85(NICA), on February 13, 2017.

90STATEMENT OF THE CASE

94On September 1, 2016, Petitioner, Josinda York, individually

102and on behalf of and as mother of Alyssa York (Al y ssa), a minor,

117filed a Petition for Benefits Pursuant to Florida Statute Section

127766.301 et seq. (Petition) with the Division of Administrative

136Hearings (DOAH) for a determination of compensability under the

145Florida Birth - Related Neurological Inj ury Compensation Plan

154(Plan). The Petition named Emily Balanky, M.D., as the physician

164who provided obstetrical services at the birth of Alyssa on

174June 11, 2014, at Baptist Medical Center South located in

184Jacksonville, Florida.

186DOAH served NICA with a cop y of the Petition on

197September 14, 2016. DOAH served Emily Balanky, M.D., with a copy

208of the Petition on September 15, 2016. On September 19, 2016,

219DOAH received a return receipt from the United States Postal

229Service showing that Baptist Medical Center S outh had been served

240with a copy of the Petition.

246On December 19, 2016, NICA filed a Response to Petition for

257Benefits, asserting that Alyssa did not sustain a "birth - related

268neurological injury" as that term is defined in section

277766.302(2), Florida Stat utes. On February 13, 2017, NICA filed

287an Unopposed Motion for Summary Final Order, representing that

296Petitioner has no objection to the granting of this Motion.

306As of the date of this Summary Final Order of Dismissal,

317neither Dr. Balanky nor Baptist Medi cal Center South has

327petitioned to intervene in this proceeding.

333FINDINGS OF FACT

3361. Alyssa York was born on June 11, 2014, at Baptist

347Medical Center South located in Jacksonville, Florida. Alyssa

355weighed 4,026 grams at birth.

3612. Donald Willis, M.D. (Dr. Willis), was requested by NICA

371to review the medical records for Alyssa. In a medical report

382dated December 8, 2016, Dr. Willis opined as follows:

391In summary, delivery was complicated by a

398shoulder dystocia. The newborn was not

404depressed with a 5 m inute Apgar score of 8.

414Resuscitation after delivery required only

419tactile stimulation and blow - by oxygen. The

427baby had an ErbÓs palsy, but otherwise an

435uncomplicated newborn hospital course.

439There was no apparent obstetrical event that

446resulted in loss of oxygen or mechanical

453trauma to the babyÓs brain or spinal cord

461during labor, delivery or the immediate post

468delivery period.

4703. NICA retained Laufey Y. Sigurdardottir, M.D.

477(Dr. Sigurdardottir), a pediatric neurologist, to examine Alyssa

485and to revie w her medical records. Dr. Sigurdardottir examined

495Alyssa on December 2, 2016. In a medical report regarding her

506independent medical examination of Alyssa, Dr. Sigurdardottir

513opined as follows:

516Summary: Alyssa is a 2 - 1/2 year - old who

527suffered a brachial plexus injury during a

534vaginal delivery complicated by a 1 minute

541shoulder dystocia. At the current age of 2

549years 5 months she has a functional deficit

557that seems relatively mild and has not needed

565surgical intervention at this time. Her

571cognition, men tal abilities seem age

577appropriate. In light of the above, my

584results are the following:

588Result as to question 1: Alyssa is found to

597have a mild physical impairment, but no noted

605mental impairment at this time.

610Result as to question 2: The brachial

617pl exopathy is most likely due to injury

625sustained during the birthing process.

630Results as to question 3: The prognosis for

638full recovery is regarded [ sic ] as she

647continues to have functional limitations in

653her right arm. She however has normal

660abilities i n other areas and her cognition is

669completely normal.

671In light of this, I do not recommend Alyssa

680to be included in the NICA program. I will

689be happy to answer additional questions.

6954. A review of the file in this case reveals that there

707have been no expert opinions filed that are contrary to the

718opinion of Dr. Willis that there was no apparent obstetrical

728event that resulted in loss of oxygen or mechanical trauma to the

740baby's brain or spinal cord during labor, delivery or the

750immediate post - delivery period. Dr. WillisÓ opinion is credited.

760There are no contrary expert opinions filed that are contrary to

771Dr. SigurdardottirÓs opinion that Alyssa has a mild physical

780impairment but is not found to have a mental impairment at this

792time. Dr. Sigurdardot tirÓs opinion is credited.

799CONCLUSIONS OF LAW

8025. The Division of Administrative Hearings has jurisdiction

810over the parties to and the subject matter of these proceedings.

821§§ 766.301 - 766.316, Fla. Stat.

8276. The Plan was established by the Legislature "f or the

838purpose of providing compensation, irrespective of fault, for

846birth - related neurological injury claims" relating to births

855occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

8667. The injured infant, her or his personal representative,

875p arents, dependents, and next of kin may seek compensation under

886the Plan by filing a claim for compensation with DOAH.

896§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

904which administers the Plan, has "45 days from the date of service

916of a complete claim . . . in which to file a response to the

931petition and to submit relevant written information relating to

940the issue of whether the injury is a birth - related neurological

952injury." § 766.305(4), Fla. Stat.

9578. If NICA determines that the i njury alleged in a claim is

970a compensable birth - related neurological injury, it may award

980compensation to the claimant, provided that the award is approved

990by the administrative law judge to whom the claim has been

1001assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1012disputes the claim, as it has in the instant case, the dispute

1024must be resolved by the assigned administrative law judge in

1034accordance with the provisions of chapter 120, Florida Statutes.

1043§§ 766.304, 766.309, and 766.31, Fla. Stat .

10519. In discharging this responsibility, the administrative

1058law judge must make the following determination based upon the

1068available evidence:

1070(a) Whether the injury claimed is a birth -

1079related neurological injury. If the claimant

1085has demonstrated, to t he satisfaction of the

1093administrative law judge, that the infant has

1100sustained a brain or spinal cord injury

1107caused by oxygen deprivation or mechanical

1113injury and that the infant was thereby

1120rendered permanently and substantially

1124mentally and physically im paired, a

1130rebuttable presumption shall arise that the

1136injury is a birth - related neurological injury

1144as defined in s. 766.303(2).

1149(b) Whether obstetrical services were

1154delivered by a participating physician in the

1161course of labor, delivery, or resuscitat ion

1168in the immediate postdelivery period in a

1175hospital; or by a certified nurse midwife in

1183a teaching hospital supervised by a

1189participating physician in the course of

1195labor, delivery, or resuscitation in the

1201immediate postdelivery period in a hospital.

1207§ 766.309(1), Fla. Stat. An award may be sustained only if the

1219administrative law judge concludes that the "infant has sustained

1228a birth - related neurological injury and that obstetrical services

1238were delivered by a participating physician at birth."

1246§ 76 6.31(1), Fla. Stat.

125110. The term "birth - related neurological injury" is defined

1261in section 766.302(2) as follows:

"1266Birth - related neurological injury" means

1272injury to the brain or spinal cord of a live

1282infant weighing at least 2,500 grams for a

1291single ge station or, in the case of a

1300multiple gestation, a live infant weighing at

1307least 2,000 grams at birth caused by oxygen

1316deprivation or mechanical injury occurring in

1322the course of labor, delivery, or

1328resuscitation in the immediate postdelivery

1333period in a h ospital, which renders the

1341infant permanently and substantially mentally

1346and physically impaired.

134911. The evidence, which is not refuted, established that

1358Alyssa did not sustain an injury to the brain or spinal cord

1370caused by oxygen deprivation or mecha nical injury in the course

1381of labor, delivery, or resuscitation in the immediate post -

1391delivery period in a hospital which rendered her permanently and

1401substantially mentally and physically impaired. Therefore,

1407A l yssa is not eligible for benefits under the Plan.

1418CONCLUSION

1419Based upon the foregoing Findings of Fact and Conclusions of

1429Law, it is ORDERED that the Petition filed by Josinda York,

1440individually and as mother of Alyssa York, is dismissed with

1450prejudice.
