does not have a
980substantial and permanent mental or motor impairm ent.
988CONCLUSIONS OF LAW
9918. The Division of Administrative Hearings has jurisdiction
999over the parties to and the subject matter of this proceeding.
1010§§ 766.301 - 766.316, Fla. Stat. (2014).
10179. The Plan was established by the Legislature "to provide
1027compens ation on a no - fault basis, for a limited class of
1040catastrophic injuries that result in unusually high costs for
1049custodial care and rehabilitation." § 766.301, Fla. Stat. The
1058Plan applies only to a birth - related neurological injury, which is
1070defined in se ction 766.302(2) as follows:
"1077Birth - related neurological injury" means
1083injury to the brain or spinal cord of a live
1093infant weighing at least 2,500 grams for a
1102single gestation or, in the case of a multiple
1111gestation, a live infant weighing at least
11182,000 grams at birth caused by oxygen
1126deprivation or mechanical injury occurring in
1132the course of labor, delivery, or
1138resuscitation in the immediate postdelivery
1143period in a hospital, which renders the infant
1151permanently and substantially mentally and
1156physically impaired . This definition shall
1162apply to live births only and shall not
1170include disability or death caused by genetic
1177or congenital abnormality. (emphasis added).
118210. The injured infant, her or his personal representative,
1191parents, dependents, and ne xt of kin, may seek compensation under
1202the Plan by filing a claim for compensation with DOAH.
1212§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. The Florida
1221Birth - Related Neurological Injury Compensation Association, which
1229administers the Plan, has "4 5 days from the date of service of a
1243complete claim . . . in which to file a response to the petition
1257and submit relevant written information relating to the issue of
1267whether the injury is a birth - related neurological injury."
1277§ 766.305(4), Fla. Stat.
128111 . If NICA determines that the injury alleged in a claim is
1294a compensable birth - related neurological injury, it may award
1304compensation to the claimant, provided that the award is approved
1314by the Administrative Law Judge to whom the claim has been
1325assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1336disputes the claim, as it has in the instant case, the dispute
1348must be resolved by the assigned Administrative Law Judge in
1358accordance with the provisions of chapter 120, Florida Statutes.
1367§§ 766.304 , 766.309, and 766.31, Fla. Stat.
137412. In discharging this responsibility, the Administrative
1381Law Judge must make the following determinations based upon all
1391available evidence:
1393(a) Whether the injury claimed is a birth -
1402related neurological injury. If the claimant
1408has demonstrated, to the satisfaction of the
1415administrative law judge, that the infant has
1422sustained a brain or spinal cord injury caused
1430by oxygen deprivation or mechanical injury and
1437that the infant was thereby rendered
1443permanently and subst antially mentally and
1449physically impaired, a rebuttable presumption
1454shall arise that the injury is a birth - related
1464neurological injury as defined in s.
1470766.302(2).
1471(b) Whether obstetrical services were
1476delivered by a participating physician in the
1483cour se of labor, delivery, or resuscitation in
1491the immediate postdelivery period in a
1497hospital; or by a certified nurse midwife in a
1506teaching hospital supervised by a
1511participating physician in the course of
1517labor, delivery, or resuscitation in the
1523immediate p ostdelivery period in a hospital.
1530§ 766.309(1), Fla. Stat. An award may be sustained only if the
1542Administrative Law Judge concludes that the "infant has sustained
1551a birth - related neurological injury and that obstetrical services
1561were delivered by a part icipating physician at birth."
1570§ 766.31(1), Fla. Stat.
157413. In the instant case, Petitioner filed a claim alleging
1584that Dariel did sustain a birth - related neurological injury that
1595is compensable under the NICA Plan. As the proponent of the issue
1607of compe nsability, the burden of proof is upon Petitioners.
1617§ 766.309(1)(a), Fla. Stat. See also Balino v. Dep't of Health &
1629Rehab. Servs. , 348 So. 2d 349, 350 (Fla. 1st DCA 1977)("[T]he
1641burden of proof, apart from statute, is on the party asserting the
1653affirma tive of an issue before an administrative tribunal.").
166314. The evidence, which is not refuted, established that
1672Dariel did not sustain an injury to the brain or spinal cord
1684caused by oxygen deprivation or mechanical injury in the course of
1695labor, delivery or resuscitation in the immediate post - delivery
1705period which rendered him permanently and substantially mentally
1713and physically impaired. Thus, Dariel is not entitled to benefits
1723under the Plan.
1726CONCLUSION
1727Based on the foregoing Findings of Fact and Conc lusions of
1738Law, it is ORDERED:
1742That the Petition filed by Ailen Benitez Morales, on behalf
1752of and as parent and natural guardian of Dariel Antonio Molina
1763Benitez, is dismissed with prejudice.
