52This cause came on for consideration upon a Motion for

81STATEMENT OF THE CASE

85On July 1 5 , 2016, Petitioners, Asia Adger and Dontae Bess,

96Sr., on behalf of and as parents and natural guardians of Dontae

108Bess, Jr. (Dontae), a minor, filed a Petition Under Pro test

119Pursuant to Florida Statute Section 766.301 et seq. (Petition),

128with the Division of Administrative Hearings (DOAH).

135The Petition named Jennifer Ivy, ARNP ; Sheri Small, ARNP ; and

145Jill Hendry, CNM, as the persons providing obstetric services at

155the birth of Dontae at Lakeland Hills Medical Center in Lakeland,

166Florida, on July 21, 2011.

171DOAH served NICA with a copy of the Petition on August 1,

1832016. DOAH served Jill Henry, ARNP, with a copy of the Petition

195on August 1, 2016. DOAH served Lakeland R egional Hospital with a

207copy of the Petition on August 4, 2016. DOAH served Sheri Shree

219Small, ARNP, with a copy of the Petition on August 23, 2016. DOAH

232mailed copies of the Petition to Jennifer Ivey, ARNP , on August 1

244and 19, 2016. However, these enve lopes were returned to DOAH

255stamped ÐReturn to Sender, Unable to Forward.Ñ

262On October 21, 2016, NICA filed a response to the Petition,

273giving notice that the injury does not "meet the definition of a

285'birth - related neurological injury' as defined in secti on

295766.302(2), Florida Statutes, which specifically requires that the

303injury render 'the infant permanently and substantially mentally

311and physically impaired.'" NICA requested that a hearing be

320scheduled to resolve whether the claim was compensable.

328On February 2, 2017, NICA filed a Motion for Summary Final

339Order, asserting that Dontae did not sustain a birth - related

350neurological injury as that term is defined in section 766.302(2),

360Florida Statutes. While no response to the motion was filed by

371Petition ers, it is noted that the Petition was filed under protest

383and asserted that Petitioners are not claimants.

390FINDINGS OF FACT

3931. Dontae Bess, Jr., was born on July 21, 2011, at Lakeland

405Regional Medical Center in Lakeland, Florida.

4112. NICA retained Do nald C. Willis, M.D. (Dr. Willis), to

422review DontaeÓs medical records. In a medical report dated

431August 19, 2016, Dr. Willis made the following findings and

441expressed the following opinion:

445Spontaneous vaginal delivery was without

450difficulty. Birth weig ht was 3,220 grams.

458The baby was not depressed. Apgar scores were

4669/9. No resuscitation was required at birth.

473The baby went to the normal newborn nursery

481and had an uncomplicated newborn hospital

487course with discharge on DOL 2.

493The child had developm ental delays. MRI was

501done at 5 years of age and was Ðunremarkable.Ñ

510In summary, pregnancy was induced for

516hypertension at term. There was no fetal

523distress during labor and the baby was not

531depressed at birth. The newborn hospital

537course was benign. MRI at 5 years of age did

547not suggest brain injury.

551There was no apparent obstetrical event that

558resulted in loss of oxygen or mechanical

565trauma to the babyÓs brain or spinal cord

573during labor, delivery or the immediate post

580delivery period.

5823. Dr. Will is reaffirmed his opinion in an affidavit dated

593January 26, 2017.

5964. Dr. WillisÓ opinion that there was no obstetrical event

606that resulted in loss of oxygen or mechanical trauma to the

617babyÓs brain or spinal cord during labor, delivery or in the

628immediate post - delivery period is credited.

6355. Respondent retained Laufey Y. Sigurdardottir, M.D.

642(Dr. Sigurdardottir), a pediatric neurologist, to evaluate

649Dontae. Dr. Sigurdardottir reviewed DontaeÓs medical records,

656and performed an independent medical examina tion on him on

666September 21, 2016. Dr. Sigurdardottir made the following

674findings and summarized her evaluation as follows:

681Summary: Dontae is a 5 - year 2 - month - old

693African - American male who is brought to the

702visit for an independent medical examination

708on his developmental delays. On review of

715his prenatal and birth history, I do not see

724any evidence of a likely hypoxic injury. He

732was born healthy and had no complications in

740the immediate postnatal period. He has then

747progressed to have mild gross mo tor delay and

756a quite significant language delay, although

762he is at this time in a regular education

771kindergarten. Neuroimaging did not show

776evidence of significant ischemic injury.

781Result as to question 1: The patient is

789found to have no substantial physical

795impairment, but to have a substantial

801language impairment at this time.

806Results as to question 2: There is no

814evidence in the medical record review of a

822substantial hypoxic event during labor or

828delivery, the infant had no signs of an

836encephalop athy in the immediate post natal

843period and no evidence of ischemic injury on

851neuroimaging. His language delay is not felt

858to be birth - related.

863Results as to question 3: DontaeÓs prognosis

870for life expectancy is excellent and for full

878recovery is good.

881I n light of the above - mentioned details and

891the lack of any evidence to suggest a birth

900related hypoxic injury, I do not recommend

907Dontae being included in the Neurologic

913Injury Compensation program, and I would be

920happy to answer additional questions.

9256 . Dr. Sigurdardottir reaffirmed her opinions in an

934affidavit dated January 20, 2017.

9397. In order for a birth - related injury to be compensable

951under the Florida Birth - Related Neurological Injury Compensation

960Plan ( Plan ) , the injury must meet the definiti on of a birth -

975related neurological injury and the injury must have caused both

985permanent and substantial mental and physical impairment.

9928. Dr. SigurdardottirÓs opinion that while Dontae has a

1001substantial language impairment, he has no substantial physica l

1010impairment, is credited.

10139. A review of the file in this case reveals that there

1025have been no expert opinions filed that are contrary to the

1036opinion of Dr. Sigurdardottir that Dontae does not have a

1046substantial physical impairment.

1049CONCLUSIONS OF LAW

105210. The Division of Administrative Hearings has jurisdiction

1060over the parties to and the subject matter of this proceeding.

1071§§ 766.301 - 766.316, Fla. Stat. (2014).

107811. The Plan was established by the Legislature "to provide

1088compensation on a no - fault ba sis, for a limited class of

1101catastrophic injuries that result in unusually high costs for

1110custodial care and rehabilitation." § 766.301, Fla. Stat. The

1119Plan applies only to a birth - related neurological injury, which is

1131defined in section 766.302(2) as fo llows:

"1138Birth - related neurological injury" means

1144injury to the brain or spinal cord of a live

1154infant weighing at least 2,500 grams for a

1163single gestation or, in the case of a multiple

1172gestation, a live infant weighing at least

11792,000 grams at birth caused by oxygen

1187deprivation or mechanical injury occurring in

1193the course of labor, delivery, or

1199resuscitation in the immediate postdelivery

1204period in a hospital, which renders the infant

1212permanently and substantially mentally and

1217physically impaired . This defin ition shall

1224apply to live births only and shall not

1232include disability or death caused by genetic

1239or congenital abnormality.

124212. The injured infant, her or his personal representative,

1251parents, dependents, and next of kin, may seek compensation under

1261t he P lan by filing a claim for compensation with DOAH.

1273§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA, which

1282administers the Plan, has "45 days from the date of service of a

1295complete claim . . . in which to file a response to the petition

1309and submit relevant written information relating to the issue of

1319whether the injury is a birth - related neurological injury."

1329§ 766.305(4), Fla. Stat.

133313. If NICA determines that the injury alleged in a claim is

1345a compensable birth - related neurological injur y, it may award

1356compensation to the claimant, provided that the award is approved

1366by the Administrative Law Judge to whom the claim has been

1377assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1388disputes the claim, as it has in the instant case, the dispute

1400must be resolved by the assigned Administrative Law Judge in

1410accordance with the provisions of chapter 120, Florida Statutes.

1419§§ 766.304, 766.309, and 766.31, Fla. Stat.

142614. In discharging this responsibility, the Administrative

1433Law Judge m ust make the following determinations based upon all

1444available evidence:

1446(a) Whether the injury claimed is a birth -

1455related neurological injury. If the claimant

1461has demonstrated, to the satisfaction of the

1468administrative law judge, that the infant has

1475su stained a brain or spinal cord injury caused

1484by oxygen deprivation or mechanical injury and

1491that the infant was thereby rendered

1497permanently and substantially mentally and

1502physically impaired, a rebuttable presumption

1507shall arise that the injury is a birth - related

1517neurological injury as defined in

1522s. 766.302(2).

1524(b) Whether obstetrical services were

1529delivered by a participating physician in the

1536course of labor, delivery, or resuscitation in

1543the immediate postdelivery period in a

1549hospital; or by a certif ied nurse midwife in a

1559teaching hospital supervised by a

1564participating physician in the course of

1570labor, delivery, or resuscitation in the

1576immediate postdelivery period in a hospital.

1582§ 766.309(1), Fla. Stat. An award may be sustained only if the

1594Admini strative Law Judge concludes that the "infant has sustained

1604a birth - related neurological injury and that obstetrical services

1614were delivered by a participating physician at birth."

1622§ 766.31(1), Fla. Stat.

162615. In the instant case, Petitioners filed a clai m seeking a

1638determination of whether Dontae sustained a birth - related

1647neurological injury that is compensable under the NICA P lan. As

1658the proponent of the issue of compensability, the burden of proof

1669is upon Petitioners. § 766.309(1)(a), Fla. Stat. See also Balino

1679v. Dep't of Health & Rehabilitative Servs. , 348 So. 2d 349, 350

1691(Fla. 1st DCA 1977)("[T]he burden of proof, apart from statute, is

1703on the party asserting the affirmative of an issue before an

1714administrative tribunal.").

171716. Dr. Willis establis hed that there was no apparent

1727obstetrical event which resulted in oxygen deprivation or

1735mechanical trauma to the babyÓs brain or spinal cord during labor,

1746delivery and the immediate post - delivery period.

175417. Further, had there been a birth - related neur ological

1765injury, the remaining issue to be determined is whether any such

1776injury resulted in a permanent and substantial mental impairment

1785and a permanent and substantial physical impairment, inasmuch as

1794both are required to establish compensability. Fla. Birth - Related

1804Neurological Injury Comp. Ass'n v. Div. of Admin. Hearings , 686

1814So. 2d 1349 (Fla. 1997).

181918. The evidence, which is not refuted, established that

1828Donte does not have a permanent and substantial physical

1837impairment. Thus, Dontae is not e ntitled to benefits under the

1848Plan.

1849CONCLUSION

1850Based on the foregoing Findings of Fact and Conclusions of

1860Law, it is ORDERED :

1865T hat the P etition filed by Asia Adger and Dontae Bass, Sr.,

1878on behalf of and as parents and natural guardians of Dontae Bass,

1890Jr ., is dismissed with prejudice.

1896DONE AND ORDERED this 17th day of February , 2017 , in
