80STATEMENT OF THE CASE

84On September 14, 2016, Petitioners , Megan Mueller and

92Corey Mueller , on behalf of and as parents and natural guardians

103of Lucas Mueller ( Lucas ), a minor, filed a Petition for Benefit s

117Pursuant to Florida Statute Section 766.301 et seq. (Petition)

126with the Division of Administrative Hearings (DOAH) for a

135determination of compensability under the Florida Birth - Related

144Neurological Injury Compensation Plan (Plan). The Petition named

152Jor ge Alvarez - Hernandez , M . D. , as the physician who provided

165obstetric services for the birth of Lucas on September 21, 2014,

176at Lakewood Ranch Medical Center in Lakewood Ranch, Florida .

186DOAH served NICA with a copy of the Petition on

196September 23, 2016. D OAH served Lakewood Ranch Medical Center

206with a copy of the Petition on September 24, 2016. DOAH served

218Jorge Alvarez - Hernandez , M.D., a copy of the Petition on

229September 27, 2016. As of the date of this Summary Final Order

241of Dismissal, neither Dr. Alva rez - Hernandez nor Lakewood Ranch

252Medical Center has petitioned to intervene into this proceeding.

261On November 1 , 201 6 , NICA filed a Motion for Summary Final

273Order, requesting that a s ummary f inal o rder be entered finding

286that the claim was not compensable because Lucas did not sustain

297a Ðbirth - related neurological injuryÑ as that term is defined in

309section 766.302(2), Florida Statutes . Petitioners did not file a

319response to the Motion.

323On November 16, 2016, an Order to Show Cause was entered

334which allowed Petitioners until December 1, 2016, to inform the

344undersigned in writing as to why the motion should not be granted

356and a summary final order be entered finding PetitionersÓ claim

366is not compensable. To date, no response has been filed by

377Petitioners to the Motion or to the Order to Show Cause.

388FINDINGS OF FACT

3911. Lucas Mueller was born on September 21 , 2 014 , at

402Lakewood Ranch Medical Center in Lakewood Ranch , Florida.

4102. Donald Willis, M.D. (Dr. Willis), was requested by NICA

420to review the medic al records for Lucas . In a report dated

433October 24 , 201 6 , Dr. Willis described his findings in pertinent

444part as follows:

447The fetal heart rate (FHR) monitor tracing

454during labor was reviewed and did not suggest

462fetal distress. Delivery was by vacuum

468assi sted vaginal birth. Vacuum assistance

474was done for maternal exhaustion. Birth

480weight was 7 lbs 7 ozÓs.

486The baby was not depressed at birth. Apgar

494scores were 7/9. The newborn hospital course

501was benign.

503ÐWell visitsÑ with Pediatrics after birth at

510one to four months of age indicated no

518problems. The baby was evaluated at 5 months

526of age for Ðhead dropping.Ñ Developmental

532delays were noted by 7 months of age.

540Seizure activity was identified by EEG at 11

548months of age.

551MRI of the cervical spine wa s negative. MRI

560of the brain at about one year of age was

570essentially negative. Genetic evaluation

574with microarray did not identify any genetic

581disorders.

582I n summary, the child was not depressed at

591birth and apparently no problems were noted

598until abou t 5 months of age. MRI of the

608brain was essentially negative.

612There was no apparent obstetrical event that

619resulted in loss of oxygen or mechanical

626trauma to the babyÓs brain during labor,

633delivery or the immediate post delivery

639period.

6403. Dr. Willis reaffirmed his opinion in an affidavit dated

650October 31, 2016.

6534. A review of the file reveals that no contrary evidence

664was presented to dispute Dr. WillisÓ finding that there was no

675apparent obstetric event that resulted in oxygen deprivation or

684mechan ical trauma during labor, delivery, or the immediate post -

695delivery period. Dr. WillisÓ opinion is credited.

702CONCLUSIONS OF LAW

7055 . The Division of Administrative Hearings has jurisdiction

714over the parties to and the subject matter of these proceedings.

725§ § 766.301 - 766.316, Fla. Stat.

7326 . The Plan was established by the Legislature "for the

743purpose of providing compensation, irrespective of fault, for

751birth - related neurological injury claims" relating to births

760occurring on or after January 1, 1989. § 766 .303(1), Fla. Stat.

7727 . The injured infant, her or his personal representative,

782parents, dependents, and next of kin may seek compensation under

792the Plan by filing a claim for compensation with DOAH.

802§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

810which administers the Plan, has "45 days from the date of service

822of a complete claim . . . in which to file a response to the

837petition and to submit relevant written information relating to

846the issue of whether the injury is a birth - related n eurological

859injury." § 766.305(4), Fla. Stat.

8648 . NICA has determined that Petitioner s do not have a claim

877that is compensable under the Plan and has filed a Motion for

889Summary Final Order, requesting that an order be entered finding

899that the claim is n ot compensable.

9069 . In ruling on the motion, the a dministrative l aw ju dge

920must make the following determination based upon the available

929evidence:

930(a) Whether the injury claimed is a birth -

939related neurological injury. If the claimant

945has demonstrated, to the satisfaction of the

952administrative law judge, that the infant has

959sustained a brain or spinal cord injury

966caused by oxygen deprivation or mechanical

972injury and that the infant was thereby

979rendered permanently and substantially

983mentally and physically impaired, a

988rebuttable presumption shall arise that the

994injury is a birth - related neurological injury

1002as defined in s. 766.303(2).

1007§ 766.309(1), Fla. Stat.

101110 . The term "birth - related neurological injury" is defined

1022in section 766.302(2) as follows:

"1027Birth - related neurological injury" means

1033injury to the brain or spinal cord of a live

1043infant weighing at least 2,500 grams for a

1052single gestation or, in the case of a

1060multiple gestation, a live infant weighing at

1067least 2,000 grams at birth caused by oxyge n

1077deprivation or mechanical injury occurring in

1083the course of labor, delivery, or

1089resuscitation in the immediate postdelivery

1094period in a hospital, which renders the

1101infant permanently and substantially mentally

1106and physically impaired.

110911 . The evidence , which is not refuted, established that

1119there was no apparent obstetrical event that resulted in loss of

1130oxygen or mechanical trauma to LucasÓs brain during labor,

1139delivery or the immediate post - delivery period. Thus, Lucas is

1150not eligible for benefits u nder the Plan.

1158CONCLUSION

1159Based upon the foregoing Findings of Fact and Conclusions of

1169Law, it is ORDERED that the Petition filed by Megan Mueller and

1181Corey Mueller , o n behalf of and as parents and natural guardians

1193of Lucas Mueller , a minor, is dismisse d with prejudice.
