77STATEMENT OF THE CASE

81On September 14 , 201 6 , Petitioner, Barbara Reyes, on behalf

91of and as parent and natural guardian of Ashley Monzon ( Ashley ),

104a minor, filed a Petition for Benefits Pursuant to Florida

114Statute Section 766. 301 et seq. (Petition) with the Division of

125Administrative Hearings (DOAH) for a determination of

132compensability under the Florida Birth - Related Neurological

140Injury Compensation Plan (Plan). The Petition named

147Lorena Tinoco , M . D. , as the physician who pro vided obstetric

159services for the birth of Ashley on July 31, 2013, at West

171Kendall Baptist Hospital in Miami, Florida .

178DOAH served NICA with the Petition on September 23, 2016.

188On October 3, 2016, DOAH received a return receipt from the

199United States Po stal Service showing that West Kendall Baptist

209Hospital was served with a copy of the Petition. DOAH served a

221copy of the Petition on Lorena Tinoco, M.D., on September 28,

2322016. As of the date of this Summary Final Order of Dismissal,

244neither West Kendal l Baptist Hospital nor Dr. Tinoco has

254petitioned to intervene into this proceeding.

260On November 2 , 201 6 , NICA filed a Motion for Summary Final

272Order, requesting that a s ummary f inal o rder be entered finding

285that the claim was not compensable because Ashle y did not sustain

297a Ðbirth - related neurological injuryÑ as that term is defined in

309section 766.302(2), Florida Statutes . Petitioner did not file a

319response to the Motion.

323On November 16, 2016, an Order to Show Cause was entered

334which allowed Petitioner un til December 1, 2016, to inform the

345undersigned in writing as to why the motion should not be granted

357and a summary final order be entered finding PetitionerÓs claim

367is not compensable. To date, no response has been filed by

378Petitioner to the Motion or to the Order to Show Cause.

389FINDINGS OF FACT

3921. Ashley Monzon was born on July 31 , 2 013 , at West Kendall

405Baptist Hospital in Miami , Florida.

4102. Donald Willis, M.D. (Dr. Willis), was requested by NICA

420to review the medical records for Ashley . In a n af fidavit dated

434November 2 , 201 6 , Dr. Willis described his findings in pertinent

445part as follows:

4485. It is my opinion that the prenatal course

457was essentially uncomplicated. Labor was

462induced at term. There was no t fetal

470distress during labor. Delivery w as

476complicated by a compound presentation and

482shoulder dystocia. Bag and mask ventilation

488and CPAP were required for the first minute

496of life, but the baby Ðpinked up quicklyÑ and

505was discharged home 2 days after birth. The

513baby was subsequently diagnose d with

519microcephaly. MRIÓs were normal . Pediatric

525Neurology diagnosed Encephalopathy of unknown

530cause.

5316. A s such, it is my opinion that there was

542no apparent obstetrical event that resulted

548in loss of oxygen or mechanical trauma to the

557babyÓs brain d uring labor, delivery or the

565immediate post delivery period.

5693. A review of the file reveals that no contrary evidence

580was presented to dispute Dr. WillisÓ finding that AshleyÓs

589injuries were not the result of oxygen deprivation or mechanical

599trauma du ring labor, delivery, or the immediate post - delivery

610period. Dr. WillisÓ opinion is credited.

616CONCLUSIONS OF LAW

6194 . The Division of Administrative Hearings has jurisdiction

628over the parties to and the subject matter of these proceedings.

639§§ 766.301 - 76 6.316, Fla. Stat.

6465 . The Plan was established by the Legislature "for the

657purpose of providing compensation, irrespective of fault, for

665birth - related neurological injury claims" relating to births

674occurring on or after January 1, 1989. § 766.303(1), Fla . Stat.

6866 . The injured infant, her or his personal representative,

696parents, dependents, and next of kin may seek compensation under

706the Plan by filing a claim for compensation with DOAH.

716§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

724which administers the Plan, has "45 days from the date of service

736of a complete claim . . . in which to file a response to the

751petition and to submit relevant written information relating to

760the issue of whether the injury is a birth - related neurological

772injury." § 766.305(4), Fla. Stat.

7777 . NICA has determined that Petitioner does not have a

788claim that is compensable under the Plan and has filed a Motion

800for Summary Final Order, requesting that an order be entered

810finding that the claim is not compensa ble.

8188 . In ruling on the motion, the a dministrative l aw ju dge

832must make the following determination based upon the available

841evidence:

842(a) Whether the injury claimed is a birth -

851related neurological injury. If the claimant

857has demonstrated, to the satisf action of the

865administrative law judge, that the infant has

872sustained a brain or spinal cord injury

879caused by oxygen deprivation or mechanical

885injury and that the infant was thereby

892rendered permanently and substantially

896mentally and physically impaired, a

901rebuttable presumption shall arise that the

907injury is a birth - related neurological injury

915as defined in s. 766.303(2).

920§ 766.309(1), Fla. Stat.

9249 . The term "birth - related neurological injury" is defined

935in section 766.302(2) as follows:

"940Birth - relat ed neurological injury" means

947injury to the brain or spinal cord of a live

957infant weighing at least 2,500 grams for a

966single gestation or, in the case of a

974multiple gestation, a live infant weighing at

981least 2,000 grams at birth caused by oxygen

990deprivatio n or mechanical injury occurring in

997the course of labor, delivery, or

1003resuscitation in the immediate postdelivery

1008period in a hospital, which renders the

1015infant permanently and substantially mentally

1020and physically impaired.

102310 . The evidence, which is n ot refuted, established that

1034there was not an obstetrical event that resulted in loss of

1045oxygen or mechanical trauma to AshleyÓs brain during labor,

1054delivery or the immediate post - delivery period. Thus, Ashley is

1065not eligible for benefits under the Plan.

1072CONCLUSION

1073Based upon the foregoing Findings of Fact and Conclusions of

1083Law, it is ORDERED that the Petition filed by Barbara Reyes , on

1095behalf of and as parent and natural guardian of Ashley Monzon , a

1107minor, is dismissed with prejudice.
